1. Meetinq Minutes - December 20, 2 007 meeting
Hamilton: Motion to approve of the minutes for the December 20, 2007 meeting,
seconded by Blier. Passes 3-0. Pabich and Summer did not vote because they were not
present.

2_._ Request of Funding Assistance for Greenscapes 2008
Barbara Warren, Executive Director of Greenscapes speaks about the Greenscapes 2008
program stating that it will include recycling. She explains that the Engineering
Department will participate this year as they are working with the water use. She outlines
the progress for this year, citing the following: (1) the guide was mailed out and received
positive feedback, (2) the website is up and updated, (3) workshops have been scheduled
for March and April (Last year more than 200 people attended the workshops), and (4) an
email newsletter is being sent to over 1200 people. She states that they offer a private,
one-hour consultation for $125, which includes a soil test.
Duques says that the cost for Salem to join is $5200, which include $1500 to participate
plus the cost of printing and distribution of the mailer. She adds that the City Engineering
Department will split this cost with them ($2600 due from the Commission). She states
that the Commission has over $40,000 in the account.
Pabich states that he supports the program. He suggests emailing the newsletter as a
PDF.
Warren says that it is very large but she can provide a link.
• Pabich: Motion to appropriate $2600 to this program for 2008, seconded by Summer.

• 3. Continuation of a Public Hearing — Notice of Intent — EP #64-471 — Carmine
and Angelo Mongiello, 120 Swampscott Road, Salem, MA 01970
Cornacchio reads the legal public hearing notice which states that the purpose of this
hearing is to discuss the proposed siltation barrier, placement of new boulders and creation
of new stream bank within a coastal bank at 120 Swampscott Road.
Engineer Scott Patrowicz presents the new plans. He reviews the adjustments, which
include: (1) placing a concrete floor as a base for the screen, (2) using high strength
mortar, (3) canceling plans to carve out the stream below, (4) mounting an 18 x18 sign
stating "Snow Storage Along the Top of the Stream Bed is Prohibited" along Robinson
Road.
Pabich suggests offsetting the posts that hold the screen from those that hold the chain
link fence. He then suggests they extend the concrete on the screen area.
Blier asks if a drain behind the concrete will be necessary.
Patrowicz says that he can place crushed stone there.
Pabich states that he doesn't want this project to be seen as a substitution for the
placement of hay bales, given what is happening on the up gradient property.
• Patrowicz agrees and says that it would have to be a condition. He adds that one row of
hay bales is adequate.
Pabich disagrees and much discussion ensues. Pabich states that the screen will do
nothing to stop the silt.
Patrowicz offers to put mirafi fabric in front of the screen.
Blier asks if this will be removed after the up gradient problem has been solved.
Patrowicz states that the screen will probably stay in place.
Duques asks if there has been discussion with the abutters about removing the hay bales.
Mongiello states that the hay bales are all rotten.
Chair Cornacchio ask abutter Mike Hutchinson if he can remove the hay bales.
Hutchinson agrees to allow the abutter to remove them and then put them back.
Pabich states that the hay bales must be operational at all times, and that construction
should occur during a dry season.
• Patrowicz asks if he can show Duques the revised plan addressing the Commission's
concerns and Cornacchio agrees to that. Those concerns include:

• 1. Using a 2" or larger stone size if possible to re-grade the eroded area adjacent to the
stream,
2. Forming a lip in the concrete wall to prevent the screen from flexing,
3. keeping the hay bales and stilt fence operational at all times, and
4. maintaining the screens so long as they are in existence.
Cornacchio opens to the public. There are no questions or comments.
Pabich: Motion to close the public hearing, seconded by Blier. Passes 4-0. Summer
abstains because he was absent at the previous meeting.
Pabich: Motion to issue an Order of Conditions, seconded by Hamilton. Passes 4-0.
Summer abstains because he was absent at the previous meeting and did not listen to the
CD and read the meeting minutes.
4. Public Hearing — Amendment to the Existing Order of Conditions — DEP #64-
417 — Mario Scire, 23 Arrowhead Drive, Saugus, MA 01906.
Cornacchio reads the legal public hearing notice which states that the purpose of this
hearing is to discuss the proposed amendment including additional wetland replication to
compensate for increased fill, changes to construction of a driveway and grading and
footprint of a single-family home at 18 Freeman Road.
• Mary Rimmer, Principal, Rimmer Environmental Consulting, LLC, describes the recent
requests for this property which include: (1) adding 5 trees, (2) amending the replication
area to reflect the filling which occurred along the driveway, and (3) extending the
replication area to include 1.5:1 which goes into a grass swale adjacent to the driveway.
Pabich asks about the original intent of the grass swale.
Rimmer states that it was constructed before she was involved but she believes it was
intended to catch some of the runoff from the driveway.
Pabich asks how much of the property needed to be blasted.
Scire points out the area on the map and states that it went about 7-8 feet below grade.
Pabich asks how the soil on the top of the rip-rap will be secured.
Rimmer states that a planting bed will hold it.
Pabich suggests laying filter fabric on the side of the rip-rap before filling the planting area
and Rimmer agrees.
Blier states that he is satisfied with the plantings that were selected for the site. He asks
• Rimmer if she is satisfied with the replication plans, and she says that she is.
Hamilton asks if a deed restriction could be in placed to prevent the removal of the bushes

• and Rimmer agrees.
Scire states that he is renting the house for one year.
Duques states that the building inspector cannot issue a Certificate of Occupancy until all
permits have been completed. She adds that, if the house sells, Scire should escrow
money until all of the plantings are in place.
Pabich raises the neighbor's concern with the potential for flooding.
Scire states that with all of the snow melting and the rain, the neighbor is still dry and
happy. He adds that the boulders and stumps will be removed from the paper road when
the weather permits.
Cornacchio opens to the public. There are no questions or comments.
Blier: Motion to close the public hearing, seconded by Hamilton. Passes 5-0.
Blier: Motion to issue an amendment to the existing Order of Conditions, seconded
by Pabich. Passes 5-0.
S. Northeast Mosquito Control and Wetland Management
• Duques states that this organization is asking if the Conservation Commission has any
comments before they begin their mosquito control program.
Pabich asks if they substance that is a derivative of marigolds.
Duques says she doesn't know, but are proposing integrated pest management techniques
to eliminate the mosquitoes, which includes introducing fish into the water, which eat the
mosquitoes.
The members agree that they have no comments or concerns, and they are in favor of an
aggressive mosquito control program.
6. Open Space and Recreation Plan
Duques asks if everyone received the Open Space plan.
The members agree that it is a good document.

2. Request for Certificate of Compliance — DEP #64-308 — 12 Swampscott Road,
City of Salem Transfer Station
Alan Hanscom, Consultant with the Beta Group representing Northside Carting, states that
the closing of the Order of Conditions for the landfill has not been completed yet. He says
that Northside Carting is contracted to expand the landfill project, and a new Order of
Conditions will be created for this expansion.
Duques states that the Order has expired, but no work was started on the proposed
project. The Order was also never recorded on the deed. Despite the lack of action an
invalid Certificate of Compliance can be issued in order to create a clean paper trail.
Keith Glidden arrives at 6:10 PM.
Duques confirms that currently residents can drop off their composting at the front of the
site and it is then transported to Plastow, NH. She states that the new Order of Conditions
for the Northside Carting expansion project will be presented on February 14. She adds
that Hanscom can explain an overview of the new plans in order to explain how the
applicant will address the Commission's concerns about the condition of the resource area
at the Transfer Station site. Issuing an invalid Certificate of Compliance will complete the
necessary paperwork for the current Order of Conditions, ultimately closing out the
• project. She reviews the perpetutial conditions.
Pabich expresses concern about possible violations occurring after this Order is closed.

• Duques explains that if the commission has any later concerns about the activities at this
site and a new Order of Conditions has not been issued a cease-and-desist or enforcement
order could be issued for non compliance with the Wetlands Protection Act.
Hancom states that the city is still the owner and will be the applicant for the new order.
Duques confirms that Beth Reynard said that the city is willing to be the applicant for the
new order.
Pabich: Motion to issue an invalid Certificate of Compliance, seconded by Glidden.
Passes 5-0.
Hanscom states that he would like to provide a brief overview of the next project for the
transfer station, and that a full Notice of Intent and presentation will be provided at the
next Conservation Commission meeting on February 14, 2008. He refers the members to
the handout booklet and describes the plans. He states that they have not found any
signs of ground water impact due to the land filling. Following his executive summary he
explains that his description will be more comprehensive at the next meeting.
Pabich asks if the salt storage shed has any runoff protection.
Hansom states that the salt storage isn't being designed now. He states that
• housekeeping requirements, or canopy provisions could be added to the Order of
Conditions.
Robert George with Northside Carting states that he wanted to add the salt shed as a
potential future option for the city.
Blier congratulates Glidden on the completed Open Space Plan.
Glidden: Motion to adjourn, seconded by Pabich. Passes 5-0.

Cornacchio reads the legal public hearing notice which states that the purpose of this
hearing is to discuss the proposed project which includes capping and closing the

Swampscott Road. Work proposed is located within a 200-foot Riverfront Area and 100
feet of an inland bank at 12 Swampscott Road. The Notice of Intent is being filed by the
City of Salem and North Side Carting Inc.
Alan Hanscom of the Beta Group, representing North Side Carting Inc., distributes
information packets and describes the plans. He states that the original incinerator was
built around 1963. The incinerator was shut down in 1968 and the site was converted to a
transfer station in 1975. The transfer station was closed in 2002 due to the violation of an
administrative consent order.
Hanscom states they wish to demolish the incinerator building and stack, cap the closed
landfill, construct a new transfer station, re-pave part of the site, and relocate leaf and
yard waste drop-off/recycling area. He describes the plans stating that erosion control
protections could be built into the construction documents. He states that the capping is
highly regulated so this will be in compliance with the DEP. He adds that he will bring
drawings of the capping to the next public hearing. He says that retaining walls will be
• placed to retain the waste on the site with an embankment with 12 inches of vegetative
growth. Regarding the 200-foot culvert, he says they wish to shorten it to about 140 feet,
which might increase the overland flow which will go into catch basins and pass through a

• water quality treatment.
Hanscom points to the additional paved surface area on the plan. He describes the new
transfer station capacity of 400 tons per day, and states that three environmental studies
are being prepared now.
Pabich asks about the waste across the river stating that he would like it to be pulled out
of the water course entirely.
Hanscom states that the culvert is 4-foot in diameter at the outlet but they will need to
examine this, doing hydrologic calculations.
Pabich asks about the class of the existing pipe. He expresses concern about the
possibility of a failing pipe.
Hanscom states that it looks to be a reinforced concrete pipe, which should have a 100-
year lifespan, but they intend to inspect this pipe to determine its condition.
Cornacchio asks if there has been any new proposals for the DEP.
Hanscom states that there is nothing new but they will keep the commission informed on
their progress with the DEP.
• Regarding Storm Water Management, Hanscom states that there will be storm septor-type
water quality systems, fed by all of the catch basins, then directed to the Forest River. He
adds that the drainage calculations are in the end of the information book.
Pabich states that due to the scope and magnitude of this project, the Commission would
require the plans to be stamped. He adds that he wishes a description of the guardrails.
Hanscom states that he will describe the guardrails. He adds that there will be no
electrical or lighting needs on the site.
Hanscom describes the capping process and states that he will bring a section to the next
meeting.
Cornacchio asks about dust control stating that he prefers they use only water and
Hanscom agrees to this.
Cornacchio states that they prefer the use of Filtrex Socks instead of hay bales and
Hanscom agrees to this.
Pabich asks about a guardrail along the top of the slope along the river and Hanscom
agrees to place a guardrail there.
Hamilton asks if they will abandon the monitoring wells. Hanscom states that they will not
• abandon them and the DEP requires maintenance of monitoring wells for a minimum of 30
years.

• Cornacchio reads the following letters into the record: from Mayor Kim Driscoll, from State
Representative John Keenan, from Al Auto Brokers. All of the letters support the project.
Cornacchio opens to the public.
Dennis Colbert of 37 Clark Street asks about the property lines and Hanscom points them
out on the plan and states that there is some landfill on the abutter's property. Robert
George of Northside Carting states that John Keenan arranged for the city to cap the
landfill on the abutter's property and he is in the process of tracking down the agreement
the landowners have regarding the portion of the transfer station that exists on the
abutters property.
Pabich states that the abutters must be a co-applicant on the NOI and they must be part
of the application unless there is a legal easement on record.
Hanscom states that there is a legal easement.
Chuck Puleo of 5 Freeman Road asks about the runoff causing back-up on Highland
Avenue.
Hanscom states that this will have no impact on Highland Avenue.
Glidden requests that the applicants list the parts of the plans which will not change.
• Hanscom agrees to this and adds that he will provide characteristics of the soil.
Pabich requests they describe the method they will use to restore the riverbank.
Cornacchio requests they schedule a site visit.
The members agree to schedule a site visit on February 23, at 8:00 AM.
Pabich: Motion to continue this until February 28, seconded by Glidden. Passes
6-0.
Old New Business
3. Request for an Extension to existing Order of Conditions — DEP #64-383 — 1-3
East Collins Street, Ward 2 Social Club
Patrick Hagen, member of the Ward 2 Social Club, states that the drain and catch basin
are in and they need to extend the Order.
Duques states that the catch basin is working. She adds that wetland area markers have
been installed and debris has been moved except for one tire.
• Blier asks where the pipe into the basement goes.
Hagen states that there is no pipe leading into that building.

• Duques states that the dumpster has been moved away from the catch basin and closer to
the building.
Hagen states that they will install the plantings when the weather breaks.
Cornacchio opens to the public. There are no questions or comments.
Pabich: Motion to grant a three-year extension to the Order of Conditions,
seconded by Summer. Passes 6-0.
4. Notice of Proiect Change — DEP #64-447 — 60-64 Grove Street — Former Salem
Oil and Grease
Duques states that the modifications to this project include removal of walls and roof of
Cooperage Room located on southern end of the finishing building located along the North
River.
Duques states that the applicant will need to check with the building inspector about
getting a building permit.
Bob Griffin of Griffin Engineering states that erosion controls have been installed and
hydro-seeding is completed, three underground storage tanks have been removed and the
• forth tank was never located after searching for it. He adds that there is a possibility that
the tank was removed much earlier. He says that the sulfurization tanks will be removed
along with a portion of the structure.
Cornacchio asks if the tanks are below grade.
Hubbard states that they are on slabs which are below grade.
Duques confirms that the building goes right up to the canal. She asks if they will work
from the land and pull the material up from the river. She asks if there will be any nets to
catch material that may fall into the river.
Griffin states that a net will be placed there temporarily to catch any debris from falling
into the river.
Duques asks about the plan to remove the demo.
Hubbard states that it will be carted off site in trucks.
Pabich asks if there will be any need for steam cleaning oil from the floor to ensure oil does
not run off into the river. He requests a letter from the LSP to assure there is no need for
steam cleaning. He asks the state of the erosion control around the SESD.
• Hubbard states that it is good.
Pabich states that any debris that falls into the river must be retrieved.

• Duques requests they give 48-hours notice before proceeding with the tank removal.
Glidden: Motion to grant a project change, seconded by Hamilton. Passes 6-0.
S. Notice of Project Change — Neptune LNG Project
Duques states that the modifications to this project include minor shifts in buoy/mooring
locations in federal waters (not under the Commission's jurisdiction) as well as moving up
the construction start date to July 2008.
Commission acknowledges Notice of Project Change and does not require filing of an
amendment.
6. Update on Administrative Consent Order for 15 Robinson Road
Duques states that the DEP sent a copy of the executed Consent Order between the
property owner and the DEP. They will be incorporating the use of a weir, required to
construct a storm water system no later than one year from the date of the execution of
the document.
Blier: Motion to adjourn, seconded by Hamilton. Passes 6-0.

Chairperson Cornacchio calls the meeting to order.
1. Approval of Minutes - February 14, 2008 Meeting
Pabich: Motion to approve the minutes from the February 14, 2008 meeting,
seconded by Glidden. Passes 5-0.
2. Continuation of a Public Hearing - Notice of Intent - City of Salem, 12

Cornacchio reads the project description which describes that the purpose of this hearing is
to discuss the proposed project which includes capping and closing the abandoned landfill
as well as constructing and operating a new transfer station at 12 Swampscott Road.
Work proposed is located within a 200 foot Riverfront Area and 100 feet of an inland bank
at 12 Swampscott Road.
Hanscom states that he has provided Duques with a set of stamped drawings, as well as a
document responding to the questions listed by Duques. He reviews all of these items.
Hanscom states that all of the waste will be incorporated under the cap, and they will
remove 60 feet of culverted river at the upstream end of the culvert.
Pabich asks about the headwall.
Hanscom states that there will be a headwall at about that 74' contour line.
Cornacchio asks if that will compromise the road.
Hanscom states that it will not because the slope will be about 4:1.
Hanscom points out the detail of the guardrail to be placed along the side of the steep
• slopes has been provided as an attachment.

• Pabich asks if they need to have footings along the guardrail that are above the cap.
Hanscom states that they wouldn't put a slab on top of the cap. He adds that he doesn't
think that they have ever done this before. Hanscom mentions that occasionally a
geotextile fabric is sprayed on to create a seal around the footing of the guardrail.
Hanscom and Pabich discuss this issue at length.
Hanscom describes the profile of the cap while referring to the diagram. He adds that they
will use a slope-mix seed for grasses that have a deep root system. He says that this
grass will need to be mowed to avoid having any deep-rooted trees or shrubs set in. He
states that any waste in the river above the water level will be removed and put under the
cap, except for white goods, which will be removed and disposed of properly. He confirms
that the material to be capped is mostly inert, and that borings have been used to
establish the contour plan. Hanscom states that the diagram provided is not correct and
that the rip-rap will go right down to the river and no portion of the cap will be exposed.
Pabich asks Hanscom if he has a sense of the amount of waste that may be under the
water.
Hanscom states that he doesn't know, but the cap will extend below the water and it would
be unusual to have significant waste beyond the cap.
Regarding the existing catch basins, Hanscom states that they will be removed, ground-up,
• and placed under the cap.
Hanscom says that the cape-cod berms will be inspected after each winter to determine if
there has been any plow damage and, if necessary, repaired.
Hanscom references the diagram of the boring sites, stating that there is a lot of sand,
gravel, glass, and slag, but no PID hits or VOCs on the site.
Regarding the abutting storage facility, Hanscom states that a construction easement will
be obtained.
Pabich confirms that this must be done before the Order can be issued and Hanscom
agrees to this.
Hanscom states that there will be no vegetation except grasses. He adds that on the west
side of the property, they can install plantings of the Commission's choice. Blier states
that this area is pretty-well vegetated anyway.
Glidden asks if the road to the future salt shed could be been removed from the plan, and
Hanscom agrees.
Hanscom states that they will use a sock instead of hay bales.
• Dugues asks why they will only sweep only once per year.
Hanscom says they will sweep as necessary, and at a minimum once per year. He adds

• that this could be specified in the Order.
Cornacchio says that he would like to install some work limits zone for the area where the
neighbors will dump their things. He says that the Order should state that this area will be
cleaned-up. He asks if they have videotaped the culvert.
Hanscom states that a registered PE will inspect the culvert to assess its condition and, if
necessary, they will replace or repair it. He adds that the bigger question is how fast they
want the water to pass through that culvert, and they might need to install a 36" or a 28"
pipe there, to replace the existing 48" pipe.
Cornacchio asks what will happen to the ruins from the demolished building.
Hanscom states that the disposal of the ruins is stipulated by the DEP, and essentially they
will remove any toxins, then crush the asphalt, brick and concrete and lay it in the area or
under the landfill.
Cornacchio asks if there are any plans to fuel the trucks there, and Hanscom states that
they will not do any fueling on site.
Hamilton asks if they will recycle any of the concrete, and Hanscom says they will if there
is enough.
• Cornacchio asks if they will save any of the granite, and Robert George of Northside
Carting states that they will save any that they find.
Pabich asks the location of the drainage system to the cap.
Hanscom states that the be will drainage below

He adds that the structures will be below the cap with a one-foot sump. Pabich and
Hanscom discuss this at length.
Cornacchio opens to the public.
Cheryl Budaj of 15 Fortune Way, unit 15, asks about the environmental impact of this
project.
Hanscom says that any asbestos will be contained during removal so there will be no loose
fibers of asbestos. He adds that with the regular building materials there will be dust and
they will spray it with a fine mist to control the dust. He says that all toxins will be abated
under DEP supervision and after completing that clean-up, what's left will include concrete,
brick and asphalt. He states that they have evaluated all of the waste on this site and
there is no environmental contamination, and the ground water is essentially clean.
Pabich says that Hanscom should include specifics on the stormwater system and the
guardrail support.

next meeting.

Cornacchio reads a letter requesting an extension from Attorney George Atkins.
Attorney George Atkins states that this is complicated because there are several deceased
abutters that are still listed as owner and it has taken some time to sort this out. He adds
that some work has already been done.
Duques points out the property on the assessors map.
Owner Kenneth Steadman states that the area next to the street has been roughed out
and graded and a hydrant has been installed.
• Pabich asks for specifics about the land court problem and whether the application was
valid.

Duques distributes photos of the seawall.
Cornacchio states that they did a beautiful job.

6. Notice that Salem Sound Coast Watch in conjunction with Dominion and City

Cornacchio states that he will be heading the clean-up.

• Duques states that the City will go with Landworks Studio Team to design and oversee the
construction of a park at 15 Peabody Street.
Pabich states that the seawall at Cat Cove is falling into the ocean.
Duques states she will look into some grant opportunities, possibly similar to the one used
to repair the Willows Seawall.

Cornacchio reads the legal public hearing notice which states that the purpose of this
hearing is to discuss the proposed project which includes capping and closing the
abandoned landfill as well as constructing and operating a new transfer station at 12
Swampscott Road. Work proposed is located within a 200-foot Riverfront Area and 100
feet of an inland bank at 12 Swampscott Road.
Duques states that David Summer will not be voting on this issue because he was not in
attendance at the last meeting but he can comment.
Hanscom address some of the questions submitted by Amy Hamilton. He states that the
TSS calculation is in the report that was submitted. He adds that they will provide a 4-foot
sump, and the 900-gallon unit requested by DEP removes 80% solids.
Pabich states that the street sweeping requirements should be specified in the Order,
perhaps quarterly at a minimum or as necessary. Hanscom agrees to this.
Hanscom states that the catch basins and the 4-foot sumps will be cleaned annually, with
inspections as required.
Pabich suggests that an inspection for these systems could be scheduled on the quarterly
• sweeping dates. Hanscom agrees to this.
Regarding the guardrail, Hanscom states that they are prepared to penetrate the cap but

use a skirt overlap and bentonite cover with a stainless steel strap attached. He says that
• the skirt could float back-and-forth without ripping up the liner. He specifies that the
guardrail will have a 4-foot depth of embedment.
For landfill gas and venting, Hanscom states that there are no methane gasses so no
venting will be required. He says that he filter bags could be used. Regarding the
salvageable materials such as the granite, Hanscom suggests that the city could retain title
to some of those materials, and those that are not kept will be managed for cleanup.
Glidden asks about potential residue on the inside of the stack.
Hanscom states that they will test the ash within the chimney for heavy metals and, if
detected, it will be properly removed.
Pabich expresses concern about dust rising during the dismantling of the stack.
Hansom states that they will put a tarp over the top and topple it and as it comes down,
they will wet it down. Or they will schedule it on a rainy day.
Hanscom states that the drainage pipes will be above the cap, and will slope to avoid any
freezing inside the pipes.
Pabich asks how they plan to drain any water collecting in a depression in the cap.
• Hanscom states that there will be seepage collars around that portion that will drain into
the storm drains.
Pabich states that pooling water might run down and collect around the interceptor.
Hanscom states that this must be finely engineered because the DEP will not allow any
damage to the cap.
Hanscom confirms that about 1330 square feet of the river area will be opened up. He
states that a hydrologic analysis of the upland culvert area was provided in their packet.
Regarding the existing pipe, if it is found to be inadequate, Hanscoms says that it will be
replaced with an 18 or 24 inch pipe. Alternately, if the 48-inch pipe is found to be
adequate, he says that it will stay in place and they will install a 12 inch pipe at the inlet
which will control the flow into the 48 inch pipe.
Glidden states that part of this area being opened is wetland.
Hanscom states that this is a backwater condition caused by the runoff. He confirms that
the 48-inch pipe is larger than it needs to be.
Glidden expresses concern about the flow management procedure being regulated only by
a smaller pipe.
• Hanscom states that a lot of downstream things could be affected if they open this outflow
too much. He says that there are drainage problems downstream.

• Much discussion ensues regarding the correct amount of flow allotted for this stream.
Hanscom states that he has deferred to the city engineer who has suggested that they
restrict the flow in this way.
Hanscom states that details of the proposed storm scepter is in the submittal along with
the updated stormwater report. He states that they will also remove waste above the
water along with other white goods and other debris, and all of this will be reconfigured
under the cap.
Cornacchio opens to the public.
Betty Yeung of 86 Cavendish Circle asks who will be monitoring this project, to see that
this execution goes smoothly.
Cornacchio states that DEP will monitor and an LSP will be on site.
Glidden states that there will be a preconstruction visit and they will also have to get a
certificate of compliance when the project is complete.
Pabich states that the Conservation Agent will monitor and communicate with the LSP.
Hanscom states that they have sampled and tested material on site and they found no
• methane production or ground water impact, and that it is mostly inert material and
organic material. He adds that they will have daily and weekly reports and they must
certify that it was constructed according to the submitted plans.
Pabich says that he would be happy to include the requirement for weekly site monitoring
by the Conservation Agent, and Hanscom agrees to this.
Chuck Puleo of 5 Freeman Road, a planning board member, asks about the possibility of
dust getting outside of the operations area if the doors are open.
Hansom states that all floor drains will be connected to a sanitary sewer and all activities
will be enclosed within the building.
Chuck Puleo asks what permit is required for this.
Hansom states that they will need to get a building permit.
Paulette Puleo of 5 Freeman Road asks if there will be a compost site.
Hansom states that there will be a drop-off location but the material will be moved off site.
Paulette Puleo expresses concern about any pesticide running out of the compost site.
• Hansom states that a rainfall will not be enough to cause leaching of the pesticides. He
adds that a water quality swale will stop the runoff.

• Chuck Puleo asks if the compost could be dumped into an area where it would not need to
be handled twice, perhaps into a container.
Hanscom states that the trailers are too tall so this might not be very feasible. He clarifies
that the compost pile will be out back, across the river.
Duques asks about pretreatment or the water quality swale.
Hanscom states that the pretreatment is the swale itself and the water will be stopped and
will infiltrate into the ground.
Dennis Colbert of 37 Clark Street asks about snow removal.
Hanscom states that they will store the snow on the other side of the guardrail where it will
be allowed to melt. He adds that no salt will be used. He states that in an extreme snow
year some snow may need to be removed.
Pabich suggests having a designated area for placement of excess snow.
Paulette Puleo asks about the likelihood of having a ruptured diesel tank.
Hanscom states that the storm center will catch all of the runoff and then it can be
• pumped out.
Glidden asks if the 24-inch pipe were to be installed, would there be any retention.
Hanscom states that there might be.
Glidden expresses concern about a possible problem with the water retention.
There is more discussion about the stream.
Glidden suggests replacing the 48-inch pipe, if it proves to be unsound structurally, with
another 48-inch pipe, and add the controlled orifice. This way, if the city wishes to open
this flow in the future, they can just remove this orifice. Hanscom agrees to this.
Beth Rennard CitySolicitor, states that the have a construction agreement with the

abutter. She suggests they add a condition that the abutter be listed as applicant on the
notice of intent as well as a letter granting a construction easement.
Pabich states that there should be a condition that the applicant appear before the board,
with final plans, prior to construction.
Glidden: Motion to close public hearing, seconded by Pabich. Passes 4-0. Summer
abstains.

Glidden: Motion to continue this hearing until May 8, 2008, seconded by Blier. Passes
5-0.
Old/New Business
4. Shetland Office Park and Pickering Wharf Realty Trust to discuss snow
management
Attorney Scott Grover introduces Tom Kent, Property Manager of Shetland Office Park. He
states that Shetland did not know that the dumping of the snow into the ocean was
disallowed, and once they learned this, they stopped immediately. He says that now they
plow the snow to an area adjacent to the ocean and then blow it into the resource area,
and they stockpile some of the snow on the west side of the site.
Grover states that he looked up the DEP guidelines for dumping snow. He distributes the
• emergency guidelines. He says that he as deemed that these guidelines can go into effect
whenever the city declares a snow emergency.
Pabich disagrees and states that the city uses the snow emergency to get cars off of the
street so they can plow.
Grover says that the problem with storing snow on the west side of the site is that it
attracts kids from that neighborhood.
Summer states that he can't justify blowing snow into the resource area just to save some
parking spaces.
Grover states that these parking spaces are leased to tenants, such as the registry of
deeds.
Summer states that they can cart the snow away as all of the shopping centers do.
Grover states that the city should designate a site for snow removal.
Shetland Manager Tom Kent states that he is afraid to attract kids from the neighborhood
because this could present a hazard.
• Cornacchio states that the Hawthorn Hotel carts all of their snow away.
Much discussion ensues about the proper snow removal procedures.

Duques agrees to consult the DEP about this.
The members agree to waive the $200 fee.
Grover agrees to look into the best substance to add to the sand.
Pabich requests a letter outlining Shetland's snow removal policy.
5. Discussion of proposal for public access signage
Duques provides photos of all of the public right-of-ways, and states that the Conservation
Commission Approved this sign to be placed on Winter Island Road and on Bay View Ave.
Glidden suggests marking only those sites that are accessible. He states that they should
prevent having the public violate private property rights. He says they should place some
gravel on part of the path, and the sign should allow only foot traffic. He clarifies that they
should only put signs on the paths that have been demarcated.
Cornacchio suggests looking into grant money for this.
Duques states that they need to create a sign that complies with the city's signage
program. She agrees to speak to the signage committee about a possible design, and to
• look into obtaining grant money.
Blier cautions against making a claim that any path is accessible if it is not ADA compliant.
Pabich suggests having the signs like those in Beverly which state, "Please enjoy this public
right-of-way".
Glidden suggests having the sign specify "for paddle craft or for foot traffic".
The members agree to discuss this further after Duques has received additional
information.
6._Request to purchase Topographic maps to create GIS mans showing
intermittent and perennial streams
Duques states that the maps might cost between $12 and $60.
Pabich: Motion to approve the purchase of maps, seconded by Glidden. Passes 5-0.

.Chairperson Cornacchio calls the meeting to order.
Old/New Business
1. Barbara Warren to discuss potential proiect at Forest River Park and provide
an update on the Pickman Park Rhraamities eradication project
• Duques states that Barbara Warren is interested in removing a pipe near Pioneer Village.
Warren states that this pipe breaks up at times, and it isn't operational.
Duques says that they might go through the process of an RDA.
Warren states that she would like to try to cut one section at a time and remove it where it
is closed.
Cornacchio states that the pond does get dry, but usually only in August.
Warren says that it is only a retention basin.
Pabich suggests that she remove the entire pipe. Pabich says that this should be exempt
under utilities.
Duques says that this would be buffer zone work. She offers to write a letter and send it
to DEP. She asks about the end that once connected to Pioneer Village.
Warren states that there is no end there now.
Pabich states that it is basically debris on the beach if it is not connected. He suggests
getting it at moon-low tide.

• Duques states that because this is covered during high tide it is considered a resource
area. She reviews the area on utility exemptions.
Warren provides an update on the Pickman Park project with the elimination of
phragmities. She says that most of the work is done but it is taking longer that they had
planned. She states that they will be doing their North River Awareness Week.
Warren says they are looking into planting willows on the North River bank near Harmony
Street.
Cornacchio states that during the early 1900s there were many willows in that location.
Pabich asks if there is any vehicle for replanting native species. He adds that they would
need an Order of Conditions.
Duques suggests an RDA.
Cornacchio agrees.
Warren says they will be working on Furlong Park to get ideas for improvement.
Cornacchio says that it was once a city dump so they can't dig there.
• Warren confirms that they will not be digging anything there. She says there might be
eels and other fish in there, and they would like to cut the phragmities in the streambed to
allow any fish to pass. She states that they will examine the area in the spring to see if
any water is coming out, and if not, they won't do anything. She offers to contact Duques.
Duques agrees to check on the exemption questions and get back to Warren.
Warren asks her to check to see if they can cut the phragmities.
Pabich states that the commission should do an RDA for the pipe removal and waive the
fee because it is an improvement project.
Cornacchio advises Warren that they will have an answer for her at the next meeting.
2. Request for a Certificate of Compliance — DEP #64-222 — 43-45 Valley Street
Duques states that the property owner at 45 Valley Street is selling their home and
learned that there is still an open Order of Conditions. She presents a plan of the
property, stating that the Order of Conditions was issued in 1995 and 43 and 45 Valley
Street are on the same Order of Conditions. She says that there is an in-ground pool at
43 Valley Street. She presents photographs for the members to review. She points out
trash and yard waste at 45 Valley Street.
Pabich states that all of that debris must be removed so it won't leach into the wetland.•
Duques says that she advised the seller's attorney that they can not issue a full Certificate

• of Compliance. She says that there was a request for a Certificate of Compliance in 1996
and she doesn't know why it was never issued.
Pabich asks if they can do a partial Certificate of Compliance, and Duques says they can
but the yard must be cleaned up first.
Cornacchio asks if Duques wishes to give them a Partial and have them clean the debris
with an after-the-fact RDA, and Duques says yes.
Duques says that a building permit was issued for the pool by the building department.
Cornacchio states that the city should not have issued the permit for the pool, and they
should have caught this.
Cornacchio summarizes by stating that they can issue a partial and file and after-the-fact
RDA.
Pabich suggests they issue a full Certificate of Compliance for the work that was permitted
and done, and then issue another RDA for the subsequent work.
Cornacchio says they might issue a full Certificate with the condition that they clean-up the
yard.
Hamilton states that it would be unfair to the buyer of the property if the seller receives
the Certificate of Compliance with the condition to clean up, and they sell the house before
cleaning up. She says that the commission would be forced to take disciplinary action on
the buyer and it will not be his fault.
Much discussion ensues about the commission's options with this issue. The members
agree to issue a Partial Certificate of Completion with the condition that they clean the
debris out of the yard.
3._ Request for an Extension to existing Order of Conditions — DEP #64-392 —
Cedarcrest Avenue — three lot subdivision and construction of 3 homes
Cornacchio reads a letter requesting an extension to the Order of Conditions.
Duques states that she visited the site and the project consists of three new homes, two of
which are completed and the third is under construction.
Pabich: Motion to approve a one-year extension for this Order of Conditions,
seconded by Hamilton. Passes 4-0.

Cornacchio reads a letter dated April 3, 2008 from Doug Boland, Chair, Parks and
Recreation Services, which supports the removal of the pipe. He states that the city has
completed a WPA Form 1.
Barbara Warren, of Salem Sound Coast Watch, says that the pipe is not that long, about
30 feet, and it is actually two pipes that are connected.
Pabich suggest that she begin at the mud line and get the downstream pipe first.
• Warren says they will do it on April 24 or 25.

Pabich suggests attaching it to a chain on a truck and pull it up.
• Cornacchio suggests using a nylon strap, not a chain.
Glidden suggests breaking it open and digging out the sand.

Taormina recommends that the approval show in parenthesis that this project is a
"temporary disturbance, betterment project".

Cornacchio reads the legal public hearing notice which states that the purpose of this

Dave Anderson, for FST Engineers, provides green card receipts to Taormina, and a letter
of information regarding the project. He states there is no shellfish habitat on the site. He
says that this is prime territory and heavily used. He explains that a steel sheet pile
cofferdam and silt curtain will be place around the perimeter in order to isolate the entire
project, and the water will be pumped out of there. He states that about one-third of the
cost of this project is going toward protection. He requests that the commission not to
demand too many additional costly controls on this project, which is already an isolated
area.
Anderson states that they will steepen the ramp to about a 15% grade on the end, and
install prop watch pads. He adds that the ramp width will increase to 30 feet, and they will
add floating boat docks near the ramp. He says that this new ramp will have riprap,
similar to the existing ramp, to protect the sides, and they will add areas of concrete fill.
He states that there is spartina on one side of the ramp and this must be considered while
locating the cofferdam. He says that the cofferdam will be designed by the contractor.
Cornacchio asks what is below the mud line.
• Anderson states that there might be some ledge and he has provided a detail for setting

the pilings into the rock by drilling. He says that this is a 4-6 month project, costing about
• $500,000.
Pabich asks what will prevent the prop wash area from silting over.
Anderson states that it might silt over.
Pabich says that it would be bad if the ramp silted over but might not be too bad if the
prop watch area silted over.
Anderson states that the silt will be removed and properly disposed during the
construction. He states that there will be trucks and stockpiled materials on the site.
Pabich states that this NOI should be conditioned with having a presentation with the
contractor, who will describe his project in detail.
Anderson suggests that the NOI require that the developer follow his outline of standards.
Pabich agrees to use this document and iterates the need to have the contractors come
before the commission.
Glidden agrees and states that contractors need to appear before the commission to
confirm the need to follow these standards.
• Taormina suggests having a pre-construction meeting at the commission's regular
meeting, and the members agree.
Pabich states that the document is very thorough.
Cornacchio opens to the public. There are no questions or comments.
Cornacchio suggest scheduling a site visit on Thursday, April 24, at 4:30 PM.

Cornacchio states that the homeowner has worked closely with Duques to comply with the
regulations, removing trash and debris from the drain and the surrounding area.
Pabich suggests using an expedited process (simplified NOI), or an RDA, if appropriate.
Glidden says the applicant can take advantage of the current regulations.
• Taormina says that this could be done with an RDA, after the fact.

and let Duques determine which process will be used for approval of this project.

Cornacchio states that there was a site visit today at 4:30 PM.
Blier was absent from the last meeting but signs an affidavit confirming that he listened to
and read the meeting minutes. By signing this affidavit he is able to vote on the item.
Engineer David Anderson completes an overview of the project. He explains that there will
be a slight widening of the ramp and pile-held floating docks will be installed on one side.
He states that there will be a cofferdam and floating silt curtain around the work area, and
then that area will be de-watered. He adds that he as stipulated additional measurements
that the contractor will follow during the project, and the contractor will meet with the
• Conservation Commission prior to the start of the job.
Blier asks Pabich for some clarification on his concerns as noted on the recording.

• Pabich states the contractor must clarify his method of de-watering and other obligations
in the contract. He explains that he has a concern about whether the prop wash area will
silt over, but acknowledges that it may not create a problem
Glidden asks if there is a scouring situation.
Anderson says there may be some scouring in some areas.
Cornacchio states that it is a well-considered plan. He adds that he wishes to have spill
absorbents placed in the site.
Duques says that the Standard 8 document should contain a requirement for the use of
spill absorbents as well as other staging criteria.
Anderson requests that the language in Standard 8 be specific enough yet not impose
some unrealistic guidelines. He adds that he mistakenly included that vehicle fueling will
onlybe done off site. He requests to strike that from the document.

Duques suggests that the document allow fueling within a specific location on site.
Pabich suggests they require the contractor to advise the commission of the fueling
procedure.
• Cornacchio opens to the public. There are no questions or comments.
Pabich: Motion to close the public hearing, seconded by Glidden. Passes 4-0.
Glidden: Motion to issue an Order of Conditions, seconded by Pabich. Passes 4-0.
The members agree to require adherence to the Standard 8 document as proposed and to
meet with the contractor for further clarifications on how he will meet all of the obligations
for in this document.

National Grid (KeySpan Facility) beach capping, Wait and Pierce Streets.
Cornacchio introduces Ken Lento of EECS and Jason Naiden of National Grid.
Ken Lento with EECS states that he is looking for a one-year extension, and they will do
more monitoring next month. He adds that a roadway has been installed and the area has
been replanted. He says that all of the beach work is done, and the boom is no longer
there.

Duques states that she was on the site and it was completed according to the
commission's request.
Glidden asks what is happening underneath there.
Duques states that it is eroding in the area where the ledge stops. She adds that the
Karam's want to work with the city to improve that area, but they wish to close out this
project before the begin the next. She says the will file a new Notice of Intent and the

have left the hay bales there in case of an April storm and to protect the area of future
work.
Duques says they will use Hayes Engineering. Much discussion ensues about the method
for treating the erosion.
Pabich suggests they re-grade the eroded area to create a gradual transition between the
coastal bank and the lawn.
Glidden suggests waiting to see how the erosion issue will be addressed before issuing a
Certificate of Compliance. Alternately, he suggests issuing the Certificate of Compliance
and using the Enforcement Order as a means of remediation.
• Pabich says that this was just an eroding path and it is the property of the city. He
suggests stabilizing it with vegetation rather than armor.
The members agree that they will not issue a Certificate of Compliance and they will ask
the Karam's to file an NOI with the city to correct the erosion issue.
S. Notice of Project Change, DEP #64-467, 3 Everett Avenue, in-kind
replacement of existing stairs
Duques states that this project was filed by Scott Patrowicz. She presents photos of the
site.
Cornacchio states no vote is required on this. The Commission members agree that there
is no problem with this change.
6. Update on construction taking place at Bridge Street, East and West Ramp,
and North Street. Soil boring to be obtained during late April/early May.
Duques states that the Commission approved a negative determination for installing the
traffic lights, and the soil boring will be obtained soon.
The members agree that no measures need to be taken by the Commission at this time.
• 7. Other Issues

Duques states that the 15 Peabody Street Park project will have a public meeting on
Monday. Cornacchio states that the park might be named the Walter Power Memorial
Park.
Pabich states that a letter should be written to the contractor about the soil piles on the
Salem-Beverly Bridge, and they should be fined. He adds that it should be faxed, mailed,
and hand-delivered. Duclues clarifies that the fine will be $200/day beginning at the
receipt of the letter.
Glidden states that the ferryboat launch parking lot looks like a disaster area, and that the
gate was open and there are torn-up areas, and there are no garbage receptacles. He
says this is an area they should pay attention to. Cornacchio suggests putting Big Belly
solar-powered trash cans there.

hearing is to discuss the proposed remediation and construction of a park at 15 Peabody
Street located within a Riverfront Area, land subject to coastal storm flowage, and buffer
zone to coastal bank.
Blier recuses himself from this item.
Cornacchio states that this item will be recorded and those members who are absent
tonight will listen to the recording and be eligible to vote at the next meeting, per the
Mullin Rule.
Susan St. Pierre of Vine Associates states that the design must be completed by June 1,
2008 in order to comply with the rules of the funding grants. She adds that this project
will run in tandem with the Harborwalk, and it might be possible to bid the two projects
together. She shows the plan and describes the existing condition of the properties, stating
that it is an L-shaped parcel with the entire site located in the riverfront area, subject to
coastal storm flowage and buffer zone.
St. Pierre says they are proposing the installation of 4 additional piles to extend the
• walkway out in the same manner as it is at the Mass Electric site. She adds that they
propose to keep all storm drainage on site, using the two existing pipes, one of which
outflows into the South River. She describes the re-grading plans stating that there will be
a low area for water retention and a mounded lawn area. She explains that a railing will
be installed along the seawall and, if future funding is available, a dry dock will be
installed.
Letitia Tormay from Landworks Studio states that there are two concrete plazas connected
by a walkway, a tot-lot with a poured flat rubber surface pitched into the low area, which
will accommodate drainage. She adds that the plantings are low maintenance.
St. Pierre shows the plantings, and photographs of the site. She states that there are
some hot spots, mainly petroleum, on the site and they will be removed down to three
feet.
Tormay shows the sections and describes the varying grade.
Pabich asks for a description of the manner in which the contaminates will be removed.
St. Pierre says they will be implementing best management practices and an LSP will be on
site. She adds that hot spots will be dug out and removed to 3 feet and properly disposed
of.

be no barrier. Tormay adds that the rubber surface used for the tot-lot will ensure that
the children cannot dig in there.
Tormay states that there will be a mosaic wall to block the view of the electric company,
and a light-weight roof system to shelter the rain. She adds that the wall can have a
movie screen component. She describes the lawn is a mix of 6 fescue grasses, which
needs mowing only once a year.
Glidden asks if the low area will be 1.5 feet lower, and St. Pierre says that it will.
Paul King of Vine Associates shows the plan for the water collection area and describes the
plan to grade everything into this low area. He states that most of the surface materials
will be grass with some bituminous material. He adds that currently the lot has a very flat
surface.
Cornacchio asks about he seawall.
King states that there are plans to repair parts of it under the Harborwalk Project.
• Glidden asks if there are plans for garbage receptacles.
St. Pierre states that there will be two solar powered trash compactors.
Glidden recommends there be three trash compactors, and Pabich agrees. Glidden asks
about snow removal.
King states that there might be snow removal along the concrete walkways.
Glidden suggests a condition that the snow will not be dumped into the river.
Duques asks about the runoff from the adjacent parking lot.
King distributes a plan and explains that the parking lot will pitch toward a gravel area and
there is a mound between the park and the parking lot to prevent water flowage into the
park.
St. Pierre agrees to ask the bank where they will put their snow.
Pabich states that he wishes to see an erosion control plan and the procedures for the
clean up. He adds that many of these details will be conditioned in the NOI.

Duques states that the commission held off on the issuance during the last meeting
because the commission wanted assurance that the NOI will be filed. He adds that she
received an NOI today for that work. Duques states that the City Council needs to vote to
allow a landowner to do work on city property.
The members discuss the correct procedure to use with this application.
Duques states that tonight the Karams are looking to close out this item with the hay bales
in place because there is a submitted NOI.
• Glidden says that if all of the hay bales are removed with the exception of this along the
new work site, he has no problem with issuing a Certificate of Compliance.
Property owner Douglas Karam states that he is willing to make a donation to the city to
stabilize their land in order to stabilize his own land.
Pabich says there is some concern that the activities that they completed might have
exacerbated the erosion problem on the city property.
Jean Karam states that the work that was completed did not impact the city property
because they did not raise the grade and they seeded the lawn.
Much discussion ensues regarding the completed work.
Cornacchio states that he has no problem issuing a certificate.
Pabich states that technically they shouldn't issue the certificate until a new NOI is
authorized. He asks the Karams if there is an issue with the issuance of the certificate.
Jean Karam states that this is emotional and she feels that she would like to have it closed,
and that she and her husband were the first ones that called attention to the erosion issue
on the city property.
• Glidden explains the legal guidelines regarding the NOI issuance and the powers of the
commission. He adds that the Karams must get all of the signatures on the new NOI prior

was at the North River, he definitely will not make the same mistake. She says that she is
looking for permission for them to work on the selected 13 structures.
Pabich expresses concern about something going wrong if this project is not properly

Susan St. Pierre from Vine Associates describes the park, which has a concrete plaza at
Peabody Street and a walkway leading to the pile-supported harborwalk on the river. She
states that there will be an elevated lawn and a tot lot, and a half-mosaic, half-green wall
along the outer edge of the property, and the contaminated areas of the parcel will be
remediated.
Cornacchio asks about the hot spots and the remediation methods.
Matt Robbins from TRC Corporation speaks about the remediation of the contamination
issues, and distributes material detailing the history of the site and plans for the clean-up.
• He makes the following points:
The property was a coal fire and electricity generation facility.

• • Three studies of the material on the property found low levels of petroleum related
materials.
• Area 1 has some collapse in the retaining wall.
• There are some areas with contamination levels exceeding excavation standards,
and some capping might be done.
• TRC will oversee the clean up to ensure compliance with the EPA standards and the
commission's conditions.
• For the remediation, the area will be closed with a chain-link fence.
• A backhoe will remove the contaminated material and load it into trucks or stockpile
it on one end of the property near Peabody Street.
• To control the dust the area will be sprayed with a minimum amount of water. By
limiting the water there will be no runoff.
• They will then backfill with clean material.
• The volume estimate for removal is 850 yards.
• All of the groundwater on the wells has been tested and is below the state clean-up
standards.
• The monitoring wells will be removed.
• Fuel tanks were removed in 1990. That is a closed environmental clean-up project.
• While drilling to obtain soil samples some layers of concrete were discovered.
Pabich asks about the seaward side of the walk if there will be tidal action bringing
contaminated materials into the water.
• Robbins states that there are impervious materials at the wall and these materials do not
lend themselves to leaching, so he sees no opportunity for contaminated materials to leech
into the water at this point.
Robbins states that these procedures will be submitted to EPA and there will be a public
comment period and the board can review this report and ask any questions they may
have.
Civil Engineer Paul King of Vine Associates distributes the erosion control plan and states
that the land is flat and they will be able to contain the water within the site. He says
there will be a security fence around the perimeter and they may put siltation fabric on the
fence.
Pabich asks how they will manage the truck access with the erosion control on site. He
suggests they install a clean gravel berm to keep the water on site.
Blier says that the sidewalk will enclose the entire area of contamination.
Pabich suggests placing a berm on the outside of the sidewalk.
Cornacchio asks if the 8-inch drain will be undersized.
King states that this may not be the main outlet, it might be just an overflow pipe.
• Pabich asks the depth of excavation in area 3.

• Williams states that the depth will be 4 feet.
King states that they will locate the pipe and encase it.
Cornacchio asks if there will be an LSP on site and King says that there will be.
Pabich states that the 8-inch pipe should not be in a contaminated site.
Robbins states that it will have no impact during the excavation, but they must be aware
of it so they won't break it.
Pabich states that this pipe was probably not engineered.
King agrees to look into that.
Cornacchio asks about the trees on the property.
Letitia Tormay of Landworks states that the trees on the property will stay and outside the
property there will be lower plantings.
Summer asks when the project will begin.
Robbins states that the remediation will begin in October or November.
• Cornacchio asks if the DEP has any comments, and Duques says they have "No Comment".
Robbins states that they would not have the trucks back over contaminated areas.
Cornacchio states that they could use a truck wash within the bermed area.

riprap to stabilize the city-owned property on Winter Island Road owned. He states that
the existing riprap is failing, causing the erosion. He says they will make a 1/1 slope with
quarter-ton boulders lying flat, backfilling with pervious material.
Cornacchio asks if they will need to be anchored and Williams says that they will not need
to anchor the boulders.
Duques states that David Knowlton signed the NOI because this property is owned by the
city. She adds that Knowlton has visited the site to review the project and he approves of
the plan.
Glidden asks if there is ledge under the edge.
Williams states that the ledge will be anchored by the first boulder, and they will not need
to go into the ledge.
Cornacchio states that he would prefer they used something better than iron.
Williams states that they have coated steel which lasts a long time. He states that they
• intend to follow that slope and there is a bowl in there and it does flatten out in that bowl.
He says that the top of the wall will meet with the grade.
Pabich asks how the boulders will stay on the ledge at the north end of the right-of-way.
Williams says they will have to find boulders that will fit into that rock. He adds that they
are working with Ken Steadman.
Cornacchio expresses concern about not having the boulders adequately anchored.
Williams says they can either get the right rock to fit in there correctly or they can have a
mechanical means to fasten the boulders.
Cornacchio asks if they will cut into the bank.
Williams says there might be some need to removed some of the bank to place a stone in
there, but there will be no mass excavation. He states that they will have to do it with a
thumb to do it correctly.

line up to the boundary to the city-owned land.
Blier asks for clarification about the indemnification agreement.
Doug Karam clarifies the indemnification agreement stating that it was an access
agreement, and it stated that the Karams would be responsible for all future activities that
occurred on the city's property.
Summer suggests they make a donation to the city for the work.

Glendale Street. Salem, MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the reconstruction of a dock and the removal of a marine railway at
23 Glendale Street.
Attorney George Atkins of 59 Federal Street speaks for the owner, Fred Atkins. He
explains that the old railway, which had been used for launching boats, will be removed as
will a portion of a permanent dock and approximately 32 pilings.
Peter Ogren of Hayes Engineering describes the plan and states that 40 feet of permanent
pile pier will be replaced with 2 new 40-foot floating sections anchored to existing pilings.
He estimates that up to 8 pilings will need to be replaced and will be done in-kind. He
adds that the marine railway, with wooden cribbing in the ground, will be removed. Ogren
states that most of the old pier can be removed with a crane and the very end of it might
need to be removed by equipment on a barge.
George Atkins states that all of the floating docks are removed every fall and returned to
the water in March or April.

Fred Atkins states that the timber cribbing rests on piles and the piles, with creosote, will

Cornacchio confirms that there will be some waterside work with a barge.
Cornacchio opens to the public.
Ward 3 City Councilor Jean Pelletier speaks in favor of the project and speaks to the good
character of the Atkins.
Cornacchio suggests a site visit at 5:00 PM on July 24, 2008.
Glidden: Motion to continue until July 24, 2008, with a site visit on the same day at
5:00 PM, seconded by Hamilton. Passes 5-0.
3. Public Hearina — Reauest for Determination of Aaolicability — City of Salem,
120 Washington Street, Salem, MA 01970 •
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the sediment sampling in the South River.
Planner and Harbor Coordinator Frank Taormina introduces Jay Borkland and Chris Morris
of Apex Companies.
Borkland states that this RDA will be only for collecting samples and based on these
samples Apex will determine where dredging is necessary. He states that there might be
elevated levels of contamination in the channel, and they intend to take a higher density
sampling in the basin.
Chris Morris distributes the proposed sampling plan.
Borkland states that Chapter 404, Army Corps of Engineers, will be the keeper of the
permits. He says they may use a drop tube sample and they probably will not need
vibracore (a similar tube that vibrates into the floor).
Glidden suggests sampling adjacent to Derby Wharf at the centerpoint where
sedimentation appears to be occurring based on the bathymetric survey shared with the
Commission. He asks if the higher points (shallower areas that have suffered from
sedimentation) along the wharf are from sedimentation from the river or if it is debris off
of the wharf. •

Borkland states that sediment might flow in from the channel or river. He adds that GPS
• will record the sample locations. He says that this is leading up to the beginning of a
permitting process.
Morris states that it will take 2-3 days to take the samples due to tide changes.
Borkland states that because of the Friendship having some problems moving through the
channel, the National Park Service might have an interest in contributing to this project.
He adds that the project is being funded by the Seaport Advisory Council.
Cornacchio opens to the public.
Jean Pelletier thanks Frank Taormina, and speaks in favor of the project stating that this
will bring in more tour boats.
Cornacchio says that a Negative 2 Determination has been recommended and the
members agree.

Ward 3 City Councilor Pelletier thanks the Commission for moving forward with the culvert-
cleaning program, stating that he will create ordinances to ensure that this work continues
annually. He adds that there is a noticeable improvement in the drainage for some of the
culverts that have already been cleaned.
4. Public Hearina — Reauest for Determination of Aoolicability — Matthew Merritt,
15 Parallel Street, Salem, MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the construction of a deck located within the buffer zone of a
Bordering Vegetated Wetland.
Cornacchio confirms that Matthew Merritt already began the project, poured the footings
and repacked the soil and spread any loose soil under the deck. He adds that the
commission allowed him to continue his project at the last meeting, but required Merritt to
return to this meeting for an RDA.
Duques states that she and Tom St. Pierre stopped by Merritt's home because she heard
that work had begun. She determined that Merritt was 30 feet from the high water line,
and Cornacchio says that he wishes to treat Merritt in a way that is consistent with other
applicants, hence the RDA. Duques reminds Merritt that he needs to check with her if he
plans to do any additional work. She explains that this is a negative determination, which
means that Merritt will not need to follow up with any additional filing.
• Merritt states that he will put lattice or some type of skirt to finish the under section of the
deck.

Paradise Road, Swampscott, MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the temporary installation of sculptures in Hawthorne Cove and

Ken Reker states that he teaches at Salem State College and is looking for alternative
outdoor venues to exhibit sculpture for one or two weeks at a time. He adds that these
sculptures are not too big and the floating sculptures are secured with rope.
Cornacchio confirms that the sculptures will not go out beyond the bulkhead located in
Hawthorne Cove.
Reker states that the sculptures are made out of PVC pipe, decking lumber, hard lumber,
rubber, and some other materials. He states that he and students will place the sculptures
into Hawthorne Cove via a row boat. The sculptures will be secured to a concrete block •
which will serve as the anchor. Reker confirms that when the sculptures are removed the
concrete blocks will be removed as well.
Glidden suggests that Reker ensure that appropriate knots are used to secure the
sculpture.
Cornacchio asks if vandalism is a possibility.
Reker states that he doesn't think so, but it could happen.
Glidden suggests that he put the police on notice so they can be aware of this and keep an
eye on the sculptures.
Blier says that it is important that the students take a closer look at the material that they
use to create the exhibits. Since they will be temporary there is concern that the materials
may degrade and decompose easily ultimately getting into the food chain. He and Reker
discuss student responsibility and how the exhibits could be designed with ecologically
friendly materials.

Duques states that the commission issued an Order of Conditions on July 14, 2005 to Tony
Tiro, and he is requesting a 2-year extension for the sewer line which is completed but not
yet connected to the homes. She adds that he is ultimately planning to construct a home
on lot #732.
Cornacchio asks if there was any erosion beyond the boulder wall, and Duques says that
she hasn't seen any. She states that the boulders are still up against the trees but the
trees are alive.
• Tiro states that the boulder wall was on the lot when he purchased the property. He says
that the house will be completed within the next two years.
Cornacchio reminds Tiro to leave the silt fence in place until Duques advises him to remove
it.
Duques states that Tiro would not have to file a separate NOI for the house, unless work is
completed within an area subject to the Commission's jurisdiction.

zone to bordering vegetated wetlands at 100 Swampscott Road.
Duques provides an update stating that they received a special permit for a non-
conforming use to allow electric go-carts, and the hours are restricted, and no music will
be allowed. She adds that they will come back to the commission on July 24 and the plans
have only changed slightly and there will be no gasoline storage area, but they will need
• permission to culvert the stream.

Cornacchio recuses himself and Glidden replaces Cornacchio as Chair for this issue.
Hamilton also recuses herself.
Steve Damiano, Senior Project Manager, Environmental Scientist, from TRC Environmental
speaks about his project and states that they will use a boom as a precautionary measure.
He says that there was a filing for a Determination over 3 years ago, but that the work is
maintenance activity. He asks that the commission make the determination that this
project complies with the exemption and therefore would not need to re-file a RDA.
Glidden confirms that there is not a formal process that finds that a project is exempt.
Duques states that typically if a project is exempt she requests that the property owner
submit a letter to her stating the activities which she reviews and then follows up with a
letter agreeing that the activity is exempt, cites the WPA, and issues a notice to proceed.
Glidden states that he is fine with this. Summer and Blier agree.
9. Potential encroachment onto land owned by the Salem Conservation •
Commission off of Highland Avenue
Duques states that she hasn't approached the property owner but asks the members if she
should send the owner a letter requesting a site plan. She shows the aerial photograph.
Glidden suggests sending a letter indicating that there is a possibility that he is trespassing
on city property. He adds that she should inquire about the city being willing to conduct a
survey prior to writing the letter.
Summer says that if there is a minimum set back requirement for the pool, the onus might
lie with the property owner to get the survey.
Duques agrees to complete some additional research and will then update the Commission
and potentially follow up with a letter to the property owner if it appears that there is
trespassing.
10. Request for a Certificate of Compliance - DEP #64-388 - Lionel Pelletier, 7
Brooks Street - Construction of a single family home, driveway, and associated utilities
Duques shows the as-built and the approved plans and reminds the members that the
finished driveway is curved and the approved one was straight. She adds that the shape
of the house changed, and they landscaped the berm. •

11. City of Peabody Flood Mitigation Proiect
Duques states that there are 3 projects, 2 in Peabody and 1 in Salem, and there will be
widening of the North River, up to 38 feet, from Howley Street to Grove Street. She adds
that the project falls under Army Corps of Engineers 205 program, and is being peer
reviewed by Woodard and Curran.
Glidden states that this work might cause the Salem end of the river to have more
flooding.
Duques states that they will start with area #2 and then do area #1 and, at some point,
get to area #3. She agrees to draft a letter for the Commission to review before the
comment period ends on August 15, 2008.
12. New Member, Rebecca Christie
Duques advises the members that the new member, Rebecca Christie will begin at the
next meeting, and she would like to buy her a handbook at the cost of $67. The members
agree to this.
Duques states that the annual MACC membership dues is $332. The members agree to
this.

Wetland Scientist Bill Manual reviews the current conditions for the "Castle Creek
Adventure Land", which includes miniature golf. He states that he flagged the wetland
resource areas and points out those areas on the plan. He says that the intermittent
stream has a watershed area of less than 'A mile. He presents recent photos of the
stream in a no-flow state as proof that this qualifies as an intermittent stream.
Manual describes the plans for the go-cart track using electric powered go-carts, which
require no gas and make no noise. He states that they will alter a small portion of the
isolated wetland, but they are incorporating a retaining wall. He adds that they are
digging out about 1250 square feet of wetland and salvage any plant that they can and
relocate them, and then replace the dead plants. He says they have applied the
performance standards as if this is BVW, even though it is out of state jurisdiction.
During the work process, Manual says they will use sand bags and a pump-around. He
states that the habitat value of this area is low because there are no banks. On the
parking lot, he says they are leaving the surface gravel and installing a catch basin swale.
• Cornacchio asks if there is concrete pipe in the center of that.
Engineer Chuck Faia says that they cleaned it up and removed the pipes many years ago.
Cornacchio asks what material will be used for the pipe.
Faia says they will use 24" reinforced concrete pipe and all of the fill will be crushed-stone
gravel.
Duques asks where the photos were taken.
Owner Dana Dilisio points to the areas on the plan where the photos were taken, upstream
from the foot bridge.
Duques says that DEP sent a letter stating that the project cannot be permitted as
proposed because it does not meet Performance Standards for 310 CMR 10.54 and that
the stream shows as perennial on the USGS map. She explains that DEP may deny this
project but that the Salem Conservation Commission can make an independent conclusion
and ruling based on the photos and observations made in the field.
Manual explains why this stream will not be considered perennial.
. Pabich asks if they wish to fill this only to pick up 25 parking spaces to meet the zoning

Pabich states that they might be able to get the parking spaces that they need by being
more creative.
Manual says that there is also a ditch that reeks havoc with the site and there is a trash
issue and an invasive species issue.
Blier asks if there is flow and ponding on the area.
Manual says no.
Blier asks what kind of infiltration will be allowed.
Manual says they will leave the gravel to allow for future infiltration.
Cornacchio says that if left for a period of time, this area will fill in anyway with invasive
species.
Faia says that this does not resemble a ditch because the pitch is very gradual.
Dilisio says they will take down 4 trees, and he got permission at the last meeting to take
those down. He adds that he plans to replace them, and he will gain parking when he
removes them. •
Duques asks if they looked at other alternatives to use 1/2 of a culvert to leave the existing
bed of a stream.
Manual says that the 180-foot pipe will deter any travel through because the animals
cannot see the other end of it. He adds that the 1/2 culverts are generally used for pipes
that span a shorter distance.
Duques asks if there are any alternatives to create parking spaces.
Manual says that the ditch is the only place that is available that works with the existing
parking. He adds that they will see that this is the logical choice when they walk the
property.
Duques states that the DEP requests soil data.
Manual says that he can tell what it will be, historic granular fill.
Hamilton asks the slope of the pipe to be installed.
Faia says that it is 3.2%.

Faia says that he put the wall higher than the track and then a fence will sit on top of the
wall. He adds that the ditch was an intermittent stream at the time of the original filing.
Cornacchio asks the board if they would like a peer review, and the member agree to
make that decision at the site visit. Cornacchio says that the next meeting is September
11.
Duques suggests scheduling the site visit early to decide if a peer review will be necessary.
She adds they can make the peer review decision now, conditioned upon the site visit.

Pabich expresses concern about altering the grade of the ditch by installing the pipe.

Chairperson Cornacchio calls the meeting to order.
1. Approval of Minutes — July 24, 2008 Meeting

• 2. Continuation of a Public Hearing — Notice of Intent — DEP #64-472 — Dana
DiLisio, 100 Swampscott Road, Salem, MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the construction of a paved go-cart track and parking lot expansion
within isolated vegetated wetlands, bank resource area, and buffer zone to bordering
vegetated wetlands at 100 Swampscott Road.
Cornacchio states that Keith Glidden did not attend the last hearing, but listened to a
recording and signed an affidavit, which qualifies him to vote on this issue. He adds that a
site visit was held on August 26th
Engineer Chuck Faia states that there have been some design changes as a result of the
site visit. He explains that they were able to narrow the width of the track by 10 feet and
install a smaller building and move the track closer to Robinson Road, which reduced the
filling to 600 feet, and reduce the wall to about 4 feet in height. He adds that they will
install a half-pipe instead of a full pipe and a box culvert from the parking area to the
headwall (36"WX30"H). Faia says that there will be 195 feet of box culvert at 2.6% with
an open bottom, and the size of the 2/1 replication has not changed (1250 ft).
Bill Manual from Wetlands and Land Management confirms that he submitted photo
evidence on 4 different days showing that the stream was in a no-flow condition, which
overcomes the presumption that this is an intermittent stream.
• Cornacchio asks if all of the go carts will fit in the storage shed overnight, and Faia says

that they will.
Faia says they will use pre cast block, made off-site for the retaining wall. •
Pabich asks if there will be a curtain on the siltation fence for the replication and the wall
construction.
Manual says they will install a siltation fence along the perimeter of the wetland area, in
the water if necessary, but if the project is well-timed it can be build while it is dry.
Pabich states that he would like to have that as a condition that all of the work be done in
the dry.
Cornacchio asks if they can get started right away, and Dana DeLisio states that he can,
and he would like to be finished before the leaves fall.
Blier asks how the box culvert terminates when it meets the bridge.
Faia states that there is a headwall there.
Cornacchio confirms that they will leave the big willow tree.
Pabich asks if the landscape plan is completed.
DiLisio states that he doesn't have a landscape plan yet but there will be a crushed stone
parking lot and he will continue the landscaping to be consistent with the existing •
landscaping, and he anticipates keeping as many junipers as possible.
Cornacchio state that DiLisio has done a beautiful job on the landscaping and he has faith
that he will continue that. He asks if there will be access to the culvert.
Faia states that there will be a manhole and a catch basin near the wall near Swampscott
Road and at the corner of the crushed-stone parking area a catch basin and a manhole.
Cornacchio asks if a maintenance plan has been designed.
Faia states that a maintenance plan has not yet been completed but it could be done. He
says the manhole will be specially made. He says there will be a butt-nosed grate.
Pabich asks if they will block the 24" downstream culvert.
Faia states that during construction they will install a temporary 24" pipe.
Pabich states that they will have to deal with a storm event by isolating it by plugging it
downstream.
Manual states that they will do a sandbag dam and a pump-around if there is a flow
condition. •

Pabich says he would like them to install the upper headwall first to they can completely
• stop the flow.
Manual states that if there is flow the best thing would be to put a temporary pipe at the
streambed.
Pabich states that they should have that in for the entire project.
Manual agrees that they will isolate that work area.
Glidden suggests having a pre-construction site visit.
Pabich agrees that they should have the condition that the contractor lay out a plan for
construction, which includes how they will isolate the streambed.
Duques states that the building inspector says they don't need a permit for walls 4 feet or
less but if the land behind the wall slopes upward to higher than 4 feet they will need a
permit.
Cornacchio opens to the public. There are no questions or comments.

• Duques reviews the conditions:
• Isolate the work area.
• Provide the scope of work, work plan, and timetable to the Conservation Agent at
the pre-construction meeting.
• Contractor to provide description of culvert work prior to start of construction.
• Complete all the work in the dry.
• Provide an annual maintenance schedule.
Pabich asks if all of the excavated materials will be used on site and Faia says that they
will.
Duques states that all fill must be clean fill.
3. Public Hearing — Reauest for Determination of Aoolicability — Dominion Energy

Cornacchio recuses himself and David Pabich takes the Chair.
Pabich reads the legal public hearing notice, which states that the purpose of this hearing
is to discuss the construction of a memorial located within the buffer zone to a coastal
bank and an area subject to flooding at 24 Fort Avenue.
• Jeff Tucker with Siemasko and Verbiage presents the design plan and states that there is
an outlet channel next to the administration building and there is a man-made jetty with a

rip-rap wall. He explains that a number of large junipers will be removed along with the
benches, and replaced with some granite edging and stone dust, red oaks, bayberry, •
rudbeckia, sedum, and golden rod. He states that the men will install the pavers with the
help of the mason, and they wish to have the park ready for the 1 year anniversary of the
accident.
Duques states that Dominion spoke to her to get a head start on some of the minor repairs
to get ready to proceed with the work, and she allowed them to do some preliminary work.
Blier asks if the cobblestone surface is set down and Tucker states that it will be recessed
slightly but then picked up a bit and pitched. Tucker adds that all of the soil will be
contained by the cobblestone curb.
Pabich asks if an LSP is necessary if the soil is contaminated.
Rob DeRosier states that there has not been any work done in that area at all and it is
unlikely that there is any contamination there.
Pabich opens to the public. There are no questions or comments.

4. Public Hearina — Notice of Intent — Rich Brennan, 429 Lafayette Street, Salem
MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the repair of an existing seawall located along a Coastal Bank and on
Land Subject to Coastal Storm Flowage at 419 Lafayette Street.
Cornacchio states that there was a site visit at this location today at 5:00 PM.
Rich Brennan states that his parents own this property and the corner of the wall was
repaired about 9 years ago using granite and it held up well, but the cement has failed and
the round stones are falling out. He clarifies that there are no washouts on the lawn, and
they can see the silt fence through one of the holes in the wall. He add that he would like
to repair, in kind, the section that they replaced in '97298, and that he will use more
granite blocks and a poured concrete cap in top.
For the restoration, Brennan states that he will excavate 30 feet along the wall, and that
all work will be on the landside, and he will not touch the grass. He explains that a small
excavator can reach the area of work by passing along a driveway that goes down to the
top of the wall. He adds that the excavator is in good shape and it doesn't leak. •

Cornacchio states that he wouldn't want a hose burst down there and Brennan agrees.
• Brennan states there is another section that has lost its integrity. He points out the area
on the plan
Cornacchio suggests the conditions that all of the material be present before beginning the
work, and that he hold the banking in place with the fabric.
Pabich asks what they will do for a footing.
Brennan states that will dig down to the hard clay bottom and fill with heavy crushed
stone. He adds that it is a porous wall. The tallest section of repair is 6.5 feet and at high
tide there is 4 feet of water there and 5.5 feet at the corner.
Cornacchio asks if he owns spill kits.
Brennan states that he keeps a kit in his truck.
Duques asks how many tide cycles the open wall will be exposed to after removal of the
original blocks.
Brennan states that they might be exposed to 4-8 high tides. He says they will put more
fabric in between the porous fill and the tight fill. He adds that there is no organic material
under the wall and no organic material in the fill, and they will toe-in the bottom coarse
• and it will hold tight.
Cornacchio asks if the DEP has reviewed this.
Duques says that they have reviewed it and she suggests that Brennan send some plans to
them.
Pabich asks if there is a Chapter 91 license on this wall and Brennan says that there is.
Pabich expresses concern about protecting the grasses.
Brennan states that they won't even be out to that area, and he will not even dig out to
that area.
Glidden states that that material flakes off after the rocks are removed so he might need
to put plywood there temporarily.
Brennan says that he could put some planks against it and stake them in with a stone
against the planks.
Pabich asks how long the excavation will be open.
Brennan states that they should get to the stone footing on the second day, and by the
• end of the second day they should be back up.

Pabich states that the whole open face of soil should be covered with fabric.
Brennan states that he wants to get it done before winter. •
Duques asks about the stairs.
Brennan says that it is only two steps and it is the only area that requires him to go
outside of the wall. He adds that he would like permission to fix those by resetting them in
place.
Duques asks about the area where the boat launch rail is.
Brennan says that there was a dead man in the yard used as an anchor to haul boats out
of the water.
Cornacchio says that he should remove all of the metal parts from that area.
Cornacchio opens to the public. There are no questions or comments.

Pabich suggests discussing the special conditions now, and then take it up at the next

• Spill kits will be on equipment throughout the duration of the project.
• The applicant will use high-grade cement.
• All work will be completed from the landside.
• All material shall be on site prior to the start of work.
• The applicant will protect the sea grass.
• All steel pieces will be removed and properly disposed of.
• Exposed soils will be covered with filter fabric prior to the tidal cycle.
• All stockpiling will be outside of the buffer zone.
S. Public Hearing — Reauest for Determination of Applicability — City of Salem
School Department, Salem, MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss resurfacing of existing tennis courts and replacement of a fence
located within the buffer zone to Bordering Vegetated Wetlands at 77 Wilson Street.
Vesna Maneva, consultant and landscape architect, states that the tennis court is one of
the projects that was originally in the scope of work in the renovations of Salem High
School. If funds are still available for the renovations of the courts the project will move
forward. She says that the condition of the pavement is not good and they need to restore •
the tennis court within their original footprint. She adds that they will replace the

pavement, and surround the court with a new chain link fence and leave the existing
• lighting. Maneva states that the runoff from the tennis court currently flows toward the
wetland and there is a ridge in the courts which results in puddles on the courts. She
explains that they will change the grade by raising up the side of the courts closest to the
wetlands. The project entails grinding down the pavement and recycling it using to as a
base. She says that they will use a perforated drain pipe in a crushed stone trench.
Duques shows the aerial view of the wetlands and says that it is not connected to an
intermittent or perennial stream.
Cornacchio states that the outfall falls into the WS1.
Civil Engineer Andrea Tavares states that the drainage trench will be 2.5 foot deep with
crushed stone and a pipe that is fully perforated around the entire pipe.
Blier asks if the west edge will be pitched higher. Maneva states it will be pitched higher in
the west end and will slope towards the east
Pabich asks if there will be a silt fence.
Maneva states that there will be a silt fence and hay bales.
Glidden asks about the deconstruction of the structure, if there is any contained liquids.
• Maneve states that she is not aware of any. She adds that they are trailers that can be
removed from the area.
Duques recommends issuing a -3 determination.

main pier will be used for large vessels, and space along the edges for smaller vessels •
(100-125 feet), on the lower side the Salem Ferry. He explains that the main result will be
to have multi-vessel berthing on each side, and a terminal building with office space and
public bathrooms and meeting space for off-season use. He states that a stub of the
existing pier will be left for public access as a fishing pier. Bourne acknowledges that with
the installation of the parking lot, a large substantial of the property, which is now gravel,
will become impermeable, and a stormwater collection system will be added.
Environmental Specialist Alyssa Richard describes the stormwater plan and explains that
snow storage will be on the upland side of the site. She adds that there will be a four-step
construction plan for the erosion control system and a final phase of dredging. She
describes each phase:
• Phase A: The whole wall, which is rip-rap, will be brought up to the same grade
in sections, with silt curtains coming up and meeting up with the hay bales.
• Phase B: The off shore work, the harborwalk, with siltation curtains
• Phase C & D: Containing the entire site on the up-shore end with hay bales
and siltation fence all along the property line. Phase D will need its own squared off
area.
• The timeline for construction is not set yet, and they can run a couple of phases at
the same time.
• Phase E: Dredging
Richard describes two other environmental concerns: .
• This is not mapped for shellfish but some were found so they will follow the dredge
line to survey for shellfish.
• They will survey for eelgrass even though it has not been detected
Blier asks if the new wall will wrap both sides.
Bourne states that a concrete bulkhead will exist along the entire perimeter of the site. He
points it out on the plan, stating that this site is very tight and they must keep within the
site. He adds that the circle must be a sufficient size for emergency vehicles. He explains
that a pile foundation would be very difficult so the building would be built on a footing-
type structure.
Pabich asks if the construction would be on top of the riprap and Bourne says that they will
need to take some of the rip-rap down first. He adds that they will be working in the
inner-tidal zone.
Pabich asks if there are contaminants or hazard on this site.
Bourne says he is not aware of any, but there will not be a lot of material going off site.
He adds that they will need fill to do the grading.
Pabich asks if they need to check it before they dig it, and Bourne says not that he is
aware. •

Pabich says the signature of the property owner is not on the application.
• Bourne states that Dominion is aware of this project and will have it signed.
Blier asks if the parking lot is flush with the boardwalk.
Bourne states that the wall will be 6" high than the parking area. And the boardwalk is
slab, and there will be a final plan brought back.
Blier expresses concern about the snow storage plan.
Bourne says there is an opportunity to use this lot for boat storage during the winter, so
there is a chance that this will not need to be plowed at all. He adds that the trees will be
in planters that are movable.
Glidden asks about trash management plans and Bourne says that there have been no
plans yet and the city will do that.
Pabich states that the condition should be that any plans should be reviewed prior to start
of the project.
Pabich states that this hearing should be continued.
Duques states that they are covered by the standard order of conditions that any changes
• must come back to the commission. She confirms that there is a maintenance plan.
Pabich asks if the dredging plan will be presented later.
Bourne states that it would be done in accordance with the US Army Corps of Engineers.
Hamilton asks about the sewer line, and Bourne states that it will be in support of the
commercial vessel pumpout. Hamilton asks how the vessels will be refueled and Bourne
says that trucks will be able to drive onto the pier to fuel the vessels directly, which will
eliminate on-site storage issues.
Duques asks about the timber wave barrier.
Bourne states that the exposure can be rough during the winter so there will be a barrier
under the pier, that runs -6 along the length of the pier to lessen the impact of the waves.
Pabich confirms that there will be an annual maintenance plan.
Richard states that the maintenance plan is in the packet and it will be submitted to the
commission every year.
Hamilton asks if there is a detail for the oil/water separator and Richard says that it is on
sheet 3. The members review this plan.

7. Public Hearina — Notice of Intent — DEP #64-479 — US Coast Guard, Civil
Enaineerina Unit, Providence, RI
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss the excavation, removal and disposal of lead impacted soil, backfilling
and re-seeding within the buffer zone of a Coastal Bank and Land Subject to Coastal Storm
Flowage on Bakers Island.
Al Stambler, coast guard civil engineer, explains that they tested for several contaminants
and found lead above the EPA allowable level, so they will remove contaminated soil, and
bring in clean soil. He adds that the source of the contamination (lead paint on the
assistant keeper's quarters) will be removed first, then they will excavate around the
remaining structures a maximum of 12 inches.
Contractor John Palmer of Charter Environmental states they will remove the paint from
the assistant keepers quarters with chemicals, then neutralize, prime and repaint the
structure. He adds that the contaminated soil will be excavated, placed in a sealed cubic- •
meter bag, removed from the island and disposed of properly. He says that he anticipates
the total removal of 1200 cubic yards of contaminated soil. He explains that a shallow-
draft barge will be parked off shore in at least 2 feet of water, and truck will drive to the
platform over a wooden road (crane mats). He states that the soil will be placed in bags
and tied shut and immediately removed, so there will be no stockpiling of soil. He adds
that they will backfill as they go along, and erosion matting will be used in steep areas,
and they will spray with seawater for dust control.
Cornacchio reads the following letters into the record:

Stambler agrees to research both of the letters and obtained copies of both letters.

a copy of all of his comments for the record. He states that he is the president of the
Baker's Island Lighthouse Preservation Society (BILPS) 5013C, but is speaking tonight as
an abutter, not on behalf of the BILPS. •

Levin reads his comments which include:
• • The applicant cannot confirm the ownership of subject property. Records do not
exist in the registry of deeds. Therefore they cannot insure the work.
• There is anecdotal evidence that there is mercury on the site, dumped there in the
1970s.
• The application is incomplete.
• The Massachusetts standard for lead is under 300 parts/mil and the applicant will
remove the lead down to 400 parts/mil. This is insufficient.
Levin requests that the commission continue this hearing until these issues are resolved.
He states that he can tell the coast guard exactly where the boundaries are and why their
information is wrong.
Stambler states that archeological study has been completed and they have found nothing.
He adds that they can check other areas for mercury including the area where the spill is
believed to have taken place.
Levin states that he doesn't know where the spill is.
Stambler states that if they find it they while they are working they will remove it.
Cornacchio states that one of the conditions would be to have and LSP on site and there
should be mercury test kits.
• Palmer states that his firm has the proper training, and they will be able to detect the
mercury and remove it and properly dispose of it.
Stambler states that EA will be the LSP on the site and they will have monitors for
mercury.
Palmer states that the project will take 8-10 weeks.
Pabich states that he would like to see the plan contain a clear description of how they will
protect, clean and re-vegetate the access area.p g ea.
Cornacchio says that a dry decon. area will be required and Palmer agrees to comply.
Peter Golden of 131 Nichols Street, Wilmington, asks about the time frame.
Palmer says they will work in October/November and if that isn't possible, then in March.
Ruth Buck of Nutter Road in North Reading, asks about the lead on the inside of the house
and Stambler says they will not touch the inside of the house.
Betsy Weir of 84 Federal Street, Newburyport, director of BILPS, says that she is not
speaking for the BILPS, but as a resident of Baker's Island. She states that she reviewed
the application and found a number of omissions. She asks the size of the concrete blocks.

wall back up above the water line, and then get another 30 tons of smaller stones installed
above the water line.

4. Public Hearing — Reauest for Determination of Aoolicability — John Keenan, 6
Manning Street, Salem, MA 01970
Cornacchio reads the legal public hearing notice, which states that the purpose of this
hearing is to discuss removal of overgrown vegetation and a dilapidated fence located
within a Riverfront area at 68 Dearborn Street.
Engineer Scott Patrowicz states that there is a very old pool, a house and much overgrown
vegetation and debris. He adds that the deck was falling apart and was an emergency
situation, so that has already been done with permission from the city, but he wishes to
further clean up the yard. He explains that he will install a temporary fence around the
pool, and remove all of the overgrown vegetation and the dead trees. Patrowicz say that
there probably will be future work on this project, such as an addition, and they will file a
separate NOI for this.
Glidden says that when they move the stuff on the bank they will probably find other stuff
under it, and Patrowicz says that he hopes not but if so, he will first advise the
commission.
• Patrowicz says they would cut the stumps at the ground level, and leave them in the
ground.

• Duques states that much of this work is on the line because it is heavy landscaping work
and it is riverfront, and the emergency work was approved so long as erosion controls
were in place.
Patrowicz states that on the bank they could break open a hay bale and spread it and plant
rye seed to hold the bank in place.
Duques states that the site looked good today and they are using all clean fill. She
recommends a -3 determination with conditions.

sidewalk gets ruined in the process they will have to fix it. He explains that he might need
to get a Massachusetts Highway permit because it is in the right-of-way of a state

Cornacchio states that the yard slopes to the resource area so hay bales and a silt fence
will be required.
Pabich asks if it is open enough to put it on the other side and Patrowicz says that it is and
theoretically the silt fence could have to go on the road side.
Patrowicz says that he may have to look in the field and see. He adds that they might do
the project in the end of the fall unless the owner finds a buyer, in which case money will
be escrowed and the work will be done in the spring.
Cornacchio asks if there is a maintenance plan for the trash pump.
Patrowicz says they are hoping to install the 1.5 inch line on the property or into the city
right-of-way. He says that during construction they will cover the trash pump with iron
plates at night.

Pabich reads the legal public hearing notice, which states that the purpose of this hearing
is to discuss the dredging, installation of piers and docks, and development of a terminal
building within buffer zone of Coastal Bank at 10 Blaney Street.
Melissa Richard present the information, stating that they conducted the eel grass survey
and the shell fish survey last week, and they found no eel grass, and found some soft shell
clam shells and only 5 live clams at the furthest point out. She explains the stormwater
report, stating that the stormwater will be collected in the catch basins, then grit will be
removed and then it moves to the oil/water separator, and then flows to the outflow pipe.
She adds that the city is working on getting the signature for the application.
• Pabich clarifies that, at this point, they are looking for an Order of Conditions for the
preliminary plan.
Ron Bourne states that he will return to the Commission once a contractor has been hired,
and there will be at least three contractors (for dredging, for the marine structures, and for
the building).
Pabich confirms that they will have to meet with each of the contractors to review their
procedures prior to the start of work. He states that the impact has the potential to be
fairly minimal.
Frank Taormina with the City of Salem states that there will be a pile supported structure
that will wrap around the entire site. He explains that the city obtained a $1.3 million
grant from The Seaport Council to finalize the information and to bring this project up to
the start of the construction, and once this is finished they will come back to the
Commission. In terms of the signature, Taormina says that he understands if the
Commission wishes to wait for it and they should have it by the next meeting.
Pabich suggests working on the conditions now so they can continue this until the next
meeting.
Duques asks if there is some information about the technique for the dredging and the
• equipment that they will use.
Bourne states that it is regulated through the water quality certificate, which deals with the

• details on the process along with black-out periods for fish spawning.
Pabich states that if there is a 21E on the property that should be submitted to the
Commission.
Pabich opens to the public. There are no questions or comments.
Taormina suggests that the Commission require the preconstruction meeting be held at
the regular public meeting. As for the final plan, he suggests that this order be
conditioned upon having the final plan approved by the Commission.
Duques agrees to write up the conditions for discussion at the next meeting.

she has a letter from a civil engineer, which certifies that everything is done to his
approval. She recommends that the commission issue a full Certificate of Compliance.

• Duques says abutting residents have concern about this pond being taken over by algae
blooms and she got a proposal from Aquatic Control Technologies, which states that it will
cost $3000 to treat it, and this treatment will last 60-90 days. She adds that the
neighbors concern is that the water level has dropped over the years and they believe it is
due to the growth of the algae.
Much discussion ensues regarding the feasibility of this treatment and possible lower-cost
alternative treatments. The members express reservations about spending $3000 on a
treatment with will only lat 60-90 days.
Cornacchio suggests that Duques write to the neighbors and suggest they convert to
organic lawn fertilizers.
Pabich suggests they look at the water to determine the source of the problem before
deciding what can be done.
Duques agrees to look into this.
13. Update on Halloween activities located within resource areas
Duques states that there will be another carnival on Derby Street this year, and last year
they put up hay bales and a silt fence and spread gravel on the site. She adds that they
are not expected to spread more gravel this year, just cut back the excess vegetation.
• They will keep two spill kits on site.
Glidden questions whether the people know how to use the spill kits.
Cornacchio states that the hay bales and silt fence creates an awareness that there is an
issue there.
Pabich states that the site should be stabilized so they can use it whenever they want to
use it. He suggests they cover this with old/new business for next meeting. He adds that
Duques should write a letter to the property owner that they need to be sure the site is in
compliance.
Duques states that in the meantime the carnival will be set up next week.
The members agree that the reinstallation of hay bales and silt fence will be appropriate.
Cornacchio suggests advising the carnival management that any hydraulic spill should be
cleaned up immediately.

Pabich confirms that there was a site visit on October 4, and some questions were raised,
specifically regarding the sampling points around the engine house.
Stambler states that he submitted a letter, which gives the coordinates for the sample
points.
Pabich reads a letter from Attorney Matthew Roberts, representing an abutter.
Duques states that she submitted the sampling information, the email, and the letter
listing the coordinates to the commissioners. She explains that the email states that an
improper description was filed, and contains a correct description and lists the coordinates.
Glidden asks if this information is in the deed.
Duques states that the book/page referenced in the NOI is not the same as that in the
email.
Glidden states that this email doesn't include the description in the later deeds. The land
description references a book/page. He states that Stambler must include the book/page
from this email in the NOI.
Pabich asks Stambler for his reasoning for excavating all the way around the engine house.
He expresses concern about the sensitive area at the top of the bank. •
Ed Price of Charter Environmental states that the material around the front and side of the
engine house will all be hand dug.
Pabich says that the plan has no contours that are specific to this area, so they cannot
discuss this information because it is incomplete. He adds that they need more specific
information about all of their activities at the top of the bluff, and if there is no lead there
he doesn't even want it to be disturbed. He iterates that he would like to see some
contours or they could shoot some grades.
Glidden asks Stambler if he knows the source of the lead on the other side. He adds that
there is enough of a slope there to make the testing necessary.
Pabich says the he wants to see if there is a need for activity at the top of the bluff, and if
there is a need for activity he wants to know the exact procedure that they will use there.
Duques clarifies the additional information needed:
• If work needs to be done at the top of the bluff
• If needed, how the work will be done
• How it will be restored
Price states that he will provide a plan stating that he will sample the area to determine if
excavation is needed, and if needed, he will describe the procedure as well as the final •
restoration plan.

• Pabich states that he wants to know how they will work along the beach before he will
approve this. He adds they need to have a discussion about how the larger trees can be
avoided or protected.
Glidden asks why there is no effort to remove the paint from the oil house or the engine
house.
Stambler states that these structures are not peeling, and the lighthouse is not peeling.
Glidden questions Stambler on the eaves that appear to be deteriorating and may be a
source of lead and expresses concern that these buildings may pose additional risk.
After much discussion Stambler agrees to test the paint on these buildings as well.
Glidden asks about the threshold level for the lead in the soil.
Stambler states that currently the lead is above acceptable levels and clarifies that the
Coast Guard will comply with EPA's thresholds for lead.
Blier asks if the shed will be on the next site plan, expressing concern that the plan is
incomplete.
Pabich agrees and states that it should be on the plan, and the resource area should be
• delineated. He points out the 3 significant points that should be sampled. He adds that
the NOI must be modified to include all of the test points. He iterates that he wants to see
contours and they can shoot some grades. He clarifies that they must return to the
commission if they find lead in the resource area, and they cannot just begin working there
without contacting the commission.
Pabich opens to the public. He stresses that the topic stay focused on wetlands issues.
Robert Leavens of 385 Magnolia Avenue, Gloucester, an abutter to the lighthouse property,
states that the engine house is built on the foundation of the original lighthouse, and that
it is probably painted with lead paint. He claims that he knows the exact boundaries.
Regarding the deed, he claims that there were 2 deeds involved, and there was a land
swap in 1900, and the bounds are included in those deed. He states that the newly
provided map is more in error than the original map, and includes more of the Barstow
land than before. He refers to one wedge of land (13,000 square feet). He claims that
without the deed, the commission may not be able to ensure that this procedure will be
conducted correctly.
Leavens claims that this potential archeological site has not been signed-off by the
applicable governing body.
Leavens discusses the uses of the site, stating that there will be no residential uses of the
site. He disputes the statement by Rachel Marino about bringing this property up to the
• point where it can have unrestricted use.

Glidden asks Leavens if any of the proposed remediation activity will be within his disputed
boundary, and Leavens says no. •
Pabich states that this is not an issue for this commission because the work will not take
place on any of the abutters' property.
Blier states that the applicant's document is unclear and incomplete and he wishes to see
further details.
Pabich ask Larry Barstow (abutter) how close the activity will be to his property. Barstow
points out his property line on the plan and indicates that the activity will not be close to
his property.
Glidden states that they see no problem issuing the Order of Conditions even if the deed is
in question because the Coast Guard has been there for many years. He asks Stambler if
he will request the Certificate of Compliance before the property is transferred.
Stambler states that he isn't sure.
Duques asks how long the work will take.
Stambler states that it will take about 4 weeks.
Stambler says that he will check to see if he will need the Certificate of Compliance prior to
the transfer of the property. •
Pabich reads a letter from the Salem Historical Commission into the record.
Pabich suggests waiting for more details on this before making a determination.
Barstow expresses concern about the lead particles blowing onto his property during the
remediation. He asks if the method of spraying down the site is actually effective.
Pabich states that it is a common practice for keeping down dust.
Hamilton asks if they will have particulate monitors up and Price states that they will, and
this will be monitored.
Hamilton says they should not work during the windy times when the particulate monitors
reflect elevated readings. She adds that the water should be effective in controlling the
dust, and at times a sticky substance is sprayed.
Pabich states that as long as there will be controls in place, he foresees no threat of having
the lead spread onto Barstow's property.
Leavens asks if they plan to have the barge come up to the structure, and if it is the same
barge that will be moving the material away.
Price states that it will be the same barge. He says that he won't sink the barge before •

moving it away, so the barge will not disturb the sand. He adds that the barge will be
making several trips to remove the material.
Glidden states that the commission should continue this. He asks Pabich is he wants the

Engineer Scott Patrowicz states that they first filed for clearing and cleaning work and it
has been complete, and now they need to rebuild a concrete deck and a wooden deck.
Duques states that the wooden deck is outside the jurisdiction of the Commission because
it is an exempt activity per the Wetlands Protection Act.
Patrowicz shows the photos of the concrete deck and the pool and states that the pool is
functional, and they will rebuild about 5 feet of concrete decking around the pool. He says
they are requesting a negative determination.
Pabich confirms that the existing deck will be removed with a bobcat. He asks about the
plan for the excavate.
Patrowicz states that it will be moved back to another area.
Pabich states that proper housekeeping must be done and the excavate must be brought
• up and out of the buffer zone. He adds that this is a flat lot.

says there may later be a Notice of Intent. He states that the channel is very narrow and
there is a lot of outcrop, and water at the outer edge is the BVW and it flows down to the
access road. He gives copies of the map to Duques and says the soils at the BVW line are
upland soils.
Pabich states that there is not much here for the commission to look at and he
recommends that they make a site visit.
Duques presents the wetlands map and points out the location of the intermittent stream.
She asks if he is looking to have the intermittent stream classified as a wetland.
Gensel states that he wishes to have it classified as intermittent rather than perennial so
there will be no surprises to the buyer or seller.

Pabich reads the legal public hearing notice, which states that the purpose of this hearing
is to discuss the construction of a one-story building and associated utility work located
within land subject to coastal storm flowage at 10 White Street, Hawthorne Cove
Marina.
Susan St. Pierre of Vine Associates speaks about the Marina, off of Derby Street,
containing 110 slips, with several outbuildings and trailers, and various utilities. She says
that there was a fire at the site in 2007 and the main office building was destroyed and
they wish to build a new office building along the waterfront. She adds that the new office
will have a slightly smaller footprint than the original, and will be pre-constructed and
installed as a modular unit. St. Pierre says they will excavate down a few feet and pour a
slab foundation, and a new gas line, sewer line, and water line will connect to the existing
utilities. She states that there will be no changes to the storm drainage system and no
changes to the sea walls, and the two buildings at the site of the original structure will be
• removed. She shows images of the new structure, and states that scheduling of the
project depends on financing.
Pabich states that the area of the proposed building is now gravel.
Blier confirms that the existing deck is adjacent to the proposed new site for the office.
Christie asks how this will affect the parking.
St. Pierre states that people currently park wherever they can, and that will not change.
Glidden asks how much area will be excavated.
St. Pierre states that it may go an extra foot or two around the building.
Vickers states that after the concrete dries they will use steel rods to secure the slab. He
adds that they chose this type of foundation because it is impractical to put pilings there.
Glidden asks if they are aware of any contamination on site.
Vickers states that they have a clean 21E on the property.
St. Pierre asks if they wish to add the placement of the gravel on the site to the NOI.

Blier says they might need to grade the flow away from the building.

the quality of life issues because it blocks much of the water view. She lives in the condos
and this building, along with the adjacent building will block out most of the water view.

Michael Blier asks if there are significant street trees that might impede the transport of
the modular building.
Vickers states that they will come in through Blaney Street and there may be some trees
along the property line.
Pabich suggests they find out if this will be an issue.
Barbara Warren of 5 Hardy Street asks about stormwater.
Pabich states that they discussed this and it appears that they will look into gutters and
downspouts for the building and there is no intent to change the grading of that site, and if
they fill the low spot with gravel they will confirm to the commission that it will not cause a
problem.

9. Update on YMCA — 40 Leaas Hill Road oroiect •
Duques introduces the project and explains to the Commission that she and Pabich
attended a site visit on December 3rd per Craig Lanouette's request to confirm that the
site conformed with the Order of Conditions. Duques noted several concerns that she and
Pabich had regarding the current condition of the site.
Pabich states that the entire toe is open rip-rap at the edge of where is ties into the top of
the bank.
Chris Nowak of VHB, the civil engineer for the project, states that he is not seeking a
certificate of compliance yet but Lanouette is looking for sign off on the building permit
(CO). He states that the original Order of Conditions covered only road for the subdivision,
and then it was determined that it not was economically feasible to construct those house
lots and they placed a grassy knoll there. He adds that they supplemented the large
boulder material there with stone and they didn't hydro-seed (a cellulose material mixed in
with the seed) it this time because it is stone and it is stable.
Pabich confirms that the toe of the slope is open and porous, and there will be sheet flow
coming into this area, which will unravel the rip-rap. He states that he doesn't see how it
is possible to vegetate this slope. He adds that the interface will be a housekeeping
problem forever. He states that there should be some sort of blanket on top of it.
Much discussion ensues regarding the disparity between the Order of Conditions and the •
current condition of the site.
Nowak states that the product they are proposing will be blown in and fill in the voids and
it has a tackifier, which prevents it from blowing away. He says that it is a work-in-
progress and it was not ready for final inspection.
Pabich points out the other corner, which will flow into the resource area.
Duques calls attention to an oak stump which might block the flow.
He states that it will be fixed when he comes in for the Certificate of Compliance. He
shows the as-built drawing.
Pabich says that limit of work below the overflow in the southern corner of the property
should be a Z-pattern, and that the slope in this area looks steeper than the design.
Duques states that the YMCA received only a 30-day temporary Certificate of Occupancy
because of her concerns.
After much discussion Pabich states that the commission can sign off on the CO.
Nowak states that he understands the commission's concern and assures the members •
that the situation will be rectified.

9. Commissioners to review letter to property owner at 289 Derby Street
Duques presents photos and says the Order of Conditions expired in October 2004 and it
needs to be buttoned up, but the site is as stable as it can be, and they might consider
using that land as a staging site for the Harborwalk project. She says that they will wait
and see where things go, but they can remove the silt fence now.
Pabich agrees that the site looks stable.
10. Reauest for a Certificate of Compliance. DEP #64-383 — Ward Two Social
Club of Salem. Inc.. 1-3 East Collins Street
Duques states that she visited the site today and they are not yet ready.

Duques recommends that they issue a full Certificate of Compliance.

• 12. Reauest for an Extension to an existing Order of Conditions — 220 Highland
Avenue
Duques states that Tropical Products purchased the project and she has been working with
Ed Burman and the site looks great. She adds that they took out a lot of poison ivy, and
they cleaned the catch basins, and they are requesting an extension. She says that Ed
Burman will monitor the basins and report to the commission every year. She
recommends a 3-year extension.
Glidden: Motion to grant a 3-year extension to this Order of Conditions, seconded by
Blier. Passes 4-0.
14. Update on the Park at 15 Peabody Street Park and Harborwalk
Blier states that the drainage strategy hasn't changed and there will still be a grassy knoll
and the walkway will run on the edge of the site and the low area for drainage will be in
the middle. He shows the elevations, and explains that the cantilevered walkway has been
removed and the walkway will run along the edge of the water. He says that they will use
stone dust for infiltration instead of some of the concrete at some points.
Duques states that the Harborwalk will be constructed of wooden piles instead of concrete,
at parts of the walkway.
Blier states that most of the ground is pervious except at the plaza near Peabody Street.

will still all be handled on site.
Blier states that they are using a no-mow grass mix in the low area of the park.
15. Update on Salem State College planting adiacent to baseball field
Duques states that this is on the very outer edge of the 200-foot river front area, and they
will place an island area for service vehicles and install at least 2 bollards to prevent people
from driving on the bike path, and they will not be planting the trees because of the
budget. She adds that there is a large retaining wall and the trees will look odd for the
first 10 or 15 years.
Blier states that he cannot read the plant palette. Duques reads the document.
Duques describes the construction road as a permanent access road.
Barbara Warren of 5 Hardy Street states that there is drainage (fresh water) coming off of
the cap via a pipe into the wetlands where they are trying to remove the phragmites.
Pabich states that they created a spot that is trapping water. He says that the pipe comes
from an area that is off of the cap. He agrees to take a look at this.
16. Exempt activities at 18 Kosciusko Street
Duques says that this is parallel to Derby Wharf and they are probably done by now. ,
17. Commissioners to review and adopt meeting schedule for 2009
Duques says that this doesn't conflict with any holidays.
The members agree that this schedule is fine.
18. Public Right-of-Way Signs
Duques says that the quote for preparing designs and a mock-up has come in as "not to
exceed $4500". She adds that she is not looking for a vote tonight.
Pabich says that this quote sounds too high and suggests that she get another quote.
