0021 SALEM STREET - BUILDING INSPECTION harei ft 'mTI GAL `��iIONAI SERVICES Nib APA 21 P I: 01 Date: 04/27/16 Niaz Ahmed, Owner - Halal Kennedy Food M5R+21'Salem-Street� 21 Salem Street Salem, MA 01970 Dear Niaz, This letter is inform you that Hargidon Architecture + Design, LLC is regretfully terminating our involvement with the project: 21 Salem Street. This is the written notice. Our contract shall terminate offically in 7 days (May 04; 2016) in accordance with the termination clause in our agreement, dated 06/27/15. Here are some of the reasons: 1) failure of the owner to inform the architect ahead of time of meetings with city officials and involve the architect in the whole regulatory process 2) failure of the owner to provide a legal survey of the rear yard of the project, having been told that this was required 3) failure of the owner to act as a reliable liason between the architect and the health department, which meant that all the legal requirement of restaurant set-up were not relayed to the architect 4) construction work performed by the owner prior to the project obtaining a building permit. This is illegal, prevents electrical and fire alarm work from taking place in the proper sequence and prevents building department controlled inspections of rough- ins (electrical, plumbing, alarm) from taking place and increases the professional liability of our office. 5) failure of the owner to fill out and file with the Health Department, City of Salem-the Food Establishment Plan Review Application, along with all the supporting documentation that is required 6) the contractor for the project, Mike Dupont, quit the project 3 weeks ago. On March 11, 2016, the owner was given 2 weeks to make progress on rectifying some of issues above. March 25 came and went with no response to our office and now it is an additional 3 weeks later with no communication from the owner. Drawings: Any copies of the drawings that you may have are labeled 'Not For Construction' and may NOT be used to file the project. We recognize that considerable effort &funds have been expended for Hargidon to produce a set of construction documents. Hargidon retains ownership of these documents in accordance with our agreement but is willing to transfer a set of the electronic files to the owner for a reasonable one-time fee. In this instance, every reference to our firm will be stripped out of the files. This request must be made to us in writing and by mail, confirming that the owner releases us from any liability in connection with this project, in connection with Niaz Ahmed,for any reason what-so-ever and for all time and must be accompanied by a check. Note that the set does not include the electrical /fire alarm work due to no E / FA consultant on board the project to produce that work. We wish the owner all the best of luck in eventual completion of this worthy project and we are sorry that we can't take part.
