MINUTES OF MEETING
January 22 , 1981
The Eonservation Commission met.lat One Salem Green on Thursday,
January 22 , 1981. The Commission members persent were: Ray Lavender,
Dave DeVoe, Alice Akatyszewski and Paul Willis.
Commission members not attending: Brad Northrup, Brian French
and Phil Moran.
The Vice Chairman declared the meeting opened with a quorum
present at 8 : 15 pm.
BUDGET
Discussion was made by commission members relevant to cutting the
budget by 17% for fiscal year 1982 . Line items were discussed
at length and the following reflects the changes in the commission
budget:

It was agreed that the commission would remove its present telephone
and use the Planning Board telephone . The commission would have a
separate listing and would use the remaining $500 to absorbe
some of the cost of using Planning Board' s telephone. A motion was
made by Paul Willis and seconded by Alice Akatyszewski to strike
from the minutes the previous motion on the budget. The vote was
unanimous and the Vice Chairman declared the motion carried.
MINUTES OF MEETING - 2 - January 22 , 1981
• NEW ENGLAND POWER
Sue Madison has spoken with Joe Centorino and he advised the
commission that the New England Power Company will not ask
for a study from the commission. He will also try for a
resolution to get the city council to vote against the waiver.
A copy of .the letter received from New England Power on the
Salem Harbor Station is attached.
It was also noted that Sue Madison, Alice Akatyszewski and
Paul Willis attended the meeting.
PALMER COVE
Since the last meeting relevant to Palmer Cove Sue has almost
received the States complete attention. The ,State will be
contacting Fisheries. Division of Waterways, who is the real
applicant, has asked that the commission amend its Order of
Conditions to allow a different time for dredging because the
Department of Fisheries wants .them to do the dredging in the
summer and spring months to protect the flounder .
Dave DeVoe noted that the wirier flounder do not spawn in the area,
• as supported by a report from Sea Plantations. Palmer Cove agrees.
Sue Madison spoke to the Mayor and noted that if Fisheries will
not reverse their decision, the commission will. She will follow-
up next week. She has asked Waterways for their information relevant
to the spawning ground of the flounder.
TIRE REEF
The Department of the Army Corps of Enginners have issued a permit
to construct. and maintain an aritficial reef of rubber tires
(copy attached) .
Dave Devoe noted that a copy of the approval should be sent to Jay
Moore at Salem State who was very much-opposed to this proposal and
to ask him what his opinion is of the Department' s rationale in
granting the permit.
Paul Willis noted that the fish species are not named and no indication
of a preliminary study of the area prior to the placement of the
reef would be done . He also noted that Joe Bragionne should be
contacted and asked for his comments. (from Gloucester)
Paul Willis also noted that the commission' s view is still that the
project is nothing more than an attempt to dispose of tires.

Sue Madison noted that Frances Grace was the Commission' s laison.
Marblehead Minutes
The selectmen from the Marblehead Conservation Commission have
received .no response to a request of the Mayor of Salem to lift
up the tidal gates for the winter. The following motion was
proposed. . . "The conservation commission request that the selectmen
take all necessary action to ensure that all the tidal gates on
the Forest River remain open. . . " All voted in favor.
Sue Madison noted that the reason the gates are not up is that
they are broken and the expense would be exorbitant.. .
Sue will contact the Marblehead commission'-to see if they have
had any response to their letter to the Mayor. The commission
will then proceed with contacting the Mayor to see what action
the Mayor is taking to defuse the situation.

Brian French noted that he had spoken with Mr . Ragone ' s engineer
and both agreed that he would continue the hearing until he had
adjusted calculations ready for submittal.
A motion was made by Ray Lavender and seconded by Phil Moran to
• continue the hearing of Mr. Ragone until all pertinent information
is ready for submittal . The vote was unanimous and the Chairman
declared the motion carried. The continuation was set for February
26 , 1981 at 8: 00 PM.
MINUTES
A motion was made by Ray Lavender and seconded by Dave DeVoe to
accept the minutes of January 22nd as submitted. The vote was
unanimous and the Chairman declared the motion carried.
GOALS FOR THE UPCOMING YEAR
Brian French gave a brief outline of the goals the Commission would
be striving to accomplish in the upcoming year.
1. Completion of Phase II Acquisition - which includes action on
Leggs Hill and some of the work left over from Phase I.
2 . YCC project.
3 . Action on the Ingemi violation.
4 . A & H Auto - Sue Madison noted that the smell in the area has
forced the Mangiello property owners to vacate. Sue has already
• spoken to Tony Fletcher and the Board of Health and also noted that
the State (DEQE) is now involved. Sue will follow up. Brian French
noted that a friendly inspection should be made by members.

5. Putting together some kind of map that clearly shows all the
land under the Conservation Commission ' s jurisdiction.
6 . Development of a Management Plan for Conservation land.
Sue Madison noted that a student from Essex Agricultural was in
to talk to Mike Moniz relevant to doing a management plan as his
senior paper. Sue suggested that the Lynn Sand & Stone land and
the Housing Authority land would be a good study for this student.
7 . Development of a closer relationship with the Conservation
constable .
8 . Forming "Friends of the Forest River" .
9 . Cocktail Party - A date of May 8th was set for the annual
cocktail party. Sue will check on dates to see if it conflicts
with other activities. Sue & Sheila will handle press release
and printing of the invitations. Con Com members will pitch in
with addressing invitations.
10 . Joint meeting with Marblehead Conservation Commission tying
contiguous land together and getting the rock shut off from hunting.
TIRE 'REEF
• Sue noted that the EPA has not made its decision. Mavroulds has
attempted to have the tire reef applicant appear before the Fisheries
Board. All Fisheries Boards in the area have written to the Army
Corps of Engineers indicating that the tire reef is not an enhancement
to the Fisheries Act but a detriment to the Fisheries Act. This to try
to force tire reef applicant to file with the Fisheries Board.
Mr . Mavroules has appealed to the Army Corps of Engineers.
Phil Moran noted that if, in fact, the Conservation Law Foundation
does bring suit for Mavroules he will ask the Conservation Commission
to join as an interested party. It will be a class action suit - which
will require Marblehead, Salem, Beverly, Manchester and Gloucester
conservation commissions to join as a group.
Arm Corps of Engineers has agreed to do a trial of 300 square feet
of tires as opposed to the original 4500 square feet. This represents
10 ,000 tires as opposed to 10 million. Goodrich believes the poly-
propolene rope would not break. EGG engineering firm said that the
movement of water is � knot and they feel it would fray. They intend
to anchor the tires with a 400 pound anchor which EGG believes would
cause more strain.

NEW ENGLAND POWER COAL CONVERSION
Sue noted that the waiver may or may not be dead. The Governor ' s
Panel stated that there was no immediate emergency. Because of their
statement, the governor could not sign the waiver. He sent a letter
to the President noting that even though his panel was against it,
he was for it. The Department of Energy has received the letter
and will review it for the President.
UPAR
Sue will bring in a report on UPAR at the next regular meeting.
The rough draft will be sent to the Conservation Commission members
for review. Review period for commission is 2 weeks.
MASTER PLAN
Sue Madison noted that the master plan is at the printers. Conservation
commission to receive three copies. It will be ready in about a month.
MACC
Dave Devoe noted that the annual meeting of MACC is scheduled for
• March 7 at Holy Cross College in Worchester.
A motion was made by Phil Moran and seconded by Ray Lavender to
adjourn. The vote was unanimous and the Chairman declared the
motion carried.

A continuation of a public hearing was held for Joseph Ragone. Phil
Christiansen, Engineer for Mr. Ragone, was present to discuss changes
and additions to the original plans. Mr. Christiansen submitted 1.

. erosion control. 2. Also a sequence of work for di rting the

ROBINSON ROAD VIOLATION
Last Monday commission me ers viewed Robinson Road at t e request of
Bob Blenkhorn because of e odor problem. Paul Willis as of the
opinion that there was an aerobic decay releasing hydrog n sulfide i
because of the lack of ox en due to the ice build-up. Two houses had j
to .be evacuated because- of the problem. It was noted that the odors were
almost gone from the water,however, there still appeared to be some

Commission members also viewed Mr. Hutchinson' s property for violations.
Bob Blenkhorn contacted Brian French February 25th and informed him
that Mr. Hutchinson had build a bank along the road so that the over-
flow would not flow down Robinson Road and by doing this the water
would flood over Mangiello' s property. . Brian French contacted Sue
Madison to issue a Cease & Desist. Sue contacted the Sheriff' s office
and a Ceast & Desist was issued. Mr Hutchinson visited Sue and
verbally abused her. Mr. Hutchinson then contacted Brian French and
informed him that he would not . take the bank away for any reason.
Brian French noted that the Commission should get the opinion of an
expert of offer any solutions to aleviating the flooding.
It was also noted that Bob Blenkhorn would like a report from the
Commission relevant to this problem. Brian French will compose
and have a report typed up covering the commission ' s findings and
possible solutions to reduce the problem for reoccuring.
A motion was made by Brad Northrup and seconded by Ray Lavender to
fully support Sue Madison' s actions on issuing a Cease & Desist order
and also to go to court immediately to have Mr. Hutchinson forced
to remove the bank and car, : which .acts :as a boundary line, from
the property. The vote was unanimous and the:: Chairman declared the
•notion carried.

a report and make recommendations on the program.
WINTER ISLAND COMMISSION
Ray Lavender noted that the first meeting of the Winter Island Commission
was held. It was an informal meeting. Members were: Ray Lavender,
John Hayes, Plummer Home; Mr. Lavoie, Rec. & Park Department; Mr.
Centorino Salem St College; M• r r. Armstrong, P.O. Department; Walter
Powers, Planning Department and Mayor Levesque. Ray Lavender will keep
the commission abreast of any happenings.
SEWER
A public hearing was set for the City of Salem on March 12th to remove
and replace some wooden sewers on Leach St. and Lafayette Place. A
small part lies in the Flood Hazard Zone.
A motion was made by Ray Lavender and seconded by Brad Northrupo
&lose the meeting. The vote was unanimous and the Chairman de cared .
the motion carried.

APPRAISAL
Sue Madison informed the commission that she met with Mr. Noone
on the Mackey appraisal and he informed her that it should be
ready within a week. He has also checked with the Town of Marble-
head and they informed him that there would be no way they would
allow a sub-division to connect into Marblehead.
A motion was made by Alice Akatyszweski to adjourn. The Chairman

Conservation Restrictions--Marblehead land
Information will be requested from Brad Northrup and Susan Madison

Highland Avenue
It appears that the Moose Lodge on Highland Avenue is filling
quite substantially at the end of the existing parking lot on
the Lynn side . The area is a wetland. This problem, together
with an area that is being filled by the City behind the Arco
station diagonally across from Willson Road, will be investigated
further by Mr. Lavender and Susan Madison. There is a question
as to whether the area behind the Arco station is indeed a wetland.
Dearborn Lane
Prior to this evening' s meeting, members of the Commission joined
members of the Planning Board to view property on Dearborn Lane
owned by Mr. Leonard Pappalardo. He has dumped fill on the pro-
perty without a permit. The Commission has requested that Mr.
Pappalardo send a plan showing how he will finish the land and
protect the toe of the bank. He will also remove fill from the
level to a point where the natural bank starts.

HUTCHINSON
Following the return of a letter sent to Mr. Hutchinson on September 15,
1981, which he refused to accept, it was recommended a criminal complaint
be filed against Frederick Hutchinson. The matter is clear cut. Charges
include storage of junk cars within 100 feet of a wetland, petroleum
products draining into the stream, illegal damming of the stream, potential
pollution to users of wells. We will ask the court to force the compliance
of the Wetlands Protection Act and to insist Mr. Hutchinson appear before
• the Commission immediately.
FIORE
The hearing against Mr. Fiore will be held on October 7, 1981. Witnesses
will include Tony Fletcher and a representative of Massachusetts Depart-
ment of Public Works (due to the state culvert) . Bill Tinti, Susan
Madison, and hopefully Phil Moran will attend. It is hoped that Mr. Fiore
will be forced by the court to take out the material to the satisfaction
of the Commission and free the stream. No more fill will be allowed
without filing under the Wetlands Protection Act.
PICKMAN PARK/SALEM ACRES
An extension of the Order of Conditions on Pickman Park was signed by the
members present.
PICKMAN PARK BEACH
Mr. John Hannon of the Division of Waterways will be contacted regarding
proposed work to the beach.
CHESTER KOHN--DETERMINATION
Mr. Chester Kohn, 30 Belleau has requested permission to repair a crack
• in his seawall. The Commission determined the area on the plan is subject
to the Act but the proposed work is not dredging, filling, removing, or
altering, and therefore a Notice of Intent is not required.

Regarding the South Channel, in lieu of calculations originally requested
in the Order of Conditions (64-65) , a plan has been submitted and approved
by Tony Fletcher. After perusal by Brian French and Alice Akatyszewski,

members, a letter will be sent to Shetland and DEQE to accept this plan
in lieuof the calculations originally requested.

APPROVAL OF MINUTES
Upon the motion of Raymond Lavender and second of Alice Akatyszewski,
the minutes of the September 24, 1981, meeting were approved with
the correction of a typographical error on p. 2.
FIORE
Mr. Moran stated that a hearing before the Clerk Magistrate was to
be held on October 7, but due to the absence of Susan Madison, it
• was postponed. A new date will be set when Susan returns . The
purpose of the meeting was to determine whether the Magistrate would
issue a criminal complaint against Mr. Fiore . Mr. Fiore would
have to appear before the Clerk . The outcome of the hearing would
be the enforcement of the Cease and Desist issued by the Com-
mission. There would be a fine according to the criminal code .
Further proceedings as to the removal of fill, etc. would be a
civil matter. However, as far as forcing Mr. Fiore to appear
before the Commission, unless it was part of the criminal complaint,
the fact the Mr. Fiore did not appear before the Commission would
not be in contempt.
NEW BOARD MEMBERS
Mr. Christopher Hagger and Mr. Glenn Yale were officially wel-
comed as new members of the Commission. Having been unanimously
passed by the City Council earlier this evening, they will be
sworn in before our next meeting.
REMINDERS
Now that Brian French has resigned from the Board, a list of re-
minders was presented in order to acquaint the new Board members
with the current issues before the Commission:

Demi: Off Highland Avenue, Mr. Ingemi has dumped unacceptable fill which is breaking down and leeching into the river. The wet-
land is now dead and a serious pollution problem exists . Despite
a Cease and Desist order issued to Mr. Ingemi some time ago , no
action has been taken to remedy this problem.

issued to Salem Acres and bears careful watching.
Conservation Restrictions--Marblehead-owned lands This area has
been a source of water for Marblehead in the past. We wish to
have Conservation restrictions on this land.
Le 's Hill: This land is owned b Macke and is the cornerstone

of the Conservation land. Many appraisals and ideas have been
presented as to the use of this land--the latest being a hotel--
and if the money appropriated for use here cannot be used, it
should be used elsewhere consistent with Conservation land ac-
quisition.
Management plan for Conservation lands: No plan is yet in place
for the proper management of the Conservation area; i. e . limits
• on use . This should be a priority for the Commission.
Formation of Forest River Advisory Committees A committee of
neighbors to the Conservation area should be formed to help
in the management and protection,of. the area. Brian French has
volunteered to chair- this' project•.• •
Coo eration with Salem Police - , ,Brian French had written a letter
to Chief Connelly '(attachedhereto and made a part hereof) des-
cribing the serious misuse and violations of the law taking place
on the Conservation land presently. There is constant dis-
charging of firearms, vandalism, fires , etc. Better cooperation
with the police department is needed in addition to the Neighbors '
Advisory Committee to help control the damage being done in the
area.
Cataloging of Conservation properties and verifying the deeds :
The long-term value of cataloging the conservation properties
is immeasurable . Deeds, easements , etc. must be checked and
properly recorded.
LAND TRUST
Brad Northrup spoke about the Salem Land Trust which was formed
several years ago to provide private cooperation regarding con-
servation as well as public. Brad turned the information over
to the Commission.

• Paul Willis commented that Brookline had set up a Land Trust
using Salem as a model. Our approach should be to find people
who have vulnerable land and see if they are interested in do-
nating
nating it. The tax structure has changed so that giving is not
what it once was , however, we must continue to try.
PROPERTY INSPECTION--GREENWAY ROAD

Brian French was asked by the Board of Appeals to inspect a piece
of property on the corner of Greenway Road and Highland Avenue .
The owner of the property wishes to build a single family home
( it is approximately 5000 square feet) . The concern is for pro-
per drainage . After inspecting the property, Brian determined
the area is not a wetland so does not fall under the pervue of
the Commission. He did, however, offer the assistance of the
Commission if needed.
Paul Willis spoke with great admiration and gratitude for Brian
French and Brad Northrup. They have tirelessly contributed a
great deal of time , effort, and energy to the Commission at a
time when the cornerstone of the Conservation effort was being
laid. He urged the Commission to continue this effort.
Philip Moran added his thanks and admiration to both Brian and
• Brad. All the members of the group gave them a round of ap-
plause .

. I write to ask for a meeting with you to discuss the pos-
sibility of a cooperative effort between your Department and
the Conservation Commission to help protect the City's conser-
vation areas. Over the last four years, $425,000 have been spent ,
for acquisition of land in fee and for easements. An additional
$126,000 has been spent in making a trail system to open the
land for people' s enjoyment and for educational purposes.
Now that our program is just about completed, the trail sys-
tem is being used by motorized vehicles which are causing serious
problems of erosion on the trails . The use of the vehicles on
the trails, together with the discharge of firearms, are dis-
couraging the type of use for which the land was intended.
I would welcome a meeting with you to explore how we can
work together and bring the authority of your Department to help
us reduce and control the inappropriate use . I will telephone
you during the week of September 7th to arrange a meeting at our
mutual convenience .

Vice-chairman Raymond Lavender called the meeting to order at 8:02
P.M.
It was decided to take the election of a new Chairman out of order
until the end of the meeting in the hope that more members would
arrive . This motion was made by Glenn Yale and seconded by David
DeVoe . It was so voted.
APPROVAL OF MINUTES
Upon the motion of David DeVoe and second of Christopher Hagger,
• the minutes of October 8 were approved. It. was so voted.
DEARBORN LANE
Each member present had the opportunity to view the property on
Dearborn Lane . All agreed that the conditions set forth by the
Commission had been met. It was suggested that the back slope
be rip-rapped or planted to minimize erosion. Mr. Pappalardo agreed
this would be a good idea. David DeVoe noted that there is no
wave action at the site but due to the loosness of the gravel,
a high water could cause a problem. Mr. Pappalardo described the
house he plans to the Board and further stated that the elevation
was in accordance with the state building code .
David DeVoe made a motion to contact the Building Inspector and
inform him the Commission approves of the site preparation of
Lot 5, Dearborn Lane and it is our opinion it is acceptable for
a building permit to be issued and the owner be released from
the Cease and Desist issued to him by the Commission in July.
Second by Christopher Hagger. It was so voted.
FUNDING FOR SUSAN MADISON
Susan Madison described the problems she has recently encountered
as to the funding of her position. The problem stems from the
• fact that funds from the Planning Board from last fiscal year were
not carried over by the City Council. (These funds pay part of Su-
san;'-s salary) Funds from the Conservation account, however, were
carried over so these monies would fund Susan's position through
June .

A motion was made by David DeVoe and seconded by Glenn Yale to ear-
mark the carry-over funds from the previous fiscal year to continue
to fund the position of Conservation/Planning Board Aide through
June . It was so voted.
Additionally, it was unanimously agreed that this position is vital
to the continued work of the Commission.
At this point the discussion turned to the importance of better
public relations for the ConservatimQmmission. Few people know
how important the Commission' s job really is . We are custodians
of over two hundred acres of land and the permits we issue are
mandated by state statute . In this time of budget cuts , etc . it
is important to acquaint city officials and the public at large
with the important work the Commission has done and plans to do in
the future .
FUND-RAISING
Susan Madison suggested the use of a Coastal Management film
which is available to us free of charge . She thought perhaps
we could show this film and have a coffee and discussion period
afterwards and it would be a way of making some money to cover
• the cost of stationery, etc. All agreed this would be a good idea
and will be pursued further. Each Commissioner will bring in two
fund-raising ideas for the next meeting.
LAND ACQUISITION
Susan Madison gave the Board an overview of the area now owned by
the city and governed by .the Commission. She discussed the 'hope
that a "greenbelt" will eventually be formed right to the Peabody
line . The Mackey land and Marblehead-owned land were discussed
further. It is hoped we can get Conservation restrictions on
the Marblehead land. There are four possibilities for land ac-
quisitions Negotiation with the owner, tax title land, purchase ,
and conservation restrictions.
ELECTION OF NEW CHAIRMAN
Upon motion of David DeVoe and second of Christopher Hagger, Ray-
mond Lavender was unanimously elected Commission Chairman. He
accepted the position for one year. Upon motion by Christopher
Hagger and second by David DeVoe , Philip Moran was elected Vice-
Chairman.
FIORE AND -HUTCHINSON
It was decided to continue to seek injunctive relief against both
• Mr. Fiore and Mr. Hutchinson.

FUND-RAISING
David DeVoe submitted several fund,-raising ideas for the Commission' s
perusal (attached hereto and made a part hereof) . These ideas in-
cluded a walk-a-thon through the Conservation Area, a concert and
tea at Old Town Hall, a cocktail party that made money, etc . He
stressed the need for good public relations and knowledge by all
the Commissioners as to the past accomplishments of the Commission.
The possibility of a walk-a-thon to end our traditional Spring
weekend was discussed; also perhaps it could be held in conjunction
with the Winter Island outing. Following further general disollssion
as to the best time to plan this type of event, it was decidedito
research further how much income would be derived from such" ars
event. Alice Akatyszewski will look into the possibility of" T-
shirts for participants (cost , etc . ) . More thought will be given
to the whole plan through the winter.
Raymond, Lavender brought up the possibility of offering helicopter
rides over the City. The possibility of hot-air balloon rides was
also discussed and Philip Moran will look into this further.
The idea of a dance at Hamilton Hall perhaps was discussed and
all agreed that the end of February was a good time for this type
of event . Also , Philip Moran very generously offered the use of
his home for the Commission cocktail party. All agreed the Spring
Weekend idea was a good one to be continued.
Chris Hagger raised the possibility of a bicycle or road race .
Philip Moran felt the city was not receptive to the idea at
• this time due to traffic control problems , etc .

• CITY-OWNED LAND
Susan Madison presented a list of tax title land taken by the City
to each Commissioner (attached hereto and. made a part hereof) .
There are four parcels on Bakers' Island that. were discussed first.
The question was raised as to whether it was the. wisli of the Com-
mission to request the City Council to put custodianship of these
parcels under the Conservation Commission. There followed a good
deal of discussion as to the relative merits of ppening up the Is-
land to the general use of Salem residents. It was agreed that
opening up use of the Island to the city would cause serious prob-
lems and in essence the Bakers ' Island residents were preserving
the Island quite well and there was no real reason to put the
Island under our jurisdiction.
Upon the motion of Philip Moran and second of Alice Akatyszewski,
it was decided to leave Bakers' Island status quo until such time
as they come to us with a request for help. It was so voted.
The Commission now owns a parcel of land off Highland Avenue to
protect the headwaters of the Forest River. There are three other
parcels which would be desireable to protect our greenbelt options
as we already have restrictions on the Lynn Sand and Stone land.
These parcels, two on Robinson Road, and one to the rear of High-
land Avenue (Lots 6/18, 6/11, and 8/8) are desireable for conser-
vation restrictions at the very least.
Upon the motion of Philip Moran and sec&nd of Alice Akatyszewski,
it was decided to request the City Council to place the above-named
lots under the jurisdiction of the Conservation Commission. It
was so voted.
For purposes of discussion, land which the Commission already has
conservation restrictions on was also included on the list pre-
sented by Susan Madison. Philip Moran will speak with the City
Solicitor in Peabody to ask for additional protection for the Spring
Pond area. Glenn Yale and Susan Madison will attend a meeting of
the Marblehead Conservation Commission to initiate discussion re-
garding Thompson's Meadow and Legg's Hill Road. Phil Moran
pointed out that we have $160,000to buy the Mackey land and we
may have to spend it somewhere else and perhaps Marblehead would
be amenable to selling Thompson' s Meadow. This matter will be
investigated further.
HUTCHINSON AND FIORE
A letter has been sent to Mr. Fiore strongly urging him to appear
before the Commission at the December 10 meeting (attached hereto
and made a part hereof) . Members of the Commission will view
the Hutchinson property on Saturday. Chris Hagger feels that if

oil and hazardous waste was indeed draining into the wetland , it
was an EPA problem.

It was also pointed out that an abutter to Mr. Fiore , a Mr. Joseph
Morphew, was also storing junk cars on the embankment. If possible
this area will be inspected on Saturday and a decision as to whether

Chairman Raymond Lavender called the meeting to order at 8 : 05 p .m.
MOOSE LODGE
Mr. William McLaughlin of the Moose Lodge appeared before the Board
with reference to the fill being stored on the bank of the stream
on their property. Previously, the Lodge had agreed to pull the
fill back away from the bank and cover it with a tarpaulin. This
has not been done as of the present and Mr . McLaughlin was asked
to appear at this evening' s meeting.
• Mr . McLaughlin stated that some fill had been pulled back from the
bank, but there is a serious problem on the land which had not
originally been anticipated. The settlement of the fill is being
monitored while numerous soil testing, etc. is being done by the
Lodge to determine the best use of the land. Mr . McLaughlin' s
impression from earlier conversations with the Commission was
that there was a six-inch clay berm under where the fill is being
stored. He feels this is an exagerration. They find very little
clay seal--no more than an inch to an inch and one half .
Susan Madison commented that removal of the fill is even more im-
portant in light of this fact .
Mr . McLaughlin replied that numerous tests are being taken on the
site and he would prefer not to comment on the results until all
tests are completed. He feels the Lodge has a marketable piece
of property and they wish to make the best possible use of the
land feasible . They have hired an engineering firm (Gallagher and
Goodwin--Andover) and they are exploring various ideas as to the
best use of the land. Currently they are negotiating with New
England Power to use their fly ash as land fill .
Susan Madison asked if the Lodge had applied for any permits .
Mr . McLaughlin replied that they plan to reinstitute the existing
• permits for the land.
Susan Madison stated that there is no Board of Health permit in
existence for the use of fly ash for fill.

• Glenn Yale further added that all permits designate the type of
fill to be used.
Susan Madison also commented that laws do change and any recent
renewal::would include wetlands .
Mr. McLaughlin felt certain that Health Agent Robert Blenkorn
said the existing permits were valid. This will be checked into
further .
Mr. McLaughlin feels fly ash would be a good stable fill. They
also want to culvert the brook--possibly adding an extension to
the culvert by the transfer station.
Christopher Hagger asked when-any plans might be available for
the Commission's perusal.
Mr. McLaughlin replied that they were still negotiating contracts
etc . Mr . Joseph Falzone is acting as overseer as to contract work
with New England power . Some equipment has already been purchased
and they anticipate a long-term project .
Glenn Yale raised the problem of the fill still being on the toe
of the slope. With inclement weather , the problem could only get
worse .
• Mr. McLaughlin replied that he does not want to touch the fill--
there is serious erosion, the bank is unstable , etc . He added
that there is no recorded flow downstream--just upstream from the
transfer station--which raised the possibility of a blockage some-
where.. He asked who would clean the culvert? Is this a Conserva-
tion problem, a state problem, what? They felt that should they
connect to the existing culvert , a trash rack would be in order .
Susan Madison stated that the problem is probably with the culvert
itself rather than an animal or something, but the culvert is the
responsibility of the state .
Glenn Yale reiterated the immediate problem of the fill being
stored on the bank.
Mr . McLaughlin felt that any. fill that went over the bank would
probably be an enhancement rather than a problem.
Glenn Yale asked that Mr . McLaughlin get his test results together
as soon as possible and a meeting will be set up with the City
Engineer . the Board of Health, and DEOE to ,get this problem re-
solved to everyone ' s satisfaction immediately.
Mr . McLaughlin reiterated his concern for the instability of the
• slope and felt the fill should be left where it was .
David DeVoe remarked that despite the future plans for the land ,
legally the Commission is charged with protecting the wetland. In

• the interim, until formal application is made for permits , etc . ,
some provision must be made as to the disposition of the slope.
Some documentation as to why the fill should not be removed must
be sent to the Board immediately . Test results should be submitted
and a meeting with all concerned parties should be set up as soon
as possible. Despite the quality of the slope and the good quality
of the fill on the slope , our concern is for the protection of the
wetland. David DeVoe asked that the Mr. McLaughlin provide the
the Board with a written narrative of his concerns. together with
the test results . At that time Susan Madison will set up a meet-
ing with all appropriate groups .
There being no further discussion , Mr . McLaughliniwas excused with
the thanks of the Commission.
HUTCHINSON
Present were Attorney .John Lescaris , Mr . Hutchinson, Mr . Angelo
Mongiello and Mrs . Carmen Mongiello . Susan Madison gave a
brief synopsis of the problems leading to the present , beginning
with the odor problem which led to testing of the wells and
brook on the Robinson Road land. It was determined the odor
stemmed from a quick-thaw situation. Further , the water and
drainage problem there is serious . Mr. Hutchinson dammed the
• brook up at one to try to alleviate the problem and this
caused flooding of one home on the road and altered the wetland.
This was done without benefit of permit and resulted in the
service of a cease and desist by the Commission. Mr . Hutchinson
did remove the dam and further has moved storage of his auto-
mobiles away from the brook .
Mr. Lescaris asked why they were asked to :.appear.
Susan Madison stated that the Commission (after viewing the situa-
tion recently) felt that the best way to solve the severe flood-
ing problem is to get Mr. Hutchinson and the Mongiello family
together to try to work out a solution to the problem.
There was much discussion as to the best way .to handle the water
problem. At one time there was a gully in back of the Lynn Sand
and Stone property which. took care of the water. In addition,
Mr . Mongiello commented that Robinson Road is now a dead end. In
the past it went all the way from Swampscott Road to Swampscott .
Now Lynn Sand and Stone has shut if off. Additionally , when '
Swampscott Road was paved, no provision was made for catch basins
or proper. drainage:
This problem has been communicated to the City many times with
no results.
• The Mongiellos and Mr . Hutchinson stated they would cooperated
in solving the problem even to doing some of the work themselves ,
but the City needs to cooperate .

Christopher Hagger suggested all concerned parties meet to discuss
this further and David DeVoe added that the problem is ultimately
the City' s . He suggested a letter to the City Engineer outlining
the problem and requesting a meeting .
Chris Hagger added that there is an additionaproblem of potential
contamination of the wetland. IV
Mr. Hutchinson commented that the brook was tested and nothing
contaminating was found.
Chris Hagger asked what the oily sheen could be on the back side
of the property. Mr . Hutchinson answered that Bill St . Hillaire
of DEOE felt it was caused by algae. Chris Hagger• commented that
despite the fact the cars have been moved from the bank, there is
a concentrated source of •potential contaminants .
Mr . Hutchinson stated that the soil is mostly clay, so there is a
run-off . Chris Hagger said this could make the problem even worse.
He asked that all test .results Mr . Hutchinson has be forwarded to
the Commission for study. Mr. Hutch nson _will send then and a
meeting will be set up .
• There being no further discussion, the gentlemen were excused with
the Board' s thanks .
APPROVAL OF MINUTES
Upon motion of David DeVoe and second of Glenn Yale , the minutes
of November 12 were accepted as amended.
FIORE
Further effort will be made to contact the Department of Public
Works person who has been advising Mr. Fiore . Mr. Fiore will be
appearing at our January meeting.
There being no further business , the motion was made and seconded
to adjourn. Having passed unanimously, the Chairman declared the
meeting adjourned at 10 :22 p .m.
