1950-PLANNING BOARD A meeting of the Planning .Board was held at City Hall on
iJanuary 24,~ 1950 at 7.30 P . M. Mr. Baker and Mr. Malkowski were
present and Mr. Wallace Williams of Fay, Spofford and Thorndike .
Mr. Williams described the latest plan of the North Street
crossing elimination. A temporary road, to be made permanent,
later, will be built from the westerly side of North Street toward
Bridge Street, opening up land formerly inaccessible .
On the matter of covering the North River Canal, Mr. Williams
.said the Community Services Commission has Federal money available
for the expenses of planning projects on which no Federal money
will be spent for cors truction. This money is loaned without
interest and not repaid until the construction is completed. A
Bill is being prepared to request the Legislature' to allow the use
of State funds now available for sewage nuisance elimintttt6n. It
is necessary to do this in order to be able to apply for Federal
money for plans. Cost of construction from North Street bridge to
about the spur track east of Goodhue Street would be $800,000.
Mr. Williams then discussed the ways and means of promoting
the engineering phase to be followed by a construction phase of
eliminating Norman and Mill Street crossings, depressing the tracks
and relocating the railroad station. No State funds are available.
The City and the B & M Railroad are to pay construction expense of
the tunnel from portal to portal. Federal money will pay for
conbtruction outside of tunnel portals. The City and State will
join 50-50 in preliminary plans (total $30,000) , which will make it
possible to figure who will pay for what. A new highway bill before
Congress will make money available for roads, etc. b y July 1st, and
it will be necessary to have plans ready to submit. The B % M will
cooperate and contribute and the Dept. of Public Works is favorable .
The B & M must agree to put this project ahead of any other
grade crossing elimination in order to expedite the financing.
Speaking of the Bridge Street overpass, he said that the
work is 18-20,% done but the hardest part is to •come:

Gentlemen:
-My client, Mr. Joseph Ingemi of 52 Jefferson
Avenue, Salem, is the owner of lots numbered 4, 5 and 6
as shorn on a plan hereto annexed. The property is
situated in the triangular piece of land bounded
Northeasterly by Loring Avenue, Southeasterly by the State
Highway leading to Swampscott, and Northwesterly by Tedesco
Road, all as shown on plan annexed hereto.
Beginning at a point on the Northerly side of
Tedesco Road, approximately one hundred (100) feet from a
• junction of Tedesco Road and the Westerly side of the State
Highway, and running in a Northeasterly direction approximately
two hundred fifty (250) feet as shove on the plan hereto
annexed, the area is zoned for business. The business zone
covers parts of Lots 4 and 5 of the property belonging to my
client.
My client has requested that I petition your Honorable
Body to extend the business zone so that it will include all of
Lots 4, 5 and 6. The area that will' be affected is more
particularly described by meets and bounds on the plan of the
area which I am enclosing with this petition.

Stanley Pietkiewlez and other residents. He said that if the
proposed zoning change is made residences in the vicinity will
be devaluated, people will be interfered with in the enjoyment

petition was referred to the Planning Board :
"Gentlemen:
My clients, Stanley M. Fietkiewicz and Geraldine M. Pietkiewicz, of
2 Paradise Road, Salem, Massachusetts, are the owners of certain property
as shown on a plan hereto annexed. The property is situated in the
triangular piece of land bounded Northeasterly by Loring Avenue , South-
easterly by the State Highway leading to Swampscott , and Northwesterly
by Tedesco Road, all as shown on plan annexed hereto.
The following is a description of my ,clientst property:
The land with the buildings thereon situated insaid Salem being
shown as Lot 7 on a Plan of Land of Maurice Hayes, situated in
Salem, Massachusetts , dated January 10, 1921) W. H. Spear, Sur. ,
recorded with Essex South District Deeds, Book 2$53 , Page 600,
bounded and described as follows:
Easterly by the State Highway, otherwise known as Paradise
Road, 102. 55 feet ;
Sutherly by Lot 6 on said plan 65.22 'feet ;
Southwesterly by Lot 8 on said plan 65.22 feet ;
Northwesterly by Loring Avenue , 102.55 feet ;
• North easterly by the curved line of said Loring Avenue and the
State Highway, otherwise known as Paaadise Road , 59.85 feet.
Containing 10,000 square .feet of land , according to said
plan. Being the premises conveyed to us by deed of Lohta M. Brown,
dated Niay 11 , 1946, and recorded in.said Registry in Book 34$$ Page 40.
My clients have requested that I petition your Honorable Body, in
their behalf, to extend the business zone so that it will include said
Lot numbered 7. The area that will be affected is more particularly

A meeting of the Planning• Boe'rd was held on Monday,
August 14, 1950, at 7 P . M., in the Council Chamber at City
Hall. All the members were present and Mr. ' Bakers the chairman.
presided.
. A hearing was held on changing a business zone at the
southeast corner of Barton and Collins! Streets to a general
residence zone. Mr. John J. OtRourke, the Building Inspector,
appeared in favor., explaining that the location was originally
zoned for general- residences was ,then'ehanged to a' business
zone for the erection of a small store which has gone out of
existence, and a house has been erected on the lot. No one
appeared in opposition and the hearing' was closed.
,A hearing was held on changing an. industrial zone at
the southerly si&e of Langdon Street and the westerly sideof
Proctor )Street. to a general residence zone. Mr. John J. O'Rourke,
the Building Inspector, appeared in favor, explaining that the
factory .originally ,located in this area 'has been removed, part
of the land has been taken over by the Park Department, new
homes are being built in the vicinity and'the character of the
neighborhood is residential. No one appeared in opposition and
the hearing was closed:
A-hearing was held on changing a- general residence zone
on-the southerly side of School Street between Devereux Avenue
and Tremont Street, about 100 feet wide, to a business zone.
mr. Philip J: ,Durkin appeared for Charles and-Samuel A. Goldberg,
owners of the land in question and a, grocery store at the corner
of School ftnd 'Tremont Streets which has been in existence for
• at least 75 years and owned by them for 29 years, the store being
continued after.the 'adoption..of the zoning.ordinanee as a non-
conforming use. The volume . of business has•. grown and the owners

wish to enlarge the store. The Board of Appeal had granted
permission for this but now it is the intention. of the City
of Salem to-widen the corner of School and Tremont Streets
and take a part of the Goldberg land. This will. necessitate
moving the store building easterly on School street. As a
non-conforming use, the present store could not be rebuilt if it
should burn down as it is in a general residence zone. There
will be ample parking space on the Goldberg' s land.
Mr. Goldberg was recorded in favor.
There was no opposition and the hearing was closed.
a. hearing was held on the petition of atanley M. and
Geraldine M. Pietkiewicz to change . tha general residence zone
at the intersection of Loring Avenue and State Road it Vinnin
Square (Lot 7 on plan on file) to a business zone. mr. Harry A.
Simon appeared. for the petitioners. He said their home was
recently damaged by fire and three lots adjacent to theirs •
had been rezoned for business, depreciating the value of their
home. Since other business has been allowed in the vicinity
there was no reason why the petitioners' lot should not be
rezoned. They proposed to erect a gasoline station and have
no intention of carrying on a sausage manufacturing business,
as has been rumored. If the persons present in opposition
had opposed the recent Ingemi petition for business rezoning,
the present petition might not have been necessary.
Mr. and mrs. Pietkiewiez were recorded in favor.
Norman T. Newey, 2 Maple Ave. , appeared in opposition, said
he bought his home, 200 yards north of the property in question,
in what he supposed would,be kept as a residential section. •
He cited the .hazardous traffic conditions.
Arthur T. Timmins, 6 Maple Ave., representing furs. George
Robinson, appeared in opposition, speaking on traffic
hazards, and asking what guarantee there was as to the
kind of business to be conducted.
ars. Arthur T. Timmins, Mrs. Arthur Sargent and
Raymond B. Loguercio, spoke in opposition.
George Nelson Brown, former owner of the property in
question, spoke in opposition. He said he sold the Ingemi
lots to Mr. Pietkiewicz with the understanding that they
would be restricted to residences.
Mrs. George Nellon BVown spoke in opposition.
Eighteen persons present were recorded in opposition.
Mr. Simon, speaking in rebuttal, said there was a limita-
tion of uses in a business zone, which does not include manu-
facturing, and any obnoxious business would require a permit.
• The hearing was closed.
On motion of Mr. Malkowski, it was voted to recommend to
the City Council that the business zone at the southeast
corner of Barton and Collins Street be changed to general
residence.
On motion of Mr. Malkowski, it was voted to recommend to
the City Council that the industrial zone at the southerly side
of Langdon Street and the westerly side of Proctor Street be
changed to a general residence zone.
On motion of Mr. Gray, it was voted to recommend to
the City Council that the general residence zone at the south-
erly side of School Street between Devereux Avenue and School
Streets, about 100 feet wide, be changed to a business zone.
• On motion of Mr. Gray, it was voted to recommend to the
City Council that the ganeral residence zone at Lot 7 at the
intersection of Loring Avenue and State Road in Vinnin Square

should not be changed to business and the petition should be
denied.
There was some discussion of the need of an*up-to-date
zoning map, and Mr. Baker said he would confer with the
Mayor in regard to an appropriation for the same.

The Planning Hoard, to whom was referred four applica-
tions for changes in the Zoning Ordinance, has held hearings as
required by law and begs leave to report on the same as followsa
On the proposed change of a business .zone at the south-
east corner of Barton:.-andl"Collins Streets - This location,
originally zoned for general residence, was later changed to ,a
' business zone and a store was located there. The store is no
longer in existence and a dwelling has been erected on the lot.
The Board recommends that the business zone be changed to a
general residence zone.
On the proposed change of an industrial zone on the
southerly side of Langdon Street and the westerly side of Proctor
Street - A leather factory ;las formerly located in this area,
but the factory burned and was not rebuilt. A portion of the
property is controlled by the Park Department and the character
of the neighborhood tends to be residential. The Board recommends
that the industrial zone be changed to a general residence zone.
On the proposed change of a general residence zone on
the southerly side of School Street between Devereux Avenue and
Tremont Street - A store was located for many years before the
adoption of the zoning ordinance at the corner of School and
Tremont Streets. To provide for enlarging and modernizing the
store, and also for widening the corner of School and Tremont
Streets, it is proposed to move the store easterly on School
Streets. The Board recommends that the general residence zone
be changed to a business zone.

Mr. Michael J. Reardon appeared for petitioners and stated
• that the persons interested in locatidg a business at the location
in question had conducted a sign business on North Street and were
being evicted because of the North Street grade crossing elimina-
tion project. Mr. Reardon described the location on Highland
Avenue and related the zoning changes from general residence to
business which have been made in the vicinity. He said that the
property which drops about twelve feet from the street level is
not adaptable for residences. A concrete block building would
be erected with provision for off-street parking.
Mr. Joseph Finocchio and Mr. Alphonso DSLuiso, prospectibe
owners of the propeity, appeared in favor.
There was no opposition and the hearing was closed.
On motion of Mr. Malkowski, it was voted to recommend to the
• City Council that the petition be granted.
The meeting adjourned at 8.30 p. m.
