TutiPO CITY CL6RK } A meeting of the Planning Board was held on Monday, February 8, 1954, at 7 :30 P.M. , at City Hall . Mr. Baker, Mr. Gray, Mr. Merrill Mr. O 'Brien and Mr. Malkowski were present . Chairman, Mr. Louis E. Baker presided. A hearing was held on the petition of N. C . Nichols Realty Corpo- ration for the purpose of extending the present zone so that it may apply to the 170 acres of land . Land being bounded by Highland Avenue and Swampscott Road. Mr. Hyman Marcus representing the petitioner appeared in favor. He said that Highland Avenue would never be used as a residential district . In requesting the change, the petitioner had no definite use in mind, but to bring his business from Peabody to Salem was one pos- sibility . Mr . Hyman Marcus also pointed out that N. C . Nichols ' land would be valuable when properly developed. He could either, rent, lease or build on this land to give the City a return of which will not cost a thing because of' the private interest . Mr. Patrick Pardo appeared in opposition. He said he had resided at 5 Barnes Road for many years, and he does not feel that the re- zoning of 170 acres of land for business purposes, without more definite possibilities should be granted. He said that this land could be used for housing instead of being restricted for businesses . Mr. John Gray asked if Mr. Nichols could inform him as to his plans for a new business but Mr. Nichols ' answer was vague . There was no one else present in favor or opposed and the hearing was closed at 8 :45 P.M. The meeting then adjourned in the Mayor ' s office and Mr . Baker attended and presided. r V "`1 On motion of Mr. W Brien'y many bi;siness,,possibilities were mentioned. Gas station, Howard Johnson, Motel and several others . Mr. Gray, and Mr. Merrill, however, did not seem to favor any industry on this land. On motion of Mr. Gray, it was voted that the Board recommend that the petition be denied . AN ORDINANCE TO AMEND AN ORDINANCE RELATING TO `ZWUNG. Be it ordained by the City Council of the City of Salem, as follows: SECTION 1. Section 2 of the Zoning Ordinance is hereby amended by adding in paragraph B the following new classification. Customary home occupation carried on for gain in the residence f the occupant, provided there is no display of goods visible from the street nor advertising, except a small announcement sign having an area of- not more, than 288 square inches and attached against: the house and not protruding therefrom, and ,.provided that such occupation shall be carried on .by a person only within a - ;* dwelling or apartment used by him as his private dwelling, without employment of help,, ,and provided that such,_occupation shall not occupy more than. one-third of the area of his residence or apart ment, and provided that such occu ation hall, not be carried on in any accessory building SECTIGN. 2. All the members were present except Mr. Merrill. and Mr. Baker presided. . A hearing was held on the petition of Camp Lion of Lynn, Mass. , Inc . , to change from general residence to business zone a parcel of land on the westerly side-of Highland Avenue, 700 ft. in length and 900 ft. in depth (approximate figures) , beginning at a point about 800 feet from the Lynn-Salem line, as shown on plan on file. Mr . Gh.arles Ingram, clerk of Camp Lion, a subsidiary of the Lynn Lions Club, appeared in favor and explained thatthe land in question was swamp in the shape of a funnel tapering in from Highland Avenue, having no use in connection with the Lions ' Girl Scouts Camp • on adjacent property and no potential residential use, and is a fire menace. Mr. Carl E. Lundgren, a director of the Camp Lion corporation, appeared in favor and reiterated that the land in question was of no use to the Lions. A part has been sold to Amanti and Fiore and the smamp cannot be filled. Directly across Highland Ave. is a gasoline station and a restaurant. The locality is not adapted to residential development and it mould benefit the City to have the land filled and a revenue development there. Mr . Ivan A. Patten, who lives between Lynn line and land in question, appeared in favor and said that the Club has no revenue othdr than from entertainments, etc. , so it has no resources to develop the property. . Mrs. Catherine McHugh, chairman of Lynn Girl Scouts Camp Committee, appeared in favor, saying that the camp on Highland Avenue is for girls from Lynnfield, Swampscott, Saugus, Nahant and J J Lynn, there being 2500 members. Any additional revenue for maintenance of camp would come from sale of this land. . Mr. Philip Strome appeared in favor, representing the proposed purchaser of the land in question who would build an open-air theatre . Mr. Strome said he represented reputable , outstanding people in the theatre industry who are specialists in drive-ins. They propose fo construct facilities for about 900 cars with the newest type of screen . tpwer, 125 £t. wide and 65 ft. high, using the very latest methods. There would be a hearing device for each car and no noise beyond 15 feet from the theatre wall. They will fill and grade the swamp with a permanent hard surface, with all wiring under ground. A 4200,000 project. In addition there would be a refreshment building 85 ft. by 75 ft. All entrances and exits to conform to state and local requirements, with no cars waiting on highway as the box office accomodates four lines of cars and 172 cars per minute at the entrance. An open-air theatre is an asset to the community,• soliciting family patronage, with playground areas for children. Such theaters are often used for religious services in the day-time. The do not create noise or traffic hazard. It is proposed to replace an un- sightly area with a fitting and proper establishment, a benefit to the community. Mr. Ingram said that the petitioners would make it a condition of any agreement with a purchaser that local labor would be used as far as pbacticable . Thomas M. Burke , 7 Barnes Road, and Evelyn Pardo, 5 Barnes Road, appeared. in opposition. Mr. Emanuel Amanti, 260 Highland Avenue, appeared in opposition. He said he bought 32 acres with 300 ft. frontage on Highland Avenue, • 500 ft. depth, from the Lions and he feels that the organization is letting him down. The theater will not enhance the property. The swamp is not a fire hazard, and it would be no problem to develop it. Traffic from Lynn as well as from Salem to the theater would greatly • increase. Be said he has a nice home and grounds. Litter from the proposed refreshment stand would be an ,annoyance . 'iJalter Henry, 15 Barnes Rd. , G. Pd. niorson, 319 ighland ,eve. , Alvah R. Varney, 17 Wyman Ave. , and Tony Canzi, 231 Barcelona Ave . , were recorded in opposition. Mr. James Linsey, 17� Barnes Rd. , appeared in opposition and said that most. of, the homes in the vicinity had been built with confidence in a residential zone . Be said that horn-blowing and other auto noise, caused by the theater would disturb the rest of hard working men. Mr. Strorm replied . that there would be policing to prevent noise. City Councillor Thomas F. Tighe appeared in opposition and said that the theater „would induce small children of the vicinity to wander from • home, that it would creat a traffic hazard and that the whole proposition would be an economic detriment to ,the city and he would make every effort to defeat it. Gladys Varney appeared in opposition,, saying that 800 cars leaving at the same time at about midnight would create a dangerous traffic block, nnderingf fire apparatus or ambulance. Mr. Edward J. Laskey, 1 Barnes Rd. , appeared in opposition, saying that it was customary at open-,air theaters. to play records over a loud epeaker for an hour or so before the. show. Be, asked if the theater would be put to any other use. Mr. Strome said it would beavailable for use by a church or a civic-minded club, playground facilities would be provided but, otherwise absolutely nothing else but an out-door theater. Mr. Baker thanked the speakers, saying due consideration would be given to their arguments, andthehearing was closed. -- J A hearing was held on the petition of Lillian A. Little to extend a present business zone and change from general residence to business zone a parcel of land on State Road (Paradise Rd. ) and • Vinnin Street as shown on plan. Mr. Baker, at the request •of �Mr. Sumner L. Raymond, attorney for the opponents, because of his business association with ]fir. Hyman Marcus, attorney for the petitioner, stated that he would withdraw from the hearing And .-from any deliberations and voting of the Planning Board on the petition, and he did so withdraw, calling Mr. Gray to the Chair. Mr. Hyman Marcus appeared for the petitioner. After protesting as reflecting on integrity of Chairman and himself, the request for Mr. Baker ' s withdrawal/, he explained to the opponents to the petition the proposed lay-out of -the business development and said that no traffic would be routed through Maple Avenue . He said he appeared for "Stop and Shop Inc . , a large and reputable company who can • be relied on to keep their promises. The matter had come up before the Board before and at that time a favorable report was made. Where is now an area of 50,000 sq. ft. at corner of State Road and Vinnin St. zoned for business which is large enough for the needs of the Stop and Shop but it is their intention to offer a business development which will be thefirst in Salem ih a long time. It will be at least a million dollar proposition with building 190 ft. off the street with five stores occupying 35,000 sq. ft. , with 16,000 sq. ft. for Stop and Shop. It is anticipated there will be drug, clothing, cleaning establishments, etc. and Stop and Shop alone will employ 150 regular and 60 part-time workers. The other stores should employ a minimum of 50. The tax return to the ' city should amount to -a minimum of $25,000 per year and there would be no expense to the City at the development will be on a state road. As far as possible his client will get together with the opponents to solve their problems. There will be a parking space for 300 Vars which will create a parking problem but it can be taken care of. Only three homes over-look theproject and no traffic would be sent through Maple Avenue . • The benefit must accrue to the City, and it should hot be defeated by a minority. Mr. Sumner L. Raymond appeared in opposition for the opponents. He siLid he asked Mr. Baker to withdraw for the good of the Board and to save him embarassment. He said he had the greatest respect for Mr. Baker and Mr. Marcus. Mr. Raymond questioned the figure of $25,000 in taxes which Mr. Marcus said the new development would pay per year and said that in the heart of the business district amounts paid on comparable property are much less than that. He said there would bejust enough business to spoil a nice little residential neighborhood. Employees would probably come from Lynn and Swampscott, since nearer to work and he • thought the proposed number was magnified. The traffic congestion alone should doom the proposition. He said that the Planning Board cannot consider the kind of business or the nature or appearance of stores. The Board must consider ( sic. ) as provided by law, the pro- motion of public welfare, safety and morals, and only that. He said there were too many groceries were now and no guarantee of success in this case. .Ten or fifteen homes on the anew would give more revenue. He said a zoning ordinance is a covenant with the residents. Mr. and Mrs. Joseph Rosicky, 11 Paradise Rd. , appeared in opposi- tion, saying that from their house they would have to look at the back of the store. Mr. John Arrigo, 1 Paradise Rd. , said that 75 n&ighbors had signed a petition in opposition and the project affects a great many people . • Mr. and Mrs. Tony Guanca, 528 Loring Ave. , Ethel G. Robinson, 6 Maple Ave. , Mr. and Mrs. Arthur Timmons, 6 Maple Ave. , Jane Porter, 18 Maple Ave. , Ralph Morin, 13 Maple Ave . , Thomas A. Frazier, 512 Loring Ave. , Mrs. Francis Marcello, 539 Loring Ave. , a representative for - Mrs. Harriet Fenton, 18 naple .eve. , 5!Tilson Kleibacher, 2 Elm .eve ., Mrs. Joseph Arrigo, 1 Paradise Ave., appeared in opposition. • Mr. naymond said that the uity of Salem suffers from lack of produc- tion and not lack of commerce. In rebuttal, Mr. Marcus said that there had been no factual presen- tation of the opposition. The Sylvania plant on Loring Ave . does not affect welfare. There are other businesses in residential districts. There is no effect on valuation. People will shop where they can park. The petitioner intends to work out the traffic problem with the Police Dept. Mr. Raymond said the shopping center would not serve Salem. There had been two attempts to locate it in Swampscott and both were turned down. The hearing was closed. On motion of Mr. Gray, seconded by Mr. Malkowski, it was • voted to request the City Solicitor to tabulate all statutes and ordi- n�nces which define the powers of the Planning Board as relating to zoning. They said the building would occupy 1200 square feet and would be well away from the residential side and a parking area would be provided. Mr. Joseph Finnocchio, an abutter to the above property appeared • and asked to be recorded in favor . No one appeared in favor of rezoning the other lots� in question. No one appeared. in opposition. The hearing was closed.
