MINUTES OF PLANNING BOARD MEETING - 1/3/74
Meeting was held at 5 Broad Street, Salem, was called to
order at 7 :40 P.M. - Present were Armand Gagne , Tadius
Sadoski, Raymond Sweeney, Thomas Berube, Michael Freeman
and Gerald T. McCarthy.
r 1. Form A - Salem Redevelopment Authority on St. Peters
St. - Registered land to be conveyed to New England
Telephone Co. - Motion made, seconded and unanimously
voted in favor.
2 . Attorney George Vallis representing Salem Acres , Inc.
requested that the subdivision entitled Pickman Park
on Station Road be approved. It was agreed at the
previous meeting that a letter be sent to the Board
of Health and to the City Engineer advising them of
the Planning Board' s intention to accept the sub-
division unless they made their objections known in
writing by this meeting. It was pointed out to the
.• attorney that he had not submitted his requests for
waivers in writing which should be incorporated into
the acceptance of the definitive plan. The requested
waivers were: 1. Dead end streets shall not be
longer than 500 feet, 2. Installation of granite
curbings and gutters (to be substituted by asphalt) ,
and 3. Underground electrical systems . A motion
was made, seconded, and unanimously voted in favor
of acceptance of the subdivision. Certification
to the Citv Clerk would be predicated upon receipt
of the written requests for waivers by the applicants
attorney.
3. The Chairman of the South Essex Sewage Board, Mr.
Willard, and their engineer, Mr. Grinnell, addressed
the Planning Board to discuss the construction of
their new treatment plant on Fort Avenue at Salem
Willows. They explained how the Board was created
by an act of the Legislature in 1925 and how they
are now required to build a primary and a secondary
treatment plant to conform with federal pollution
standards . They have almost completed the first
phase of the project which is a 78" interceptor pipe
from Peabody to Salem. The primary treatment plant
is now under construction and hopefully will be
completed in 1975 . The secondary treatment plant

must u t be completed by 1980 . They explained the proposed
route of a new outfall pipe through the state fishery
installation, across Juniper Cove and down Cheval Ave.
where it will connect with the existing pipe going
out to Great Haste Island. The portion of discussion
that attracted the most attention was the proposed
incinerator that would be used to dispose of solids
on the site of the plant. There was concern that
obnoxious odors would be discharged in what is now
a residential area. Mr. Grinnell indicated that
every effort would be made to minimize any adverse
effects that such an installation would cause.
The meeting was adjourned at 9 :40 .

MINUTES OF PLANNING BOARD MEETING - 1-17-74
Meeting was held at the Old Town Hall in Salem and was
called to order at 8 :15 P.M. Present were Gerald McCarthy,
Tadius Sadoski, Abby Burns, Jane Lundregan and Tom Berube.
City Planner Greg Senko was also present.
1. Motion made to speak with the Mayor about slum landlords.
Motion was seconded and with all in favor, voted accepted.
2 . Minutes of last meeting accepted.
3. Form A - North Street - McArdle and Little. Board
voted to decline application since it left an isolated
lot and thus would constitute a sub-division within
the meaning of the sub-division control law.
4. Meeting on Sub-division Regulations with Greg Senko
and Bob Connaughton of the Planning Department to be
held on January 23 , 1974 at 7 :30 P.M. at the Old
• Town Hall.
Meeting adjourned at 9 :50 P.M.

PLANNING BOARD MEETING: 3/21/74
The meeting was at the Old Town Hall in Salem and was called
to order at 8 : 33 P.M. Members in attendance were Ted Sadoski,
Michael Freeman, Gerald McCarthy, Jane Lundregan and James
Garrity.
Form A - Sumner Raymond for Florence Davidson, Holly Street.
Form B - Attorney George Vallis representing Salem Acres, Inc.
addressed the Planning Board and requested the subdivision on
Station Road be given the Board' s consideration as quickly as
possible. Mr. Vallis cited previous delays encountered by his
client on other proposals, and in an attempt to avert such
delays , Mr. Vallis felt it necessary to speak with the Board.
The Board indicated that information had been requested from
the City Engineer and the Board of Health on this proposal.
The Board, through the City Planner, will contact both parties
and ask them again for this needed information.
After a discussion with Greg Senko of the latest developments
relative to New England Power Company' s proposal for the tem-
porary use of Winter Island, with particular emphasis on the
circulating water discharge system, a motion was made, seconded
and adopted to write a letter to Mayor Levesque making the
following comment recommendation:
the safeguards built into the latest draft agreement,
including specific dates of occupancy, specific buildings for
demolition, and provisions for safety and security, are reason-
able and in the best interest of Salem;
(2) after careful review of the March 15 , 1974 corres-
pondence from N.E.P.C.O. regarding the circulating water dis-
charge system, it is still the recommendation of the Planning
Board that a tunneling scheme is for many reasons a more
acceptable alternative that the cut and cover method.
After a discussion concerning the South Essex Sewerage District ' s
treatment plant at Cat Cove, a motion was made, seconded and
adopted to have the Chairman of the Planning Board and the City
Planner draft letters to be sent to the proper authorities
regarding this project, and to be reviewed by the entire
Board at the next regularly scheduled meeting.

TO VARY TERMS OF SALEM ZONING ORDINANCE.
Miss Florence Davidson, through Sumner E. Raymond, her conservator, appointed
on September 12, 1973 by the Probate Court of Essex County on account of her
physical disability, petitioned the Board of Appeals to vary the terms of the
Salem Zoning Ordinance insofar as it affects a parcel of land containing her
dwelling house ,, being Number 12 Holly Street , an R-2 , two-family residential
district .
As is hereinafter set forth, Miss Davidson. desires to divide her said parcel
into two lots making the unoccupied lot available for constructing a two-family
house.
A hearing on this matter was held on October 29 , 1973, pursuant to notices
mailed postpaid to the Petitioner, Board Members, abutters , abutters to
abutters and others , and advertisements were duly published in the Salem
Evening News advising of this Public Hearing.
Present were Chairman John M. Gray, Sr. , William Abbott, Arthur Labrecque ,
Donald Roleman, and Associate Member, Warren Baughn.
Whe parcel .is rectangular in shape containing 14,339 square feet , 'with a _
rontage of 152. 18 feet , westerly side line of 94. 18 feet , easterly side
line of 93. 67 feet , and northerly rear line of 153. 16 feet . This single
family dwelling was erected shortly after the Salem fire in about 1916
and prior to the enactment of a zoning ordinance in the City of Salem.
The house was placed, as was legally permissible at the time , in its present
location which is approximately in the middle of the lot , the then owner
having no possible forewarning or foreknowledge of, future limitations of any
zoning ordinance . The easterly wall of the house is about 50 feet from the
easterly lot line and its westerly wall is about 60 feet from the westerly,
lot line. There is a setback at the rear of the house of approximately 40
feet and at the front of approximately 8 feet.
Under the present zoning ordinance, the zoning district in the City here
this lot is located is an 1111-2 Residential District" which permits two-
family houses. Insofar as it is here material , the following zoning regula-
tions apply:
Minimum lot area 7 ,000 square feet, minimum lot area per dwelling unit 3, 500
square feet , minimum lot width 60 feet , minimum depth for front yard 15 feet ,
minimum width of side yard 10 feet , and minimum depth of rear yard 30 feet.
A registered land surveyor has divided Miss Davidson' s lot into Lot A and
Lot B. Said plan being on file with the Board of Appeals , a copy of which
is attached hereto ) . Miss Davidson' s house i.s .located on Lot A which con-
•tains 9,081 square feet , frontage 9.6 .68 feet , easterly side line 93. 67 feet ,
northerly rear line 96 .89 feet , and westerly side line 93. 99 feet ; the set-
back :from westerly side line is 10 feet , the setback from easterly side line
is 50 feet and the rear set back is 40 feet.

; On Lot 'B it is proposed to build a two-family house , for which a building
permitihas been denied. Lot B contains 5, 258 square feet , frontage 55. 50
feet , easterly side line 93. 99 feet , northerly rear line 56 . 27 feet , wes-
terly side line 94. 18 feet; setback of proposed house from easterly side
line 10 feet , from westerly side line 10 feet ; from front line 20 feet , and
from rear line 45 feet.
Said Lot B is in all respects in strict compliance with the present zoning
ordinance except that its frontage will be 4Z feet, short of the frontage
required and its area instead of being 7 ,000 square feet will be 5,258
square feet . .
The picture of' the neighborhood density in the district as it now relates
to Miss Davidson' s property and as it will appear on the granting of the
variance as ,requested, is as follows :
Holly Street is a short street with houses on every lot, most of them being
built for two or three families . All of the house lots are small except
for Miss Davidson' s which is huge by- comparison. Hazel Street which is here-
inafter referred to intersects the westerly end of Holly Street and the
street numbers on Hazel Street hereinafter referred to , are of houses close
to Holly Street . In the analysis which follows lots are -referred to thus
"Lot 271 (12) " . The first number following the word "Lot" is the number on
the Tax Assessors ' plan, a copy of which is attached, and the second number
(in parentheses) is the street number of the house.
Holly Street - Lot Area Statistics
•Miss Davidson' s Lot 271 (12 ) is big enough to contain Lot 314 (11), Lot 313
(9) , Lot 312 (7) on Holly Street and Lot 292 (5) on Hazel Street with 812
feet to spare . The area of Miss Davidson' s Lot 271 (12) is so big that it
could contain Lot 276 (2) , Lot 275 (2Z) , Lot 272 (8) Holly Street and Lot 291
at 3 Hazel Street.
Miss Davidson' s Lot 271 (12) is so large that it will contain any two lots on
Holly Street and, with two exceptions , will contain any two lots on Holly
Street with thousands of feet to spare .
After. Lot B has been approved, there will be twenty lots on Holly Street
and Lot B will be larger in area than fifteen of these twenty lots .
Aside from Miss Davidson' s Lot , 271 (12) , there is not now one lot on Holly .
Street which has an area of 7,000 feet.
Right now, aside from Miss Davidson' s lot, the average area of the other
eighteen lots on Holly Street is 4, 889 feet. In other words the average
shortage of area when compared with the ordinance requirement is 2, 111
square feet.
Frontage
As far as frontage is concerned, Miss Davidson' s Lot 271 (12) has a frontage
which .exceeds the combined frontage of the next two biggest lots on the
•street.

+Miss Davidson' s Lot 271 (12 has a frontage that exceeds the combined frontage
of Lot ,275 (22) , Lot 276 (2; , and Lot 314 (11 ) , with 33 feet to spare .

Wiss Davidson' s Lot 271 (12 ) has a frontage which is equal to the combined
frontage of Lot 274 (4) , Lot 275 (2z) and Lot '276 (2) . Miss Davidson' s Lot
271 (12) has at least twice the frontage of the combination of the frontage
of any two lots on the street.
Miss Davidson' s Lot 271 (12) exceeds by nine feet the combined frontage of
four lots in the area - Lot 275 (22' ) and Lot 276 (2) on Holly Street, Lot
291 (3) ,and Lot 292 (5) on Hazel Street.
After Miss Davidson' s Lot B is established, its frontage of 55. 50 feet will
be only 42 feet short of the ordinance requirement of 60 feet.
The frontage of 55. 50 feet of Lot B when established will exceed that of eight
other lots of the twenty lots on Holly Street.
Set Backs
As is clearly indicated by examining the attached Tax Assessors ' map, , very
few buildings on Holly Street comply with the present ordinance regulatory
side , front or rear setback.
The dwelling house proposed by Miss Davidson for Lot B will be one of the
few buildings on the street which in all respects will comply with the pres-
ent zoning ordinance regulatory set backs.
•It is a fact that Miss Davidson' s lot is of adequate size to permit its
division into two lots which can legally contain two , two-family houses
which will in all respects comply with the present zoning ordinance . This
could, as a matter of legal right, be accomplished in either of three ways :
1 . Demolish the, present house and establish a dividing line for Lot
A and Lot B so that each lot would have. adequate frontage and
area. Actually each lot would have an area of 7 ,164 square feet
and a frontage of 76. 09 feet if the line were drawn in the middle ,
i . e. an excess of 169 square feet of area for each lot and an
excess of frontage of 6 .09 feet for each lot .
2. Move the present house a distance of 22 feet to the east so that
as moved there could be Lots A and B exactly as pointed out in
Item 1 just described above with the present house on Lot A and
with Lot B available for building as proposed.
3• So as to give Lot B the 4z feet of frontage that it lacks , take
that much frontage from the westerly end of Lot A. This would
involve reconstructing the westerly side of .the present house
by removing 41 feet from westerly wall of the house and rewall-
ing the building as thus narrowed thereafter to give Lot B the
additional required area, transfer 1742 square feet from the
rear and side of Lot A to Lot B.

The performance of any one of these proposals is economically and practicably
absurd, but suggesting them serves to illustrate exactly the hardship which
�the legislature had in mind when in the language of the Statute , General
aws Chapter 26, Sec . 5A) and adopted in the .Salem Zoning Ordinance Section
10, pg. 49) it said: "Where owing to conditions especially affecting such
parcel or such building but not affecting generally the zoning district in
which it is located, a literal enforcement of the provisions of the ordinance
would involve substantial hardship, financial or otherwise , to the appellant" ,
the Board of Appeals is authorized to grant a variance .
This large , open lot of 14,339 square feet, on a street with many residents
living on small lots and in a general area teeming with active youngsters ,
creates a condition especially affecting this lot , but none other. It
causes this lot in effect to be an attractive nuisance which results in
excessive costs for policing, prevention of vandalism and unintentional
damage , broken fences and the like , to say nothing of possible injury to
trespassers and passersby. This , too , constitutes a substantial hardship,
financial or otherwise , to the appellant lot , but to none other in. the area.
If, because of a literal enforcement of the zoning ordinance , it is impossible
to use this large tract of land for additional residential purposes , it has or
may become an unsightly and undesirable litter area, an area covered with un-
mowed, dry grass , piles of dry leaves and debris , constituting a fire hazard
to Miss Davidson and to others to whom she might be liable and causing loss
and expense to the petitioner in maintaining it. There is also the perennial
expense of sidewalk clearance of ice and snow required by City ordinance .
All of these features constitute conditions especially affecting this parcel
but not affecting generally the zoning district in which it is located, with
•the result that a literal enforcement of the zoning ordinance would involve
substantial hardship, financial or otherwise , to the appellant .
This whole area of Holly Street and surrounding territory , is a neighborhood
of small compact lots economically oriented to low operation costs , yet with
an income potential equal or better than that of Miss Davidson. This is be-
cause owners of these lots or their predecessors in title prior' to or since
the zoning ordinance minimized the sizes of their lots . To require Miss
Davidson to maintain the oversized lot which she now owns with no hope of
economic ,recoupment is another reason for finding that she is sustaining a
substantial hardship, financial or otherwise , unlike any other lot owner in
the district .
For the reasons stated, this variance as requested has been granted as it
is clearly evident from a description of the circumstances of the case that
it has been demonstrated that :
' a. special conditions and circumstances exist which especially affect
the land, building, or structure involved and which are not gener-
ally affecting other lands , buildings , and structures in the same
district ;

MINUTES OF PLANNING BOARD MEETING 4/4/74
The meeting, held at the Old Town Hall in Salem, was called
to order at 8 :00 P.M. Armand Gagne, Michael Freeman, Gerald
McCarthy, Jane Lundregan and Abby Burns were present.
Form A - George Vallis for the Salem Redevelopment Authority -
Essex Street and Liberty Street. Parcel P-8 on plan to become
part of Liberty Street and the easterly line of P-8 will be
the new street line. Parcel RC-10 to be conveyed to Empire
Clothing Stores. Motion was made, seconded and approved.
ForW A - George Vallis for the Salem Redevelopment Authority.
Essex Street and Liberty Street. This plan to be used in
conjunction with the widening of Liberty Street and the trans-
fer of land from the SRA to Empire Clothing. The purpose of
this plan is for filing with the land court. Motion was made,
seconded and approved.
Form A - George Vallis for the Salem Redevelopment Authority.
• Essex Street and Liberty Street. The Urban Renewal Master
Plan proposes the widening of Liberty Street which will
include a portion of parcel P-8. The lower portion of parcel
P-8 to be conveyed to the SRA by Empire Clothing. Motion
was made, seconded and approved.
Form A - John Serafini for Loring Hills Development Trust, ,/
presented by Atty. Robert Ledoux. Lot has frontage on both
Loring Avenue and Loring Hills Avenue. Motion made, seconded
and approved.
Form A - John Serafini for Loring Hills Development Trust,
presented by Atty. Robert Ledoux. Horton Road (named Laurent
Road) . Changing lot line - leaves insufficient frontage.
Denied.
George Vallis requested that the Planning Board hold a public
hearing to look at a Form B, a preliminary plan on Jefferson
Avenue - subdivision of 300 lots . Motion was made, seconded
and approved. The meeting will be held on May 2, 1974 at
the Old Town Hall, second floor.
It was requested that the Board write a letter to the Building
Inspector asking that the building permit for the South Essex
Sewerage District on Fort Avenue, be rescinded. Motion was
• made, seconded and approved.

MINUTES OF PLANNING BOARD MEETING - 5/2/74 r
The meeting was held in the Old Town Hall, Derby Square, ;Salem,
and was called to order at 8 : 10 P.M. Hank Garrity, Abby Burns,
Mike Freeman, Gerry McCarthy, Jane Lundregan, Tom Berube and
Ted Sadoski were present. '
This was a public meeting to discuss the preliminary subdivision
called Pickman Park, and to be developed by Salem Acres, Inc.
Salem, Mass. Attorney George Vallis represented Salem Acres , Inch.
and made a presentation of the preliminary subdivision plan, and
was recorded in favor of the proposal.
The following people were recorded as being opposed to
the proposal: Paul D'Amour, Mrs. Hogan, George Atkins, Joe
Salerno, Mr. Vorges, Peter Bouley and Bill Quinn.
The public meeting was adjourned at approximately 9 :20 P.M.
The Planning Board then conducted its regular meeting in
the Conference Room, Old Town Hall, 32 Derby Square, Salem, and
• dealt with the following business :
Form A - Emile J. & Rose I. Bilodeau, South Street. Motion by
Michael Freeman, voted accepted. ✓
Form A - Ernest Belleau, Jr. Four lots on the east side of
Lafayette Street, opposite Raymond Road. Denied. Application
not stamped by the City Clerk, high and low water marks should
be more precise, streets on west side of Lafayette Street should
be indicated.
The meeting was adjourned at 10 : 30 P.M.

MINUTES OF PLANNING BOARD MEETING - JUNE 6 , 1974
The meeting was held at the Old Town Hall, 32 Derby Square.
Gerry McCarthy, Ted Sadoski, Tom Berube and Paul D'Amour were
present.
With only ;four members present the Board did not have a
quorum to consider business presented; nonetheless , those
members present decided to consider and make finding on the
matters listed below and require the appropriate party to
secure the proper number of Planning Board Members ' signatures.
Form A - Matthew W. & Patricia A. Cronin, 47 and 49 Buena
Vista Avenue and Lot 227B Sable Road, Salem. Rear property
lines on lots shown on plan to be rearranged leaving all
of the lots with the required frontage. Accepted. Had
already been approved by the Board in November, 1972.

The Application for Permit was denied by the Building Inspector for the following reasons:
DIRECT APPEAL
The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning By-Laws
and the Salem Building Code and order the Building Inspector to approve the application fee permit to build
as filed, as the enforcement of said Zoning By-Laws and Building Code would involve practical difficulty or
unnecessary hardship to the Undersigned and relief may be granted without substantially derogating from the
intent and purpose of the Zoning By-Laws and Building Code for the following reasons:
The Petitioner respectfully requests the Board of Appeals to grant a variance to permit
the construction of a four (4) unit apartment building as shown on the enclosed plans.
The'Board granted a variance to permit the construction of a four unit apartment on the
other side of the street. Sometime after permission was granted and construction began,
• the City of Salem took approximately 5,000 square feet of land owned by the said Petitioner
for flood control purposes, making it impossible to construct any further units on the
Petitioner's land in that area. The Petitioner would like to construct the proposed apart-
ments shown on the enclosed plan and marked "Z-2", consisting of four units. The proposed
apartment building will share a common driveway with the existing apartment building
as shown as "Y-2" on the enclosed plans . There is ample area for parking and sufficient
area in the Petitioner's opinion to accommodate the proposed four unit building. It is
respectfully requested thatthe Board herein grant a variance so as to permit the construction
of an additional apartment building consisting of four (4)units all as shown on the enclosed
plans.

PLANNING BOARD MEETING - 9/19/74
The meeting was held at the Old Town Hall, Salem and called
to order at 8 : 10 P.M.
Members present: Jane Lundregan, Gerald McCarthy, Michael
Freeman, James Garrity, Ted Sadoski, Thomas Berube and
Paul D'Amour. Also present were Carl Johnson of the Salem
News and Howard Iverson and Ruth Taylor of the Salem Gazette.
Members Absent: Abby Burns and Ray Sweeney.
There being no items of immediate business , the meeting consisted
of a general discussion of aims for the board for the coming
year. The preparations or updating of our comprehensive plan
was discussed. It was pointed out that this matter was under
consideration several years ago and Mort Braun was interviewed.
He proposed a "self-help" type of program where the board and
interested citizens would do all of the work and he would act
as advisor. The cost of this project would be $90 , 000 over a
three year period. It was decided that members of the board
did not have sufficient time for such a project. Swampscott
entered into this type of project and it was thought that the
finished product was of doubtful value.
Representatives from the Department of Community Affairs had been
interviewed in the past but it appeared that their funds were
limited and that they would not be much help.
It was decided that the board should ask the City Planner to
look into available funds for such a project.
Recently the City Planner had presented a final draft of an
update in the subdivision control regulations. It was suggested
that a follow-up in this matter be pursued. A general discussion
of subdivision regulations followed. A comparison was made with
regulations of other communities. The advisability of including
topographical lines on plans was explored to properly determine
the run off to adjacent lots. It was pointed out that the
paragraph regarding lighting was not clear. It was also suggested
that some thought be given to include cluster zoning in our
ordinance.
The meeting adjourned at 9 : 10 P.M.

The meeting was held at the Old Town Hall, Derby Square, Salem
and was called to order at 8 : 10 P.M.
Members present: Thomas Berube, Jane Lundregan, Gerald McCarthy,
Michael Freeman and Paul D'Amour.
Members absent: Abby Burns , James Garrity, Tadius Sadoski and
Ray Sweeney.
Others present were George Vallis , Greg Senko and Kris Swiniarski.
First order of business : Request for waiver by George Vallis
for Salem Acres,, Inc. of 50 ' street requirement and granite
curbings for the proposed Pickman Park Subdivision. Action
taken: waiver deferred until additional information is pro-
vided by the Board of Health and the City Engineer regarding
the subdivision.
Second order of business : request for information by George
Vallis for Salem Acres, Inc. regarding the Pickman Park Sub-
division from the Board of Health and the City Engineer. Action
taken: letters to be sent requesting this information by the
next Planning Board meeting on October 17 , 1974 .
Third order of business : South Essex Sewerage District ' s
sludge incinerator. Action taken: a letter is to be sent to
the Building Inspector requesting him, as Zoning Enforcement
Officer, to investigate the matter and report to the Planning
Board by the October 17 , 1974 meeting what action (s) he plans
to take to remedy the situation.
Greg Senko then gave progress reports to the Planning Board
on the revision of the Subdivision Control Law, the Salem-
Peabody Connector Road, and the development controls proposed

MINUTES OF PLANNING BOARD MEETING - DECEMBER 5 1974
The meeting, held at the Old Town Hall, was called to
order at 7:35.
Members present - Gerald T. McCarthy, Jane Lundregan,
Abby Burns, Paul D'Amour, Al Rozumek and Tadius Sadoski.
Also present - Greg Senko, Kris Swiniarski, Howard Iverson,
Robert Scagliotti, Attys. John Serafini and Robert Ledoux.
Motion made by Tadius Sadoski to release $35 , 000 of a
$50,000 bond to John Serafini, Atty. for Highland Realty
Trust. Motion was seconded and accepted unanimously.
Robert Scagliotti, architect for Haskell & Hall, 36 Webb
• Street, Salem, introduced a proposal to expand facilities
of this company at their present location. Plan will be
presented to the Board of Appeal for a variance.
Executive meeting of the Planning Board to be held on
Thursday, December 12 , 1974.
