Minutes of Meeting
Thursday, January 27, 2000

A regular meeting of the Salem Conservation Commission was held on Thursday,
January 27, 2000 at 7:00 p.m. in the second floor conference room at One Salem Green.
Those present were: Chairman Mark George, Kevin Comacchio, Abby Burns, Karen
Fabiszewski (9:00), Laura Rome and Debbie Hurlburt. Also present were: Conservation
Administrator Steve Dibble and Eileen Sacco.
Approval of Minutes
i The minutes of the Conservation Commission meeting held on January 13, 2000 were
presented for approval. Motion made by Debbie Hurlburt to approve the minutes of the
meeting of January 12. 2000 as amended, seconded by Kevin Comacchio and approved
unanimously.
Continuation of Public Hearing -Notice of Intent - Autumn Development Company Inc -
proposed 120 unit residential apartments in five buildings at the former Vincent's Potato
Chip Company 201-205 Highland Avenue adjacent to the South River
• Chris Wrikert addressed the Commission and explained the plans. He explained the
locations of the resource area on the plan that they have identified on the site. He noted
that there would be no impact on the wetland bank of the stream and they would use hay
bales and they would remain in place until the final stabilization of the site.
Abby Bums stated that she felt that this is a good project.
Mark George asked if a 2 1 E had been done on the site. Mr. Corchoran stated that the
owners had a 21E done when they removed fuel tanks from the site. He noted that the
material that was noticed at the site visit has been removed. Atty. Correnti stated that
they would ask the owners to submit their findings and plans to the Commission.
Mark George stated that he would like to have the information on what was found on the
site. Atty. Correnti stated that they are comfortable with what the scope of the work will
be and what the owners may have to do. He noted that he cannot speak for them, but they
have been advised of the situation.
Kevin Comacchio stated he felt that this was a good project.

• Mark George stated that he would like more information on the 21E report. Debbie
Hurlburt noted that the Commission should get that information from the owner of the
property and not the applicant. Steve Dibble reviewed the order of conditions that was
issued to the owner of the property. He noted that they were given approval to remove 2
underground tanks
Mark George asked how the applicant determined that the water course is an intermittent
stream. Mr. Wrikert explained that they used an Essex County soil survey,Federal
Insurance rate map, site investigations and visual observations to make that determination.
Steve Dibble recommended that the Commission put a condition on the project for a no
cut no disturb zone on the plan that would be mathamatized and recorded at the Registry
of Deeds. He also recommended that the Commission consider a condition regarding the
treatment of the swimming pool such as the drainage and the storage of chemicals. Mr.
Wrikert noted that they have a storage area for the pool supplies in the clubhouse.
Laura Rome suggested that they should reduce the amount of chlorine in the pool water
before releasing the water to the resource area.
Steve Dibble recommended a stormwater management plan to include cleaning the traps
twice a year and the drainage calculations should be submitted to the City Engineer for
approval prior to the start of construction.
• Debbie Hurlburt stated that she would like something to demarcate the no cut no disturb
zone on the site so that whoever is managing the site would know what areas to cut etc.
A discussion was held on what should be used for the demarcation. Steve Dibble
suggested 3 foot boulders. Debbie Hurlburt suggested that shrubbery would be
appropriate. It was suggested that the developer submit the information on what they
propose to use to the Commission prior to doing the work.
Mark George asked if there was anyone present at the meeting who wished to speak on
the matter. There was no response.
There being no further questions or comments on this project, a motion was made by
Abby Burns to close the public hearing, seconded by Laura Rome and approved
unanimously.
Debbie Hurlburt suggested that the Commission write the conditions at the end of the
meeting.

• Continuation of Public Hearing-Notice of Intent - City of Salem Planning Department -
new Bowditch Elementary School (K-8) - on the grounds of Salem High School 77
Wilson Street
Lisa Brothers of Judith Nitshe Engineering addressed the Commission and stated that they
reviewed the stormwater management with an eye towards looking to alleviate the
flooding problems on Wilson Street. Rick Gorman explained the plans to the Commission
and noted the changes that they have made to the drainage plan. He noted that they met
several times this week with Mike Collins and Steve Dibble. He explained that the
changes will decrease the volume by a half acre foot. He explained that moving a
significant amount of drainage from the front of the site by redirecting the roof runoff to
the rear of the site.
Debbie Hurlburt noted that at the last meeting she questioned the Redevelopment and
New Construction noted on the application. She stated that she does not think that this is
a redevelopment according to DEP regulations and she would like the paper work to
reflect that this is new construction.
Abby Burns stated that she still has concerns about the flooding, and noted that we do not
have impartial engineers reviewing the city's drainage calculations. She stated that she has
concerns about the city reviewing their own drainage calculations, noting that Mike
Collins would be gone tomorrow if he said that this is a bad plan. She also suggested that
• the school should remain at Federal Street.
Kevin Comacchio stated that he did not think that a peer review of the plan was
necessary.
Debbie Hurlburt noted that the focus of the Commission is the wetlands and if Abby
would be more comfortable with a peer review then the Commission should order one.
Dan Tuberty, the Architect for the project addressed the Commission and explained the
bidding schedule for the project. He noted that they hope to go out to bid on February 9,
2000.
Debbie Hurlburt noted that the Commission could condition the approval with a peer
review and that would allow the project to go forward.
Steve Dibble reviewed the drainage for the neighbors and noted their concerns. He also
read a letter from Mike Collins regarding the drainage and the changes that have been
made to the plan.
Mark George opened the hearing up for public comment at this time.

Roger Fruggiero of 11 Berrywood Lane addressed the Commission and expressed his
concerns that the project would disturb the wildlife that is in the area.
Stan Porier of 11 Cottage Street addressed the Commission and stated that he likes the
idea of a peer review of the drainage calculations. He also suggested that the city should
properly maintain the detention system.
Debbie Hurlburt suggested that the catch basins and sump pumps should be cleaned at the
end of the construction so that they start clean, when the site is occupied.
Keith Fraser of 5 Berrywood Lane addressed the Commission and stated that he likes the
idea of a peer review of the drainage calculations.
Dr. Herbert Levine, Superintendent of the Salem Public Schools addressed the
Commission and stated that he wanted to thank Mike Collins and Steve Dibble for all the
work they put in to make the changes to the plan. He noted that when all is said and done
we will have a great facility for the kids to learn in, and that is the best part. Dr. Levine
thanked the neighbors as well for airing their concerns which allowed them to address the
issues.
Ward Seven Councillor Joseph O'Keefe addressed the Commission and suggested that any
condition regarding the maintenance of the catch basins should be directed to the School
• Department.
The Commission held a discussion about the funding of Peer Review. Mark George
suggested that the cost could be absorbed by the school building project.
Dr. Levine addressed the Commission and reported that the changes that have been made
to the plan also increased the cost of the project significantly and that if the money is to
come from the building project he hoped it would be minimal.
Debbie Hurlburt stated that she did not feel that the school building project should pay for
the peer review since it is being requested by the Conservation Commission and they have
funds available to them to have this done. It was estimated that the cost of the review
could be $5,000.
There being no further questions or comments at this time a motion was made by Debbie
Hurlburt to close the public hearing, seconded by Abby Burns and approved unanimously.
Steve Dibble reviewed the suggested conditions for the project. He.suggested standard
conditions with a NCND zone demarcated by large trees along the area not to be
disturbed. The.Commission set.a $5,000 capon the.cost of the Peer Review of the
drainage calculations.

• Motion.made by Debbie Hurlburt to issue an Order of Conditions as enumerated by Steve
Dibble, seconded by Kevin Comacchio and approved unanimously.
Request to Amend Order of Conditions -DEP File#64-295 - Goldeneye Corporation
proposed changes to the design for a marine facility located on Blaney Street
Bob Blair addressed the Commission and reviewed the revised plans. The Commission
reviewed a draft Order of Conditions.
Karen Fabiszewski.suggested that the Commission should consider issuing a date by which
the completion of the sea wall should be done. Mr. Blair noted that the design of the pier
could be completed within 12 months.
Kevin Cornacchio questioned whether they need a discharge permit from DEP for the
vegetative swale. Atty..Correnti,stated that they have not come across.that, but,he.will
check into it. Mr. Comacchio suggested that they notify the Commission of the status of
that prior to any work starting.
Mark George opened the hearing up for public comment at this time.
Russ Vickers addressed-the Commission and expressed his concerns about.the extended
sea wall.
• George Smith addressed the.Commission and expressed his concerns about the existing
floats on the site. Mr. Blair stated that they would remain on the site and explained the
locations on the plan.
There being no further comments or questions,regarding.this matter a motion was made
by Kevin Comacchio to amend the Order of Conditions for Goldeneye Corporation as
submitted on the revised plan and conditioned, seconded by Karen Fabiszewski and
approved unanimously.
Public Hearing -Determination.of Applicability - City of Salem Public Services
Department -Proposed continued operation and maintenance of the City of Salem Solid
Waster Transfer Station - 12 Swampscott Rd - adjacent to the Forest River
Sean Scully of Beta Engineering addressed the Commission and explained the violations
that were found by DEP at.the Transfer Station. He noted that the most serious violation
was that compost and demolition debris is being stored at the site without a permit within
an apparent Wetlands Buffer Zone.without filing.a Determination.of Applicability or
Notice of Intent with the Conservation Commission,.and that is the reason for this filing.
Abby Bums stated that she would like to have a site visit to see what is going,on up there.

. The Commission agreed that a site visit would be in order, however it should be done in
the spring when there is no snow cover. Motion made by Karen Fabiszewski to continue
the public hearing to April 27, 2000, seconded by Laura Rome and approved unanimously.
Issuance of Order of Conditions for Autumn Development Company
The Commission reviewed the Order of Conditions for Autumn Development. Debbie
Hurlburt noted that the 21E issues were not the concern of this applicant and the owners
of the property should deal with that. She suggested that the Commission contact them
and invite them in to discuss the matter.
There being no further questions or comments regarding this matter, a motion was made
by Debbie Hurlburt to issue an Order of Conditions for Autumn Development Company,
seconded by Abby Burns and approved unanimously.
Old/New Business
Marlborough Road/ Strongwater Brook appeal before DEP
Steve Dibble reported to the Commission that he and Assistant City Solicitor John Keenan
attended a mediation session in Boston regarding Strongwater Brook. He reported that
• DEP is clear that it is not a river and as a compromise the project will be remanded back
to the Commission. He explained that he the last two houses would not have the 100 ft.
NCND that was required on the other lots, but he felt that this is a fair compromise and
the Commission should accept it. He noted that a vote will be needed at a future meeting.
Other Business
Steve Dibble reported to the Commission on a number of items that required no action by
the Commission.
There being no further business to come before the Commission at this meeting, a motion
was made by Kevin Comacchio to adjourn the meeting, seconded by Debbie Hurlburt and
approved unanimously.

A regular meeting of the Salem Conservation Commission was held on Thursday.
February 10, 2000 at 7:00 p.m. in the second floor conference room at One Salem Green.
Those present were: Chairman Mark George, Kevin Comacchio, Abby Bums, Karen
Fabiszewski_ Debbie Hurlburt and Paul Orr. Also present were: Conservation
Administrator Steve Dibble. hr the absence of Eileen Sacco these proceedings were
taped.
Approval of Minutes
The mantes of the meeting of January 27, 2000 were presented for approval. Kevin
Comacchio moved to table the approval of the minutes since there are three members
absent this evening, seconded by Abby Bums and approved unanimously.
Public Hearing- Determination of Applicability -Glover Estates LLC 485 Lafayette St
Proposed assessment and monitoring abutting the Forest River at the former lead mills
Dr. Hugh Mulligan of Gulf of Maine Research Inc. addressed the Commission on behalf
• of his client. Dr. Mulligan noted that Richard Bane was also present at the meeting and
his Atty. John McCann as well. He explained the plans and the location of the property.
He noted that in the Salem parcel there is a sea wall that is considered coastal bank. He
noted the 100 foot buffer zone on the plan and the location that would be affected. He
explained that some of the land is filled land. He noted that they are going to dig some
test pits to determine 21 E material. Dr. Mulligan explained the protocol for the process
that they intend to use. He stated that they will not be removing any trees on the Salem
side of the project. He explained that they will be digging a hole, taking some soil
samples and filling the holes in again, so there is minimal disturbance expected.
Dr. Mulligan recalled that at one time there were several industrial properties on the site.
Paul Orr noted that they are proposing five test pits on the plan, and asked if any of them
would be monitoring wells. Dr. Mulligan stated that there are three monitoring wells on
the site now, but they can only find one of them. He explained that they have not found
any lead in the water, but there is some in the soil. He noted that their intent is to go down
8-10 feet to get a profile, to detennine the vertical and horizontal extent of the
contamination.
Dr. Mulligan estimated that they may have to trim some saplings minimally to get to one
area that they need to test.

Kevin Comacchio asked if they would be using a boring machine on the Salem side of the
• project. Dr. Mulligan stated that he expected to use a boring machine in Marblehead,

• although at this point he is not sure if they might do some borings in Salem. He stressed
that he did not feel that they would be.

they would have to see how much they would need but in any event they will be filled

Abby Bums asked how much soil is in a sample. Dr. Mulligan stated that they usually
send an eight ounce jar.

regarding the proposed building of an Assisted Living Facility on the site. Paul Orr read

zones. Dr. Mulligan explained the buffer zone areas and the coastal bank, and noted that
the riparian zone is considered to be a no disturb zone, however this will be considered a
redevelopment of the site. He noted that the work that is proposed for the river front area
is a benefit to the river front.
Paul Orr stated that he would recommend a Negative Determination with conditions. He
requested that if there is any significant change in the location of the boring pits, or
removal of more shrubbery than has been discussed at this hear, the Conservation
Administrator should be notified. He also asked that they submit a contingency plan be
submitted to the Commission for the handling of the material prior to the start of the
testing. Kevin Comacchio requested that some kind of diapers be available in the event
that a hydraulic line pops on the excavator. Paul Orr asked that they leave the second plan
with the Commission and that the access paths be the approximately the path that they will
use to access the site.

Wayne Duncan addressed the Commission and explained that they are looking to get
permission for Amtrack to do their vegetation control. He explained the regulations that
govern the Amtrack. He explained the various zones that they have along the tracks.
Kevin Comacchio asked what time of year they do the spraying. Mr. Duncan explained
that they do their work in the first two weeks of July noting the process that they use.
Abby Bums asked how they change the sprays during the application. Mr. Duncan stated
that a representative of the Amtrack accompanies the contractor to point out the markers
along the site. He explained that they have a buffer zone mix that use along the entire
track agreed to by the DEP and the DFA. He noted that there is a list of recommended
herbicides that they can choose from. Abby Bums suggested that it might be best not to
use any at all. lvlc. Duncan explained the reasons that they should use them. He explained
that the track needs to be weed tree for safety reasons.

concerns to the consultant. He noted that most of his concerns are regarding traffic. Mark
George expressed concern that traffic is beyond the jurisdiction of the Commission. Paul
Orr recalled that the Commission has commented on issues such as traffic through the
MEPA process. Mark George expressed concern that the Commission was not notified of
the MEPA session. Abby Burns suggested sending a letter to Patrick Raffert regarding
this. Paul Orr noted that the City Planner was notified and the process was followed by
• MEPA, so there was a breakdomi in communication internally. Paul Orr suggested that
the Commission send a letter to the Planning Department expressing the Commission's
wish that Steve Dibble be notified of these meetings. Mark George stated that he would
rather not do anything official as Chairman and leave it to Steve Dibble to work it out with
his boss.

A regular meeting of the Salem Conservation Conunission was held on Thursday.
February 24, 2000 at 7:00 p.m. in the second floor conference room at One Salem Green.
Those present were: Chairman Mark George, Kevin Comacohio, Abby Bums, Karen
Fabiszewski , and Paul Orr. Also present were: Conservation Administrator Steve Dibble
and Eileen Sacco.
Approval of Minutes
The minutes of the meeting of January 27, 2000 were presented for approval. (previously
tabled on February 10, 2000). Motion made by Kevin Comacchio to table the approval of
the minutes, seconded by Paul Orr and approved.
Public Hearing - Notice of Intent-JPU James V D'Amico Jr 190 Bridge Street
proposed redevelopment of the Parker Brothers manufacturing faciliri
Attorney Joseph Correnti addressed the Commission and requested that the matter be
continued to March 9, 2000. He explained that there was an error in the notification to the
• abutters of the property and they will be correcting the matter.
A letter was read into the record from Ward Two Councillor Regina Flynn noting that the
neighbors on Woodbury Court and Northey Street were not notified of the hearing.
A discussion was held on whether or not the Commission should schedule a site visit
before the meeting on March 9, 2000. Paul Orr stated that he would rather schedule the
site visit during the public hearing so that the public who are not at the meeting this
evening would be aware of it.
Motion made by Abby Bums to continue the Public Hearing on the Parker Brothers
Property to March 9, 2000, seconded by Paul Orr and approved unanimously.
Appeal - Strong Water Realty Trust- Marlborough Road Lot 91 and Lot 47 DEP File
#'s 64-282 and 64-283
Assistant City Solicitor John Keenan addressed the Commission and stated that they have
met with DEP and Mr. Gremer several times regarding this appeal. He noted that Heidi
Davis has visited the site and there is a difference of opinion as to whether the area in
question has an intermittent stream. He explained that the Commission cannot disprove
the guidelines that DEP uses in making that determination and it is a difficult case to
make.
He reported that a settlement has been reached if the Commission agrees which would
require the applicant to increase the No Cut No Disturb Zone on the property which is a
• benefit to the Commission.

Atty. Jack Keilty addressed the Commission and explained the revised plan noting the
location of the NCND zone. He noted that they added 20 feet to the original line to make
it a gradual increase in the NCND zone.
Arty. Keenan informed the Commission that he is to report back to the Administrative
Law Judge if this is acceptable to the Commission. He also noted that he felt that this is a
good solution for both parties.
Paul Orr noted that the Commission would be getting a 50 foot NCND zone and the issue
of the stream is a moot point now. He stated that he felt that this is a fair compromise.
Mark George asked if the jurisdiction of the matter would revert back to the Conservation
Commission, noting that he would like any subsequent changes to the plan be reviewed by
the Commission. Atty. Keenan stated that he was not sure about that, but would see if that
is possible.
Motion made by Paul Orr to withdraw the Salem Conservation Commission appeal
contingent upon the original special conditions for lots 4 and 5 with the exception that a
50 foot NCND zone on lot#7 rather that the previously required 100 $. NCND and shall
be demarked by boulders, and that all subsequent jurisdiction be referred to the Salem
Conservation Commission, seconded by Kevin Comacchio and approved unanimously.
• Public Hearing -Notice of Intent- Kernwood Country Club- proposed construction of a
new well
John Gregory addressed the Commission on behalf of Kemwood Country Club. He
explained that over the last few years they have found that the existing well used for
irrigation has been declining in yield. He noted that they are not looking to increase the
permitted volume of water that they use, but are going to supplement the existing well
with a new one. He noted that they are permitted for 700 gallons per minute and both
wells would provide that together so there would be no increase in usage. He explained
the plans and the location of the proposed well and noted that they will install hay bales
and a silt fence during the construction of the well.
Abby Bums asked how big the building would be. Mr. Gregory stated that it would be
10X12 or smaller.
Mr. Gregory showed pictures of the golf course and the area where the well would be
located.

Kevin Comacchio asked how deep the well would be. Mr. Gregory stated that it would be
not over 75 feet and similar to what they have now.

• Abby Bums expressed concern that the water level would change dramatically. Mr.
Gregory stated that there would be some draw down, but noted that the two areas would
help maintain the _yield of the existing well.
Paul Orr asked what plans they have for stockpiling of materials on the site. Mr. Gregory
stated that a truck would be brought in and would remain on the site until the work is
finished.
Mark George opened the hearing up to public comment at this time.
Luericia DelNegro of 239 Lafayette Street asked if the golf course uses pesticides in their
treatment of the greens. Mr. Gregory stated that they use environmentally safe treatment
on the golf course.
Abby Burns asked if there was any other facility that was drawing water from the same
aquifer. Mt. Gregory stated that they do not have enough information at this time to
determine that.
The Commission discussed conditions for the project. It was suggested that standard
boiler plate conditions be used with special conditions. Steve Dibble suggested that the
hay bale line noted on the plan also be the limit of work lure. He also suggested that if in
the event that the well has to be dug deeper than 75 - 80 feet, the Conservation
• Commission should be notified.
There being no further questions or comments concerning this project a motion was made
my Abby Bums to close the public hearing, seconded by Paul Orr and approved
unanimously.
Motion made by Paul Orr to issue an Order of Conditions to Kentwood Country Club for
the installation of a well, with the standard conditions and special conditions as follows,
seconded by Karen Fabiszewski and approved unanimously.
Special Conditions:
The hay bale line shall serve as the limit of work line
The Conservation Commission shall be notified if the well is to be deeper than 75 - 80
feet.
The pump test shall be submitted to the Commission prior to the submission of the water
management test.

Proposed assessment and monitoring abutting the Forest River at the former lead mills
Dr. Hugh Mulligan of Gulf of Maine Research Inc. addressed the Commission on behalf of
his client. Dr. Mulligan noted that Richard Bane was also present at the meeting and his

noted that in the Salem parcel there is a sea wall that is considered coastal bank. He noted
the 100 foot buffer zone on the plan and the location that would be affected. He explained
that some of the land is filled land. He noted that they are going to dig some test pits to
determine 21 E material. Dr. Mulligan explained the protocol for the process that they
intend to use. He stated that they will not be removing any trees on the Salem side of the
project. He explained that they will be digging a hole, taking some soil samples and filling
the holes in again, so there is minimal disturbance expected.
Dr. Mulligan recalled that at one time there were several industrial properties on the site.
Paul Orr noted that they are proposing five test pits on the plan, and asked if any of them
would be monitoring wells. Dr. Mulligan stated that there are three monitoring wells on
the site now; but they can only find one of them. He explained that they have not found
any lead in the water, but there is some in the soil. He noted that their intent is to go
down 8-10 feet to get a profile, to determine the vertical and horizontal extent of the
contamination.
Dr. Mulligan estimated that they may have to trim some saplings minimally to get to one
area that they need to test.

Abby Burns expressed concern that the water level would change dramatically. Mr.
Gregory stated that there would be some draw down, but noted that the two areas would
help maintain the yield of the existing well.
Paul Orr asked what plans they have for stockpiling of materials on the site. Mr. Gregory
stated that a truck would be brought in and would remain on the site until the work is
finished.
Mark George opened the hearing up to public comment at this time.
Lucricia DelNegro of 239 Lafayette Street asked if the golf course uses pesticides in their
treatment of the greens. Mr. Gregory stated that they use environmentally safe treatment
on the golf course.
Abby Burns asked if there was any other facility that was drawing water from the same
aquifer. Mr. Gregory stated that they do not have enough information at this time to
determine that.
The Commission discussed conditions for the project. It was suggested that standard
• boiler plate conditions be used with special conditions. Steve Dibble suggested that the
hay bale line noted on the plan also be the limit of work line. He also suggested that if in
the event that the well has to be dug deeper than 75 - 80 feet, the Conservation
Commission should be notified.
There being no further questions or comments concerning this project a motion was made
my Abby Burns to close the public hearing, seconded by Paul Off and approved
unanimously.
Motion made by Paul Orr to issue an Order of Conditions to Kemwood Country Club for
the installation of a well, with the standard conditions and special conditions as follows,
seconded by Karen Fabiszewski and approved unanimously.
Special Conditions:
The hay bale line shall serve,as the limit of work line
The Conservation Commission shall be notified if the well is to be deeper than 75 - 80
feet.
The pump test shall be submitted to the Commission prior to the submission of the water
management test.

Public Hearing-Central Wharf: Proposed installation of Public landing
Representatives from the National Park Service are Susan St.Picrre and Colleen. Representing the Salem
Partnership is Russ Vickers.
Susan opens discussion by explaining the purpose of this float facility is to provide berthing for visiting
ships such as The Earnestina. This facility will be done in two(2)phases. Currently the existing
platform is where the vessel Friendship is docked. The Friendship will be moved back to allow
demolition of the old platform and rebuild a new landing. This landing will have two(2)ramps,one for
high tide and one for low tide. The low tide ramp will be handicap assessable. The difference in heights is
designed to accommodate easy access to the different size vessels.

A proposed mixed use Luxury Apartment/Retail development by JPI. Attorney Joseph Correnti
representing 63 Federal Street.
Detailed drawings are displayed. Phillip Smith from JPI&Tom Sokolski from Rizzo Associates present
their notice of intent. A mixed-use luxury apartment complex with retail space and substantial recreational
areas for biking,walking and viewing of the river.
• The Planning Board&Conservation Commission will be involved with meetings with local Department
Heads, substantial Local& State permitting is also involved.
Chapter 91 application has been filed.
About JPI : Phil Smith is the Regional Development Manager based in Dallas,Texas.
The company is 3 '/3 years old,has 13 regional offices. The company is just starting in the New England
area. Their developers find this the most interesting project, it will be an extraordinary asset for renters and
the City of Salem. With the location close to Rt.128 and the MBTA Train Station,they expressed this
development with thoughts of"Urban fabric of Salem", "Urban edge","Urban corridor"—a link for
Bridge Street.
This complex will have 65 hundred square feet for a conference area,faxes,cafe,ATM etc..
JPI will not construct the retail space that will be proposed.
The name of the development will be"The Jefferson at Salem".
265 rental units
10,000 square feet retail
Bridge Street will be built by Mass Hwy,not JPI.
There is a"plan B"which will not depend on how the road will be in respect of the right of way for the
State Hwy. If the Hwy plan takes long,the development of this project can still continue.
Two(2) issues have been taken into consideration:
1) The"100"year flood plain. The boundary is shown on diagram for the storm surge.
• 2) The Buffer Zone to the coastal bank. The property will be separated by the seawall.

Thursday, May 11, 2000
A regular meeting of the Salem Conservation Commission was held on Thursday,
May 11, 2000 at 7:00 p.m. in the second floor conference room at One Salem Green.
Those present were: Debbie Hurlburt, Abby Burns, Kevin Cornacchio,Karen
Fabiszewski, Joseph Furnari, Laura Rome,. Also present were: Conservation
Administrator Don Girard, Steve Dibble and Eileen Sacco, Clerk.
Forest River Conservation Area Update -Dr. Milt Vorgeas
Dr. Vorgeas gave the Commission a brief update of the progress of the Forest River
Conservation area. He noted that they are continuing with their efforts to involve the
schools with an educational program. He also noted that they may be getting a donation
of 200 ten foot telephone poles thanks to Councillor O'Keefe who contacted DH
Engineering. Dr. Vorgeas reviewed the list of donations that have made to the project by
local businesses.
Abby Burns thanked Dr. Vorgeas for his hard work on behalf of the Forest River
Conservation area.
• Continuation of Public Hearing - Determination of Applicability- City of Salem Public
Services Dgpartment - continued operation and Maintenance of Transfer Station at 12
Swampscott Road
Don Girard reported that he forwarded some information to Stan Bornstein requesting
some information as requested by the Commission, but he has not received anything from
him. He explained that it seems that they are required to file with the Commission but a
decision is not required. It was suggested that a letter be sent to Mr. Bornstein to see
what his intentions are and invite him to the meeting on May 25, 2000 to update the
Commission.
Motion made by Kevin Comacchio to send a letter to Mr. Bornstein to see what his
intentions are and invite him to the meeting on May 25, 2000 to update the Commission,
seconded by Abby Burns and approved unanimously.
Public Hearing-Notice of Intent -Lot 631 A and 630A Freeman Road-Thomas Berube
Debbie Hurlburt noted that since the applicant has not shown for the meeting the
Commission should table the matter to the next meeting on May 25, 2000. Kevin
Cornacchio moved and Abby Burns seconded a motion was table the Berube application
• to May 25, 2000. The motion was approved unanimously.

37 Station Road-Discussion with Mr. DeFrancesco regarding the status of the re lice ation
area.
Steve Dibble stated for the record that he is a neighbor of Mr. DeFrancesco and has no
financial interest in the property.
Don Girard reported that he visited the site with Steve Dibble and it appears that a small
trench has been dug. Mr. DeFrancesco explained that he dug the trench to drain the
standing water that accumulates in that area. He also noted that he used a small truck
load of dirt to fill in the wholes.
Kevin Cornacchio stated that he visited the site and noted that from what he saw they
should have come to the Commission for approval before any work was done.
Debbie Hurlburt explained to Mr. DeFrancesco that he made his lot buildable by filling in
some wetlands and he was required to replicate those wetlands in another area. She noted
that he needs to file with the Commission before he does any work in that area. Ms.
Hurlburt also noted that she would like to see some natural vegetation planted there.
Mr. DeFrancesco stated that he will file the appropriate applications with the Commission.
• Letter from Mr. Gelpy-requesting to eliminate pbragmites
Debbie Hurlburt informed the Commission that we are in receipt of a letter from Mr.
Gelpy requesting to eliminate pbragmites on his property to restore the salt marsh. Mr.
Gelpy was present at the meeting. Ms. Hurlburt explained to Mr. Gelpy that he needs to
file a Notice of Intent with the Commission and follow the process.
Discussion on McCabe Park
Abby Burns asked if there was an update on the work that was done at McCabe Park.
Debbie Hurlburt explained that Larry McIntire was at the last meeting and he was going to
file a NOI for a culvert and to keep the road wide. Debbie Hurlburt suggested that the
Commission should visit the site.
Business Cards for Dr. Vorgeas
Debbie Hurlburt noted that as has been discussed in the past the Commission should
purchase business cards for Dr. Vorgeas since he does so much volunteer work on behalf
of the Commission. She explained that this would be helpful to him when soliciting
donations. Abby Burns moved and Kevin Cornacchio seconded a motion to purchase
• business cards for Dr. Vorgeas. The motion was approved unanimously.
• Don Girard and Steve Dibble updated the Commission on several informational items that
required no action by the Commission.

Laura Rome moved to approve the minutes of the meeting of March 23, 2000 as

Abby Burns moved to approve the minutes of the meeting of April 12, 2000 as amended,
seconded by Karen Fabiszewski and approved unanimously.
• Chairwoman Debbie Hurlburt noted that Mr. Cornacchio would be late for the meeting
and suggested that the Commission proceed with the rest of the agenda until he arrives
and hold the NOI for JPI - 190 Bridge Street.
Continuation of Public Hearing -Notice of Intent- Thomas Berube Lot 631A and 630A
Freeman Road- proposed construction of an extension of the roadway providing
turnaround potential and residential structure (32'X26') within the buffer zone on inland
resource area
Mr. Berube addressed the Commission and explained that this project was approved by
the Conservation Commission in 1993 and the Order of Conditions expired in 1996. He
explained that the current owner of the property did not realize that the order had expired.
He explained the topography of the land and noted that the area gets saturated from the
runoff from the properties above the site.
Karen Fabiszewski stated that she felt that a new plan should be submitted noting that
things may have changed since the original approval. Debbie Hurlburt agreed that the
wetlands change over time and noted that she would like some further information
submitted to the Commission. She requested_that the wetland be flagged so that the
Commission can see where the resource area begins and ends.

Steve Dibble suggested that the applicant could submit a memo from Paul Sommer
• verifying that the plan is accurate. Abby Burns questioned the merits of having the same
person who did the original plan verify the accuracy at this point.
Karen Fabiszewski noted that the Commission needs to see what is there and if it has
changed significantly then the Commission needs to take that under advisement.
Debbie Hurlburt opened the hearing up for public comment at this time.
Ralph Salvo addressed the Commission and expressed his concern about the extension of
the road.
Joseph Piemonte of Crowdis Street addressed the Commission and expressed his concern
about the statement that the building of the houses on Crowdis Street created the
problems in the Freeman Road area. He noted that there were always water problems in
that area and asked the Commission to reconsider allowing this house which would create
serious problems.
Mary Skaliotis of 23 Crowdis Street addressed the Commission and stated that there was
always a natural stream on Crowdis Street.
Mr. Sylvanowicz of 13 Freeman Road addressed the Commission and explained the
• history of the site which he stated has been filled over the years. He also explained the
direction of the runoff on the plan.
Barbara Erps addressed the Commission and expressed her concern over any disturbance
to the land. She noted that she is afraid that the water level will shift and she has had
tremendous water problems in the past.
Debbie Hurlburt asked Mr. Berube to come back to the Commission with more
information and the Commission will schedule a site visit.
Abby Burns moved and Laura Rome seconded a motion to continue the public hearing to
June 22, 2000. The motion was approved unanimously.
Continuation of Public Hearing -Determination of Applicability- City of Salem Public
Services Department- Continued Operation and Maintenance of Transfer Station at
12 Swampscott Road
Don Girard explained to the Commission that he asked for flagged plans and has not yet
received them. Debbie Hurlburt stated that she would like to see the information that goes
along with the flagging and suggested that the Commission should pay to have the area
reviewed. Laura Rome moved to continue the public hearing to June 8, 2000, seconded
by Abby Burns and approved unanimously.

• Request for Extension of Order of Conditions DEP File#64-264 - proposed construction
necessary to build a permanent docking facility at Derby Wharf for the SV Friendship
Debbie Hurlburt read a letter from Steve Kesselman from the National Park Service
requesting an extension of an Order of Conditions. Debbie Hurlburt questioned whether
the Order of Conditions had expired. Steve Dibble reviewed the file and determined that
the Order of Conditions had expired. Don Girard will notify the National Park Service
that they need to file for a new NOI.
Old/New Business
Don Girard reported that the Amtrack Vegetation Control Plan has been received by the
Planning Department.
The peer review from Rimmer Associates has been received by the Planning Department.
Update on the Forest River/Goldeneye Mitigation
Debbie Hurlburt reported that the site visit last Sunday was attended by herself, Abby
Burns and Laura Rome. She noted that Dr. Vorgeas gave them a one hour tour of the
area it is a beautiful site. She urged the other members of the Commission to go out and
see the area. Ms. Hurlburt also reminded the Commission that if they schedule a site visit
. members should make an attempt to attend or call if they are unable to attend.
Don Girard reported that Walter Montgomery has been contacted regarding the mitigation
but they have not responded.
Bob Blair updated that Commission on what he knows of the mitigation plans.
Request to Amend Order of Conditions- Goldeneye Corporation- Blaney Street
Bob Blair from Goldeneye Corporation addressed the Commission and explained that
there are issues on the site in terms of how to make the drainage work. He noted that he
hoped to be open for business this weekend, but there are a few things that he needs to do
before he can open. Mr. Blair explained that he is proposing to move the direction of the
drainage.
Debbie Hurlburt noted that she did not think it was a big deal if the only change is that
they are moving the drainage in the other direction.
Steve Dibble reviewed the Order of Conditions that was issued for the project. It was
noted that the armourment has been completed as well as the walkway to White Street.

• Mr. Blair reported that the Building Inspector issued a building permit for the construction
of the handicap ramp. Debbie Hurlburt suggested that Mr. Blair get a memo from Mr.
Strout regarding the building permit. She also suggested that he meet with the City
Engineer regarding condition 63 and the discharge permit and give that information to
Don Girard.
Update on McCabe Park
Don Girard updated the Commission on the status of McCabe Park. He reported that Mr.
McIntire had indicated that he would file a NOI with the Commission. He reported
receiving a hand drawn plan and the application was not filled out properly.
Karen Fabiszewski expressed concern that the application was not filled out properly. It
was suggested that a copy of the application and a letter be sent to Mayor Usovicz.
Abby Burns suggested that the Commission issue an enforcement order until they come in
and follow the process.
Mr. Fumari and Ms. Rome left the meeting at this time.
Continuation of Public Hearing -Notice of Intent- JPI - 190 Bridge Street
• Atty. Joseph Correnti addressed the Commission and explained that since the public
hearing was opened they have been in the Site Plan Review process with the Planning
Board. He noted that the plan is evolving and changing at the Planning Board level. He
noted that while the plan has changed it has not changed dramatically regarding the
location of the units and the layout of the site. At this time the only issue at the Planning
Board is the elevations and he expects a decision from the Planning Board in June.
The Commission reviewed the plans with Steve Dibble. He suggested that the parking lot
be swept in the spring and fall to meet the 80% TSS on the storm water maintenance plan.
He also noted that the stormwater easement for Bridge Street that goes across the site
needs to be addressed. Atty. Correnti agreed that the easement needs to be relocated.
Steve Dibble noted that the relocation needs to be approved by the City Engineer.
There being no further comments or questions regarding this application a motion was
made by Abby Burns to close the Public Hearing, seconded by Karen Fabiszewski and
approved unanimously.
The Commission reviewed the standard conditions for the project with special conditions.
In addition to the standard conditions it was noted that 4 foot deep sumps will be installed,
TSS of 80%, and the parking lots shall be swept twice a year in the spring and fall. The
City Engineer shall approve the relocation of the stormwater easement.

Minutes of Meeting
Thursday, June 8, 2000
A regular meeting of the Salem Conservation Commission was held on Thursday,
June 8, 2000 at 7:00 p.m. in the second floor conference room at One Salem Green.
Those present were:, Kevin Cornacchio, Karen Fabiszewski, Joseph Furnari, and Laura
Rome. Also present were: Conservation Administrator Don Girard, and Eileen Sacco,
Clerk.
In the absence of Chairwoman Debbie Hurlburt, Kevin Cornacchio assumed the chair.
Public Hearing -Notice of Intent - 4 Daniels Street Court -Linda Maribito and Stephen
Ingemi- proposed reinforcement and stabilization of an existing stone block seawall
within the Buffer Zone of a Coastal Resource Area
Mr. Ingemi addressed the Commission and explained that he is planning to stabilize the
existing sea wall. He explained the plans and noted that the area that the work will be
done in is a coastal bank subject to flooding and it is noted on the plan.
Mr. Ingemi explained that he proposes to stabilize the stone sea wall that has eroded. He
• stated that he plans to dig a trench behind the wall, fill it with filter fabric and stones and
set it in fast setting concrete. He noted that there would be no replacement or relocation
of the sea wall at all. He will landscape the top of the wall with plantings and landscape
timbers.
Kevin Cornacchio asked Mr. Ingemi how he will access the property. Mr. Ingemi replied
that he would use the public street and go in through his yard.
Laura Rome asked how long he expected the project to take after the back hoe digs the
trench. Mr. Ingemi estimated that the work should take two days, but with weather
considerations it should be completed in a month. Kevin Cornacchio stated that he would
like to see a time line for the project. Mr. Ingemi stated that he would like to see the
project completed in 3 consecutive days.
Kevin Cornacchio suggested that the Commission have a site visit. Motion made by
Karen Fabiszewski to continue the public hearing to June 22, 2000, seconded by Laura
Rome and approved unanimously.

Continuation of Public Hearing -Determination of Applicability- City of Salem Public
Services Department- Continued Operation and Maintenance of Transfer Station at 12
Swampscott Road
Mr. Cornacchio noted that there are not enough members present to open this public
hearing, noting that there are four members present, however Mr. Furnari was not present
when the public hearing was originally opened.
Sean Skully was present to update the Commission but due to a lack of a quorum it was
suggested that a site visit be scheduled so the Commission could-take that matter up at a
future meeting. It was suggested that the Commission visit the site on Saturday, July 8,
2000 at 1:00 after the close of business at the Transfer Station.
OLD/NEW BUSINESS
Update on the Bowditch School Project- Report from Rimmer Associates
Bob Corning addressed the Commission and stated that they have received the report from
Rimmer Associates regarding the Bowditch School. He noted that some issues are minor
and can be resolved easily. He recommended that rather than review the information with
the Commission at this time, he would like to meet with the City Engineer and get the
issues out on the table and resolve them and then make a recommendation to the
Commission.
A letter from City Councillor Joan Lovely was reviewed and filed.
Laura Rome asked that Don Girard be notified of the meeting with the City Engineer.
There being no further business to come before the Commission at this meeting a motion
was made by Karen Fabiszewski to adjourn the meeting, seconded by Laura Rome and
approved unanimously.
The meeting was adjourned at 7:50 p.m.

Thursday, July 13, 2000
A regular meeting of the Salem Conservation Commission was held on Thursday,
July 13, 2000 at 7:00 p.m. in the second floor conference room at One Salem Green.
Those present were: Chairwoman Debbie Hurlburt, Kevin Cornacchio,Karen
Fabiszewski, Abby Burns, Joseph Furnari, and Laura Rome. Also present were:
Conservation Administrator Don Girard, and Eileen Sacco, Clerk.
Approval of Minutes
The minutes of the Meetings of May 11, 2000 and May 25, 2000 were presented for
approval.
Debbie Hurlburt suggested some minor changes to the minutes of May 11, 2000.
Motion made by Abby Burns to approve the minutes of the Conservation Commission
meeting of May 11, 2000 as amended, seconded by Kevin Comacchio and approved
unanimously.

Motion made by Abby Burns to approve the minutes of May 25, 2000 as amended,
seconded Laura Rome and approved unanimously.
Forest River Tidal Gates Discussion
Chairwoman Debbie Hurlburt addressed the those present and explained that the
Commission had held a brief discussion with Councillor Joseph O'Keefe at the last
meeting and thought it might be helpful if the Commission invited some of the people who
have been advising them over the years regarding the tidal gates issue. She introduced Dr.
Jay Moore, a retired professor from Salem State College, Professor Alan Young from
Salem State College, Brad Chase from the Division of Marine Fisheries, and Christine
Marcel from Salem Sound 2000.
Dr. Moore read a summary of his 1992 report on the Forest River Estuary.
Professor Young addressed the Commission and stated that he has done no formal study
of the area but has noticed while doing other projects that invasive species were starting to
get a foothold in the area. He noted that since the gates have been left open they seem to
be dying off.

• Professor Young also noted that in reference to the portion of Dr. Moore's report that
was taken out of context in the news papers there may be no short term significant effect,
but it is not a good thing for the flushing of the tide.
Christine Marcel of Salem Sound 2000 addressed the Commission and noted that she has
done water sampling in the Forest River and Pickman Park. She explained that looking at
the water quality all came out over the public health standard, noting that Forest River
was higher on a wet day. She stated that they would be concerned that people swimming
in those areas would be at risk.
Brad Chase from the Division of Marine Fisheries addressed the Commission and stated
that he felt that Dr. Moore's report summed things up. He explained that he has done
some research relative to fisheries in the area.
Debbie Hurlburt opened the meeting up for public comment at this time.
Al Voutour of 7 Sunset Road addressed the Commission and asked for an explanation of a
spring tide. Dr. Moore explained what a spring tide is.
Peter O'Connor addressed the Commission and questioned Dr. Moore on what effect he
has seen since 1963 when the tidal gates were changed. Dr. Moore noted that he came to
Salem in 1966 so he could not address that. He explained that at one time the gates were
vandalized and for a long time they were in disrepair. He noted that again in 1975 the
• gates were vandalized in the closed position.
Ward Seven Councillor Joseph O'Keefe addressed Dr. Moore and questioned if he has
any new information since the report that was done in 1992. Dr. Moore explained that he
has retired and has done very little research. Dr. Moore explained how he came to do the
research in the first place. He explained that he did a study on dissolved oxygen in 1988
and in 1992 he and Cindy Delpapa did a study at their own expense.
Brad Chase addressed the Commission and noted that it should make sense that the flow
of the tide is healthy for the estuary. He noted that there are not many communities that
allow tidal gates to be closed. He also noted that upstream growth has increased and
suggested that aerial photographs should be taken of the entire estuary. He stressed that
to restrict the flow of the tide is not a good practice.
Councillor O'Keefe asked of Dr. Moore and Professor Young would be willing to do a
study while the gates are closed.
Council President Kevin Harvey addressed the Commission and asked the Commission to
use a common sense approach to this matter. He stated that the neighbors are not
interested in harming the ecosystem He noted that there is a historic past for the closing
of the gates from Memorial Day to Labor Day.

• Councillor Harvey stated that he feels that there is room for compromise here so the
neighbors can enjoy the beach. He also suggested that the city could pay for a study on
the effects of the closing of the gates.
Councillor at Large Arthur Sargent addressed the Commission and asked if there was a
time when closing the gates is a good thing. Dr. Moore stated that the only time would be
if there were an oil spill.
Councillor Sargent suggested a compromise that would allow the gates to be closed
according to the tide and opened at the end of the day rather than keep them closed all
weekend. He noted that if they were closed for example and 9 am and opened at 5 p.m.
that would reduce the hours that the gates are closed.
Councillor at Large Tom Furey addressed the Commission and stated that he felt that
limited use would be beneficial to the area.
Dr. Moore addressed the Commission and stated that he does not see closing the gates at
anytime as beneficial to the estuary.
Brad Chase stated that he does not support the practice of closing the gates, but offered to
assist the Commission if they decide to plan some kind of schedule.
• David Mackey addressed the Commission and suggested that an impartial study should be
done on the effects of closing the tidal gates. He also noted that the Mayor agreed to
close the gates over the 4" of July and whoever closed them did so at low tide.
Abby Burns noted that the Conservation Commission was not consulted by the Mayor on
the closing of the tidal gates July 4th.
Councillor O'Keefe challenged the report on the water quality that was done by Salem
Sound 2000 and submitted to the Board of Health.
Former Chairman of the Conservation Commission Mark George addressed the
Commission and stated that he was amazed that the issue continues to be bantered. He
also noted that the marsh restoration project that is part of the GTE Landfill Capping and
is now under the direction of Salem State College would be affected by the constant
closing of the tidal gates.
Mr. O'Connor asked the Commission what steps they have taken to save the marsh. He
noted that he appeared before the Commission last year to express his concerns and a
meeting was supposed to he held with the state. He stated that Mr. George promised that
he would get back to him and he has not heard a thing since that meeting.

• Mr. Voutour addressed the Commission and asked them to consider a compromise as was
suggested this evening by City Councillors and allow the gates to be closed twice a
weekend.
Dr. Young stressed that he saw a big improvement in the estuary since the gate have
remained open.
Councillor O'Keefe addressed the Commission and reviewed the statute noting that the
Mayor should consult with the Conservation Commission. He asked that the Commission
consider the neighbors request and work out a compromise.
Chairwoman Debbie Hurlburt thanked everyone for attending.
Public Hearing -Notice of Intent - George D. Belleau- 7 Scenic Way- proposed
construction of a 10 X 10 deck within the buffer zone of the resource area
Mr. Belleau addressed the Commission and explained that this project has been approved
by the Commission and he is proposing to construct a 10 X 10 deck and he has revised the
plan slightly. He noted that he plans to do some minor grading and plant grass and there
is really little change to the approve plan.
Kevin Comacchio clarified that the house is not in the resource area, but the deck would
be.
• Debbie Hurlburt opened the hearing up for public comment at this time.
Jean Casey, an abutter addressed the Commission and expressed his concern about
stockpiling on the property. He also expressed concern of the grading of the road. Mr.
Belleau explained that the grade of the road would actually be lower when they are
finished.
There being no further comments or questions regarding this matter a motion was made
by Abby Burns to approve the Order of Conditions with special conditions, seconded by
Laura Rome and approved unanimously.
The Commission discussed special conditions for the project. It was suggested that a silt
fence be installed and hay bales be staked to establish a limit of work line.
Public Hearing Determination ofApplicability- John Giardi- 5 Scenic Way-proposed
grading changes and lawn installation within the buffer zone of a resource area
John Giardi addressed the Commission and explained that he would like to move the
location of his house 20 - 30 feet back to allow for grading and the installation of a lawn.

• Laura Rome asked how much of the area would be in the buffer zone. Mr. Belleau stated
that it would be 10 feet into the buffer zone.
Kevin Cornacchio questioned if this would cause any flooding to Mr. Casey's property.
Mr. Belleau stated that the drainage would go to the rear of the property so Mr. Casey's
property would not be affected.
Debbie Hurlburt opened the hearing up for public comment at this time.
William Gallagher asked to have the buffer zone explained to him Debbie Hurlburt
explained the buffer zone and the role of the Commission in determining what can be done
there.
There being no further questions or comments regarding this matter, a motion was made
by Abby Burns to issue a Negative 3 Determination, seconded by Kevin Cornacchio and
approved unanimously.
Discussion on the Installation of a Flag Pole at Pickman Park
Debbie Hurlburt reported that Mr. Bomestein has been requested to install a flag pole at
Pickman Park. She explained that the baseball field has been restored and a memorial
• dedicated to Mr. Jackman has been removed and they would like to reinstall it.
Karen Fabiszewski expressed concern about the city doing any work considering what
they did at McCabe Park without the consent of the Commission. A discussion followed
and it was agreed that a member of the Conservation Commission of an Administrator
from the Planning Department should monitor the work.
Motion made by Kevin Cornacchio to approve the installation of the flag pole at Pickman
Park, seconded by Abby Bums and approved unanimously.
Update on the City of Salem Transfer Station- 12 Swampscott Rd.
Debbie Hurlburt read a letter from the EPA regarding the Transfer station noting that an
enforcement conference would be held on Wednesday, July 26, 2000 to answer charges
that the City has not adequately responded to the Notice of Non Compliance issued in
December of 1999.
Mr. Skully, representing North Side Carting addressed the Commission and reviewed the
events that have taken place since the NON was issued in December. He also noted that
the property has been used as a landfill that was supposed to be capped in the 70's and has
not yet been done. He explained that the cost to cap the landfill would be $200,000.

• Debbie Hurlburt stated that the Commission needs to determine if the wetlands have been
identified.
Ward Three Councillor Joan Lovely asked what exactly is grandfathered on the site. Mr.
Skully stated that the activity is grandfathered.
Debbie Hurlburt stated that she feels that the Commission should issue a positive
determination and they should file a Notice of Intent with the Commission for the work
that needs to be done.
Motion made by Kevin Cornacchio to issue a Positive Determination for the Salem
Transfer Station at 12 Swampscott Road, seconded by Abby Burns and approved
unanimously.
The Commission discussed other violations that were found during the site visit held on
Tuesday, July 11, 2000. It was noted that there are trucks leaking into the resource area
and North Side Carting needs to be notified to move the truck from that area.
Kevin Cornacchio noted that he questions the integrity of the pipe that runs under the
road.
Discussion on the Approval to Pay Invoice for Rimmer Associates -Peer Review of the
• Bowditch School
Debbie Hurlburt explained that a meeting was held with the City Engineer and the
Architects for the Bowditch School project and Mary Rimmer reported to her that she was
comfortable with how the meeting went. She suggested that the Commission could vote
to allow the city to move forward with the Bowditch School project, with the
understanding that the Mary Rimmer and her Engineer review and concur with the final
plans.
Laura Rome moved and Kevin Cornacchio seconded a motion to allow the city to move
forward with the Bowditch School project, with the understanding that the Mary Rimmer
and her Engineer review and concur with the final plans. The motion was approved
unanimously.
Abby Burns moved and Laura Rome seconded a motion to approve the payment of the
invoice for Rimmer Associates in the amount of$900.00. The motion was approved
unanimously.

Update on McCabe Park
The Commission held a discussion on the status of McCabe Park. It was noted that Mr.
McIntire was going to file plans with the Commission. Debbie Hurlburt suggested that a
letter be sent to Mr. McIntire asking him to file plans for the next meeting on July 26,
2000.
Motion made by Abby Burns and seconded by Kevin Cornacchio to send a letter to Mr.
McIntire asking him to file plans for the next meeting on July 26, 2000.
Discussion on Forest River Tidal Gates
The Commission held a lengthy discussion on whether they should vote on the
recommendation to the Mayor this evening or not. Karen Fabiszewski expressed her
concern that the neighbors are under the impression that the matter will be decided at the
next meeting and they are not present now. The Commission decided to make their
recommendation at the next meeting on July 26, 2000, which will be held at 6:00 p.m.
rather than 7:00 p.m.

was made by Abby Burns to adjourn the meeting, seconded by Kevin Cornacchio and

September 14, 2000
A regular meeting of the Salem Conservation Commission was held on Thursday,
September 14, 2000 at 7:00 p.m. in the second floor conference room at One Salem
Green.
Those present were : Chairwoman Debbie Hurlburt Abby Bums, Karen Fabiszewski,
Laura Rome, and Kevin Comacchio. Also present were Don Cefalo and Eileen Sacco
Determination of Applicability—B P Oil Company Derbv Street
Rebecca Wholley, representing Gibbs Oil Company addressed the Commission and
explained their request to install monitoring wells on the site. She explained the locations
Of the wells and noted that they intend to collect samples at all tides and a still well will
be installed to show tidal effects.
Debbie Hurlburt asked if the were looking for petroleum. Ms. Wholley stated that ey

were looking for gasoline components but they expect to find petroleum on the site based
on the history of the area.
• Debbie Hurlburt suggested that they check with the Harbormaster to see if other permits
are required for the project.
There being no further questions or comments regarding this application, Debbie
Hurlburt suggested that a Negative Determination 2 would he in order, noting that the
work that the propose to do would have a negligible impact on the river front.
Motion made by Abby Bums to issue a Negative Determination 2 for the B P Oil
Company, Derby Street seconded by Kevin Comacchio and approved unanimously.
Request to Extend Order of Conditions Salem/Beverly Bridge Street Bypass
Joe? addressed the Commission and explained the status of the project. He explained
that the bypass road it as the 75%design stage but when it will actually go to
construction he could not say. He also explained that the Bridge Street reconstruction at
Washington Street is at 25%design.
Abby Burns commented that the park along the North River canal is in terrible shape.
She noted that she walks in the park and it is dangerous along the edge, noting that if
someone falls into the canal there is no way to get out. She also noted that it is unsafe
and the grass is struggling.
Mr. ?expressed his reservations that the park is in terrible shape, noting that he was there

Debbie Hurlburt asked who was responsible for maintaining the park. Mr. ? ted that
the city is responsible for maintaining the park.
Motion made by Kevin Cornacchio to extend the Order of Conditions for 3 years,
seconded by Karen Fabiszewski and approved unanimously.
Certificate of Compliance—Marblehead Municipal Light Plant
Debbie Hurlburt read the letter requesting a Certificate of Compliance for the Marblehead
Municipal Light project at Leggs Hill. She noted that the letter is not stamped by an
engineer as is the usual requirement of the Commission. She suggested that the
Commission table this matter and have the letter resubmitted with the stamp from the
engineer.
Old New Business
Bowditch School Update
Debbie Hurlburt addressed the Commission and reported that she talked to Bob Gellar
from Gellar Associates and he told her that revised drainage calculations are still needed.
She also noted that he informed her that the other changes that had been recommended by
Gellar Associates were made to the plans.
• Salem Transfer Station
Don Cefalo reported to the Commission that the mulch pile has been moved away from
the river front. He also noted that the plans have been submitted and no further work has
been done.
McCabe Park Update
The Commission discussed the status of McCabe Park. Debbie Hurlburt stated at
to that she
talked to Patrick Reffett. She noted that she was upset with the tone of the letter that was
received from Park and Recreation Director Latry McIntire. She reported that Ivh-.
Reffett stated that the Planning Department would be filing an NOI on behalf of the Park
and Recreation Department and the Engineering Department will pay for it.
Letter from Dr. Vor ac
Debbie Hurlburt stated that she would like to spend a little time going over the letter
received by the Commission from Dr. Vorgas. She reviewed the letter and noted that Dr.
Vorgas is requesting 24 signs be placed throughout the Forest River Conservation area.
The Commission discussed the request and suggested that two signs, one at the entrance,
and one at the exit to the area would be sufficient. It was suggested that a letter n sent

the letter the times that are of concern to Dr. Vorgas. It was also suggested that Dr.
Vorgas be invited to the next meeting of the Commission to make a report.
Debbie Hurlburt reported that Commission member Paul Orr has resigned and Mayor
Usovicz will need to appoint a replacement. She suggested that the Commission should
vote on a Vice Chair at the next meeting.
There being no further business to come before the Conservation Commission at this
meeting, a motion was made by Karen Fabiszewski to adjourn the meeting seconded by
Laura Rome and approved unanimously.

Public Hearing Notice of Intent-City of Salem Park and Recreation Department improvements to McCabe Park
Jim McDowell of Eastern Land Survey addressed the Commission on behalf ofhis client the
City of Salem. He explained that the BV W has been identified and no actual vegetated
vvetland was lost with the construction of the road. He noted that there was alteration of the
river front but it looks like the culvert didn't change. He suggested that some of the big stones
and some of the fill be removed.
Debbie Hurlburt stated that she took

a well written order could get a lot ofthat out of there.
Debbie Hurlburt noted that the two way traffic on the road is a concern to her. She noted that
she would have like to have seen if there was a problem with two way traffic and than address
it,rather than just widening the road.
Debbie Hurlburt also noted that she looked at the application that was filed and asked the
consultants if they felt that the work was done in a river front area. Joe Orzell of Gulf of
Maine Research Inc.addressed the Commission and stated that he telt that is was in the river
front zone. She cited the Rivers Protection Act and stated that there is an exemption for
maintenance on a roadway_
Kevin Comacchio suggested that he would like to see it brought back to its original footprint.
Laura Rome agreed that she would also like to see the original footprint restored.
Debbie Hurlburt asked who would be doing the work. Don Girard of the Salem Planning
Department stated that the City of Salm DPW workers and the Park and Recreation
Department would be doing the work. He stated that they intend to do the work in accordance
• with the wishes of the Commission.
Debbie Hurlburt requested that the Conservation Administrator go out and mark the area
following along the Kemwood Road side of the site. She also suggested that the hay bale line
should be extended to meet the other path at the intersecting road.
The Commission discussed a time line for the project. Debbie Hurlburt suggested that she
would like the erosion control measures in place by October 12, and the remediation project
completed by November 151h. It was suggested that they can cover the area with straw and do
the plantings in the spring. She also suggested that the Conservation Administrator be notified
48 hours in advance of the start of the work.
Debbie Hurlburt stated that she would like to see a cross section of what the slopes should be
on both sides of the path at the next meeting for Const rvation Commission approval. She also
stated that she would like to see a maintenance plan. Mr. McDowell stated that he would
write up a maintenance plan for the approval of the Commission
Debbie Hurlburt also stated that during the construction there should be no additional
disturbance of the existing vegetation.

Don Girard of the Salem Planning Department addressed the Commission and explained that
they are intending to resurface a parking area located behind the former Summer's Paint
building on Derby Street. He noted that the lot faces the South River. He reviewed the
problems with the site and the most notable problem being that of maintaining trash there. He
explained that this plan intends to resolve the flooding problem on the lot,and create public
access with a path along the river front. He also noted that the area would be landscaped.
Mr.Girard noted that there are dumpsters on the property which would be enclosed with a
stockade fence. It was recommended that seagull roofs be used to prevent the spread of trash.
Kevin Comacchio stated that he telt that it was a good plan and an improvement to the area.
Don Girard stated that they would like to do the work this fall either before or after Halloween
,noting that they have to go out to bid.
Motion made by Kevin Comacchio to approve the Notice of Intent of the 315 Derby Street,
seconded by Abbv Burns and approved unanimously.

Forest River Conservation Area
• Debbie Hurlburt reported that we have received a verbal commitment from Captain Comeau
of the Salem Police Department for increased patrols in the Forest River Conservation area.
The Commission discussed the proposed sign that Dr. Vorges would like to put in the area. It
was concluded that this is not exactly what the Commission had in mind and would like to
discuss with Dr. Vorges at the October 12th meeting. Karen Fabiszewski suggested that the
QM11"ission imvited Dr.Vorges to come and report to the Commission on a regular basis after
the first of the year.
Update Bowditch School
Debbie Hurlburt reported that we have received some information that is unclear about the use
of CDS Technology in place of the storm ceptor. She requested clarification from the
Architect on that matter.
Election of a Vice Chair
Debbie Hurlburt noted that we need to elect a Vice Chair of the Commission since Paul Orr
has resigned.

A regular meeting of the Salem Conservation Coannission was held on Thursday,October 12,
2000 at 7:00 pm. in the second floor conference room at One Salem Cn-een.
Those present were : Chairwoman Debbie Hurlburt Abby Bums, Karen Fabiszewski, Laura
Rahe,Joseph Fuinan and Kevin Comacchio. Also present were Don Cefalo and Eileen
Sacco.
Discussion with Councillor Joseph O'Keefe regarding the Forest River Tidal Gates
Councillor Joseph O'Keefe addressed the Commission and explained his plans to propose to
Mayor Usovicz that the city,fund a study of the effects of the periodic closing of the tidal gates
at Forest River- He explained that he would like some direction from the Commission.on what
kinds of things the study should cover.
Abby Bums suggested that they consult with Dr-Jay Moore's study that he did in 1991.
Councillor O'Keefe stated that they would use that study, but lie would like additional
suggestions from the Commission on what they would like the study to include.
Abby Bums questioned why the city should pay for the study. Councillor O'Keefe stated that
all he wants is some guidelines from the Commission that he can take back to the Mayor,and
if the Commission has a problem spending city money on the study, then that would be the
time to address that.
Debbie Hurlburt suggested that the Commission could put something together for Councillor
O'Keefe and discuss this further at a later time, since Councillor O'Keefe needs to leave the
meeting to attend a City Council meeting.
Update from Dr. Iyfilt Vorgeas on the Forest River Conservation area
Dr. Vorgeas addressed the Commission and updated the Commission on the work that has
been done at the Forest River Conservation area. He also noted that he is requesting to be
placed strategically throughout the Forest River Conservation area. He also reported that the
fence that needs to be repaired should be done as soon as possible. It was suggested that a
letter be sent to AMTRAK and the MBTA requesting that the fence be repaired.
Debbie Hurlburt noted that the Commission has looked at the request for the additional
signage and feels that there are too many signs.
Debbie Hurlburt also noted that the Police Department has agreed to additional patrols in that
area with the Bicycle Police.

Salem Police Officer Tim Salvo who was present in the audience addressed the Commission
and noted that he is a member of the bicycle patrol and he has been told by Captain Comeau to
patrol the Forest River Conservation area on a regular basis.
Discussion Regarding the Extension of the Superceding Order of Conditions for the Salvo
Property
Debbie Hurlburt addressed the Commission and reported that she talked to Jim Sprague fi-om
DEP and he wanted Commission input on the extension of the Superceding Order of
Conditions for the Salvo property. She noted that the matter is really in the hands of DEP, but
if the Commission chose to,they could comment on the matte,-

the Commission when it was taken up. She noted that since it is not a requirement that the
Commission comment on it, and thev have no say officially- she would be uncomfortable
commenting on it.

Don Cefalo addressed the Commission and stated that City Solicitor John Keenan is in favor
of approving a one year extension for this project.

• Public Hearing Notice of Intent-City of Salem-Proposed installation of RCP drain line
from Rosie's Pond to the Forest River
Debbie Hurlburt recognized Ward Seven Councillor Joseph O'Keefe and noted that he would
like to speak because he has to leave to attend a City Council Meeting. Councillor O'Keefe
addressed the Commission and endorsed the project noting that it is necessary for public safety
during heavy rains.
Debbie Hurlburt recognized Ward Three Councillor Joan Lovely who wished to address the
Commission as she also had to attend the City Council Meeting. Councillor Lovely addressed
the Commission and apologized for not being able to stay for the meeting. She stated that she
is asking for approval of this project that will bring relief to the neighborhood which has had
sever flooding problems. She recalled that in 1996 many neighbors were devastated by
Hooding. She noted that there were members of the neighborhood group present at the meeting
who would address the Commission when the meeting is open for public comment.
David Pabich of Camp,Dresser& McKee Inc.addressed the Commission on behalf of the
City of Salem and explained the plans to install a 36 inch RCP drain lune fi-oim Rosie's Pond to
the Fores4 River in an effort to relieve flooding in the Brook Street and Canal Street areas. He
explained that the proposed drain would primarily be installed along the abandoned

reaches of the Forest River. He noted that this system has been designed for a 25 near storm
event and the pipe will remain dry until and event.

Mr.Pabich explained the erosion control measures that they propose for the project. He noted
that there would be no long term impact on the resource area from the project.
Laura Rome questioned how much more water would reach the Forest River in a 25 year
storm. Mr. Pabich stated that it would be about 20 CFS. Ms. Rome suggested that if the gates
at Forest River were closed that would have an impact on the flooding. City Engineer Stan
Bornstein stated that when a significant storm is expected they would open the gates for other
considerations.
Kevin Cornacchio questioned if all of the manholes and catch basins are all deep sumps. Mr.
Pabich stated that they were.
Debbie Hurlburt noted that the Commission recently approved a plan for mosquito control in
that area. Mr. Bornstein stated that the city has a contract where they come out and clean out
the marsh and spray it.
Karen Fabiszewski asked how long they expect the project to take. Mr. Pabich stated that it is
a fairly simple project that should take about 60 days,noting that they would like to start as
soon as possible. He explained that it has to be completed by April 30, 2001 so that the grant
money will be spent,otherwise the money has to go back and they will lose the grant.
• Debbie Hurlburt questioned if they would need other permits for the additional outfall. Mr.
Pabich stated that they are not creating a new outfall just a net increase to Salem Harbor.
Debbie Hurlburt opened the hewing up for public comment at this time.

Fred I Zodaof 212 Jefferson Avenue addressed the Commission and explained the effects that
the flooding in 1996 had on his neighborhood. He showed the Commission pictures of the
devastation and presented letters of support for the project from Mayor Stanley Usovicz and
Council President Kevin Harvey.
Steven Keiss from Salm State College addressed the Commission and expressed his concern
that the backup of sewerage behind Salem State College in 1996 and this new pipe would be
emptying behind SSC. Mr.Pabich noted that the sewerage problem was with a manhole down
stream on Jefferson Avenue that overflowed and a 25 year storm should not effect that. Stan
Bornstein addressed the question and explained that in October of 1996 there was so much
storm water in the pumping system that it just could not keep up with it. He explained that
they have spent 2 1/2 million dollars removing stone water from the sewers and another 2
million repairing catch basins.
Debbie Hurlburt asked if there was any sewerage that gets into the Forest River_ Stan
Bornstein stated that there were two spots that they may have missed in the repairs, but they
are in the Collins Cove area.
Debbie Hurlburt asked if the members of the Commission wanted to visit the site. The

they will be doing the work. The Commission will look at this further at another meeting.
Salute to Salem Volunteers
Don Cefalo reported that he has received a letter from Councillor Joseph O'Keefe notifying
him that he is nominating Dr. Milt Vorgeas for the Salute to Salem Volunteers award.
Debbie Hurlburt noted that she has been getting some calls from people in the Forest River
area who are a little upset that Salem State College has no permits for the work that is being
done. She suggested that the Commission visit the site,noting that there may have been a
misunderstanding on the amount of work that was to be done. She also suggested that no
further work should be done until the Comrnission takes a look at it.
The Comnnission scheduled a site visit for Saturday,November 4, 2000 at 10:00 am.
There being no further business to come before the Conunission at this meeting a motion was
made by Joe Furnari to adjourn the meeting, seconded by Laura Rome and approved
unanimously.

to brush clearing, installation of three groundwater monitoring wells, six soil borings and one
