There is no work to be performed on the first floor restaurant level. The existing building is all wood construction and is classified as construction type VB. There is no existing sprinkler system. There are existing alarm systems installed but it is unclear if they are in good working condition. CHAPTER 3 USE AND OCCUPANCY CLASSIFICATION SECTION 301 GENERAL 301.1 Scope.The provisions of this chapter shall control the classification of all buildings and structures as to use and occupancy. SECTION 302 CLASSIFICATION 302.1 General.Structures or portions of structures shall be classified with respect to occupancy in one or more of the groups listed in this section.A room or space that is intended to be occupied at different times for different purposes shall comply with all of the requirements that are applicable to each of the purposes for which the room or space will be occupied. Structures with multiple occupancies or uses shall comply with Section 508.Where a structure is proposed for a purpose that is not specifically provided for in this code,such structure shall be classified in the group that the occupancy most nearly resembles,according to the fire safety and relative hazard involved. SECTION 420 GROUPS I-1,R-1,R-2,R-3 AND R-4 420.1 General.Occupancies in Groups I-1,R-1,R-2,R-3 and R-4 shall comply with the provisions of Sections 420.1 through 420.6 and other applicable provisions of this code. 420.2 Separation walls.Walls separating dwelling units in the same building,walls separating sleeping units in the same building and walls separating dwelling or sleeping units from other occupancies contiguous to them in the same building shall be constructed as fire partitions in accordance with Section 708. 7083 Fire-resistance rating.Fire partitions shall have a fire-resistance rating of not less than 1 hour. Exceptions: 1. Corridor walls permitted to have a 1/2-hour fire-resistance rating by Table 1020.1. 2. Dwelling unit and sleeping unit separations in buildings of Type 11B,IITB and VB construction shall have fire-resistance ratings of not less than 1/2 hour in buildings equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1. Dwelling unit separation walls must be 1/2 hour fire rated due to the construction type being VB and the introduction of a new NFPA 13 sprinkler system . 4203 Horizontal separation.Floor assemblies separating dwelling units in the same buildings,floor assemblies separating sleeping units in the same building and floor assemblies separating dwelling or sleeping units from other occupancies contiguous to them in the same building shall be constructed as horizontal assemblies in accordance with Section 711. 711.2A3 Dwelling units and sleeping units.Horizontal assemblies serving as dwelling or sleeping unit separations in accordance with Section 420.3 shall be not less than 1-hour fire-resistance-rated construction. Exception:Horizontal assemblies separating dwelling units and sleeping units shall be not less than 1/2-hour fire- resistance-rated construction in a building of Type IIB,IIIR and VB construction,where the building is equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1. 96 North Street,Salem,MA 03/12/19 Project Number 19012 Page 3 of 15 Horizontal separations between dwelling units must be 1/2 hour fire rated due to the construction type being VB and the introduction of a new NFPA 13 sprinkler system. 711.2A.6 Other separations.Where a horizontal assembly is required by other sections of this code,the assembly shall have afire-resistance rating of not less than that required by that section. Refer to 780 CMR 508 later on in this document for the horizontal separation requirements between the existing restaurant and the second floor dwelling unit. [F]4205 Automatic sprinkler system.Group R occupancies shall be equipped throughout with an automatic sprinkler system in accordance with Section 903.2.8.Group 1-1 occupancies shall be equipped throughout with an automatic sprinkler system in accordance with Section 903.2.6.Quick-response or residential automatic sprinklers shall be installed in accordance with Section 903.3.2. Refer to Chapter 34 review following this section for new sprinkler requirement. [F]420.6 Fire alarm systems and smoke alarms.Fire alarm systems and smoke alarms shall be provided in Group 1-1,R- 1,R-2 and R-4 occupancies in accordance with Sections 907.2.6 ,907.2.8,907.2.9 and 907.2.10,respectively.Single-or multiple-station smoke alarms shall be provided in Groups 1-1,R-2,R-3 and R-4 in accordance with Section 907.2.11. BEGIN CHAPTER 34 REVIEW CHAPTER 34 EXISTING BUILDINGS SECTION 101 GENERAL [A] 1013 Intent. The intent of this code is to provide flexibility to permit the use of alternative approaches to achieve compliance with minimum requirements to safeguard the public health,safety and welfare insofar as they are affected by the repair,alteration,change of occupancy,addition and relocation of existing buildings. This report will serve as the required investigation and evaluation. WORK AREA.That portion or portions of a building consisting of all reconfigured spaces as indicated on the construction documents.Work area excludes other portions of the building where incidental work entailed by the intended work must be 96 North Street,Salem,MA 03/12/19 Project Number 19012 --- Page 4 of 15 performed and portions of the building where work not initially intended by the owner is specifically required by this code. 301.1.2 Work area compliance method.Repairs,alterations,additions,changes in occupancy and relocated buildings complying with the applicable requirements of Chapters 5 through 13 of this code shall be considered in compliance with the provisions of this code. This project will use the work area compliance method. SECTION 504 ALTERATION-LEVEL 2 504.1 Scope.Level 2 alterations include the reconfiguration of space,the addition or elimination of any door or window,the reconfiguration or extension of any system,or the installation of any additional equipment. 504.2 Application.Level 2 alterations shall comply with the provisions of Chapter 7 for Level 1 alterations as well as the provisions of Chapter 8. SECTION 505 ALTERATION—LEVEL 3 505.1 Scope.Level 3 alterations apply where the work area exceeds 50 percent of the building area. 505.2 Application.Level 3 alterations shall comply with the provisions of Chapters 7 and 8 for Level 1 and 2 alterations,respectively,as well as the provisions of Chapter 9. The aggregate existing building area is 5,051 SF. The total aggregate work area is 1,688 SF. 1,688/5,051 = 33.4%. The total aggregate work area is less than 50% of the aggregate building area and therefore this project will be a level 2 alteration. CHAPTER 8 ALTERATIONS—LEVEL 2 SECTION 801 GENERAL 801.1 Scope.Level 2 alterations as described in Section 504 shall comply with the requirements of this chapter. Exception:Buildings in which the reconfiguration is exclusively the result of compliance with the accessibility requirements of Section 705.2 shall be permitted to comply with Chapter 7. 801.2 Alteration Level 1 compliance.In addition to the requirements of this chapter,all work shall comply with the requirements of Chapter 7. 8013 Compliance.All new construction elements,components,systems,and spaces shall comply with the requirements of the International Building Code. Exceptions: 1. Windows may be added without requiring compliance with the light and ventilation requirements of the International Building Code. 2. Newly installed electrical equipment shall comply with the requirements of Section 808. 3. The length of dead-end corridors in newly constructed spaces shall only be required to comply with the provisions of Section 805.6. 4. The minimum ceiling height of the newly created habitable and occupiable spaces and corridors shall be 7 feet (2134 mm). All new work will comply with the code for new construction except as listed under the above exceptions. 803.2.2 Supplemental stairway enclosure requirements.Where the work area on any floor exceeds 50 percent of that floor area,stairways that are part of the means of egress serving the work area shall,at a minimum,be enclosed with smoke-tight construction on the highest work area floor and all floors below. 96 North Street,Salem,MA 03/12/19 Project Number 19012 Page 5 of 15 Exception: Where stairway enclosure is not required by the International Building Code or the International Fire Code. Existing stairwell enclosure walls are allowed to be smoke tight walls per the above code section. All newly constructed stair enclosure walls must be 1 hour fire rated with 1 hour fire rated doors and closer. 803.4 Interior finish.The interior finish of walls and ceilings in exits and corridors in any work area shall comply with the requirements of the International Building Code. Exception:Existing interior finish materials that do not comply with the interior finish requirements of the International Building Code shall be permitted to be treated with an approved fire-retardant coating in accordance with the manufacturer's instructions to achieve the required rating. 803.4.1 Supplemental interior finish requirements. Where the work area on any floor exceeds 50 percent of the floor area,Section 803.4 shall also apply to the interior finish in exits and corridors serving the work area throughout the floor. Exception: Interior finish within tenant spaces that are entirely outside the work area. The work areas on the second and third floors are greater than 50% of the story floor area. All wall, ceiling and floor finishes must meet 780 CMR Chapter 8 and Table 803. Existing finishes that do not meet Chapter 8 requirements are allowed to be treated with an approved fire-retardant coating to meet Chapter 8 finish requirements. Requirements for rooms and enclosed spaces shall be based upon spaces enclosed by partitions.Where a fire-resistance rating is required for structural elements,the enclosing partitions shall extend from the floor to the ceiling.Partitions that do not comply with this shall be considered enclosing spaces and the rooms or spaces on both sides shall be considered one.In determining the applicable requirements for rooms and enclosed spaces,the specific occupancy thereof shall be the governing factor regardless of the group classification of the building or structure. d.Lobby areas in Group A-1,A-2 and A-3 occupancies shall not be less than Class B materials. e. ClassC interior finish materials shallbe permitted in places of assembly with an occupant load of 300 persons or less. f. For places of religious worship,wood used for ornamental purposes,trusses,paneling or chancel furnishing shall be permitted. g.Class B material is required where the building exceeds two stories. 96 North Street,Salem,MA 03/12/19 Project Number 19012 Page 6 of 15 h.ClassC interior finish materials shallbe permitted in administrative spaces. i. ClassC interior finish materials shallbe permitted in rooms with a capacity of four persons or less. j. Class B materials shall be permitted as wainscotting extending not more than 48 inches above the finished floor in corridors and exit access stairways and ramps. k.Finish materials as provided for in other sections of this code. 1. Applies when protected by an automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2. SECTION 804 INTERIOR FLOOR FINISH 804.1 General.Interior floor finish and floor covering materials shall comply with Sections 804.2 through 804.4.2. Exception:Floor finishes and coverings of a traditional type,such as wood,vinyl,linoleum or terrazzo,and resilient floor covering materials that are not comprised of fibers. 804.2 Classification.Interior floor finish and floor covering materials required by Section 804.4.2 to be of Class I or II materials shall be classified in accordance with NFPA 253.The classification referred to herein corresponds to the classifications determined by NFPA 253 as follows:Class I,0.45 watts/cm2 or greater;Class II,0.22 watts/cm2 or greater. 8043 Testing and identification.Interior floor finish and floor covering materials shall be tested by an agency in accordance with NFPA 253 and identified by a hang tag or other suitable method so as to identify the manufacturer or supplier and style,and shall indicate the interior floor finish or floor covering classification in accordance with Section 8042.Carpet-type floor coverings shall be tested as proposed for use,including underlayment.Test reports confirming the information provided in the manufacturer's product identification shall be furnished to the building official upon request. 804A Interior floor finish requirements.Interior floor covering materials shall comply with Sections 804.4.1 and 804.4.2 and interior floor finish materials shall comply with Section 804.4.2. 804A.1 Test requirement.In all occupancies,interior floor covering materials shall comply with the requirements of the DOC FF-1 "pill test"(CPSC 16 CFR Part 1630)or with ASTM D 2859. 804A.2 Minimum critical radiant flux.In all occupancies,interior floor finish and floor covering materials in enclosures for stairways and ramps,exit passageways,corridors and rooms or spaces not separated from corridors by partitions extending from the floor to the underside of the ceiling shall withstand a minimum critical radiant flux.The minimum critical radiant flux shall be not less than Class I in Groups 1-1,1-2 and 1-3 and not less than Class II in Groups A,B,E,H,1-4,M,R-1,R-2 and S. Exception: Where a building is equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1 or 903.3.1.2,Class II materials are permitted in any area where Class I materials are required,and materials complying with DOC FF-1 "pill test"(CPSC 16 CFR Part 1630)or with ASTM D 2859 are permitted in any area where Class II materials are required. SECTION 804 FIRE PROTECTION 804.1 Scope.The requirements of this section shall be limited to work areas in which Level 2 alterations are being performed,and where specified they shall apply throughout the floor on which the work areas are located or otherwise beyond the work area. 804.2.2 Groups A,B,E,F-I,H,I,M,R-1,R-2, R-4,S-1 and S-2.In buildings with occupancies in Groups A,B, E,F-1,H,I,M,R-1,R-2, ` R-4,S-1 and S-2,work areas that have exits or corridors shared by more than one tenant or that have exits or corridors serving an occupant load greater than 30 shall be provided with automatic sprinkler protection where all of the following conditions occur: 1. The work area is required to be provided with automatic sprinkler protection in accordance with the International Building Code as applicable to new construction;and 2. The work area exceeds 50 percent of the floor area. Exception:If the building does not have sufficient water supply for design of a fire sprinkler system available to the floor without installation of a new fire pump,work areas shall be protected by an automatic smoke detection system throughout all occupiable spaces other than sleeping units or individual dwelling units that activates the occupant 96 North Street,Salem,MA 03/12/19 Project Number 19012 Page 7 of 15 notification system in accordance with Sections 907.4,907.5 and 907.6 of the International Building Code. For Use Group R and I-1 buildings with an aggregate building area of 12,000 ft2 or more,a., mixed use buildings containing R-Uses,the sprinkler system shall be designed and installed throughout the structure in accordance with NFPA 13. 3. An automatic sprinkler system installed in accordance with section 903.3.13 shall he permitted in Group R-3 occupancies. On the second and third stories, the work areas share exits with other tenants. On the second and third stories, the work areas are greater than 50% of the floor area. Therefore a sprinkler system is required to be installed throughout the entire work area. However, since the sprinkler system must meet the requirements of new construction per note a in Table 903.2, the sprinkler system must be an NFPA 13 system. In addition, since the building is a mixed use building containing an R use group, note a applies and the sprinkler system is required to be installed throughout the entire structure. 804.4 Fire alarm and detection.An approved fire alarm system shall be installed in accordance with Sections 804.4.1 through 804.4.3.Where automatic sprinkler protection is provided in accordance with Section 804.2 and is connected to the building fire alarm system,automatic heat detection shall not be required. An approved automatic fire detection system shall be installed in accordance with the provisions of this code and NFPA 72.Devices,combinations of devices,appliances,equipment shall be approved.The automatic fire detectors shall be smoke detectors,except that an approved alternative type of detector shall be installed in spaces such as boiler rooms,where products of combustion are present during normal operation in sufficient quantity to actuate a smoke detector. 804.4.1 Occupancy requirements.A fire alarm system shall be installed in accordance with Sections 804.4.1.1 through 804.4.1.7.Existing alarm-notification appliances shall be automatically activated throughout the building.Where the building is not equipped with a fire alarm system,alarm-notification appliances within the work area shall be provided and automatically activated. Exceptions: 1. Occupancies with an existing,previously approved fire alarm system. 2. Where selective notification is permitted.alarm-notification appliances shall be automatically activated in the areas selected. 804.4.1.1 Group E.A fire alarm system shall be installed in work areas of Group E occupancies as required by the International Fire Code for existing Group E occupancies. 804.4.1.2 Group I-1.A fire alarm system shall be installed in work areas of Group 1-1 residential care/assisted living 96 North Street,Salem,MA 03/12/19 Project Number 19012 Page 8 of 15 facilities as required by the International Fire Code for existing Group I-1 occupancies. 804.4.13 Group I-2.A fire alarm system shall be installed throughout Group I-2 occupancies as required by the International Fire Code. 804.4.1A Group I-3.A fire alarm system shall be installed in work areas of Group I-3 occupancies as required by the International Fire Code. 804.4.15 Group R-I.A fire alarm system shall be installed in Group R-1 occupancies as required by the International Fire Code for existing Group R-1 occupancies. 804.4.1.6 Group R-2.A fire alarm system shall be installed in work areas of Group R-2 apartment buildings as required by the International Fire Code for existing Group R-2 occupancies. 804.4.1.7 Group R-4.A fire alarm system shall be installed in work areas of Group R-4 residential care/assisted living facilities as required by the International Fire Code for existing Group R-4 occupancies. A manual fire alarm is not required in R-3 occupancy. 804.4.2 Supplemental fire alarm system requirements. Where the work area on any floor exceeds 50 percent of that floor area,Section 804.4.1 shall apply throughout the floor. Exception:Alarm-initiating and notification appliances shall not be required to be installed in tenant spaces outside of the work area. 804A3 Smoke alarms.Individual sleeping units and individual dwelling units in any work area in Group R and I-1 occupancies shall be provided with smoke alarms in accordance with the International Fire Code. Exception:Interconnection of smoke alarms outside of the work area shall not be required. Provide smoke alarms in dwelling units as required by 780 CMR 907.2.11.2 through 907.2.11.7. SECTION 805 MEANS OF EGRESS 805.1 Scope.The requirements of this section shall be limited to work areas that include exits or corridors shared by more than one tenant within the work area in which Level 2 alterations are being performed,and where specified they shall apply throughout the floor on which the work areas are located or otherwise beyond the work area. 805.2 General.The means of egress shall comply with the requirements of this section. Exceptions: 1. Where the work area and the means of egress serving it complies with NFPA 101. 2. Means of egress conforming to the requirements of the building code under which the building was constructed shall be considered compliant means of egress if,in the opinion of the code official,they do not constitute a distinct hazard to life. 8053 Number of exits.The number of exits shall be in accordance with Sections 805.3.1 through 805.3.3. 8053.1 Minimum number.Every story utilized for human occupancy on which there is a work area that includes exits or corridors shared by more than one tenant within the work area shall be provided with the minimum number of exits based on the occupancy and the occupant load in accordance with the International Building Code.In addition,the exits shall comply with Sections 805.3.1.1 and 805.3.1.2. 8053.1.1 Single-exit buildings.Only one exit is required from buildings and spaces of the following occupancies: 10.In buildings of Group R-3 occupancy equipped throughout with an automatic fire sprinkler system,only one exit shall be required from basements or stories below grade. (780 CMR base code)10063.2 Single exits.A single exit or access to a single exit shall be permitted from any story or occupied roof where one of the following conditions exists: 96 North Street,Salem,MA 03/12/19 Project Number 19012 Page 9 of 15 4. Group R-3 and R-4 occupancies shall be permitted to have one exit or access to a single exit. The second and third stories are use group R-3. As such per 1006.3.2, item #4 they are allowed to have a single exit to the exterior of the building. There are 2 exits provided from each dwelling unit. 805.9 Handrails.The requirements of Sections 805.9.1 and 805.9.2 shall apply to handrails from the work area floor to, and including,the level of exit discharge. 805.9.1 Minimum requirement.Every required exit stairway that is part of the means of egress for any work area and that has three or more risers and is not provided with at least one handrail,or in which the existing handrails are judged to be in danger of collapsing,shall be provided with handrails for the full length of the stairway on I at least one side.All exit stairways with a required egress width of more than 66 inches(1676 mm)shall have handrails on both sides. 805.9.2 Design.Handrails required in accordance with Section 805.9.1 shall be designed and installed in accordance with the provisions of the International Building Code. 805.11 Guards.The requirements of Sections 805.11.1 and 805.11.2 shall apply to guards from the work area floor to, and including,the level of exit discharge but shall be confined to the egress path of any work area. 805.11.1Minimum requirement.Every open portion of a stairway,landing,or balcony that is more than 30 inches (762 mm)above the floor or grade below and is not provided with guards,or those portions in which existing guards are judged to be in danger of collapsing,shall be provided with guards. 805.11.2 Design.Guards required in accordance with Section 805.11.1 shall be designed and installed in accordance with the International Building Code. All existing stairways must be in conformance with the above code section. SECTION 806 ACCESSIBILITY 101.4.7 Architectural Access.Any reference in 780 CMR to accessibility shall be considered reference to 521 CMR: Architectural Access Board.521 CMR is enforced by the building official. 521 CMR 9.00: MULTIPLE DWELLINGS 9.1 GENERAL A multiple dwelling is considered to be either a lodging facility or a residential facility for hire,rent,lease,or sale containing three or more dwelling units in a building. Facilities used for temporary accommodations are considered transient lodging facilities. See 521 CMR 8.00: TRANSIENT LODGING FACILITIES. Group 2A units must comply with 521 CMR 9.5, Dwelling Unit Interiors; and 521 CMR 44.00: GROUP 2 BATHROOMS; and 521 CMR 45.00: GROUP 2 KITCHENS; and 521 CMR 47.00: GROUP 2 BEDROOMS. Both dwelling units are included in the aggregate work area and must be in conformance with 808.3.1 thorugh 808.3.7. 8083.1 Enclosed areas.All enclosed areas,other than closets,kitchens,basements,garages,hallways,laundry areas, utility areas,storage areas and bathrooms shall have a minimum of two duplex receptacle outlets or one duplex receptacle outlet and one ceiling or wall-type lighting outlet. 8083.2 Kitchens.Kitchen areas shall have a minimum of two duplex receptacle outlets. 80833 Laundry areas.Laundry areas shall have a minimum of one duplex receptacle outlet located near the laundry equipment and installed on an independent circuit. 8083A Ground fault circuit interruption.Newly installed receptacle outlets shall be provided with ground fault circuit interruption as required by NFPA 70. 80835 Minimum lighting outlets.At least one lighting outlet shall be provided in every bathroom,hallway, stairway,attached garage,and detached garage with electric power,and to illuminate outdoor entrances and exits. 8083.6 Utility rooms and basements.At least one lighting outlet shall be provided in utility rooms and basements where such spaces are used for storage or contain equipment requiring service. 8083.7 Clearance for equipment.Clearance for electrical service equipment shall be provided in accordance with the NFPA 70. SECTION 809 MECHANICAL 809.1 Reconfigured or converted spaces.All reconfigured spaces intended for occupancy and all spaces converted to habitable or occupiable space in any work area shall be provided with natural or mechanical ventilation in accordance with the International Mechanical Code. Exception:Existing mechanical ventilation systems shall comply with the requirements of Section 809.2. 809.2 Altered existing systems.In mechanically ventilated spaces,existing mechanical ventilation systems that are altered, reconfigured,or extended shall provide not less than 5 cubic feet per minute(cfm)(0.0024 m3/s)per person of outdoor air and not less than 15 cfm(0.0071 m3/s)of ventilation air per person;or not less than the amount of ventilation air determined by the Indoor Air Quality Procedure of ASHRAE 62. 8093 Local exhaust.All newly introduced devices,equipment,or operations that produce airborne particulate matter, odors,fumes,vapor,combustion products,gaseous contaminants,pathogenic and allergenic organisms,and microbial contaminants in such quantities as to affect adversely or impair health or cause discomfort to occupants shall be provided with local exhaust. All mechanical work must be in conformance with this code section. SECTION 810 PLUMBING 810.1 Minimum fixtures.Where the occupant load of the story is increased by more than 20 percent,plumbing fixtures for the story shall be provided in quantities specified in the International Plumbing Code based on the increased occupant load.
