1932-PLANNING BOARD A meeting of the Planning Board was held on Monday,
. February 1, 1932, at seven o 'clock P. 14. All the members
were present except rir . wiswall and the Chairman presided.
The Chairman read a draft of the proposed Annual Report
for 1931. The report was discussed.
On motion of Mr. Perkins , it was voted that the report
be accepted and presented to the Mayor and City Council.
On motion of Mr. Perkins, it was voted to request an
appropriation of five hundred dollars for the year 1932, the
amount to include the expense of attendance at conventions
On motion of Mr. Webber, it was voted to request the
• City Council and the Board of Appeal to notify the Planning
Board of any petitions or hearings relating to the zoning
laws , street widening, or related subjects.
On motion of Mr. O'Donnell, it was voted that the members
be individually authorized and directed to appear before the
City Council or the Board of Appeal to support the policies
of the Planning Boai7d as outlined in the Annual Report for
1931.
On motion of Mr. Perkins, the Board adjourned at eight
o'clock P. IT.

A meeting of the Planning Board was held on Honday, April
4, 1932, at 7.30 o 'clock P. 19. Mr. Pitman and Mr. Webber were
present. Mayor Bates and President Fitzgerald of the City
Council were also present.
The proposed location of a new street from Dead Han's
Curve, so-called, on Loring Avenue,to Lafayette Street was
discussed.
As there was no quorum of the Planning Board, the meeting

As there was no a quorum the meeting adjourned to a conference

After- some discussion' of the proposed shore boulevard, it -was de-
cided that a committee be -appointed - to agree upon a definite plan for
a shore boulevard along Forest River, with features of benefit to
the two communities , and to endeavor to determine an approximate
cost and its distribution upon state, county and the two communities.
The following committee was appointed: Messrs . Perkins, Bates,
Fitzgerald and Wiswall of Salem, and Messrs Bell, Goodwin and
Parsons of Ilarblehead.
The plan suggested by Salem is for a road from I,orinC Avenue
along Forest River to a point in Marblehead opposite Forest River
Park, thence across the river by a viaduct to the edge of the park
land and along the shore connectin- with Con,'ress Street , following
substantially the original City Plan of the PlanninC Board in 1912.
The plan suggested by Marblehead is for a new road from Norman
Street through Beacon Street and then connecting at the junction

of Lafayette and Maple Streets .
Both communities approve the construction of the viaduct to •
make a grater basin of about fifteen acres.
The object of both communities is to eliminate traffic from
business and residence areas.

An Ordinance to amend an Ordinance relatinc to /�oning .
Be it ordained. by the City Council of the City of Salem, as
follows:
Section 1 . The Zoning Ordinance and the Zoning. Map is hereby
amended by changing the genefal residence zmne at the corner of
Loring evenue and Vinnin Street, known as lot 13, and bounded
as follows : Beginning at the westerly corner of said lot thence
running southeasterly by the easterly line of Vinnin Street as
established by the County of Essex about 129 ft. , thence running
northeasterly by lot 14 about 61 ft. , thence running northwesterly
by lot 12 124.05 ft . , thence running southwesterly by the southerly
line of Loring Av me about 102 ft. to point be-,gun at; to a business
zone for the specified use of restaurants or other eating place,
as provided in said Ordinance, Section 6, Paragraph A, Item 5.
Section 2 . This ordinance shall take effect as provided by the
City Charter.
In City Council, June 23; 1932, adopted by vote of 9 yeas, 2 nays .
Vetoed by Mayor on July 5, 1932
In City Council, July 28, 1932, adopted again notwithstanding veto.

Arguments against Rezoning of boring Ave. for
Restaurant or Tea Room
First:- It is aimed at the eery rootof zoning, which is for the pro-
Lection of the house owner. . This, if allowed, places a res-
taurant or tea room within a short distance of the $100000
home, which it was supposed would be protected by the zoning,
as it was in a residential section.
Second:- This area, when zoning hearings were held, was placed in the
residential class on application of residents near that vicinity.

Third:-' It violates the principal of zoning because it sets aside a
small tract of land, one mall lot, for business purposes. It
is .special legislation in the intdrests of one party against the
interests of the residents..
Fourth There is no crying need and certainly no demand for such a
business in that section of the city.
Fifth:- It is legislation by the Salem City Council for people residing
out of town, and against residents who have not only built up
the section but actually reside there, owning property bringing
in a good income to the city in taxes. Those seeking the change
do not live in Salem, but in Lynn. One only, ?Sias Hayes, owns
the property valued at 6V750. She lives in Lynn, employed a
Lynn lawyer to represent her, and the people who are to run the
place are residents of Lynn.
Sixth:- The property is not to be purchased, but is only leased, and for
a business which the residents and property owners who appeared
claim is objectionable to them.
Not stated last evening through error. For the first time in
the history of zoning the change specifically limits the area
to be rezoned to a restaurant or eating place only, and should
that fail, and other business desire to establish there, it
would be absolutely necessary to come before the city council
for another change before anything could legally be done.
A very bad precedent to establish, to place in the law just that
one business be conducted in the zoned territory. In the past a
piece has been zoned for "business purposes" while this amend-
ment limits the kind of business and the only kind that can be
conducted there if rezoned. if. E. W.
A meeting of the Joint Salem-Marblehead Committee on Shore Boule-
vard was held at City Hall on Thursday, July 7 , 193 � at e 'eht o ' clock
P. I.I. All the members were present and Mr. Harry S. Perkins presided.
1r. Frank P. Morse, City Engineer of Salem, and lir. Harold B. Breare ,
Town Engineer . of '"rblehead, were also present .
7r. Bell stated that he had been in touch with the State Depart-
ment of Public Works in regard to the new road and the Department
recd-amended that the Committee -come to some conclusions as to where
the road is to go, and that the Department would then send the State
EnC.ineers to make a preliminary survey. After that the matter could
'be taken up directly with the Department, probably under Chapter 90
of the General Laws , the costs apportionment of that chapter allowing
the State to pay an amount from nothinf to 75%. The road as shoi�Tl
by the original plan is all in Marblehead but the only portion of any
value to the Town is the viaduct. Mr. Bell suggested that the Com-
mittee come to an agreement on .a plan and then ask for a -hearing
before the State Department of Public Works .
Mr. Fitzgerald ;ave. a rough estimate that the viaduct (2600 feet ).
would cost $ 70, 000.00, exclusive of the road-bed.
Mayor Bates stated that while the viaduct is only a new road for
Salem, it opens up a''potential residential district for Marblehead.
ar. Bell said that unless 11r. A. E. .Little, the owner of the land
involved in ,aarblehead, is willing to give the land for the new road,
Marblehead is not interested in the proposition.
Mr. Parsons said that he considered it advisable to keep the road
on the 1.1arblehead side of the basin back from the shore , as shore
property depreciates in value if the road spoils the beach .
Mayor Bates said that. Salem would like to have the portion of the
road between Loring Avenue and Lafayette Street on the Salem side of
Forest River, and that in that .case-Saler.2 would be prepared to assume
the entire cost of that portion, with I-arblehead payinj for the portion
in that town, both sections to be built with state and county aid also .
On motion of Mayor Bates , it was, voted that Mr. Nalcolm Bell be
appointed a Committee of one to confer with the State Department of
Public Works with the object of asking the State Engineers. to .make a
survey of the potential possibilities of a shore route , in conjunction
with the City Engineer -of Salem and the Town Engineer of Marblehead;
the road to start from' a point on Loring Avenue near Dead Ban' s Curve,
so-called, thence running in a northeasterly direction on the Salem
side of Forest River to Lafayette Street and thence in a more easterly
direction to the junction of the proposed viaduct, and the proposed
West Shore Road in Harblehead, thence in a general easterly direction
to Village Street;, also from the junction of the proposed viaduct and
the proposed ''lest Shore Road thence northwesterly along the viaduct
to Forest River Park in Salem and thence in the same uirection to
Congress Street.
