1980-PLANNING BOARD Nor 1980 • MINUTES OF THE SALEM PLANNING BOARD HELD FEBRUARY 21, 1980, THIRD FLOOR, CITY HALL ANNEX, ONE SALEM GREEN , SALEM , MASSACHUSETTS MEMBERS PRESENT: Donald Hunt, Paul D'Amour, Ted Sadoski, Richard Lutts, Peter DiGangi, Abby Burns and vvilliam vuheaton MEMBERS ABSENT: John Brown, Walter Power ALSO PRESENT: John Nestor, City Council Acting Planning Board Chairman Donald Hunt called the meeting to order at 7:30 P.M. BOUDREAU -- 409 LAFAYETTE 'STREET Donald Hunt opened the public hearing at 7:30 P.M. Mr. Richard Mailhoit, engineer for the project, presented the plans proposed for the construction of • a pier and float. Susan Madison reported that the Engineering Department has not reviewed the amended plans . The comment sheets from other City departments show the Conservation Commission, Health Department, and Building Inspector all concur with the project. Mr. Mailhoit was asked if the Army Corps of Engineers had been notified yet , and Mr. Mailhoie said he would do that and provide the Planning Board with a letter from the Army Corps of Engineers saying they are aware of what is being done . Peter DiGangi made a motion, seconded by Richard Lutts , to close the public hearing and after passing unanimously, the public hearing was closed at 7:50 P.M. A motion was made by Paul D'Amour and seconded by Abby Burns , to approve a Special Permit pends ng approval of the plans by the Engineering Department. The motion passed unanimously. MINUTES The minutes of the meeting of February 7 , 1980 were reviewed and an addition made. A motion was made by Paul D'Amour and seconded by Ted Sadoski to approve the minutes of the meeting of February 7 , 1980, as amended. Susan read the document.to.the Planning .Board (copy attached hereto) . Ted Sadoski suggested that no action be taken on this matter until Board members receive a copy of the Vote to review. Ted Sadoski requested that Bill Tinti send a note to the Planning Board saying he suggests we take this action. William .vheaton suggested that we also ask at what point the statute of limitations expires on the originally signed subdivision and therefore at what point will the development of the land come under the new zoning. The Board unanimously agreed to that. BOARD OF APPEALS MEETING Susan asked for ideas regarding an agenda for the meeting . Peter DiGangi suggested the meeting agenda include two sections: (L) inter-related workings • with them, and (2) any suggestions they might have regarding zoning changes. HEWITT CONSTRUCTION -- Public Hearing Clark Road .Halter Power called the public hearing to order at 7:35 P. M. The public • hearing is to divide a lot of land at the intersection of Clark Road and Barnes Road into four separate house lots. The lot is in a wetlands district. This area has had a lot of drainage problems in the past. Walter Power read the comment sheets from the other City Departments. The Conservation Commission concurred with the project. The Building Inspector cannot concur with the proposal because the Salem Zoning Ordinance (Section VIII B. 3) prohibits subdivision of lands which create lots or portion of lots that do not conform with the density requirements established by the Ordinance. The Board of Health visited the site, viewed plans and concurs with the proposal. Mr. Frank Damata, 30 Clark Street, expressed concern about the water problem. He said he would like to see houses go up there. He said he spoke with Mr. Hewitt previously and Mr. Hewitt agreed in writing to stay about one foot below the grade level of his property. Mr. Hewitt said there will be a swale above the drain so that if the drain fails , Mr. Damata's land will still not be flooded. Mr. Thad Wlodyka, 137 Derby Street, is the owner of eleven lots of land on Clark Avenue. His property abuts back to back with Mr. Hewitt. He wanted to know how this plan would affect his lots. He felt his property would be • SALEM'PLANNING BOARD March 20, 1980 Page 2 • adversely affected. It was resolved that Mr. Wlodyka would accompany Susan Madison and Donald Hunt to the site. Ms. Madison is going to the site to spray trees to mark the exact line of fill. Hearing no further comments from the Board or the audience, Walter Power d"eclared the public hearing closed at 8:10 P.M. STERN-TISE ASSOCIATES -- Phase II Condominiums on Federal Street. Attorney George Vallis came before the Board to familarize-;them with this project. Previously, a plan for an office building and condominiums on the old A & P lot was submitted to the Board of Appeal and was denied. They have now come back with a revised plan showing substantial changes. The Board of Appeal agrees there is substantial change and they will be writing to the Planning Board on this shortly. The revised plans show twelve condominium units instead of the sixteen originally planned and they now provide twenty parking spaces . 20'x22' DERBY STREET SIGN NEAR PICKERING WHARF. • Greg Senko came before the Board to present a plan for an oversized sign showing directions to Pickering Wharf, Salem Y.illows, and historic sites along the way. The general feeling of the Board was that the sign was confusing for motorists and could create further traffic problems in an already congested spot. Ed Stevenson, representing the House of Seven Gables, said there is a real problem with tourists not being able to find them. Donald Hunt objected to the size of the sign. He suggested providing tourists with maps if that were possible. Mr. Stevenson agreed with the proposal but said that they must work within their limits. William vwheaton felt the sign was an inappropriate solution to an appropriate problem. He felt better information on the site would serve the same purpose. Peter DiGangi suggested tourists be directed to one tourist information center, and once there, should be given maps. Greg Senko said there was not the money available in the Chamber of Commerce to staff a visitor center. As a viable alternative for the present, he suggested that the Planning Board go with the sign to see if it works even if the Board feels there should be performance guarantees involved. Maps are in the process of being made but that is further down the line. Mr. John Campbell, representing Salem Willows , said their problem is that people have no idea how far away the Willows is. He would like something more than just an arrow and a direction. • SALEM PLANNING BOARD • March 20, 1980 Page 3 A motion was made by Richard Lutts and seconded by, Peter DiGangi that a specific sign be erected (the design of the sign to be reviewed and approved by the Planning Board) at this site for a term of one year, to be taken down at the end of one year. The motion passed 4 - 3 'with Paul D'Amour, William .vheaton and Donald Hunt opposed. ` A motion was made by William vvheaton, seconded by Richard Lutts, that the Salem Planning Board write a strong letter of support for a visitors' center to be located at Riley Plaza and staffed by trained personnel , with adequate signs directing visitors to it. The motion passed unanimously. LORING HILLS The Planning Board had asked Bill Tinti to write a letter on how the Board should vote to remove the conditions before it. Walter Power read the letter received from Bill Tinti (copy attached hereto and made a part hereof). The motion passed unanimously. PIERCE ROAD • Mr. Clayton Smith is coming in at the next meeting for a special permit to build a single family residence. The lot exists now as three lots. Because he is not on a public way, the Building Inspector should not issue a building permit. BOARD OF APPEAL MEETING. Walter Power read his March 17 , 1980 letter to the Salem Board of Appeal (copy attached). MINUTES The minutes of the meeting of March 6, 1980 were reviewed and corrections recommended. A motion was made by William .vheaton and seconded by Abby Burns to approve the minutes of March 6, 1980 as amended. The motion passed unanimously. PALMER COVE SEAvvALL. There is no real resolution on the question of ownership of the land. Susan has been told there is a lease agreement , but she has not seen it. As far as issuing • the special permit , Susan felt that should only entail whether the wall will SALEM-PLANNING BOARD March 20, 1980 Page 5 stand or not. Walter Power said by approving the special permit, the Planning Board is approving the construction of a wall, and if the wall is partially ori abutter's land, shares responsibility for its being there. Therefore, the Planning Board should address that issue. A motion was made by Peter DiGangi and seconded by Paul D'Amour-.to approve the special permit on the condition that the construction shall take place within the boundaries owned or leased by Palmer Cove. The motion passed unanimously. MISCELLANEOUS COMMUNICATION Walter Power read his answer letter from Governor King regarding the Connector Road (copy attached). l Mr. Hawkes in Bridge Street got his variance from the Board of Appeal to split his lot into three separate lots. Greg Senko reported that his staff is presently reviewing the Zoning Ordinance and he should be back in in two weeks . The Master Plan is being retyped and • is to go out for printing in about another month. A motion was made to adjourn, and having passed unanimously, the meeting adjourned at 10:10 P.M. If taken by the Planning Board, the effect of the Vote would be to include under existing zoning all of the land in the subdivision plans of Loring Hills Developers Trust. This is not to say that successors in interest to Loring Hills Developers Trust may not attempt to grandfather the old Zoning by the filing of a purported modified definitive subdivision plan. The Planning Board, in that case , would defend its position on the basis that a reasonable time period has elapsed and no modification can any longer be filed . Boulger, Jr. , Chairman Gentlemen: The Appeals Board and the Planning Board have their re- sponsibilities in mutual areas of interest. In conducting our everyday business, there are times, I'm sure, when one or the other would have benefited from knowing the policies of the other. Also, with the completion of the Master Plan, the Planning Board would like to hear the views of the Board of Appeals before the implementation phase begins. • We, therefore, should like to propose a meeting to ex- plore our common interest so as to understand each other' s views. If you are agreeable, please give us .a list _of• topics you would like to discuss and we can develop an agenda. Topics which we would like to discuss' are: 1. Form A approvals. 2. AGREEMENT IN PRINCIPAL BETWEEN Salem Planning Board and Loring Hills Developers Trust Charles Quigley, Herman Brettman, Trustees The parties agree in principal that the following represents their intent and under- standing concerning development of approximately eighty (80) acres of land owned by the said Trust off Loring Avenue in Salem, Massachusetts and appearing on a plan previously submitted to said Board. 1 . Development on Parcel B shall be permitted to go forward and a permit issue for a building to be used for "housing for the handicapped" , and this building is shown-on plan previously submitted to the Building Inspector of the City of Salem with the following changes: a . Only (1) and (2) bedroom units; • b. No townhouses; c. Number of units not to exceed 250; d. Height to be 95 feet with elevator wells extending above the roof as shown on the submitted plan; e. Taxes assessed by the City shall be in accord with City practice as they pertain to private and conventional financed apartments in the City of Salem. The Developer will not seek a 121A agreement. Assessment shall be in accordance with standards used by the City of Salem assessors in assessing property in Salem.. 2 . Parcel G - A nursing home consisting of not more than 150 beds shall be permitted on Parcel G as soon as plans for the same shall be submitted. After • discussion, a motion was made by John Brown and seconded by Ted Sadoski to -approve the minutes of December 20, 1979 as amended. The motion passed unanimously. _DEARBORN LANE-- Miscalculations Ms. Madison read a letter from Richard Swenson, Engineering Department, saying the plan is a paper drawing only that doesn't fit the actual subdivision (copy of letter attached hereto and made a part hereof). The calculations do not.compute. There is a problem with sideline set back. Ms. Jyladison will contact-the City Solicitor to find out the proper procedure'to correct-this problem. - She will also talk with Rich Swenson to find a way to help Mr. Dickson. --Mr-.* Dickson said his plans are still on paper and the house can .be moved. A letter was drafted to be sent to Mr. .Decculos informing him there-are errors in the subdivision .plan. A copy of the letter will go to the City Solicitor, Assistant City Solicitor Bill Quinn, A. V. Fletcher and Richard Swenson of the Engineering Department. A copy of the letter is attached hereto. i SALEM PLANNING BOARD January 3, 1980 . Page 2 U-HAUL -- Violation of Special Permit After a public hearing last summer, the Planning Board approved a special permit for U-Haul on Jefferson Avenue with the conditions that they conform to the Plans and that also they add curbing as per instruction of the .City Engineer, Ms, Madison received a memorandum from the City Engineering notifying the Planning Board that the curbing has not been put In. Ms. Madison will writing a letter to U-Haul informing that that they are now In violation of the Special Permit; the Building Inspector has been notified; and that they have ten days to correct the violation. SALEM PUBLIC LIBRARY -- Renovation of Main Branch John Brown presented plans as information only for the renovation of the Main Branch Library on Essex Street. PETER ROAD SUBDIVISION - • This subdivision was before the Board in 1970. It appears now that the bond was never released. Ms. Madison inquired whether anyone had any specific recollection of this. -Ted Sadoski recommended that Susan call Gerald McCarthy, Chairman of the Planning Board at that time. BOARD OF APPEALS AGENDA I The.-Board=oEAppeals=agenda for January 16, I980 was discussed. It was decided that no letters'.would be-written. Appeals' Board Rulings -- Potential Form A Susan..Madison.presented.for the record a potential Form A application.of Peter . and-Carol_Katsarakes. requesting a variance .for Lots 14517, 4519, and #57.1 Cherry Hilr Avenue. :They wish to combine three lots into two. The Board of Appeals granted the variance conditioned upon approval. by the Planning Board. Also presented was the petition of George R. Tilton requesting a variance for Lots 035-3, #355, #356, #354, and #357 Marlborough Road. They wish to combine five lots into two. The variance was granted. . The position that has been established by recent Board of Appeal decisions is that although the Board of Appeal will grant variances relative to frontage,. they will be conditional on Planning Board approval through the Form A process. l SALEM PLANNING BOARD January 3, 1980 Page 3 Susan Madison asked if she should automatically notify the petitioner and • send- them a Form A application. It was felt that unless there was an obvious problem, the Planning Board should wait for the Petitioner to contact the Board. The Clerk was instructed to form a new file for Form A Potentials on Board of Appeal Rulings. A motion was made to adjourn, and having passed unanimously, the meeting was adjourned at 9:25 P.M. FORM A -- 335 Bridge Street Part of Kiernan Auto Sales parking lot is being sold to Robert Magarian Carpet Co. as a good neighbor policy. This 30' lot would allow parking for Magarian • employees and also room for trucks to unload carpets off the street. A motion was made by Paul D'Amour and seconded by Abby Burns to approve the Form A, approval under Subdivision Control Law not required. The motion . passed unanimously. NATHANIEL BOWDITCH PARK . Mr. Michael Moniz reported that City Planner Greg Senko met with the City Council last night. The Master Plan looks like it is going out for printing next.week. He also discussed the. South River with the City Council and will be coming in to the next Planning Board'meeting to talk about that meeting. Mr. Moniz and Ms. Christine Sullivan presented their relocation plan .(copy attached hereto). This plan assesses what the needs are so-that when the grant approval comes in, they can start working on a one-to-one basis. The plan includes a list of available space for commercial use in the city. Mr. Moniz has .met with all the business owners involved in this project except for Peter Strout. This commercial space list will go into the State (Department of Community Affairs) to be reviewed by them. This plan also lays out a financial schedule for reimbursement ofmoving expenses. • • SALEM PLANNING BOARD January 17 , 1980 Page ? • The State just found out what their total allocation on the self-help will be. The City should be finding out the amount in two or three weeks. Then, the Planning Department will find out what the grant award will be. The grant award sets the time clock in motion and gives the City 30-60 days to come up with a short term bond which will be 50% reimburseable. Walter Power asked when the Planning Board would be issuing an invitation to meet with 'the business owners. Mr. Moniz felt it would be best left until they have had a chance to go over the figures and find out what monies are available for their move. Christine Sullivan explained to the Planning Board the general layout of Nathaniel Bowditch park. She talked of a possibility of a hotel. Economically, a hotel would have to be large enough for 100 rooms. If they could get a hotel, they could conceivably go after a UDAG grant to construct a parking garage. Jimmy's Marina is a possibility although they have no money figures on that. There is a group of people interested in bringing another hotel into the City (names and addresses attached hereto). Chirstine Sullivan also talked of a group working on tourism for.the City and passed out a list of their .names and addresses (attached hereto). Ms. Sullivan said there is money to do a market study on Nathaniel Bowditch park, and plans are to-look at all approaches such as a hotel, visitors' center, convention center, etc. COMMUNICATIONS John Brown introduced an article by Bruce Koon of the Wall Street Journal on howr city dwellers act to retain their parking spaces (copy attached). Walter Power asked Board members to'read the article and jot down any questions they have. It will be discussed at the next meeting. Walter Power read a letter from City Clerk Josephine R. Fusco.advising the Board that Councillor John F. Nestor has been appointed as the City Council's liaison to the Planning Board. The Clerk was instructed to write a letter of congratulations to Councillor Nestor and to invite him to the next meeting (copy attached hereto). Rybi ��l,vv Clerk NATHANIEL BOWDITCH PARK RELOCATION PLAN SECTION 1: NARRATIVE The proposed Nathaniel Bowditch Park project area, focus- ing on the abandoned and unmaintained waterway known as the South River, is at the center of a number of revitalization projects and is regarded as the key link in the eventual unification of downtown Salem, its historic waterfront, and adjoining low- and moderate-income neighborhoods. The Park project will utilize vacant or inappropriately used waterfront property and transform the area into a water- front and neighborhood park. The target area presently houses four commercial buildings. and contains 3 .76 acres of .vacant or -. underutilized land. (A list of present owners, tenants and businesses is included in Section 3 . ) The south side of the channel will be a recreation area which will serve as both a waterfront amenity and 'a neighborhood resource. The large open lot at the corner of Congress and Peabody Streets will become a playground equipped with basket- ball courts and a playing field. A totlot will be developed" • off central Peabody .Street serving both as a play area and a gateway into the neighborhood. As a waterfront amenity, the area will support and complement the economic development of the area and preserve public access to the waterfront. As- a -.neighborhood resource, this project responds to the virtual .. absence of recreational facilities in .the Point neighborhood which is exacerbated by serious overcrowding in the area. The west side the channel will serve the City in a number of ways. First of all the area will serve as a physical and . visual link between the south side and the abutting neighborhood and the newly revitalized downtown. Secondly, the area will act as a visual gateway to the harbor opening up the hidden amenity of the South River channel for the enjoyment of the citizens of. and visitors to Salem. The west side will also serve as a vital link to the area along the. north side of the channel and waterfront projects to- the .east. The -City is presently ,study ing the north side of the channel for revitalization or redevelop- ment purposes. . The parcels targeted fcr .acquiSi-ion on the northeast side of the channel 74.11 be utilized as a parkin' area for the Park and the proposed boat 'basin that will. be developed within the South River channel itself. Salem is hopeful of receiving acquisition funds through the Massachusetts Urban Self Help Program and the Department of Interior Land and Nater Progra"m; administered by the Heritage • Conservation Recreation Service (H.C.R.S. ) . Preliminary applica- tions. for $1, 000,000.00 in acquisition funds were submitted in August to H.C.R.S. The City is expecting notification on the. . awarding of. funds during November of this year and, if the City is successful, a Grant Agreement *with H.C.R.S. would have to be signed within 30 .days. The displacement period would begin as ' soon as possible after the Grant Agreement is signed with letters of just compensation being sent to the owners and occupants. PLANNING BOARD AIDE REPORT South Essex Sewer District. Ms. Madison asked for all letters Board members have received and names of all people who have called them regarding SESD's storing of ash. Walter Power said the Planning Board will respond to all letters. Susan reported that the Planning Board does not have any jurisdiction now because where they are storing the fly ash is not in a flood hazard zone. Donald Hunt disagreed because they are in violation of zoning. j SALEM PLANNING BOARD February 7 , 1980 Page 2 • Pickman Park. Presently, the City is in search of a Clerk of the Works. This is a more detailed position than normally Would be the case because of the 15 or 18 pages of conditions to be met. The salary has not yet been agreed upon. . Form A. There is another variation in Form As. Susan discussed this with Bill Tinti and he suggested the following wording to be used when Form A results in lots not in conformance with the Zoning Ordinance: Division of land on the basis that two or more buildings were standing on the lot when . the subdivision law went into effect in the City of Salem. However, the approval of this plan does not establish compliance with the existing Zoning ordinance of the City of Salem. " -It was decided to use this language on any Form A that doesn't have adequate frontage. A motion was made by William ..vheaton and seconded by Ted Sadoski to change procedure so that applicants get their appeal decision first before coming in for a Form A. The motion passed unanimously. • Public Hearings. Next meeting, there will be two public hearings. Ms. Madison reported that they are both incomplete. She asked if she should notify the owneis that there will be questions. It was felt that Susan should call-them and request that they withdraw without prejudice. Dearborn Lane. A letter has been sent to Attorney Decoules on January 4, 1980 requesting another Subdivision Plan. He has not called or written since. Mr. Dickson, the owner of Lot #4 Dearborn Lane, is able to start building. The'City is presently holding a bond from Mr. Decoules. Peter DiGangi suggested the Board seek' an opinion from the City Solicitor on what to do with the bond money. " BOARD OF APPEALS MEETING. Walter Power suggested that the Planning Board set up a meeting with the Board of Appeals to develop some policies on areas of mutual interest. The Board members agreed that a meeting should be set up. An agenda will be made up and Mr. Power asked that any ideas Board members may have be given to Susan so that an agenda can be formalized before the next meeting. SALEM PLANNING BOARD February 7, 1980 Page 3 CONNECTOR ROAD Walter Power drafted a letter to Governor King regarding the connector road. He read the letter and asked Board members for their support. William ..heaton made a motion, seconded by Abby Burns, that halter Power be empowered to send the letter to Governor King with a copy, to the Mayor and the newspaper. The motion passed unanimously. ' GREG SENKO --CITY PLANNER Mr. Senko reviewed the Quarterly Report with the Board. He outlined his department personnel and explained changes made. He now has five members of the Planning Department which he calls his "Senior Staff" members. They are responsible for specific projects and for working with junior staff members on other projects. Greg has included the staff member responsible for each project on the Quarterly Report so that-Board members may call the staff member directly concerning any questions they may have. The Planning Department • is presently looking for an overall housing coordinator. They will be advertising shortly. Regarding zoning, Greg suggested that the Board appoint subcommittees or Individuals who would be willing to meet almost continuously on this. It is going to be quite a project. After discussion, the Board members felt that Planning Department members should come in before the whole Board. BOARD OF APPEAL AGENDA. The 'Board of Appeal agenda for February 20, 1980 was reviewed. Regarding the petition of Gary H. Palardy and Philip L. The motion passed unanimously. UPCOMING PUBLIC HEARINGS Pierce Road. This is coming up on April 3. It is a paper'street and there is no water there. They will be coming in for a 'Ncllands/Flood Hazard spacial permit to build the house, . The Conservation Commission looked it over and everything seems to be alright. The elevation is above the 15.36 m.l.w, It there is a problem with water and sewerage, then it is up to the City Engineer • to get the Building Inspectornot to issue a building permit. �. It the owner does have to go through the Form A process to erase lot lines, the Planning Board would not be able to approve the plan because of lack of frontage on an existing way. HEWITT CONSTRUCTION - Clark Road J' This public hearing for a special permit is coming up at the next meeting, March 2.0, 1980. In 1977, Hewitt went to the Board of . Appeal for a variance on frontage. The Planning Board at that time wrote to ' the Board of Appeal requesting they deny the variance because they were filling the land illegally, thus violating the Wetlands Protection Act. The variance was denied. The Board of Health has a notation on their file that the problems have been corrected. Susan asked it this should come under controlled growth and was told to look up the point system to determine that.._.If so, he will ha,V-a to go through the control growth procedure. Susan will also check with Mr. Hewitt to ,see what he is planning to do for sewerage, • PALMER COVE SPECIAL PERMIT. This is the Wetlands/Flood Hazard special permit that came in just before Christmas wit`s plans for a seawall. The Engineering Department and the Conservation Commission had some serious questions about the plans. They have now submitted a stability analysis on the wall and revised plans which have been reviewed by the Engineering Department. They feel they now meet the requirements of Section VII of the Zoning Ordinance. Walter Power asked if they cleared up the ownership question brought out at the public hearing. Ms. Madison had no information on that.. She will call .Phil Moran, a member of the Conservation Commission and also a member of the Palmer Cove Yacht Club. This matter will have to be either denied or granted at the next meeting. MINUTES The minutes of the meeting of February 21 vvere reviewed. Hawkes, Trustee of Salem Bridge Street Realty Trust, for variances to place three multi=family dwellings located at 140-142-144 Bridge Street on separate lots, was reviewed. • After much discussion, it was decided to authorize William ..heaton to take whatever action he deems necessary to handle this matter.- Regarding the petition of Zolotas Realty Trust for a variance for the property located at 36-38, 38-40 Irving Street, to convert the factory building to 12 residential single family units, the Board objected to the proposal on the ground that 12 units violates almost all zoning requirements; it is in total violation of the character of the neighborhood; and the question of hardship is open to debate since the building is currently not in use and thus is generating no income. The -Board recommended they deny the variance. Regarding the petition of Mary L. Powers fora special permit to operate an antique shop in a portion of the first floor at 384 Essex Street, the Board • objects to the variance because the building already has many more units than is currently allowed under zoning; on other occasions has recommended that Essex Street remain exclusively residential; that parking during the day time is already a serious problem; and that a commercial variance will run forever and although the present owners may restore the building, future owners may not. MEETING WITH BOARD OF APPEAL. ..alter Power recommended we include areas of common interest in our agenda.. Some ideas were: - 1. Common policy regarding Form A appeal. 2. PIERCE ROAD - Public Hearing Walter Power called the public hearing on the petition of.Clayton Smith to order • at 7 :35 P.M. He explained to the audience the procedures followed for a public hearing. Susan Madison explained that what is being proposed is the building of a single family residence on Pierce Road. Pierce Road is a paper street. Mr. Smith is proposing a 25 foot driveway into his property. A special permit is required because the property is in a wetlands/flood hazard district. The Planning Board is concerned mostly with engineering questions regarding a wetlands. Mr. Joseph Carter, representing Clayton Smith, made his presentation'to the Board. The house is being planned well above the flood hazard elevation require- ment. Most of the lot will remain in its natural state. Mr. Dibiasi`is the present owner. Mr. Smith is buying the land conditional upon the permits being issued. Mr. Carter estimated that about 20,000 square feet of land is above the 15 . 36 flood level. There is an existing sewer easement across the front of the property. The driveway is above the 100 year flood level. Paul D'Amour asked if the sewer line was operative. Mr. Carter responded that there is a 30" sewer line which is in constant use. He has heard stories about leakage occasionally but has nothing concrete on that. He commented that a 30" pipe serves a large area and two more people using it would be considered very minor. Walter Power asked if there would be any objection to this being approved with the condition that all construction be above the 15 .36 fpot level. Mr. Carter • said there would be no objection to that. SALEM PLANNING BOARD April 3, 1980 Page 2 • Mr. Power read the comments from other city boards. The Conservation Commission concurred with the proposal, noting that the site of the proposed house did not appear to be in a wetland.r'The soil and vegetation are not the type found in a wetlands area. They also noted that a road installed on Pierce Road would encourage illegal dumping. The City Engineer concurred with the proposal with the following comments: "Though the structure complies with the provisions of the Zoning pertaining to Flood Hazard areas, the following must be noted: 1. Pierce Road is not an accepted street, and was not layed out by the City Engineering Division. Therefore, if a building permit is granted, permit should clearly state that paving or other services to the structure are not a requirement. 2. Water,' line must be laid outside sewer easement. 3. Builder/owner must sign release for possible sewage back as' Pierce Road sewer trunk line frequently surcharges due to age and infiltration, 4. City will assume no responsibility of maintenance or replacement of driveway placed on sewer easement as City trucks must frequently work this area. S . See corrections MSL. " The building inspector cannot concur with the proposal. He commented that he • would not be able to issue a building permit for this project since the property shown does not meet the definition for a "lot" which requires frontage on a paved street (see section IIB-24 of the Salem Zoning Ordinance). There may also be some foundation problems in this area due to soil conditions. The Board of Health concurred with the proposal with the comment that based on high water table area, it is recommended that inside foundation be damp proofed. Ms. Lillian Papalegis, 29 Pierce Road, wanted to know exactly where the driveway will be put in. She has maintained that area of land for 24 years. Mr. Carter said all construction will be done on Mr. Smith's property. Mr, Richard Burke, 20 Buchanan Road, expressed concern about the water. He said during a heavy storm he gets water in his cellar. He said the lot of land in question is squishy even on a dry day. Councillor John Nutting thanked the Planning Board for being so concerned. He is opposed to the plan. The sewer lines are already overloaded. At high tides, this lot is someti nes under water. He felt a 10 foot wide driveway would be out of context with the streets up there. He is concerned about street lighting, sidewalks, snow plowing, etc. He also felt the owner of the lot might come back at a later date and petition for a seawall. SALEM PLANNING BOARD April 3, 1980 Page 3 • Mr. Charles O'Donnell, 18 Buchanan Road, expressed concern about the grade level. He wants to be sure that the grade filling is as the engineer said because if there is any back filling , it will go into his property. Mr. Carter responded that this was a recent survey done be a registered surveyor. Mr. O'Donnell said he gets water in his cellar from rain. Mr. Carter said the grading would be continuous down graded so as not to cause flooding. Mr. Albert Dumas, 16 Buchanan Road, said he does not get any water in his cellar. Mr. John Tature, 2 Buchanan Road, Anthony Zukakis , 4 Buchanan Road, and Mr. Callahan, 22 Cleveland Street, all said they get water in their cellars. Councillor Brian O'Keefe said he felt that if there were development there, it would have some adverse effect on the people already there. He urged the Board to consider the complaints of the neighbors. Walter Power said the Planning Board would like more information on the hydrology in the area. Mr. Carter said the natdral drainage of the area will be unaffected. There will be perimeter drains installed. • Mr. Clayton Smith, 47 Beach Avenue, Swampscott, explained that he works in Salem and is anxious to live in Salem and be a part of the community. He doesn't want water problems on his land and stated he want to some expense to avoid flooding problems. He asked the neighbors to please call him at the Salem Five Cents Savings Bank when there are water problems in the area. Hearing no further comments , the public hearing was declared closed at 8:35 P.M. STERN-TISE CONDOMINIUMS Attorney George Vallis came before the Board to make his presentation. He gave the Board the history of the project and asked for a unanimous vote stating that there has been substantial change. A motion was made by Abby Burns and seconded by Donald Hunt that (a) the changes made are specific and material; (b) these changes are specific and material in relation to the conditions upon which the unfavorable decision was made; and (c) the Planning Board now approves of the application. The motion passed unanimously with eight members voting in favor. FORM A -- 8 and 81/2 Allen Street property of Tohn Keane • This is one parcel of land with a house in back of a house. Mr. Keane would like to split the lot and have a right of way to Parcel B but belonging to Parcel A. The motion passed unanimously. CHARLIE'S LIQUORS -- New Sign Susan Madison made the presentation for an additional sign for a new business • in back of Charlie's Liquors on North Street. There is going to be a 7-11 store. According to the Sign Ordinance, the owner is entitled to two free-standing 65 square foot signs plus signs attached to the building. The owner of Charlie's Liquors is willing to compromise for one free-standing sign of 74 square feet for both businesses and an undersized sign on the 7-11 store. A motion was made by Richard Lutts and seconded by William .,heaton to approve the sign as presented. The motion failed by a vote of.? - 6. The Board wanted to see what actual use the building will be put to before they issue a sign. PLANNING BOARD AIDE REPORT Pickering Park Subdivision. Susan Madison met with Hayes Engineering. The architect will come to the April 17 meeting to discuss preliminary designs. Hewitt Construction - Clark Road. Susan visited the site and sprayed the trees where he will'b' e filling to even off. The wetland area is well behind that. It was felt that the Board should write a letter to the Mayor and the City Solicitor pointing out that the City has not adopted an insurance plan to protect the boards. This should be done immediately so that something could be put into the budget this year. The Town of Danvers has just adopted such a plan. There should be something in writing to indemnify the Board from any monetary loss. Walter Porter will form the proper wording to present to the Mayor and bring it to the next meeting. PICKMAN PARK -- Architects' Renderings • Salem Acres would like to start construction on Pickman Park this summer. They will construct two or three houses on Preston Road. Ms. Madison stated that all conditions have been satisfied as far as they have progressed. There are more engineering requirements to be satisfied. Mr. John Emerson made the presentation for Salem Acres. He presented to the Board a paper stating the purposes of the presentation and the conditions relating to prototypical designs (copy attached hereto and made a part hereof). Regarding Condition 6, Mr. Emerson stated this particular condition is a little difficult. At this point, they cannot determine exactly what the mean finished grades are. He would like to shelve that except to tell the Board the buildings will be 2 1/2 stories high . He felt it was premature to talk about grade. Looking at the drawings presented, Mr. Emerson first talked about the "stripped down" model. One is a "flat", one-level design, and the other is a "town house", or multi-level design. There are several add-on elements such as cathedral ceiling in the dining area or an added balcony. In the second plan, they show two split-level units. These units do not show in-unit parking garages. There are add-on elements here also such as a balcony or a sky light. The third set of drawings shows what happens when areas are combined from both designs. This will allow for variety.. • SALEM PLANNING BOARD April 17 , 1980 Page ? • Approximately 50% of the units will have garage space in the units. This will depend on the site and the marketing. All units will have chimneys. There is a correction not shown in the drawings . The chimneys will have chimney pots which are not pictured. Therefore, the chimneys will not be as high in brick as pictured. Mr. DiBiase would like fire places in the apartments. Regardnj-)wood stoves, the units would be built with all precautions. The size of the clapboards is 4" exposed. This could vary from 3 1/2" to 4 1/2 ". Susan Madison asked how close these drawings were to actual construction. Mr. Emerson said they are very close. Minor adjustments are expected like the exact placement of windows and the level of refinement. Substantially, it is as presented in the drawings. The buildings will have gutters and downspouts. They have adequate water collection points. When asked if there Mould be full basements , Mr. Emerson said in the "flats" there would be a garage taking some of the full basement. In the "split-levels", there will be crawl spaces . These crawl spaces will be accessible for both • possible mechanical equipment and other storage. The crawl space will be 3 1/2 feet high. All the buildings will have some kind of storage space. Ms. Madison said it was felt there would not be a need for a Clerk of the Works for the first season since soltittle actual construction would take place. This will be handled in-house. It was decided Susan will get something in writing from the City Engineer on this. The Board expressed their enthusiasm in the project and thanked the people for coming. WILLA -- Small Cities Grant. The total amount of the grant is 2.8 million, with one million left for this year. The broad categories are pre-prescribed. It will include street improvements on Essex Street, Lynde and Norman Streets. This will define the down town area. The neighborhood strategy area goes from Summer Street across town to slightly beyond Webb Street, around Pickering+Wharf to include the UDAG area, cuts Lafayette Street and goes back to Summer Street. This whole program will serve 70% loin/moderate income. • f 1 SALEM PLANNING BOARD April 17 , 1980 Page 3 They are working with the owners of down town businesses to rehabilitate the facade of the buildings . This is used as a "giant carrot" for the owner of the business to further rehabilitate. This will be used mostly on Washington Street and Essex Street. Bowman's Bakery is being done this , year. The change here is not affecting frontage. Parcel A is to be conveyed to Philip and Carol Moran. This will join their existing parcel. THE PURPOSE OF THE PRESENTATION Condition 8 of the referenced Special Permit requires that plans for structures "...shall be submitted to the Planning Board prior to application for a building permit for verification of conformance with conditions numbered 3, 4, 5, 6 and 7." We wish to make this a two step procedure in order that the Architect and Mr. DiBiase have the benefit of the Planning Board's guidance during the development of the designs. There are certain issues related to the design of the buildings proposed for construction in Pickman Park which are independent of their locations on particular sites. These issues, specifically conditions 3, 5, 6 and 7, have been addressed in what we call the prototypical designs. We ask that these issues be considered by the Board at this time, leaving • those which relate to specific siting, condition 4, for review as each site plan is developed. CONDITIONS RELATING TO PROTOTYPICAL DESIGNS Condition 3. "All building plans shall be prepared and signed by an architect licensed•: to practice in the Commonwealth of Massachusetts." The owner, Mr.. Ugo DiBiase, has entered into an agreement with John V. Emerson, AIA (reg. no. 2399) to prepare the plans. The prototypical designs being submitted this evening have been signed as will be all future submissions. Condition 5. "Exterior building designs shall be compatible with the surrounding natural state of the land." This is a highly interpretive condition which the Architect with the Owner's concurrence have addressed as follows: a. •Exterior sheathing material. We propose to use cedar clapboards with semi-transparent stains. In our estimation this treatment will permit a variety of colors without offence to the natural environs. • b. Roofing materials. We propose to use asphalt shingles. Colors are proposed to be in the range of woody and earth colors as • most appropriate in this context. c. Form and massing. The basic unit is a simple enough element with a 2: 1 pitched roof. In combination with other units adapting to changes in grade, the addition of add-on elements such as bay windows and balconies, along with other simple variations, will result in buildings of subtly modulated form which should be most compatible with the surrounding natural state of the land. We are deliberately avoiding both extremes of the overarticulated "romantic" style and simplistic geometric shape, overstatements in both cases and therefore offensive in this context. Condition 6. "No building or structure of any kind shall be erected which shall exceed 2.5 stories in height measured from the mean finished grade at the building line." Please refer to 'drawings. Condition 7. "Dwelling units to be erected upon the above described property shall contain no more than two (2) bedrooms. A "den," "study" or similar room shall be considered as a bedroom." CLAYTON SMITH -- PIERCE ROAD The Conservation Commission has had their public hearing. They will come up with an order of conditions soon so there is permission to build. Ms. Madison presented two lettsrs1from Mr. Carter (copies attached) and Mr. Smith submitted new plans (copy attached) . Ms. Madison reread the enineerin3 requirements. Mr. Fletcher will be submitting additional comments when Ms. Madison submits the new plans to him. PUBLIC HEARING -- Pickering Wharf Marina Special Permit Walter Power read the public notice. The public hearing regards a special permit to upgrade existing diesel storage underground tank from 1 ,000 cations to 5 ,000 gallons , and also to install underground one 1,000 waste oil storage tank . The Board of Health concurs with the proposal. The Build[ ng Inspector concurs . The Conservation Commission agrees and has submitted their Order of Conditions . SALEM PLANNING BOARD ,r September 4, 1980 Page 2 • The City Engineer did not agree with the proposal. In a letter dated September 4, 1980 (copy attached hereto) , Mr. Fletcher listed changes that have been agreed to and requested written confirmation to the Planning Board from the Engineer. This letter from Daniel J. Lynch (copy attached hereto) was received and Mr. Fletcher is will to accept it to serve as part of the conditions in lieu of a new plan being submitted. A motion was made by Jim Fox and seconded by Paul D'Amour to approve the Special Permit on the conditions that all work shall be done in accordance with the plan entitled "Pickering Wharf Marina, proposed fuel oil storage" prepared by D. J. Lynch of Marblehead. Revised pian and uplift calculations will be resubmitted within two weeks incorporating the five suggestions in Mr. Fletcher's September 4th letter. The motion passed unanimously. SPECIAL PERMIT -- Clayton Smith Pierce Road. The proposal was reviewed. Susan Madison met with the City Solicitor and it was his opinion that if the City Engineer thought the plan was unsafe , the Planning Board should act on his recommendations . Susan Madison then prepared • a list of conditions which both the City Engineer and Mr. Smith's attorney and engineer agreed with. The Order of Conditions from the Conservation Commission was reviewed. A motion was made by Richard Lutts and seconded by James Fox to approve the special permit on the condition that the City Engineer approve the proposal and that the Order of Conditions from the Conservation Commission be incorporated in the special permit. The motion failed by a vote of 2 - 3 with one abstention (Abby Burns) . A motion was made by William Wheaton and seconded by Paul D'Amour to deny the special permit because 1) attachment to the sewer system may further deteriorate the present system , and 2) the driveway will be below the 100 year flood hazard level in places . This may create safety hazards to the occupant. The motion passed by a vote of 5 - 2 (Richard Lutts and Walter Power opposed). BOARD OF APPEALS AGENDA Regarding the petition of Paul and Elizabeth Hinchion for a special permit to add a third floor apartment to the existing two-family dwelling at 6-6 1/2 Cushing Street, the Board decided to write a letter suggesting the variance be denied because 1) putting a third unit in this house would violate the density requirements of this district even though there may be adequate parking , and SALEM PLANNING BOARD September 4, 1980 Page 3 • 2) except in extreme circumstances , the Planning Board is against changing the zoning. Regarding the petition of Frank A. Bisegna requesting permission to construct a restaurant at 411=413 Essex Street, the Board decided to write a letter 1) recommending that the Appeals Board require that there be no venting on the east or north side of the building, and that any doors , vents , etc. be on the other side or the back of the building, and 2) stating that the Planning Board is concerned with odors and noise on a residential area and recommends that it be designed to minimize the impact on the neighborhood. SPECIAL PERMIT -- Harry Hewitt Intersection of Clark and Barnes Roads . This proposal was reviewed. No action had been taken previously because Mr. Hewitt was proposing four house lots in the subdivision. He would have had to go to Board of Appeals and also go through control growth. Now he is proposing three houses be built. A motion was made by Richard Lutts and seconded by Donald Hunt to approve the Special Permit, referencing the plans and incorporating the Order of Conditions • issued by the Conservation Commission. The motion passed unanimously. SPECIAL PERMIT -- Carl DeCotis , 35 Belleau Road This is a two-part proposal to install an underground 4 ,000 gallon fuel storage tank and to construct a riprap wall going out 12 to 20 feet on to the beach. A motion was made by William Wheaton and seconded by Richard Lulls to approve that portion of the plan concerning the installation of an underground oil tank. It does not approve that portion of the plan dealing with a riprap seawall. This approval shall be contingent on Mr. DeCotis' separating the application into two parts. The motion passed unanimously. A motion was made by William Wheaton and seconded by Richard Lutts to deny the application regarding the construction of a riprap seawall. The disapproval is based on the fact that it will require filling of salt marsh lands . The motion passed 6-0 with one abstention. The Engineer has agreed to change several design factors as follows: a) He will isolate the slabs for each tank with a construction joint. b) He will re-design the bottom concrete slab from 8" to a 12 inch thickness which will in turn increase the factor of safety to an acceptable value. c) The Engineer has also specified a 6 thick concrete roadway slab with 18" of earth below to make a total distance of 2 feet from finish grade to the top of the tank. d) He will furnish a copy of the manufacturer's method of clamping the tank to the slab. e) He has stated that- the bituminous concrete roadway slab is not being consi- dered. MEMBERS ABSENT: William Wheaton, Abby Burns , Peter DiGangi Planning Board Chairman Walter Power called the meeting to order at 7:30 P.M. SMALL CITIES PROGRAM City 'Planner Greg Senko brought with him Assistant City Planner Robin Campbell and Willa Small to explain what has been happening with the Small Cities Program. The new target area will include the Harmony Grove Cemetery area from Mason Street up to Tremont Street. This area is approximately 60% tow to moderate income . Paul D'Amour expressed concern over low income people being helped • who are not in the target area. Ms . Campbell said there are very limited funds (10% of the grant) set aside for extreme hardship cases outside of the target area. The maximum amount of money available in the grant for three years would be 2 .4 million. This money will be divided into five categories . Energy conservation is one area they will be stressing. For this area, they would like to hire a planner to set up courses on saving energy and cutting energy costs . During the day , this person could set up an energy quorum plan as to how the City could save on its energy costs . One million seven hundred thousand dollars is earmarked for this category. The second project group ($400,000. 00) is neighborhood improvements . This would include street repair, curbing , etc. The third category is business districts development ($381,000.00). This is to do physical improvements like building facades . Also, technical assistance will be offered to the owners of businesses to help them stay in Salem. The fourth category is Community Development Corporation. This will Loan money to small businesses to help them expand in Salem or to come to Salem in exchange for their agreement to follow the affirmative action program. The last category is to promote public service programs . Mr. Senko asked for the Board's support of this proposal. The Planning Board • wholeheartedly supported the program and a letter to that effect will be sent out. i l SALEM%;PLANNING BOARD September 18 , 1980 Page 2 MASTER PLAN Mr. Senko said the Master Plan is now on the word processor. Four of the six booklets are done and the other two will be ready to go out shortly. They will be going out to bid by October 1. NATHANIEL BOWDITCH PARK This project is in a state of flux. Susaki is preparing an analysis and will submit their findings in October. . Other developers are also analyzing the area. This area is presently zoned a B-3 district and Mr. Senko requested that it be changed. Things should start to come together on this within the next few months . ZONING AND SUBDIVISION REGULATIONS At the next meeting, Greg will come in and present Cheri Cooper's recommended changes for review. -Ralph will also come in for discussion on UDAG. Greg • felt proper zoning is critical for Highland Avenue and Loring Avenue now and would like to discuss that. FORM A -- Joseph & Ida Beaupre 2 1/2 - 4 Ropes Street Mr. Fallon represented the Beaupres and explained that this is a simple division so that the bank wilt give financing. There is difficulty financing anything over four units . There will be no change of use. The units have been there over 40 years . • A motion was made by Abby Burns and seconded by Jim Fox to approve the Form A, approval under the Subdivision Control Law not required. The motion passed unanimously. VVEST END HEIGHTS -- VISTA AVENIE -- Preliminary subdivision plans. Mr. Mailhoit presented the changed subdivision plans. The streets have now been widened to 45 feet. They have revised the grades of the hill. The plans show bituminous curbing which, after discussion, the Board felt would not be acceptable. Ms . Madison recommended Board members visit the subdivision site because the hii!s are vary steep and should be viewed. Mr. Mailhoit wants to go on to a definitive plan. He asked Board members to approve the 45 foot roadway size. After discussion, it was felt that no approval could be given until further input was received from the City Engineer. Mr. Fletcher wilt be invited to attend the next meeting to discuss this . 14r. Mailhoit felt it would be dangerous for a wide road to go into a smatter road at each end of the subdivision. RALPH RUSSO-NICOSA • Ralph explained that UDAG has $500,000.00 for a condominium conversion program. There is money from the federal housing turn-key program. Also, there is promised money from the 'banks , mainly for mortgages . Public improvement money will mostly be spent for a public parr, on the corner of Palmer.and Prince. Streets. Low bid on this project was $91 , 000. 00. SALEM PLANNING BOARD October.2:,, .1980 Page 2 • There is a rebate program where the owner pays for renovations and is rebated 40% of the cost. This involves an agreement that the owner cannot consider the repair costs in rent increases . Preference will be given to owner occupied houses. Turn Key is a federal housing program. They will buy a site and act as the general contractor. The lowest bidder gets the contract and when the work is done , they turn the keys over to the housing authority. GREG SENKO -- ZONING AND SUBDIVISION (REGULATIONS Greg's plan for revising the Zoning Ordinance is to take the lot tine maps available now and have Board members go through them neighborhood by neighborhood, using Cheri's recommendations . Walter Power suggested that the whole Board, rather than a sub-committee , meet with someone from the Planning Department who could compile and present recommendations system- atically. Tanzella is looking to divide the property in order to sell the houses. Presently, there are two dwellings on one lot and this is to be divided into two lots , each with a dwelling . The property is in disrepair and Mim Gaynor of Realty World said the prospective buyer will live in one house and sell the other dwelling to an owner/occupant. A motion was made by, Richard Lutts and seconded by Abby Burns to approve the Form A, approval under the Subdivision Control Law not required. The motion passed unanimously. FORM A -- Raymond Lemieux Lots 201 & 202 Silver Street. The proposed transfer of a six foot strip of property takes away, or adds to, respectively, the lots of the present owners in such a manner as not to leave either lot without the previousifrontage. PUBLIC HEARING-- James Gemma , 40 Marlborough Road The public hearing was opened. Mr. Jom McDowell, engineer for the project, said the proposal is to build a single family dwelling with an attached garage on land that has already been filled. The City Engineer concurs with the • proposal with comments. He states: 1) that the driveway and front yard Will be graded away from the house. This should also be made-a condition of the permit or noted on the plans. The Department of Public Works will not approve driveways which are pitched down toward a house unless provision has been made for drainage. 2) There should be no changes of the as-built elevations from those shown on the submitted plan. 3) It should be noted that the City Council action will be necessary before relocating the utility pole. 4) The Water service should be installed a minimum of four (4) feet below finish grade. 5) The owner must apply for the proper' sewer, water and street opening permits at this office before construction. 6) A hydrant will be replaced in the future at the location shown on the accompanying sketch. The owner should consider this location when landscaping or constructing walkways . After reviewing the plan and viewing the site , the Board of Health concurs with the proposal. The Building Inspector concurs with the project , stating that all necessary permits are to be acquired from all departments . The Conservation Commission had their public hearing and their Order of Conditions will be issued at the next meeting. They did address the question of illegal fill. Walter Power read a letter from Ward 4 Councillor Frances J. Grace concurring with the project. Mr. Bill Possello, 9 Cloverdale Avenue , stated that as a neighbor he had no objections to the proposal. There being no further comments , • the public hearing was declared closed at 8:00 P. M. SALEM PLANNING BOARD November 20 , 1980 Page 2 • PUBLIC HEARING -- Silent Ships 12 Franklin Street Mr. Richard Mailhoit, engineer for the seawall project, explained that this is the original plan. Previously, the stability calculations did not match. The Conservation Commission felt these should be shown on the plan so the design was withdrawn at that time. Mr. Mailhoit presented his drawings showing a granite wall with some stone . He stated that is a problem as to who owns what. He presented a pian of the shore line that has been recorded at the Registry of Deeds . Donald Hunt commented that Mr. Russell was instructed to go to the Army Corps of Engineers back in August and get clearance from them before proceeding any further with the Planning Board. Mr. Mailhoit said he has talked with the Army Corps and as more information becomes available to him he will present it to the Board. His instruction from the Army Corps was to proceed in getting all permits from the City. Walter Power felt we should get an opinion from the City Solicitor concerning filling in a riverway. The Board of Health reviewed the plan, viewed the site, and concurs with the • proposal. The City Engineer cannot concur with the proposal stating that the requirements of Section II-A of application have not been satisfied by the submitted plans . In Paragraph 1, there is disagreement as to the extent of ownership between the plan submitted and Assessors' plan and deed description available to this office. This may be satisfied by submission of a copy of the deed verifying the area shown on the plan. Also , no tie-in to the nearest road intersection has been given. In Paragraph 2 , no lot dimensions have been shown on the plan. A proper plan of the land stamped by a Registered Land Surveyor or Registered Professional Engineer should be submitted. In Paragraph 3 , the existing and proposed contours are inadequate. They should be extended further inland to give a more complete indication of proposed work and drainage patterns . In Paragraph 4 , drainage and means of access have not been shown on the plan. The Building Inspector concurs with the proposal, stating that if it is supervised properly, it could be a substantial improvement to the neighborhood. The Conservation Commission will issue their Order of Conditions at their next meeting. Attorney William Mahoney, 81 Washington Street, spoke in opposition to the plan. He represents Mr. William Linsky, an abutter. He expressed his client's concern about something sticking 50 feet out into the North River. Mr. Mahoney said that Mr. Gifford Russell stated, while under oath, that Silent Ships is no longer a legal corporation. Hr stated that Mr. Sinsky does not want any tie-in • with a riprap wall to his property. SALEM PLANNING BOARD November 20 , 1980 Page 3 • Mr. Staley McDermet, 30 Dearborn Street, made the statement that according to the Subdivision Regulations , the Land has to be zoned correctly before a Special Permit can be issued. A marina would be a different use for this Land. The previous use was for a tannery. Mr. Russell stated that the property has been used as a boat yard for good many years . The public hearing was closed at 8:30 P. M. It was decided to write a letter to Bill Tinti asking for his legal opinion regarding zoning , ownership, and illegal filling. HYMAN MARCUS -- Vinnin Square Drain Project The Chairman read a letter from the City Engineer (copy attached) asking the Planning Board to force action on uncompleted work. The Board agreed to contact the Bond Company in order to free up the money. A memo will be written to Bill Tinti regarding proper procedure. CHRISTMAS PARTY The Planning Department is having its Christmas party on December 12 , 1980 at the Christopher Columbus Hall on High Street and Planning Board members are • invited. Robert Lappin was present to explain Shetland's proposal. Donald Hunt and Paul D'Amour questioned ownership of the site where Shetland Park proposes for their marina. Susan Madison explained that meetings have been held between the Mayor, City Engineer, Building Inspector, City Planner; herself, Robert Lappin, and representatives of Pickering Wharf as to the property dispute. All parties agreed that the north basin is owned and will be developed by Pickering Wharf. The south basin will be developed by Shetland Properties . Bob Lappin stated that he would •! allow a public landing in his proposed marina and he would lease it to the City at a very nominal fee. He mentioned $1.00 a year. Donald Hunt questioned why the amended plan for the Shetland Marina was not stamped by a registered engineer. Mr. Lappin agreed to have the plan stamped by a registered engineer and have it properly referenced as an amended plan. There was discussion by Paul D'Amour that there was an existing plot plan showing the City had ownership to the float area off the Congress Street bridge on the Shetland Mills plan. Mr. Ralph Hobbs, Chairman of the Waterways Advisory Board then stated that he had no objection to.Shetland's plans as long as the issue of the public landing was addressed. Bob Brambles, representing Heritage Trust II, spoke in favor or Shetland property's marina. Mr. Bob Lappin asked to withdraw his negative comments that he had made in relation to the Pickering Wharf marina now that the dispute had been settled, and that now he. was in favor of their project. �Ie noted that he would like to see Pickering's plan amended to show the newly agreed upor property line. Both the Building Inspector and City Engineer, through their comments to the Board; noted that they would like to see stability calculations. They would have no objections to the permits being issued with the condition that stability calculations be submitted bGore the work began. The public hearing was closed at 8:30 P.PSI. BOB ANDREWS -- H.M.A. CAR WASH, North Street. Mr. Andrews is seeking a variance from the sign ordinance. He proposed a 192 square foot sign to advertise the services of his business . It was noted that this is approximately the size of a billboard. , Mr. Andrews explained that he had permits for .numerous small signs which could be placed on his buildings and he felt that one large sign and the elimination of the smaller signs would be esthetically more pleasing . SALEM PLANNING BOARD JULY 2 , 1980 Page 2 After discussion, a motion was made by Abby Burns and seconded by Peter DiGangi that the Planning Board endorse a variance from the Sign Ordinance which would allow for a sign of 160 square feet and the elimination of all the smaller signs that he is entitled to under the Sign Ordinance. The motion passed unanimously. A letter will be written to the Board of Appeal. FORM A -- ROSANNA MULLIGAN The lot is located on Markboro Road. The property is located on Marlboro Road. The property consists of three lots of land. The petitioner obtained a variance from the Board of Appeal as to frontage requirements so that the three lots could be combined to make two lots , each having frontage of approximately 89 feet. In the ensuing discussion, it was noted that this land is zoned R-C and that frontage requirements for an R-C area is 200 feet. It was also noted that the proposed size of the lots does conform with already existing housing in the area. A motion was made by Richard Lutts and seconded by William Wheaton to endorse the Form A, approval under the Subdivision Control Law not required. The vote was 6 in favor, two opposed (Donald Hunt and Paul D'Amour) . • BP STATION -- CANAL STREET. Discussion was held on information gathered at the public hearing and information submitted by the various boards regarding installation of gas tanks on Canal Street. It was noted that the Board of Health were objecting previously and that their concerns had been addressed satisfactorily. A motion was made by John Brown and seconded by Abby Burns to issue a Wetlands/ Flood Hazard Special Permit to the BP Station with the condition that the tanks be - installed according to the submitted plans. The motion passed with one abstention. JULY AND AUGUST MEETINGS A motion was made by Donald Hunt and seconded by Paul D'Amour that the July 17 and August 21 meetings of the -Planning Board be cancelled. The motion passed unanimously. Ms. Madison explained that this proposal is to replace a retaining wall and install an underground 4,000 gallon 02 fuel storage tank. There has been controversy over the type of wall being proposed. Vr. DeCotis is proposing a riprap embankment that would go out fifteen feet. The abutters feel this would have an adverse effect on their beach. The Conserva- tion Commission is concerned about the saltmarsh and suggest Mr. DeCotis construct a vertical wall. This will be. part of their order of conditions. The Building Inspector concurs with the proposal. The City Engineer concurs with the proposal and asks for additional information on uplift calculations which have since been addressed satisfactorily. The Conservation Commission has determined that the area is a salt marsh and therefore order that 'fiLl shall not be placed there. Mr. DeCotis commented that because of the wave action his engineers felt there would be a lot of pressure on a vertical wall and this .was the major reason they decided on a riprap. Mrs.. Patricia La Brie, 11 Hemenway Road, spoke in opposition to the plan. She felt with a sloping wall, seaweed will collect and smell. Also, it will affect the current and the beach. Mr. Ed Ferris spoke in behalf of the Osgood Park Neighborhood Association.. Walter Power read a letter he presented (copy attached) . There are 60 families in the Osgood Park Neighbor- hood Association and they are in favor of a vertical wall or one sloping inward. Susan Madison explained to Mr. DeCotis that it might be to his advantage to have two special permits , one for the oil tank which no one objected to, and a separate one for the wall. The lot presently houses a garage which Mr. Fraser rents and is used for minor auto repairing. He petitioned for and was granted a variance from the Board of Appeals to work there. A motion was made byRichard Lutts and seconded by Paul D'Amour to approve the Form A, approval under Subdivision Control Law not required. The motion passed unanimously. SPECIAL PERMIT PROCEDURES There was general discussion on permit procedures , and it was decided to adopt the following disclaimer language for all Special Permits approved: "This order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private/public property or any invasion of public/private rights. These have been addressed. The drain will be permanently sealed. The rainproofing and waterproofing questions ,'have been met. The plot plan had to be' revised. A motion was made by Donald Hunt and seconded by Abby Burns to approve the Special Permit with the condition that the work be done in accordance with the revised plans . The motion passed 5-0 with one abstention. FORM B -- Vista Avenue. The. preliminary designs were studied. They are seeking a waiver from the 52 foot road width requirement. All existing roads now are 40 feet wide. It was felt 28 feet of roadway was too narrow and unacceptable. . Mr. Serafini suggested the Planning Board accept the preliminary design together with the Engineer's comments which would cover the Planning Board's concerns. Walter Power felt they would be better served to work out as many problems as possible before a final plan is prepared when they will be subjected to time limits. Mr.'Serafini • said they will work as closely as they can to the regulations and then come back in again. SILENT SHIPS., INC . -- Preliminary Presentation Mr. Gifford Russell has withdrawn his previous plan and he intends to apply with a new proposal. This preliminary proposal was reviewed and discussed at length. Ms . Madison noted that there is an Order of Conditions out on the old plan. There is objection to the fill there. It has to be pulled out, sifted, and put back. It was felt the major setbacks Silent Ships would encounter with the proposed plan would be the 50 foot marine railway and the quality of the fill that has been put in there. Top grade fill will have to be put in there. The Board suggested Mr. Russell should get input from the Army Corps of- Engineers and this should be cleared up before a public hearing is set. MICHAEL MONIZ and CHRIS OLNEY : Bowditch Park Mr. Chris Olney reviewed plans for Bowditch Park. The Redevelopment Authority was asked to pick a developer for the hotel'. They are putting a UDAG application • ;for $3 ,000 ,000.00 together now. This $3,000,000.00 is for land acquisition and for parking on the first floor of the hotel. The additional money would be for relocation. Ms. Christine Sullivan is working on the proposal: A conference center is an -integral park of the plan. Michael and Chris will come to the next meeting for Planning Board approval on this. PLANNING BOARD ut'Just 7 , 1980 page 4 Zoning Change. Heritage Plaza West needs upgraded zoning. B-5 zoning would allow for residential housing. It was asked that the down town area be changed from R-2 to B-5 immediately. A motion was made by William Wheaton and seconded by Abby Burns to authorize the Planning Department to .submit on the Planning Board's behalf a proposal to . the City Council to change the City Zoning Ordinance of the downtown area to. B-5 zoning-as indicated in the presentation of the Planning Department this evening, with a note that the small parcel on the west side of Summer Street be returned to R-2 zoning. The motion passed unanimously. HERITAGE TRUST II -- SPECIAL PERMITS They have split their proposal. The Conservation Commission had required additional information on uplift calculations. Their Order of Conditions has come in and it just references the Plan; A motion was made by William Wheaton and seconded by Abby Burns to approve the Special Permi t to replace existing marina floats , referencing the .plan. The motion = . passed 5-0 with Paul D'Amour voting present. SHETLAND PROPERTIES -- SPECIAL PERMIT Ms. Madison explained the major difference between Pickering Wharf and Shetland is that we do not have stability calculations on the Shetland walla The Conservation Commission has listed in their order of conditions that they require stability calculations before he starts work . Notification of Abutters. Dear Committee Members: I am opposed to any encroachment seaward with respect to a sloping seawall. I believe that such a seawall would intensify the stagnation of the eroded land area adjacent to my property, as well as change the current pattern of flow across the beach at Osgood Park. An Army Corps. of Engineer 's study should be conducted prior to issuing of any permit to construct such a . wall, inasmuch as a much less significant unauthorized change at the end of Fairview Road several years ago significantly changed the erosion pattern of the land adjacent to my property • (north side) and significantly changed the flow pattern across the beach area at Osgood Park.. This change caused a much greater stagnation and erosion pattern of the land adjacent to my property on the north side and a serious erosion problem with respect to the sand on the beach at Osgood .Park, that: could be expected. Please understand that I am absolutely for a new seawall , inas- much as I realize that a new wall is required. I do believe that a sloping seawall (rip-rap) could be installed without encroaching seaward. This wall could slope toward the pool area on theE-s side`of the property up to a point where it would meet a vertical wall to protect- the pool . This vertical wall would be almost completely above the mean high tide and would gradually disappear into the sloping seawall, as the wall extended eastward. On this basis, a properly sloped seawall could be constructed to protect the property without any additional encroachment seaward. We believe that a seaward projection as proposed would result in a pocket which would not be flushed out by tidal action. This would cause the seaweed and other debris to collect and decay resulting in an odor problem similar to that experienced in the Lynn/Nahant beach area . In addition, this projection :•:ould cause a change in the current pattern across the Osgood Park beach area which would adversely affect the beach. We are concerned , as a much less ambitious undertaking at the end of Fairview Road several years age significantly changed the erosion pattern at our beach such that the drainage outfall pipe is now completely exposed. , The Osgood Park Neighborhood Associat-.on is in favor of a new seawall either vertical or sloping inward from the base of the existing wall .
