1933-PLANNING BOARD i A meeting of the Planning Board was held on Monday, January
30, 1933, at 7.30 o' clock P. M. All the members were present
except Mr. Wiswall and the Chairman presided. Mr. A. H. Phippen
and Mr. Kenney were also present.
The Board considered rezoning the property of Mr. Kenney
adjacent to the Creedon garage on Essex Street from a general
residence zone to a business zone . Mr. Kenney explained the
situation and stated that none of _the neighbors were opposed
with the exception of Miss Caulfield.
The Board also reconsidered the rezoning of-the Collins
Cove flats. Mr. A. H. Phippen explained that he was prepared
to sell 629, 000 square feet of flats to the City at one cent
per square foot, if the City would rezone the portion of upland
adjacent to the Salem Gas bight Co. for an industrial district.
This upland lies between Planters Street and Osgood Street.
He would also be prepared to give land to extend a street to
the flats for accesstothem.
Mr. Perkins expressed the opinion that the situation
suggested a compromise in the nature of exchanging a small piece
of waterfront , not likely to be developed as residential, for an
extended piece of waterfront now zoned residential.
The question -of principle :involved was as to the position of
the: Planning Board.
Mr. Webber was opposed to any unrestricted zone at this
• location, as previously requested. He suggested that the
Board take no official action.
It was agreed that the members of the Board see no reason
for opposing the rezoning of the property involved at Collins
Cove .to an industrial zone . .
On motion of Mr. Perkins , it was voted that the Board has
no objection to the petition of Mr. Kenney, unless there is a
concerted opposition by the neighbors .
The budget for 1933 was discussed.
On motion of Mr. Perkins , it was voted that the Planning
Board request an appropriation- of $300.00 for 1933. It was
voted that this amount should be considered to include the ex-
pense of attendance at .the Convention of Planning Boards .
It was voted that• the salary of the clerk should be
$100.00 per year.
On motion of Mr. Perkins , it was voted that the preparation
of the Annual Report for 1932 be referred to a Committee con-
sisting of Mr. Webber and Mr. O'Donnell.
The Board adjourned at nine o' clock P. M.

In regard to Collins Cove Flats owned by the Heirs of
George D. Phippen "lying southerly and southwesterly from northerly
line of Osgood Street extending to Salem Neck".
The owners hereby agree to sell to the City this area
of flats, approximately 6299000 square feet at a price of one cent
per square foot with the understanding nevertheless that considera-
tion shall be given to removal of the. Zoning Iaw from thattDortion
of our property lying below and outside the line from Osgood Street s
as above stated.

• A meeting of the Planning Board was held on Honday , March
279 1933, at 7.30 o'clock P. M. All the members were present
except Mx. Webber and Mr. O'Dhnnell and the Chairman presided.
The Board considered House Bill 1240, relative to powers
of boards of appeal in connection with zoning ordinances , which
apparently does nothing to limit the authority of appeal boards ,
and, if anything, gives additional powers.
On motion of lir. Pet�kins , it was voted that Mr . Miswall be
requested to attend the hearing on the above Bill, if possible,
as the representative of the Board and that he be authorized to
use his own judgment in appearing in favor or in opposition to
the Bill/
Mr. Pitman explained a proposed project of community garden-
ing and farming to relieve unemployment . He described the
Springfield project which he had recently visited where a tract
of forty acres is being reclaimed, probably to be used as a park
or . recreation centre . At this project , a "hotel" feeds several
hundred men (at eight cents a meal ) who are working out fool cards.
The food raised goes to the maintenance of the hotel. Another
plot of land gives each man his own produce .
The land available, and being considered for such a project
in Salem would be the Jacobs Farm, Cabot Farm, Willows Road and
North Shore Country Club .

• A meeting of the Planning Board was held on Friday, May 5,
1933, at 7 .30 o' clock P. M. All the members were present and the
Chairman presided. Mr. James Kinsella, City Solicitor , was also
present.
The Chairman stated that the Mayor would support the Board
in an appeal to the Full Bench of the Supreme Court on the decision
allowing .a change of zone at the corner of Vinnin Street and Losing
Avenue (see Records of City Council, Vol.44) if they so decide after
a conference with the City Solicitor, and on the advice of Mr.
Wiswall and Mr. Kinsella.
Mr . Kinsella presented two points on which an appeal might
be taken:
1. Number of votes required to pass zoning csdinance amend-
ment over the Mayor' s veto.
2. Question whether City Council has right to rezone single
lot.
Mr. Wiswall said that there was a possibility of winning in
an appeal to the Full Bench and nothing to lose.
It was unanimously voted to request the Mayor to direct the
City Solicitor to take case of Vinnin Square zoning amendment to the
Full Bench of the Supreme Court on exceptions to the finding of Justice
Waite that a writ of mandamus be issued to the petitioner. .
The Board adjourned at nine otclock P. M.
