1946-PLANNING BOARD A meeting of the Planning Board was held on r'ebruary 7, 1946, at 7.30 P. M. Messrs. Butler, Baker and Merrill were present and YYIr. Butler presided. ,,:r . Hans and mir. Wallace L. Williams were also present . Mr. Butler asked Pair. Williams, representing 1,'ay, Spofford & Thorndike, to review the history of the grade crossings elimination project. kr. Williams said that the money for the Bridge Street crossing had been appropriated and the work should start within 60 days, just as soon as the contract was made . The previous contract was cancelled due to war conditions, but a technicality was holding up the matter in the Attorney General' s office. . He explained the proposed widening of the tunnel, depression of the tracks and relocation of the' station with changes in adjacent streets, all as shown on a plan prepared by Mr. Hans. On the yquestion of raising funds, lair. Williams said that under a new law, Federal sponsored funds might be obtained which could pay for 50% of land damage. the B. & M. R. R. could pay up to 15% of construction costs and President French has agreed to cede title to the City of Salem of all B. & M. R. R. property not actually needed to run their tracks (not including North Street crossing and Danvers branch) He thought the total cost would be approximately $3,000,000. not including the �p500,000 already allocated. the plans as drawn would provide a parking space for about 300 cars . In a general discussion with the B.aard, Prir. Williams advised getting the Bridge Street overpass under way and then concentrating on the tunnel project, before pressing for elimination of the worth Street crossing. Mr. Hans asked that Fay, Spofford and Thorndike consider his plan for a new highway along North River when they aremaking plans for elimination of the iaorth River sewage nuisance, and it was decided that air. Butler confer with the mayor and get his approval on this. Mr. Williams said he had obtained State approval of a new highway, as planned by Mr. Hans, connecting with Summer *�)treet and providing around a by-pass for traffic around _ the center of the city. Funds for preparing .plans may be obtained from Federal Emergency Planning Eivision, with approval of mass . Dept . of Public Works, Federal Bureau of Good Roads, and mass. Attorney ueneral. If plans go through, the City reimburses the llivision without interest, otherwise there is no cost to the City. mr. Merrill reported on a meeting attended by Board members at the invitation of the Chamber of Commerce Housing Committee, where a demonstration was given on prefabricated houses. Mr. Merrill said he thought such houses in this cl'ima' te were suited only for temporary housing emergencies. It was decided to write �to Bruce H. Coffin, chairman of the C. of C. committee, thanking him for the opportunity to see the exposition, and offering the cooperation of, the Planning Board in relieving the housing problems in balem. On motion of sur. Baker, it was voted to hold regular monthly meetings on second Tuesdays, at 7.30' P. M. Mr. Butler called attendion to. a recent article in the Salem Evening Thews quoting councillor Frank Dolan as saying that the tunnel development project would provide parking space for "thousands" of cars. i,.t his suggestion, it was' decided-that mr . Hans should prepare a plan to show Mr..Dnl"an that his figure was much exaggerated. All the members were present 'except Mr. Mann. Mr. Baker presided. A hearing was held on the petition of Nederie Gaudrault, Joseph A. LeBlanc, Ludger 0. Demers and Rene J. Ouellette to change a general residence zone on Canal Street Extension, from Forest Avenue about 550 feet, and averaging in depth from Canal Street Extension about 200 feet, to a business zone . Mr. Nederie Gaudrault, 8 Bristol Street, appeared in favor. He said he had owned land with his father at this location for twenty years. He had been in the gasoline station business on Boston Street before going into the Service and he now wanted to erect a gasoline service station on Canal Street Extension. • Mr. Joseph E. Gauthier, 13 Ocean Avenue, appeared'in ,favor, saying that the opposite side of Canal Street is now industrial, it is a main thoroughfare and a busy street and no residential development is likely. Mir. Rene J. Ouellette appeared and asked that his name be withdrawn from the petition. Mr. Roland Berube, 20 Hancock Street, appeared in favor. He said the location was ideal for business and as it was ledge and swamp it would be too expensive to improve for residential use. He said he was an ex-Service man and wanted to go into business . there. Mr. Wilfred Gosselin, 226 Canal Street, appeared in opposition. He said he bought his property there 18 years ago with the understand- ing that it was a residential district. He said Canal Street Extension was not laid out when the zoning law went into effect. He� thought neighboring property would be devalued. He presented a petition in opposition. Celia Scaletti, 28 Forest Avenue , appeared in opposition. She said it,would not be safe forethe children of the neighborhood to have any additional traffic. Mr. Gaudrault said that there was an industrial zone on.the west side of Canal Street Extension and there would be no interference with traffic on Forest Avenue. Mr. Gosselin questioned the restrictions on the lots in the . vicinity at the time they were sold. Mr. Robert W. Reardon, for the Almy Estate, said that much of theproperty involved was purchased from the Almy Estate and had not been built on due to the depression and the war. The opposite side of Canal Etreet Extension is zoned for industry but is also a fine residential neighborhood. The zone in question is an available residential area, not Grade A desirable land, but could be developed. Mr. Gaudrault said the land has been idle for many years and it • is harder to build now than in the past. From Charles Street to Hersey Street is swamp. On Canal Street is ledge. Mr. Dante Pellicelli, 33 Forest Avenue, said he intended to build in the neighborhood as . soon. as possible. Mr. Clement Theriault, 220 Canal Street, appeared in opposition, saying his son wanted to build in neighborhood. Mr. Gaudrault said he wanted to make an honest living and did not. want to make enemies. His lots are open for sale if people want . to buy them. Mr. Joseph A. LeBlanc and Mr. Ludger 0. Demers requested that their names be removed from the petition. The hearing was closed.. Mr. Butler and Mr. Baker, speaking from the legal standpoint, said that they believed that any private restriction on the sale of land supercedes any zoning restfliction. All the members were present except Mr. Mann and Mr. Butler presided..,- Mayor Coffey, City Solicitor Kinsella and Mr. Hans were also present. Thp question of lots. for veterans off Fort Avenue was taken up. Mr. Kinsella read the Mayor' s letter to him in regard to a . proposed form of deed to the veterans. He then read a draft of antale agreement and also orders for passage by the City Council, which would give the Planning Board authority to dispose of the lots. The. Clerk read a letter to the Mayor from the Salem Veterans Council asking to have two members sit in with the Planning Board in regsrd to the Fort Avenue project, and the Mayor' s reply. On motion of Mr. Baker, it was voted to invite the Salem Veterans Council (Henry Gryczkiewicz, Sec. , 6 Becket Ave. ) to send two rep- • resentatives to meet with the Planning Board on May 22, 19465 at 7.30 P . M. On motion of Mr. Baker, it was voted to pay Mr. Hans salary for two weeks out of the regular Planning Board appropriation, for the weeks ending May 16th and May 25th. The Mayor said he approved this E action and the clerk was directed to send a notice of the vote to the City Auditor. On motion of Mr. Merrill, the meeting adjourned at 9.55 P . M. Respectfully submitted, Secretary • A meeting of the Planning Board was held on May 22, 1946, . t - • at 7.30 P . M. All the members were present and Mr. Butler pre- sided. Also present were Mayor Coffey, City Solicitor Kinsella, Mr. Hans, and also William B. Griffin and John Burke representing the Salem Veterans Council. Mr. Griffin said that they were interesting in sitting in with the Planning Board so that they can report back to their organiza- tion on the plans being made for the Fort Avenue land. Mr. Hans explained the lay-out and plan. Mr. Butler reviewed the history of the project, speaking of the legislation which was necessary to release the strip of park land along Fort Avenue. He said the Engineering Dept. had made a contour plan, and the first. street could be put in this summer. Some lots are now available. He explained that the City Solicitor • was preparing the necessary papers to give the Planning Board authority to handle the lots, and also a purchase agreement . Dir. Kinsella explained the purchase agreement, which would provide that building must be started within 180 days and completed within one year thereafter, subject to modification by the rlanning Board. The agreement would also provide the conditions under which Veterans might dispose of their property. s Mr. Butler said that mr. Hans was qualified to act as con- sultant and advisor in matters of architecture and landscaping; and Mr. Baker added that Mr. Merrill could act in an advisory capacity in the matter of u. I. loans. In reply to a question by Mr. Griffin, Mr. Hans explained that the land was at present zoned for single residence, and ivir. Kinsella suggested that it could be rezone"d for general resi- dence if that was the wish of a majority of the veterans. i Mr. Griffin suggested that the lots be drawn in a lottery and Mr. Butler said that the Board wanted to use any plan that the Vet- erans want and that will be fair to all. also if the majority of • the veterans want a change to a general residence zone, the Board will favor it. Mr. Hans advised the building of orcllarless 'houses, also duplex instead of the conventional two-family houses, and suggested that the Veterans voluntarily submit plans to a board of local architects for suggestions. Mr. Baker suggested joint ownership of duplex houses. Mr. Merrill thought there should be no requirement that a veterans must be the tenant in a two-family house. Mr. Griffin suggested that each veteran organization be asked to submit a plan for the distribution of the lots. Mr. Kinsella spoke on the legal question of the sale of the lots by the city for p1.00 each. He thought it possible that special . legislation might be needed. Mr. Burke asked if veterans of any war were to be included and Mr. Griffin said that in his conversations with veterans he thought the general opinion was that the lots should be for veterans of avorld War II. The members of the Planning Board agreed. Mr. Griffin said he would like to have a meeting which the veterans could attend and be addressed by Mr. Hans and Mr. Merrill and where copies of the plan of the project could be inspected. The Board directed Mr. Hans to have copies of the plan prepared. mr. !mann suggested that the veterans show their financial quali- fications before the lots are drawn. Air. Merrill did not think this practical. On motion of Mr. Baker, the Board voted to hold a meeting with the veteran applicants for lots and all other interested veterans on July 1, 1946 at 7.30 P . M. in the Council Uhamber, and to invite the city uouncil . to attend. The meeting adjourned at ten o' clock P. M. • Mr. Butler and Mr. Baker directed the clerk to invite the Mayor and City Council and the Committee of the Veterans Uouncil to attend the next regular meeting of the Planning Board on June 11th. That the Zoning Ordinance and the Zoning Map of the City of Salem is hereby amended by changing the following described area zoned in part for industrial purposes and in part for general residence purposes to an industrial zone, namely, that area commencing at the Southerly side of Swampscott Road in Salem, and running ' 3312 feet from the Swampscott Road in a Westerly direction along the line dividing the town of Swampscott and the city of Salem to a point; thence turn- ing and running at approximately a 45 degree angle] 2088 feet Easterly to the'Swampscott Road; thence turning and running in a Southeasterly direction along Swanpscott Road to the point begun at as shown, on a plan accompanying this ordinance, and hereby made part thereof. Morse, City Engineer", for the price of One Dollar. No betterment tax shall be assessed against said real estate. Said sale to be made on the condition that the purchaser shall execute an agreement with the City of Salem to erect on said lot of land a dwelling house to cost not less than Fifty-five Hundred ($5500) Dollars, and that he shall begin construction of said dwelling house within one hundred eighty days after the date of said agreement, and with the further provision that all construc- tion on said dwelling house shall be fully completed within one year after the work is begun. It is further provided that if circumstances arise which make it seem desirable to the Mayor and the Planning Board that they may alter the aforesaid terms and conditions and that they may extend the time for the beginning and completion of construction as provided above, and that the Mayor be and hereby is authorized to sign said agreement on behalf of the City of Salem. All members were present. Louis E. Baker, vice chariman of the Board presided. A hearing was held for all Veterans who had applied for Building Lots at the city-owned land on the northerly side of Fort Avenue and for all other interested Veterans. Mayor Edward A. Coffey, Councillors Morency, Durkin and Szetela were present and approximately fifty Veterans. Louis E. Baker spoke briefly on the housing sites at the Salem Willows and the great need of homes and the desire of the Planning Board to assist in this great need. Mayor Edward A. Coffey spoke on the City of Salem' s interest in • the project in the matter of furnishing Water, Sewers and Streets and spoke of available money in the City to lay out these streets and said he would go before the City Council and ask for money to carry out this plan. He also suggested that the road parallel to Almshouse Road (Road B) be opened up first, this being, in his opinion the best location to start on. There being some forty lots on this location , and with the City furnishing Water, Sewers and Streets it would be possible to start by spring. Warren H. Butler, Chairman of the Board spoke briefly on the beauty ofplocation and of the immediate need of roads. Edward E. `'errill spoke on the matter of financing of these homes and cited many instances where he had had personal contact with these cases and how they were handled as to financing. The • minimun cost of building a home would be $5500.00 2. Edgar W. Nickerson, representing the City Lngineer' s Office, spoke *riefly and pointed out on a map on display .in Council Chamber the different locations of lots and what roads would have to be started first if certain locations of lots were developed. Mr. Harry Miller (veteran) spoke again and mentioned other more desirable locations in the city such as the Municipal Golf Course and stated that there should be more interest in the present housing problems, which should be taken care of first instead of future plans. A long discussion was held on the matter of financing of homes and how much income would be necessary to finance these homes. Mr. Sullivan, (Salem Veterans' Council) spoke briefly on the matter of Veterans' housing emergency and the financing of same. Mr. William Griffin (American Legion and Salem Veterans' Council) poke briefly on the matter of Veterans' housing emergency and said the main aim of the Planning Board was to draw plans for future homes and not the financing of these homes, and he thought that the group should come to some decision on the plans of awarding of lots, the setting down of rules and the disposition of the house lots. ' Councillor IvIorency ,poke on the matter of financing homes, the selection of home sites, the building of homes, and spoke of the desirable location of the Fort Avenue Development, and spoke in opposition to temporary housing plans, such as multiple housing plans. Councillor Durkin spoke briefly and thought the group should decide on how many lots were available and the number of applications on file and to come to some-.decision on disposition of same and stated that he felt that the whole 140 lots should be developed at once rather than a few, 0 hat there should be less discussion on the matter of finance and more interest on the deciding of lots and development of lots. 3. AWARDING OF OF LOTS William Griffin moved that the Planning Board come to some plan on the manner of drawing of lots and that the drawing be made public and that these be picked in two drawings: 1. Awarding of lots in general. 2. Awarding of location of lots. Vincent Bane (veteran) suggested that drawings be made from two bowls, the first bowl to contain name of applicant and the second bowl to contain numbers of lots which are to be given. He also suggested that if lots were not satisfactory that applicant could swap with another veteran who had drawn lot , providing it was satisfactory with each individual. The Veterans voted unanimously in favor of the two drawings. TIME OF DRAWING OF LOTS Mayor Coffey spoke on questions submitted in communication from Veterans of Foreign Wars, as listed below and Mr. Baker called on veterans present to express their opinion on these questions: 1. Would Veteran be permitted the building of one and two family houses? Yes. Unanimous vote of Veterans to allow the building of two family houses. 2. Would renting to non-veterans in two family houses be permitted? Seventeen veterans in favor of renting to veterans only. 3. Would renting of two family houses to veterans and immediate families of veterans be permitted? Seventeen veterans in favor of renting to jimmediate family. Mr. Baker then declared there was a tie vote on questions two and three. 4. 4. If lot is awarded and veteran cannot keep his original commitment what should be done about lot? Lots to be put back in original pool. Unanimous vote. 5. Would veteran be permitted to sell in five or more years to non-veteran? Yes, no restrictions after five years. Unanimous vote. 6. Would exchange of Lots with another veteran be permitted? Yes. Unanimous vote. 7. Would over-seas servicemen be allowed to obtain lot if family makes application and if he is not back at specified time? Yes, providing serviceman is in service priorto V Day, August , 1945. At that time your name was drawn and you will find enclosed a list of lot numbers and the name of the Veteran dram for each lot. A plan which shows the location of the lots may be consulted at the City Engineer' s Office in City Ball. In order to qualify for a lot , it is necessary to be an honorably discharged veteran of world VVar II and a bona fide resi- dent of the City of Salem. It is also necessary to sign an agree- ment with the City of Salem, which provides that (1) no dwelling is to be erected which costs less than $5600.00; •, ( 2) building must start within six months after signing the agreement ; ( 3) construc- tion must be completed within one year after construction begins; and (4) no property shall be sold for five years after the deed is signed. It is also advisable that you make sure that you qualify for a G. I . Loan before signing the agreement. The terms of the agreement may be modified by the Mayor and the Planning Board if circumstances warrant such action . Anti:Veterans who iuere awarded lots in the drawing may exchange their lots at will among themselves provided they giva notice of such change to the Planning Board in writing. r - i If any Veterans release their lots or are in any way dis- qualified, then those lots will be assigned in order to Veterans who had -applied but whose names were. not drawn on October 7th for a lot. The names of these Veterans were drawn at that time , however, to determine the order in which they vaoula be . eligible for any such released -lots. In order to qualify for a lot, it is necessary to be an honorably discharged veteran of World War II and a bona fide resi- dent of the City of Salem. It is also necessary to sign an agreement with the City of Salem, Yh ich rovides that (1) no dwelling is to be erected which costs less than 95500.00; (2) building must start within six months after signing the agreement; (3) construction mgzst be com- pleted within one year after construction begins; and (4) no property shall be sold for five years €after the deed is signed. It is also advisable that you make sure that ,you quelify for a G. I. Loan before signing the agreement. The terms of the agreement may be modified by the Mayor and the Planning Board if circumstances warrant such action. :Any Veterans who were awarded lots in the drawing may exchange their lots at will (among themselves provided they give notice of such change to the Planning Board in writing. If any Veterans release their lots or are in any way dis- qualified, . then those lots will be assigned in order to Veterans who had applied but whose names were not drawn on Octobrr 7th for a lot. Thp names of these Veterans were drawn at that time, however, to deter- mine the order in which they would be eligible for any such released lots. Mr. Baker and Mr. Merrill were present and Mr. Baker presided. A hearing was held on the matter of changing a general residence zone , 200 feet wide, on Highland Avenue,f:scutherly side, from the Lynn line to the property line between the estate of Dennis Coffey and the Almy Estate, to a business zone * Mr. Hyman Marcus appeared in favor. John Grasso, Marlborough Road, Michael Pierro, Barcelona Avenue, and Carmen Pierre, Sheldon Rd., Swampscott, app= ared in favor. A representative of the Eastern Tank and Manu- facturing Co. appeared in favor. Mr. Patrick F. Pardo, owner of a house in the vicinity, appeared in opposition, stating that he was opposed to rezoning the whole area in question, but had no objection t6 rezoning of the Grasso property. He did not think the other property should be rezoned against the wishes of the owners. Rezoning would open Highland Avenue to all kinds of business, possibly objectionable. He said he was the owner of sixteen house lots. Messrs. Daniel O'Hara, Barnes Road, and Louis G. Provencher, also appeared in opposition. In bebuttal, John Grasso said that since "spot" zoning was illegal, it was necessary to rezone a large area. The representative of Eastern Tank and Manufacturing Co. said the area would never develop for residential purposes and homes would never be built on the dual highway now under construction. He called attention to the fact that owners of property do not have to allow business on their land just because the: property is rezoned for business. Mr. Pardo. said. there had been no residential development on Highland Avenue because there was no water supply, and in addition the war had stopped building. He thought conditions would be different now. The hearing was closed., A hearing was held on an ordinance to allow the use of third floors of two and one-half story houses in residential districts, except the single residence districts. Mr. Francis J. Thompson appeared in favor. Mr. Walker Cahill questioned the advisability of setting aside the law temporarily and suggested that the change should be made permanent if it is desirable. Mr. Thompson sspoke of the housing shortage in Salem, with many veterans needing homes and no other housing projects in view. On question of financing btrc=thbtCIItyiof the alterations r allowed in the ordinance, Mr. Cahill said he was opposed to the City going into the real estate business, and Mr. Thompson said that the veterans' organization of which he was a member (Amvets? ) was opposed to the City financing such alterations. Mr. Kinsella said he thought the proper procedure would be to request the .Mayor to direct the ,City Solicitor to prepare an order for submission to the City Council which would authorize the Mayor to execute deeds for the sale of lots • off Fort Avenue to those veterans who sign an agreement with the City of Salem as drawn by the City Solicitor. No decision was reached and Mr. Butler directed the clerk to hold such a communication pending further discussion. On motion of Mr. Mann, it -was voted to recommend to the City Council that the petition to change a general residence zone on the southerly side of Highland Avenue from the Lynn line to the property line between the estate of Dennis Coffey and the Almy Estate to hEbusiness zone be granted, with the further recommendation that such zone should extend 400 feet wide from the line of Highland Avenue, instead of 200 feet as requested in the petition, in order to provide sufficient space for suitable parking areas in conjunction with any large business development withih the zone . Mr. Butler, as an interested party, asked to be excused from voting. On motion of Mr. Mann, it was voted thatnapy addi- tional applications for veterans' lots received since the lots weredrawn or in the ..future should be added in order at the'-•end of the supplemental list .of veterans eligible for lots released. Mr. Baker, Mr. Mann and Mr. Merbill were present and Mr. Baker presided. Also present were Mayor Coffey, City Solicitor Kinsella, City Engineer Morse, Building Inspector O'Rourke, John M. Gray and Frank T. Gallagher of the Emergency Housing Committee, and Mr. Walsh of the Matter Builders' Association. A large number of veterans were also present. . The purpose of the meeting was a conference with the veterans, to explain to them certain problems and situations arising in connection with .the veterans ' lots off Fort Avenue. Mr. Morse explained the topographical map of the area and answered questions. He said it would take at least a year to put in water and sewer ' services. He advised against building, except in the Almshouse Road�Fort Avenue area, before blasting for streets had been completed. He said he had no funds available to install sewers. Mr. Harry Miller advised the veterans against building in this area and said other locations were more desirable. In 'reply to a question, Mr. Mann said the southerly side of Fort Avenue was not chosen because of the proximity of the settling basin, as well as other undesirable features. Mr. Walker .Cahill spokein defence of the location on the northerly side ofFort Avenue .and said similar conditions had existed in other parts of the bifillows before they were built up. He said the project was a credit to the Planning Board. Mr. Walsh, speaking as a builder, said the average veteran cannot afford to own a single house, even on a perfect lot. He said that under present conditions the cheapest house will cc a cost $7500.00. • Mayor Coffey recommended that -the , City,blast ,every cellar and remove the stone, and that one road should be built at once. Mr. Gray .described what is being done in,other communities, but principally under semi-private enterprises, .and made a generous offer to help and advise the veterans in every wa7 possible. . I Mr. O'Rourke said-he thought there were 30 to 40 lots that could. be built on at once. Mr. Kinsella explained the agreem3nt and the deed. Mr. Clarence Mayo, of the Salem Gas and Electric Lighting Co. said that the installation of electricity and gas would depend on the availability of materials and the progress of the development. The Company would cooperate .in. every way possible. Mr. Baker- taid that if a.-holder of .a lot was obliged to leave the city, in .order to find a.place to live he would not forfeit his lot. Mr. Baker 'said ,that -.the meeting, was held to boring all facts into the open, so that the veterans would not think that the city was trying to cover up.anything.1' The meeting .adjourned. at ten P. Our clerk, Miss E. Mabel Curtis, has done part-time work for the Board since about 1922. At that time, she was a clerk in the City Clerkts office (under Civil Service) and was later appointed Assistant City . Clerk. She left the City Clerk's office in 1939 but continued to do some work for the Planning Board. She has been paid varying amounts, depending on the amount of work done, the maximum being $100 per year, until the last two or three years when the work increased to some extent. This year she will have been paid $300.00. The special work which required this extra payment probably will not be continued during 1947 In view of the small salary, we have never considered that this position would come under the Civil Service rules. Miss Curtis was form&vby on the Civil Service list, but I do not know what her standing may be since she left the City Clerk's office.
