DeCoulas of 27 Durham Drive, Lynafield; and for 72 Dearborn Street, owned by James F. Cahill, Jr. of 17 Ober Street, Beverly. All abutters have been notified. It was proposed and carried that the above properties are applicable under the act, the sites were viewed by 5 commissioners on April 24, 1976. It was also voted unanimously that. notice of:-,applicability be attached- to the claim of title. Richard Morton reported that a house at 66 Dearborn Street (Map 36, Lot 488), has been denied an occupancy permit by the Building Inpector.due to structures and fireplaces not included in the plan filed. Also a cease and desist notice to be sent because . filling in of a wetland at the same property. The owner is Mr. Belleau. Mr. Morehouse will attend the next ConCom meeting, TUESDAY, May llth, to discuss the Wetlands Mapping. Councilor Frances Grace has notified the ConCom that property located on Highland Avenue, opposite the old High School, may be a proposed donation to the ConCom. Dolores Jordan distributed membership envelopes from the New England Forestry and Friends of the Earth. Cleti Cervoni distributed copies of the Wetlands Brochure and at'sounced that the General Brochure will be ready on Tuesday for distribution during Conservation Weekend. Mr. Cady did ask for a copy of the analysis being made by the Health Department and ConCom. Mary Ellen Pelletier will check into sources of biological consultation for present and future testings needed. It was voted unanimously to commence civil action against Mr. Ingemi as to date he has not fulfilled any of his responsibilites and ConCom feels that any further delays could seriously endanger the environment of the wetland and downstream marsh. Commission members attending were: Chairman Brian French, Vice-Chair- woman Mary Ellen Pelletier, David DeVoe, Donald Hunt, Henry Nichols, Brad Northrup and Paul Willis. Associate members attending were: Alex Arcisz, Cleti Cervoni, Dolores Jordan, David Pelletier, Elias Theriault and Pollyanne Tierney. Also attending were: Council Liaison Joseph Saraceno, Councilor Len Cawley, Conservation Assistant Richard Morton and Reginald Hartley, John G.W. Thomas, Jr. , James J . Hourihan, Jr. and Marcia Hourihan from the Marblehead Conservation Commission. The minutes of the previous meeting were accepted with correction. Mr. Willis stated that he wished his objection to acceptance be noted as he felt the minutes were re- ceived too late to be read properly before voting. Ito following notices and communications were announced: A notice from the Conservation Law Foundation of New England regarding the refusal of Building Inspectors to issue building permits if a potentail violation of the Wetlands Protection Act may be involved. Rep. Norris Harris has proposed a bill to the House (#536), concerning the South Essex Ocean Sanctuary, which would limit and control and require special licenses to remove, dredge or fill in the ocean within the S .E.O.C . area. A letter from the South Essex Sewerage District concerning the Wetlands Protection Act and their applicability to it with the Marblehead connector. A determination was made at their own request, and it was determined they must file. A notice of special events scheduled by the Salem Bi-Centennial Commission: Dedica- tion of Fort Lee, Sunday June 20, 1976 at 3:00 P.M. ; McIntire Arch dedication on the 4th of July at 4:00 P.M. and the dedication of Fort Pickering on September 18th at 2:00 P.M. A letter was received from the Mayor requesting 2 members of the ConCom to serve on a group studying zoning. Dori Hunt and Brian French will serve. Letter from Massachusetts Audubon announcing workshops on Wetlands, to be held April 7, 14,21 , and 28. Richard Morton and Dolores Jordan to attend. Information from City Solicitor William Tinti stating that Conservation Assistant Richard Morton has the right to 'trespass, serve and enforce the Wetlands Protection Act was received. A letter has been sent to Mr. Tinti regarding the ownership of the Islands and rocks in Salem's waters . Also a letter regarding the Dennis town By-laws, which we hope might be incorporated similarly into an ordinance for Salem. A seminar on Coastal Recreation Resources in an Urbanizing Environment to he held • April 12 - 14th on Cape Cod. Attendance fee: $30.00. Mary Nestor to attend. - 1 - 1:. An informal discussion was held with Mr. Joseph Ragone regarding his property off of Swampscott Road. Mr. Ragone had received a permit to fill in 1970 for the front portion of his property. He is now storing materials from the new court house site and wishes to stockpile materials . Because the areas fall within 100 feet of wetland, Mr. Ragone is liable under the act and must have a wetlands hearing. He will provide his notice of intent and his plans as soon as possible and we will schedule a hearing. David Devoe reported on Financial Business . We have $2355 in our expense account, Mr. DeVoe summarized the various bills due and expenses paid for the Map File, the MACC conference, ordering of publications, film and developing charges, stationery supplies. The balance in the expense account will be used primarily for printing costs.. Brad Northrup led a discussion and explained the plans for the Forest River Conserva- tion area with maps and areas listed for acquisition. The first priority is to protect the estuarine tidal marsh and watershed, the second is the scenic value as the last major open area in the city from Salem to Boston. The land needed to be acquired is about 250 acres, 150 acres are now in public ownership, and we discussed the use of a conservation easement with the Town of Marblehead, who owns Thompson's Meadow. Mr. Reginald Hartley of Marblehead pointed out that Marblehead owns 100 acres of conservation land within the town. The city has applied for a HUD grant for $35,000 and has applied for Massachusetts self-help and B.O.R. matching funds. Mr. Northrup will meet with David Lash regarding appraisals needed to complete the application processes . David Pelletier reported the Marine Resources Committee has accumulated about 300 r slides of Salem Harbor and the Islands . There is a need now to document the flora, • fauna and establish a marine inventory. He reported on the Coastal Zone Management ( Workshops, the meeting on April 8th will be held at the Salem State Library at 8:00 P.M. and the topic will be managment mechanicisms . The local towns and cities in the area 'hope to establish a united front for safeguarding the coast through the Coastal Zone Management programs . Paul Willis is in contact with the Waterways Advisory Board regarding the preservation of the islands and establishing boundaries. Cleti Cervoni distributed the schedule for Spring Weekend. Further discussion and .r assignments will be discussed at the next meeting. Everyone's help is required to insure the success of Spring Weekend. David DeVoe reported that under Chapter 40, Section 8-C we are entitled to set up a fund, administered with restrictions, for use for contingencies, that would be separate from the annual budget and could be carried over from year to year. Also, we might establish a second fund, private in nature, that could utilize and accept gifts, contributions, land bequests, etc . More information on these will be reported at a later meeting. There was a general discussion on the format of ConCom meetings. Mr. DeVoe felt that although the agenda must be flexible as our meetings are also work sessions, that it was difficult to get a topic on the agenda as no real agenda is established in advance. Mr. French replied that due to the time restrictions we all suffer from, the agenda is not set up until the day or so before the meeting. It was agreed that if anyone . wished a specific topic to be discussed at the meetings, they should call Mr. French prior to the meeting and he would be happy to add that topic(s) to the agenda. It was voted upon unanimously that the Publicity Committee's name would be changed to Education Committee, as that is primarily the duties of that committee . The meeting adjourned at 10:45. Commission members attending were: Chairman Brian French, Vice-Chairwoman Mary Ellen Pelletier, Paul Willis, Donald Hunt, and Brad Northrup. Associate members attending were: Alex Arcisz, Cleti Cervoni, and Mary Nestor. Also attending were: .Conservation Assistant Richard Morton, Mr. Kastrinakis and Richard Mailhoot. The minutes from the meeting of April 12th were accepted. The minutes from the meeting of April 26th were accepted with corrections . Paul Willis abstained from voting on the minutes of April 26th. Brian French asked the Commission to consider Mr. Kastrinakis/ request for a determination on his property - Stombergis Restraurant. He explained that the owner wanted to riprap the edge of his property near the beach. He then read a letter submitted by Mr. Kastrinakas which discussed the erosion affecting his access road. This road is now becoming dangerous for the trucks delivering to his restraurant. Brian French, Paul Willis and Richard Morton have seen the area in question and agree to the seriousness of the erosion. Brian French stated that he did not believe that the Wetlands Protection Act was applicable in this case since the owner only wanted to protect the land still existing, not fill in additional land. Paul Willis made a motion that the Wetlands Protection Act does not apply in this case. Brad Northrup seconded the motion and it was approved unanimously., , s Communications and Notices Minutes from the May 20th and June 3rd Marblehead Conservation Commission were discussed. Brian French noted further discussion on conservation restrictions on Ram Island._ - The Conservation Legislation Bulletin containing all pending environmental legislation was noted. Brad Northrup stated that it should be read by'all members . Brian French asked if he would read it over and report on some of the more significant legislation. The bank statement was read and there is now a balance of $43.63. A notice was read announcing the availability of a book entitled Guiding Growth and Change by Sarah Peskin. Cleti Cervoni said the book was available through Audubon and should be free for the ConCom. A discussion was held concerning the dispute between the SESD and the EPA. The ConCom has received copies of communications between these two agencies . Mary Nestor stated that the EPA was ' fed up/ with SESD. SESD does not want to go to secondary treatment of sewerage. Provisions for primary treatment S were to be completed by March 1976 and have not been finished yet., The EPA is considering taking SESD to court on this matter. Brian French asked -2- Richard Morton to get a copy of the discharge permit from SESD. Paul Willis is to report back concerning the application for renewal of discharge permit for Salem Power Station. • Minutes from the April 22nd and May 20th meetings of the Planning Board were noted. An announcement concerning the dedication commemorating the completion of the Natural Preserve project at Fort Lee . noting the file numbers for Two notices from the DEQE 1° , applications made by Peter T. and Peter D. Clarizia (64-14) and DeIules Bros. Construction Co. (64-12) Mary Ellen Pelletier was given a questionnaire from the Department of En- vironmental Planning to fill out: The ConCom has received the instructions and warranty for their camera. Donald Hunt passed out the dates for meetings for July to December. Business A discussion led by Brad Northrup on the bottle bill was held. Brad Northrup informed the ConCom that 10,000 signatures were needed by the end of June so that the bottle bill could be placed on a referendum. Paul Willis expressed the belief that the bill had been defeated because of the bottle lobby. Brad stated that the lobby was from interests outside of Mass . There is only one brewery in Mass . and the bottle bill would create • jobs not eliminate them. This bill would make bottles and cans returnable and eliminate the flip tops. \ Committee of the Council Donald Hunt reported on the Municipal W meeting he attended. The question was raised there as -to why there was a beautification program for Salem since no 'provisions have been made for maintenance once the SRA and the Bicentennial Commission disband in January. Brian French asked if Donald Hunt :had asked if the ConCom could take over Fort Pickering. Brian French and Paul Willis expressed the desire to take over the running of Fort Pickering. Donald Hunt was opposed to this action. The title on the property in question has not been cleared, it is.stilled owned by the federal government. Brad Northrup started a discussion of the Forest River acquisition. City Solicitor William Tinti and David Lash are now determining the property lines of Mr. DiBiase, and Ms. Quigley. Brad pointed out that the acquisition of these properties was of a politically sensitive nature and that at this time only Mr. Quigley/s land (located on the south side) was being appraised. It was felt that Mr. DiBiase might still voluntarily give his property to the city. It became apparent during the discussion that a better map or plan of the area was needed. In conjunction with the Forest River acquisition, William Tinti, Brad Northrup and Richard Morton will attend the Marblehead Water Board meeting on July 12th. Brad Northrup will report on the proposed Conservation restrictions of Thomsons meadow & land off Loring Ave.' Richard Morton next reported on Mr. Quigley�s activities on Loring Ave. • Mr. Fletcher has stated that there are no wetlands involved and that Mr. Quigley will not request a determination. Paul Willis informed the ConCom -3- • that the area was loaded with blue flag, typical vegetation for a wetland. { there was some discrepancy, however, concerning exactly where Mr. Quigley is going to put his building. Brian French requested that Richard Morton go out and see the property. Donald Hunt suggested that he request a plot plan in order to ascertain where the building will be. placement of Brian French then read the Order of Conditions he had drafted to send to John Serafini concerning the proposed filling and riprap on property owned by Peter T. and Peter D Clarizia. The Order of Conditions stated that Mr. Clarizia could place riprap in order to protect, his existing property but he could not fill. Brad Northrup felt that the Order of Conditions should be more specific regarding the boundary of the riprap. Brian French explained that the pivotal reason for the decision rested on the fact that any addi- tional filling in that area would aggravate theflooding. _ . Brad Northrup then asked about the mussel flats in the area. Brian said that could be another reason if the area was cleaned up. Brad then suggested that the conditions should state that he could riprap at mean high water. Richard Morton pointed out that that would probably include a larger area than the Commission intended. Brian French then suggested that the con- ditions could read that riprap can be placed on the existing bank. Paul Willis then made the motion that the proposed project would sufficiently aggrevate flood conditions and forbids placement of any fill. Donald Hunt seconded the motion and the vote was unanimous . • Brian French then suggested that there should be a meeting soon concerning the organization as well as present and future plans of the ConCom. It was decided that the meeting would be at Brianis 'house on June 24th at 7:30 P.M. Brian French left at 9:50 P.M. and the meeting was turned over to Mary Ellen Pelletier. Paul Willis reported on the Skinner and Sherman report. The report, which cost $1000, only speaks of a 'tpotentiall fire hazard and Paul feels that they will not word it any stronger. Mary Nestor suggested that the EPA could be called concerning the protection of inland wetlands. Donald Hunt suggested a meeting with William Tinti on the Ingemi problem. Alex Arcisz reported on the 208 Program. He said that for the most part the discussions have been very general containing little that would be applicable to ConCom. They are working on water quality control and future land use. . They are also discussing the correlation between water usage and population. One thing that was significant was that they list Forest River as an environ- mental hot spot. Mary Nestor is to send for a copy of this report. Cleti Cervoni reported on the Education Committee. She stated that there weren't any plans for additional programs this summer, but that in the fall she plans to do work with the schools . Cleti has ordered the sheets for the slides . Cleti Cervoni, Alex Arcisz and Donald Hunt are going to take over maintenance of the nature trail from Julia Yoshida for the summer. • f -4- Richard Morton spoke of a request for determination from Mr. Pezzulo on • Brook Street. Brian French informed ConCom that the Massachusetts' 4-H is going to have a conser- vation workshop for young people August 2-5, 1976. The idea behind this workshop is to prepare teenagers to be able to be contributing members to their local conservation commissions. The ConCom decided that the $60 it would cost to sponsor a person going to this workshop could be used for a better purpose. A copy of the discharge permit requested at the last meeting was obtained from SESD. Alex Arcisz is to read and report on it for the next meeting. (Map Down) Copies of the Classification Manual were received. In it are discussions on land use,vegetation cover and maps of the different areas . Addresses of the offices for the Cooperative Extension Service of the University of Mass . were noted. Minutes of the Public Hearing of the. Salem Planning Board regarding the application. for a development permit by Zoel Labrie was noted. A letter from the personnel department of the City of Salem turning down Brian French s request for a part-time secretary was noted. A notice from DEW stating that the Wetlands Act application of Paul J. and Shirley Ann Gallo has been assigned 64-15 as their file number. A letter was received from William Tinti, City Solicitor concerning the legal case of the ConCom vs. Girard and Marie Le3lanc.. Enclosed was the affidavit and a copy of the summons regarding this case. This hearing will be held in court Friday, July 2nd at 10:00 A.M. It was also noted that Mr. Gibney s case would be heard Tuesday, June 29th at 2:00 P.M. Also noted was a letter from William Tinti to Jack Powers regarding the transfer of • city property to the custody of the Salem ConCom. ii -2- Brian French received a letter from SESD stating that since the construction of sewer facilities was accepted by a town meeting of the Torn of Marblehead prior to January 1, 1973, it was exempt from complying with the Wetlands Protection Act. r• and they will not file a notice of intent. A copy of a letter sent by John Serafini to the Mass. Department of Natural Re- sources appealing the decision of the Salem ConCom regarding the property of Peter Clarizia was noted. Minutes from the May 19th meeting of the Waterways Advisory Board were noted. Minutes from the June 17th meeting of the Marblehead ConCom were discussed. Brian French noted that these minutes state that no buildings, tents etc. are visible from the shore of Ram Island. He also noted that they were also requesting a certificate of title on Ram Island. Cleti Cervoni presented the book Guiding Growth & Change to the ConCom. A questionnaire on Coastal Zone Management will be filled out by Paul Willis and Cleti Cervoni. Richard Morton passed out some Manuals of City Government that he had received. Donald Hunt led a discussion concerning a letter he had received from the Pembroke ConCom. They feel that the force of the Wetlands Protection Act is hampered because the State is the sole appeal agent. When an appeal is made it is taken completely out of the local ConCom s hands . The state may lack information which is known on the local level and as a result a disservice to the intent of the WPA may result. i• Donald Hunt also said that Bob Gillette of Pembroke is considering proposing an ammendment for the WPA and is asking for support from other Conservation Commission' s in this matter. Brian French stated that he felt that Pembroke s action should be endorsed. Brad Northrup made a motion that the Salem ConCom endorses what the Pembroke ConCom has decided to undertake. Donald Hunt seconded the motion and the vote was unanimous. Paul Willis passed out copies of an article entitled' Where the Sea Meets Land: The Coastal Zone.H Alez Arcisz then spoke of a Scenic River Meeting that he had attended. He stated that if a river is declared a Scenic River by the state, then 100 yards of land on either side of the Bank would be protected from development. Alex expressed the belief that this might lend muscle ° to the ConCom s'plans for Forest River. The application would go to the Dept: of Environmental Mgmt. Richard Morton inquired if he could get the form for this by writting Bette Woody. Brad Northrup and Polly Tierney will do research on this and call Richard. Business BobCarmardathen asked if he could speak to the ConCom about the problems of his property on Valley Road. He explained that his grandfather had left him the property. After receiving it he had a drain put in because flyash was draining on his i ; -3- land. At this time he did not have the money to develop the land. In the mean- time Salem had raised the street four or five feet. Mr. Cappuccio (his neighbor) then filled his land and by doing so caused flooding on Mr.Carmarda'sland. Mr. Carmarda then went to Mr. 0 Brien, who was then the Building Inspector, and asked if he could fill his property to meet the grade. He received permission and as a result Mr. Cappuccio's land was flooded. The City of Salem then informed Mr. Cappuccio that he should drain in the street. It was pointed out by Brian French that Mr. Carmarda's drain is blocked up. MrCarmardareplied that he did not know how it happened and that he suspected that other people had been dumping on his property. Mr. Carmarda also felt that even if the drain was cleared out, it would not solve the problem of Mr. Cappucciofs flooding. In fact Mr. Cappuccio had already suggested that Mr.Carma.rdaput in additional pipe from his drain and MrCArmarda had refused. Brian French informed Mr,Carmardathat all of the people involved in this disagree- ment were in violation of the Wetlands Protection Act. Brian then suggested a meeting with the Building Inspector and the City Engineer in order to solve this problem for once and for all. Brian also voiced the belief that if the two other drains were working, there would be no problem. Brian French then discussed the outcome of the 'Informal meeting held at his home on June 24th. At that time it was decided that the Committee structure be done away with. A list of projects with the individuals assigned to them was then passed out. David DeVoe then presented the expenses for the month. He explained that the Commission could pay $423.29 of the bills at hand. The breakdown was as follows : {• $ 93.06 Essex Camera supplies 19.41 Essex Stationery 140.00 Printing 38.07 To Brian French for telephone calls made for ConCom 25.00 Massachusetts Audubon 24.10 To Richard Morton to supplement his on-the-job gasolene expenses 83 .65 May Telephone Bill David explained that $7.76 was left in the account. He then explained that there was $200. in bills that would have to come out of next year s budget. The June telephone bill was $132. He said that if this was an average bill then the Com- mission would end up spending $1584 on telephone bills during the next year. Brian French stated that Richard Morton would be available for telephone calls at the office between 8:30 A.M. and 10:00 A.M. It was also suggested that calls be limited in length as much as possible in the future. Brad Northrup then went through the written restrictions concerning Forest River which were drafted and are to be presented to the Marblehead Water Com.. on July 12th. The document lacks a land description but Mr. Tinti said that that was alright. The paper stated that Marblehead would be giving up their rights to develop Thomson s meadow and Loring Ave, but that the water rights would be re- tained by the Town of Marblehead. To have such an arrangement there has to be property that would be benefitted. Since Salem owns the abutting land this. is.,taken care of. Brad continued by explaining that the restrictions called for would include: 1. No advertisements or buildings on the land. 2. No filling or removal 3. No cutting of vegetation except for foot paths . 4. No dumping. The water rights, again, would be retained by Marblehead but any expansion of these (.� facilities would have to be approved by tEe City of Salem. Brian French commended Brad Northrup on the fine job he had done . Brad Northrup also reported on a Planning Board meeting he had attended. Present • at the time were Messrs . Powers, McDerm et, D'Amour , Betrix, Wheaton and Emerson (architect). The purpose of the meeting was to exchange information with Mr. Emerson regarding new concepts in subdividing Pickman Park . Mr. Betrix indicated that 32.9 acres would be donated to the city of Salem as _part of the Forest Rid-Pr •- - - Conservation -area. . Mr. Betrix also said that Mr. DiBiase was not interested in singlefamily housing but did want housing that would appeal to the upper middle class . Brad felt that it was a successful meeting .. Er.. Emer- son was going to draw up some sketches of possible housing and bring them back to the Planning Board. Next followed a discussion led by Brian French regarding the order of conditions for Mr. Gallo. There still exists some discrepancy concerning the sketch done of the land in question. There is really no way of knowing if the line Paul Willis and Richard Morton made agrees with the line found in the sketch. Mr. Gallo was suppose to have the exact distances noted, but it has not been done at this time. Brad Northrup suggested that the order of conditions state that Mr. Gallo could fill to an elevation of 70 and that no land could be filled if determined to c a wetland by vegetation. It was also decided that a slope of 311 could be loamed and planted. Paul Willis then addressed 'himself to the Wetland's mapping project. Paul Willis is to call Greg Sanko but he felt things were moving right along. Of the people discussed, Paul felt Jerome Long was the best suited for the ,job. He pointed out that Mr. Long :had bee assgciated with the wetland's mapping for the .town of s Wenham. . Brian French inquired whether the job could be done with less .� expense. Paul pointed out that Avis had done the air mapping so that was already done. Dr. Long would do test borings-. and analyze boundaries by vegetation. Paul felt that this would make for very specific boundaries . Paul Willis is to ask Dr. Long to come to the next ConCom meeting. Brad Northrup made a motion to adjourn. Communications and Notices Brian French read a memo he had written to David Lash concerning the pro- posed wetlands mapping of Salem. In the memo Brian requested a price for partial wetlands mapping for North Salem. He also requested that the ConCom be directly involved in any arrangements made with Dr. Long. g • Brian French then read the results of the court hearing of Charles F. Quigley vs . Anthony Fletcher. The order stated that the City Engineer, Anthony Fletcher, will file an application for a sewer connection permit. This "sewer permit will not be wetted until the condition causing exfiltration be corrected in the area known as Forest River Marsh, said condition con- sisting of approximately 200 defective joints . . ." Brian French informed the ConCom that there is going to be a public information meeting to discuss plans for a proposed pedestrian walkway on Highland Ave at 7:30 P.M. on August 5th. Brian French noted that all annual reports are due on or before Oct. 6th. Letter was received from Bette Woody concerning the questionnaire that was enclosed with the invitation to the SCORP Workshop. Mary Ellen Pelletier stated she would complete it for the next meeting. Brian then read a letter from Gerard LeBlanc . In it he asserts that he intends to comply with the Wetlands Protection Act. Brian mentioned a notice from the City Auditor, Charles Passales announcing that the City is converting to Data Processing for revenue bills payable. Richard Morton will attend an information meeting concerning this on July 27th. • Brian announced we were now members of Audubon. _2_ Brian informed ConCom that a group was trying to start an Ipswich River Watershed Association. Brian explained that there was a fee of $25 to join • and that he felt we should join since Salem was one of the major users of C water from the Ipswich River. A brief discussion followed. Brad Northrup moved that the Salem ConCom join the Ipswich River Watershed Association. Donald Hunt seconded the motion. It was passed by an unanimous vote . Brian announced that Tufts University was again offering an Environmental Advocacy Fellowship Program. Mary Ellen Pelletier attended the program and said that it was very good. The program would be from Sept. to May. Brad Northrup informed the ConCom that he had spoken to Bill Tinti regarding the appraisals for acquision concerning the Forest River Project. So far there has been one bid of $3500. The deadline for additional bids is tomorrow. Cleti Cervoni informed the ConCom that she called David Pelletier and that he was no longer planning on being active in the Commission. Brad Northrup noted that a business acquaintance of his, .Jim Rhinehart, is moving to Salem. He is going to be working for the Park Service in Boston and Brad noted that he would be a good addition to the ConCom. Richard Morton informed the ConCom that he had spoken to Councillor Grace regarding a piece of land across from Salem Hospital. Dick stated that the land is owned by the Hospital, but that if the Commission would approach the Hospital Board with an exact use for the land, they would give it to • the Commission. Dick suggested that park benches could be placed on the small strip of land. Brad Northrup was not familiar with the land and said he would look at it before the next meeting. A decision concerning this land will be made at the next meeting. Regarding the clam flats, it was noted that Rep. Harrington is going to ask the Governor if the .National Guard would reserve one day a month in order to clean up the clam flats. Business David DeVoe gave the financial report. David explained that since Salem was changing their accounts payable system, no bills would be paid in July. He said that ConCom has $251.42 worth of outstanding bills . Part of the telephone bill has been paid and that the bill is now approximately $132. Wetlands Hearing At 9:00 P.M. there was a wetlands applicability hearing concerning the pro- posed borings and sewer installation in the south west portion of the City. David Goodemote explained the proposed route for the sewer line. A discussion followed between Mr. Goodemote, the Commission and residents of the proposed site . Len Cawley offered to take the members of the ConCom on a tour of the sewer route . The inspection tour will be at 8:00 A.M. on August lst. J -3- The Commission will make a determination at the August 9th meeting of the ConCom. Brian French explained that it would have to be a two part deter- mination. The first determination would include the borings and the second would include the actual construction. Brian pointed out that the borings would have no lasting environmental impact, but that since the sewer line would be going through some wetlands, certain areas may require a wetlands hearing. Business Richard Morton asked.the Commission to make a determination concerning the . property of Robert Conwell of 8 Bridge St. Richard explained that Mr. Conwell wants to put in a pier off of his property. The construction would consist of two pieces of 3" pipe being placed in the harbor. Brad Northrup made the motion that the Wetlands Protection Act did not apply in this instance. Mary Ellen Pelletier seconded the motion and the vote was unanimous. Cleti Cervoni asked the ConCom if it was interested in participating in the Salem Market days on September llth and 12th. Brian French explained that the booth could have a three part theme: 1. Illustrating the enforcement of the Wetlands Protection Act through Pictures . 2. Exposure of the Forest River Project. 3. Education through nature and advertisement of the autumn nature walks. Cleti explained that she would need support in the coverage for the booth. Massachusetts 01970 G©RRECTED 7/26/76 Minutes of Meeting---------July 12, 1976 The Conservation Commission met at One Salem Green on Monday, July 12, 1976 at 8:10 P.M. Commission members attending were: Chairman Brian French, Paul Willis, Donald Hunt, Brad Forthrup, and David DeVoe. Associate members attending were: Alex Arcisz, Cleti Cervoni, and Polly Tierney. Also attending were: Conservation Assistant Richard Morton, Jerome Long, David Lash and Len Cauley. Dr. Jerome Long of Terrain Inc . spoke to the ConCom concerning wetlands mapping. Dr. Long was responsible for the 1973 wetlands mapping for the town of Wenham. He is an advocate of aerial photo-interpretation. He explained that he starts with possible wetland areas that appear in the aerial photographs . He follows it up with on-site inspection and testing of each possible wetland. After this the proof plans are publicly exhibited for a three or four months for what he referred to as the 'challenge period' . David DeVoe asked what happened during this challenge period in Wenham. Dr. Long said there had only been one small correction. Dr. Long then explained his five criteria for wetlands mapping which were �• incorporated in the Wenham project. 1. Accuracy Topography, water and soil content all have to be considered in determining a wetland. Dr. Long explained that the Wenham mapping had been done before vegetation could be utilized in determining a wetland. Accuracy is also es- sential when transferring the wetlands from the aerial plans to the tax assessor's plan. 2. Qualifying Wetlands The thickness of the organic deposits, determined among other things by peat probes, can also be used to determine the quality of a wetland. These differences in the quality of a wetland can then be used when judgments concerning filling arise. For example, if there is deep organic peat it can be recommended that there be no filling. 3. Contour Line In doing Wenham, Dr. Long based the line on the '68 flood because it was the most fully documented. He expressed the opinion that the HUD contour line based on the 100 year flood is 'somewhat mythical' . Brian French pointed • E i _2_ out that, unlike Wenham, Salem is a coastal city and so there is data to • substantiate the 100 year flood contour line here . i, Dr. Long pointed out that the contour line is useful when the areas are horizontal but can not be used as a criteria when considering areas like elongated swales . 4. Buffer Zones Dr. Long pointed out that it was quite difficult to establish absolutely exact boundaries for wetland areas . Therefore he established what he refers to as buffer zones which provide a transitional area between the 'vet' and 'dry' areas . Dr. Long explained that he first sets the boundary for the wetland and then establishes the buffer zone 100 feet wide or 5 feet elevation above the wetland (whichever includes less land) beyond the wetland boundary. Another advantage of the,buffer zone is that when placed on the map it indicates the type of slope going into ,the wetland. 5. Detail On Map Dr. Long explained that physical details such as stone walls and fences placed on the assessors map makes it easy to identify the exact position of wetland areas . Dr. Long then showed an interesting slide show of the Wenham project and other wetland studies. Following the slide show Brian French asked Dr. Long how' he arrived at • the demensions for the buffer zone. Dr. Long replied that the decision was arbitrary. In discussing the wetland mapping of Salem it was brought out that there was no topographical map of North Salem. Because of this Dr. Long would be unable to include a buffer zone for the wetlands in that area. If additional monies become available, however, one portion of the North Salem area con- twining an important wetland area may be able to be added to the study. Dr. Long explained that he should be able to have the proof sheets showing property lines by October. David Lash explained that Dr. Long would get the maps needed to make his cost estimate within a week. The ConCom thanked Dr. Long for his talk and slide show. Brad Northrup and Richard Morton reported on the results of the Marblehead Water Com. meeting. Brad was happy to report that by the end of the meeting they were in favor of the written restrictions presented by Brad on behalf of the Salem ConCom. However, they were not sure of their authority in + -3- • this matter. For this reason Mr. Tinti is going to talk to the town counsel a regarding this matter. It was felt that there should be a decision by September. Communications and Notices The May 24th minutes for the Salem ConCom were accepted as corrected. The thank you note from Mrs. Nichols was noted. Minutes from the July 1st meeting of the Marblehead ConCom were noted. Brian French mentioned that they were in the process of bringing the certi- ficate of title on Ram Island up to date. The minutes of the June 3rd Planning Board Meeting were noted. Brian French asked Paul Willis to respond to a letter received from the Department of the Army. The letter concerns a request by Arthur Fraser to build a ramp and floats at Palmer's Cove. Richard Morton is to fill out a questionnaire received by him by a representative of the EPA. Len Cawley, Councillor at Large, spoke to the Commission regarding • Baker's Island. He explained that there were people interested in buying lots on Baker's Island. Mr. Cawley wanted to know' if the Commission was interested in this land for future use. Brian French replied that it was not one of the islands requested by the ConCom. Mr. Cawley- also explained that the City Council was in the process of setting up a review board in the selling of Citv land. Mr. Cawley suggested that the ordinance should s include a review' of the property by ,the ConCQm. This waagreed upon. Donald Hunt is to contact Mr. McCabe concerning the junkyard ordinance. She explained that she had spoken to Bob Murray concerning a booth for the Market Days . He said that the Commission could set up in an alley off of the enclosed stalls without paying a fee. Brian French felt that it would be more advan- tageous for'.the Commission to pay the fee in order to get an enclosed stall. Cleti is going to check to see if there are any enclosed stalls still available. Cleti next informed the ConCom of the prices for the car stickers. Cleti • explained that the stickers would be the ConCom logo and would measure 3-1 inches in diameter. The prices for the different quantities are: 500 @ $.28 and 1000 @ $.18. The ConCom decided to purchase 1000 and sell them for $ .50. Regarding the prices for poster enlargement: 1' x lit $2.95 12' x 2 3.95 2' x 3' 4.95 3' x 4' 7.95 There followed a brief discussion as to the desirability of having the posters made up in quantities to sell. It was pointed out that the posters will start to fade in six months and that an initial investment of $200 would be required to make up the negative. The ConCom decided only to purchase the posters necessary for a poster display. Speaking of transfers and the possibility of selling T-shirts, Cleti informed the ConCom that she had contacted Fosters in Marblehead and found out that the transfers are $ .60 each and T-shirts are priced at $1.25. There would be an initial charge of $12.50 to make a screen. The ConCom decided to order 100 with an emphasis on children's sizes . As to the slide show for the booth, Brad Northrup stated that he had a rear screen projector that repeated. Paul Willis said that he would do the titles for the slides . w _2_ . Regarding the wetlands mapping, Brian French reported on Greg Sanko's results s with the Planning Board. The cost for the wetlands mapping and land use study (including North Salem) is $11,000. The Planning Board is requesting a starting and finishing date for the update of the Master Plan that is to be done before they will approve of this additional expense. Brian French pointed out that Dr. Long's contract was already overdue in being sent out. Brian suggested that the ConCom provide $5000 of the cost with the Planning Board providing the rest. Brad Northrup made the motion that Brian French contact Dr. Long and request that he start the wetlands mapping with the guarantee that the contract would be signed on the Friday following the next Planning Board meeting. If this is not acceptable to Dr. Long then Brian is to use his discretion regarding what is necessary to insure the success of the wetlands mapping project. Paul Willis seconded the motion and the vote was unanimous. Brian French informed the ConCom that Joseph Ragone is not compling with the Order of Conditions issued by the Commission. The dam which was to have been built in order to prevent downstream siltation has not been started. Also, Phase 1 requires that the southerly side of the wetland be filled. Mr. Ragone is filling on the northerly side of the wetland. Brian informed the ConCom that he has written a letter to Mr. Ragone stating that if this situation is not cleared up by August 31st the ConCom will be forced to revoke the Order of Conditions . Brian explained that if Mr. Ragone does not comply this could lead to the issuance of a cease and desist order and taking Mr. Ragone to court. Brad Northrup made the motion that if at the end of the month Mr. Ragone has not complied with his Order of Conditions the ConCom will explore the various alternatives of further action. Paul Willis seconded the motion and the vote was unanimous . �• Brian French stated that David Goodemote has requested a one q year extension on the Order of Conditions for Phase l of the sewer construction. Brad Northrup made a motion to grant him the one year extension. Paul Willis seconded. The vote was unanimous. Next followed a discussion of construction being done on Mrs . Moore's property at 560 Lafayette St. There was some question as to whether she was adhering to her Order of Conditions . It was decided that she was in compliance with the Order of Conditions . The ConCom next considered the construction and proposed park:irg lot to be built by Mr. Quigley. It was determined that the proposed parking lot is more than 100 feet from any wetland. Paul Willis made a motion that the Wetlands Protection Act did not apply.in this instance. Brad Northrup seconded the motion and the vote was unanimous . 'and from Marlboro Rd. to Highland Ave.' Then followed adiscussion of the proposed borings and sewer installations for the south west portio of the city. It was stated that the areas from Highland Ave. to Marlboro St efinitely included wetland areas. It was also pointed out that the propose borings would have no environmental impact. Brad Northrup moved that the city could go ahead with the proposed borings, but that part of the construction is subject to the Wetlands Protection Act and would require a Wetlands Hearing. Paul Willis seconded the motion and the vote was unanimous. is i f -3- j Anthony Fletcher spoke to the ConCom of the flooding problems on Willson Road . and the proposed drain that he wants to install in order to alleviate the problem. After a brief discussion, David DeVoe made the motion that the pro- posed work does fall under the Wetlands Protection Act, but because of the emergency nature of the recent flooding the necessity of a Wetlands Hearing should be waived. He also noted that the posters would be $6 each. Richard is also going to check on the cost of doors and hinges for the purpose of the photo display. Cleti announced that she would make a schedule for coverage of the booth for the Market Days . A discussion followed concerning the themes of the booth. Brian French said that it had proved impossible to illustrate the enforcement of the Wetlands Protection Act through photographs. Instead the theme "Is there a wetlands in your area?" was substituted. Brad Northrup suggested that the names and addresses of the people that purchase something at the booth be taken. In conjunction with this the idea of issuing a quarterly newsletter was also dis- cussed. Next followed a discussion with Mr. and Mrs. Moore concerning their property on Lafayette St. It was brought to the attention of the Commission that 16 wood poles with concrete surrounding them had been placed , to hold the sea wall. This construction had not been mentioned in the original Order of Conditions . Mr. Pelletier explained that the poles in question had been driven dorm to refusal. The depth of the poles went from ? to 13 feet depending on the point of refusal. Mrs . Moore explained that the man who did the work was only available for a very short period and that there wasn't time to notify the ConCom. Brian French reminded Mrs . Moore that the Order of Conditions is a legal document and that by deviating from it she ran the risk of having to undo the work that had been done. The members of the Commission present allowed that the poles could remain, but that did not eliminate the need for the proposed rip rap noted in the Order of Conditions . rubble Mrs . Moore then inquired if she could put r;alls indicating her property lines going 20 or 30 feet into the ocean. Brian informed her that before this could be done she would have to contact the harbor master and the Army Coxes of Engineers , Division of Waterways in addition to The ConCom. Brian felt thalu it would be considerably easier to simply place a stone post in. the ground indicating • her property line . i -2 • Paul Willis pointed out that the dirt that Mr. and Mrs. Moore had been piling on the adjoining land belonging to Mr. Belleau was blocking a storm drain and creating a new drainage route and causing siltation. This situation is to be investigated and discussed further. Brian French reported that Mr. Goodemote had requested a more detailed des- cription concerning the specific areas requiring a wetlands hearing during the Phase II sewer construction. Refering to the maps, the following areas were determined as wetland areas requiring hearings: Sheets 1 & 2 Ml - 5C 5A - MH8 MH11A - MH14 Sheets 3 & 4 M14A - 14B DIR18 - MH19 Sheet MH19 - 22B Further discussion 'as held on the Ingemi situation. The report made on this dumping of f� material only states that there is a potential of fire, Skinner and Sherman will not state anything more conclusive without more testing. Paul Willis • said he would check with other communities as to what problems they have had in disposing of pulverized material and possible solutions they have found. Brian French stated that the Planning Board was going to discuss the Land Use Study at their September 2nd meeting. Brian also announced that the contract with Dr. Long had been written. He state that by the terms of the contract the Planning Board has reserved the right to make changes during the Wetlands Mapping. Brian stated that he was to receive a letter from David `Lash-stating that the•c greement of the"06hU m""• was to be obtained prior to any 'change in the scope of work covered in the i� contract for Wetlands Mapping. Richard Morton stated that he had been informed by -DES that he would be notified before any decision was made concerning the appeal by Mr. Clarizia.. . A letter from.MAPC regarding their Spring Public Workshops was discussed. The schedule for the Fort Pickering dedication ceremonies were discussed. Brian French mentioned the letter written by William Tinti to Mr. Joseph Ragone stating that if Mr. Ragone does not comply with his Order of Conditions by August 31st the City of Salem will take legal action. A letter from MAPC announcing a conference on offshore oil development to be held on September 24th. A notice was received from SESD concerning construction of sewer pipes across Salem Harbor. Receipt of the "OCS Report" was noted. Receipt of a letter from William Tinti regarding a changed ordinance requested by the ConCom changing the procedure used in selecting a Chairman for the ConCom. A questionnaire from a student attending Roston University was received and will be filled.out by Brian French. Registered mail receipts have been received for letters written to David Goodemote, David Flaherty and Joseph Ragone. An article entitled "Helping Conservation Boards" that appeared in the Boston Globe was discussed and Brad Northrup was asked to write a letter to the Globe commending the work of the Conservation Law Foundation. Business Mary Ellen Pelletier reported that she had contacted the U.S . Fish and Wildlife Service in Nashua, New Hampshire and spoke to Mill Evans regarding the dumping of Pulverized material. Mr. Evans is coming down in a few days and will. speak with Richard Morton. Mary Ellen explained that 14r. Evans is interested in seeing the Skinner & Sherman report, a sample of the material being dumped, and the current status of the cease and desist issued to Mr. Ingemi. Brian French reported on the tour of the islands in Salem Harbor that he took with Messrs . Cawley, Powers; Tinti and-Homer. He explained that 4'additional islands are to be added to those previously specified to come under the care of the ConCom. These additional islands are Coney Island, Coney Ledge, Grays Rock and House Island. Doloras Jordan reported on the Essex County City Growth survey that is being done and asked the Commission if they could think of additional areas of the City which could be used as part of a scenic road. • Brian French advised the Commission that Alex Arcisz was withdrawing as an Associate Member of the ConCom. 9/13/76 -3- Cleti Cervoni presented a bill for slides purchased at Audubon for the ConCom. ( Richard Morton reminded the .Commission that money was still owed for various • posters that were purchased. David DeVoe next gave the financial report. He informed the Commission that due to the changes in filling out the w'arrent, a detailed itemized receipt was now necessary before payment would be made. He also informed the Commission that so far this fiscal year $450. had been accrued in telephone expenses. He explained that he had transferred money from several different accounts in order to pay the telephone bill and provide the Commission with additional monies for future telephone expenditures . The warrent for this month amounted to $376.78. Brian French inquired about the possibility of purchasing a tape recorder to be used at hearings . The Commission agreed -that the need was present for a recorder but that for financial reasons the purchase of the machine would have to be put off until the next fiscal year. -The City Council requested the opinion of the ConCom on, the advisability of the city selling two parcels of land. One piece of land is a 4000 sq. ft. empty lot onBalcomb Stand the second is on Carrolton St. Brian noted that he had received a communication from Anthony Fletcher that he had no objections to the sale of the Balcomb St property but that the Carrolton St Property was a point of access and for that reason he did not feel that it would be advisable for the City to sell it. After a brief discussion Brad Northrup made the motion that there was no natural resource value in either property and the Conservation Commission was not opposed to its sale. The motion was seconded by Donald Hunt. After additional discussion Brad Northrup withdrew his motion and Donald Hunt seconded. It !• was decided that the commission would postpone its decision until members had viewed the properties in question. Mary Ellen Pelletier reported on the completing of the SCORP Questionnaire. She then asked the Commission for any additional ideas they might have re- garding the questionnaire . In discussing the "greatest deficiencies of outdoor recreation opportunities in your area" it was decided that the lack of public access to the coastline, lack of Conservation land and improper use of public land ranked high. The Commission also pointed out in the survey that one of the greatest needs at this time is for sufficient funds in order to purchase land that is still available. The Commission also made clear that through various programs such as the ConCom Education Program, the Commission was trying to increase public awareness of the problems and the possible solutions that were available to them. The Commission also pointed out that the role of SCORP for the Salem Areahas been, up to this time, one of providing general information and therewas a need for more specific coverage of the Salem area. Brian French next listed various topics that he felt should be included in the annual report: 1. Enforcement of the WPA 2. The aquisition of 10 acres of land for conservation purposes • h. 9/13/76 -4 3. The role of the ConCom in the current sewer construction. ;• 4. The acquision of some funds in order to purchase land in the Forest River area through application for federal and state monies. 5. The Wetlands Mapping being done by Dr. Long. 6. An increase in public awareness due to events sponsored by the ConCom such as the ConCom booth during market days, the ConCom Spring Weekend and the nature walks done in conjunction with Mass. Audubon. 7. Work done with the Zoning Committee and the Growth Policy Committee, Planning Board sub-committee. 8. Support of the controls to the zoning ordinance. Cleti Cervoni reported on Market Days. A discussion followed concerning the impact that the Commission felt the ConCom booth had. Cleti reported that $26 in t-shirts and stickers had been sold. Cleti next outlined the fall walks that are to be scheduled in various parts of Salem. The walks are to take place on Sundays and will include the Forest River area, Highland Park and Strongwater Brook areas. Polly Tierney stated that she would be interested in compling the information for a ConCom newsletter. It was tentatively established that it would be done 1. quarterly. Polly pointed out that the Annual Report could be utilized for the first newsletter. It was also stated that the final draft would be dis- cussed by the ConCom as a whole . Regarding the Pickering property it was decided that the WPA was applicable and that Richard Morton should obtain the names of the owners and that they should file a request for determination or file a Notice of Intent. Richard Morton informed the Commission that Mr. Belleau wants to build on his property located on Lafayette St. Richard Morton is to ask Mr. Belleau to file a notice of intent Richard Morton told the ConCom that the Army Corps of Ena_ineers are inquiring into the action of:Mr. Pelletier, of North Shore Dredging Co. , for dredging in the South River without a permit. on Salem Oil & Greese Co. Donald Hunt next reported on two dumping violations The first occured on August 31st across from Harmony Grove Cemetary. The alledged violator is Kenneth Mielcarzand he has since written that he has removed the rubbish he had dumped. The second violation occured on Sept 5th and concerned a 1967 BK International pickup, license plate All-140 registered to Frank Beradino of Everett. The subject of this hearing will be the possible rezoning of Northey St. from part residential and part industrial to totally residential. j � Briar, French noted the receipt of the Sept. issue of Environment News and the July/August issue of the Mass. Coastal Zone Management Coast Lines. Brian French informed the ConCom that he has written a.letter to Hyman Marcus regarding the possible acquisition of Mr. Marcus' land located in the back of Stop & Shop. - Brian French is-also writting a letter to Bill Tinti which will include a list of the harbor islands which the ConCom wishes to have transferred to its custody. Brian noted receipt of information regarding the Bottle Bill from the Mass. Association of Conservation Commissions. Brian French briefly discussed an item in the September 16th minutes of the Marble- head ConCom. The Marblehead. ConCom has sent a "letter to Mr. Iagallo, Acting .Director of the Division of Wetlands, for the DEQE, re: the need for clari- fication and improving the- Rules & Regulations, with special attention :to the meaning of 'bordering' and .'horizontal'." Richard Morton informed the ConCom that Mr. Cappuccio is requesting the ConCom to allow Mr. Redican to spread the fill on his property on Valley Road. Mr. Cappuccio feels that the dirt and cement already dumped on Mr. Redican's land creates an eyesore which. could. be rectified by allowing Mr. Redican to spread the fill. Tn addition Tony Fletcher has outlined plans for a suitable drain system for Mr Carmarda's property. It is, now up to Mr. Carmarda to install it,after discussion with the ConCom. 1_i -2- • Business The minutes of September 13, 1976 were accepted with corrections. There is still $15 expected for the sale of T-shirts and there is approximately $70 in the checking account. The ConCom next considered a request from Mr. Dion to place riprap along the side of his storage shed. A letter received from Mr. Dion dated May loth described the proposed work. The stones will be from 2 Z ft. in diameter to 12 in. The riprap will cover a length of 200 ft and will be at a 45 angle from the top of the present wall. A temporary ramp used for a bulldozer will be removed after the work is completed, which should be in two to three weeks. Also discussed was a letter from Richard Swenson, Asst. Civil Engineer, stating • that no riprap should be placed within 5 feet of the sewer pipe and with 10 i feet the riprap should be placed by hand. Paul Willis made a motion that the work proposed by Mr. Dion is not significant, to the Wetlands Protection Act and work, within the restrictions outlined by Mr. Dion and Mr. Swenson, should be allowed. Brad Northrup seconded the motion and the vote was unanimous. The Commission next considered a request from Mr. .Dion, for-an extension .of . his Order of Conditions (file 64-1) . This work includes dredging being done by Mr. Dion. Brad Northrup made the motion to extend Mr. Dion's Order of Conditions (file 64-1) for one year. Paul Willis seconded the motion and the vote was unanimous. The sale of property on Balcomb and Carrolton St. by the City was discussed by the ConCom. The possible sale of 23 Balcomb Street was considered first. Richard Morton reported that the stream indicated by the map is no longer there and although there is a swale in the middle of the road, he felt that the land had no natural resource value . Brad Northrup made the motion that the Conservation Commission is not opposed to the sale of 23 Balcomb St. Donald Hunt seconded the motion and the vote was unanimous . The sale of part of Carrolton St. by the City was dealt with next. Although it was the opinion of the Commission that the land in question did not signify a natural resource, a letter from Tony Fletcher stating that the sale of this particular land would compound existing problems of plowing, sewerage and ', i 9/29/?6 -3 (• drainage in that area was noted. A discussion followed as to whether the Commission was tied to the WPA when considering the sale of City land or whether it could also offer its opinion as concerned citizens. Brad Northrup made the motion that a memo be written to the City Council stating that in the opinion of the Conservation Commission the land on Carrolton St, has no natural re- source value, however the Commission requests the City Council to consider the opinion of City Engineer, Anthony Fletcher, regarding future problems of plowing, sewerage and drainage. Paul Willis seconded the motion and the vote was unanimous . Mr. and Mrs . Moore spoke to .the Commission concerning their proposed swimming pool. Mrs. Moore informed the ConCom that she had submitted the plans for the swimming pool to Jack Powers and he stated that she would have to appear before the ConCom before he would consider the plans . It was stated in her original Order of Conditions that the pool must be constructed in such a way that it would not float up when empty. Gus Hoaghul explained that a one-way hydrostatic valve would be installed to prevent the problem of buoyancy. There was no diagram of the proposed valve available for consideration at this time. Brad Northrup stated that he felt both the ConCom and the Building Inspector should have. a diagram of the valve for consideration. Brad Northrup made the motion that the Commission write a letter to the Building Inspector, Jack Powers, stating that if, in his opinion, the valve serves the purpose of preventing floatation by admitting water at all times when the tide elevation is greater than the pool water surface, the ConCom has no objection to the construction of the pool. Donald Hunt seconded the motion and the vote was unanimous, '• The Commission next discussed the revoking of Mr. Ragone's Order of Conditons (file 64-11) . Paul Willis made the motion to revoke Mr. Ragone's Order of . Conditions for the four violations listed below: 1. Mr. Ragone has failed to build the dam.which was to prevent downstream siltation. 2. Instead of filling only .on the southerly side of the wetland; Mr. Ragone: has filled on both sides and has blocked the river. 3. The removal of debris from the pond has not:been accomplished. 4. The fill ,that is being used is ,not clean fill. Donald Hunt seconded the motion and the vote was unanimous. Next followed a discussion of possible action. to be taken against Mr. Ragone. Donald Hunt said that he would be available to go to court. Paul Willis made the motion that the Commission should direct ,the City Solicitor, William Tinti, to go to court to endeavor to accomplish the following: 1. An injunction,against Mr. Ragone to stop work in the area off of Swamscott Road immediately. 2. A fine against Mr. Ragone covered under the Wetlands Protection Act. l` -4-- 3. A court order directing Mr. Ragone to close off his property to prevent / • further dumping and requiring him to remove the inappropriate fill and clean up the wetland. Brad Northrup seconded the motion and the vote was unanimous . Paul Willis brought up the bill to Mr. Ragone from Thomas Rich of Geochemical.Assoc. He made the motion that Mr. Thomas Rich should submit a bill to the Salem Conservation Commission for payment and that the City Solicitor should take this item under consideration when he starts court action against Mr. Ragone. Brad Northrup seconded the motion and the vote was unanimous. It was brought to the attention of the Commissibn .that'.the property next .to.+. the Ragone property is being filled. Richard Morton is to find out the name —. of the owner of this property. Brad Northrup made the motion that the owner of the property between the City owned land and Mr. Ragone's property off of Swampscott Rd. should be notified that he is in violation of the Wetlands Protection Act and should file for a hearing. Paul Willis seconded the motion and the vote was unanimous. Richard Morton informed the ConCom that Mr. Pickus called him to ask if when land is transferred the Order of Conditions still apply. Brian French stated I hat any Order of Conditions is attached to the land. Steve Lezinsky of the Army Corps of Engineers has inspected the Ingemi property. . He cannot 'make a determination until he confers with his home office, but he did state that Ingemi's dumping does affect a tributary in the headwaters. Richard Morton is to call the State Attorney General's office to inquire about similar cases and what action is possible from their office. It was brought to the attention of the Commission that the Stop and Shop in Salem is constructing an addition to their building and parking lot. The , . work being done is within 100 feet of a wetland. Paul Willis is to contact them and ask them to submit a request for determination. Donald Hunt requested the ConCom's approval of a letter he wishes to write to the Salem newspaper. The letter would begin "The Salem Conservation Commission unanimously urges you to support Question 6 on the Mass. State ballot in Novembe r banning the use of non-returnable beverage containers and fliptop cans." The rest of the letter would be based on the information the ConCom has received from the Mass. Association of Conservation Commissions. Donald Hunt made the motion that he would write a letter for the ConCom concerning the Bottle Bill to the newspaper. Thomas Rich, of Geochemical Assoc. , spoke to the Commission regarding a possible water quality test program of the Forest River Area. If the water does not meet the State qualifications for Class C and SC (lowest class water (then an attempt will be made to pinpoint the source of pollution and eliminate it. Brian French pointed out that the tests should be made during or after a heavy rainfall in order to observe the effects of maximum leaching of pollutants • One of the specific phenomenan to investigate is the black suspension observable in the Salt Marsh. Brian French pointed out that the water flowing from Mr. Ingemi's property is black at times . Some of the specific areas of testing to be considered are: 1. Tests for PH, color and turbidity which can be made on site. (on a numerical scale( 2. The State of Massachusetts allows for 15mg. per liter of scum and gas- oline deposits in Class C water. Tests are to be done for this. 3 Testing for dissolved 02. Thomas Rich pointed out that this test 'was more detailed and would have to be completed in a lab. 4 . Thomas Rich explained that for measuring oil he would use a trichloroethylene extraction. 5., Testing of various chemical constituents with an emphasis on chlorides, bicarbonates, andimetalic contaminates . . Brian French observed that the Skinner & Sherman report might be useful in this testing. Detailed testing should be done from the pond on Mr. Ragone's property to the property of Mr.. Ingemi, as well as the Salt Marsh. Paul Willis is to help Thomas Rich.through the initial walk of the area and sampling program as well as an estimate of the test costs will be considered at the next meeting. • -2- Mr. & Mrs . Moore next spoke to the Commission regarding their proposed swim- f • ming pool. Mrs . Moore pointed out that she had been assured by Paul J. Woods \ & Co. that two valves would be installed in the deep end of the pool and that the pool would be underlain . by an 18" layer of gravel. Since there was still some doubt about whether this would be enough to fulfill the part of their Order of Conditions (File #64-10( dealing with the pool construction, additional requirements were discussed. Paul Willis made the motion that: 1. Two pressure relief valves are to be installed in the deep portion of the pool. 2. The, complete pool is to be underlain by at least a 18" layer of gravel. 3• That the pool plan be approved for construction at that site by being stamped by a Civil Engineer who is a registered Professional Engineer in Mass . The stamped plans must be accompanied by a letter from the Engineer stating that he is aware that the pool is being constructed at a site in Salem Harbor which experiences a 100 yr. flood level of 15.3 feet mlw (Salem Datum( . Donald Hunt seconded the motion and the vote was unanimous. Communications and Notices A notice has been received from MACC announcing a meeting to be held in: f Lexington on Saturday, October 30. A percolation test is to be done, as • well as various panal discussions dealing with the improvement of the quality of life in urban areas, use and management of conservation land and the signifi- cance of the 208 program to local Conservation Commissions . Richard Morton is to attend. Brian French noted that he had received a letter from Michael Harrington announcing a meeting to be held at 1 P.M. on October 20th to discuss an information retrieval system on Federal. assistance programs . The minutes of the October, 7th meeting of the Marblehead Conservation Com- mission were briefly discussed. It was noted that the Marblehead ConCom has received a land donation of approximately .65,000 sq. ft. There was also mention of the pollution of different areas of Forest River. Brian French noted that he had received a letter from David Lash stating that the wetlands mapping program is to be "a joint undertaking of the Planning Department and the ConCom and that decisions and administration shall reflect the mutual involvement and views of both groups ." A memo from Greg Senko concerning an aerial inventory of Salem which has been made was noted. The inventory has been made with 35 mm color slides and is available for viewing by the various City Departments and Boards . The ConCom will see these slides at their next meeting. • An OCS Reporter dealing with offshore oil exploration was noted. -3- l• A copy of a letter from Anthony Fletcher to Robert Camarda concerning drainage requirements for Mr. Camarda's land was discussed. Mr. Fletcher recommended that Mr. Carmarda discuss with the ConCom the permits needed for this work. The ConCom. received a letter from various abutters of Mr. DiBiase's property in the Forest River Area. They are inquiring into the possibility of acquiring nine lots of land to be used as a buffer zone between their properties and the proposed conservation land of Forrest River. A notice has been received for the DEU stating that they are going to hold a Public Hearing on the adoption of .Amendments to the "Regulations under the Wetlands Protection Acts G.L. Chap. 131, Sec. 40." Brian French noted that most of the proposed changes have to do with further clarification of the original act. One proposed addition, however, is that "an Order allowing dredging may provide that maintenance dredging may be performed for a period of five years subsequent without the necessity of a further filing or application for extension" . The minutes from the Sept. 2nd and Sept. 16th meeting of the Planning Board were noted. A notice from SESD announcing the public hearings that are to be held dealing with the South Essex Sewerage District, Danvers-Beverly. Relief Interceptors. Brad Northrup brought the Commission up to date on the Forest River project. • He noted the initial application from Greg Senko to Dr. Evelyn Murphy, of the Executive Office of Environmental Affairs for funding assistance through the Brreau of Outdoor Recreation. He stated that of the 30D acres to be placed under Conservation only one-third is to be purchased. He also explained that this applicationz should be considered as a two phase proposal. The first phase is the purchase of land. Upon completion of the acquisition program more funding will be requested to assist in the development of passive recreation facilities. It was also noted that the necessary reports from the appraisers are to be forwarded by October 29th. Regarding the progress of the appraisers, Brad spoke of two letters he has received. The first was a letter written by David Lash to Martin Coleman of Coleman & Sons Appraisers . The appraisal has not been received yet though the land in question was viewed in August. David has informed Mr. Coleman that his proposal is needed immediately. Also considered was a letter written to David Lash from Foster Appraisal and Consulting Co . Mr. LaPorte of that firm wrote to say that he had spoken to Mr. Todreas regarding his property (lots 236 and 237( in the Forest River Cons. Area. Mr. Todreas is interested in selling lot 236 (the smaller of the two lots off Lafayette st.( , but since -lot 275- controls access- to his land located in Marblehead he is unwilling to sell it. A discussion was held concerning various possible solutions to this problem. This parcel is important since the stream can be controlled from there. It was the sense of the Commission that both parcels should still be appraised. • Brad Northrup is to speak to David Lash regarding this appraisal . 4 Brad also spoke of a letter written by Mayor Levesque asking for the political • support of Senators Kennedy and Brooke, Senate President Harrington, Congressman Harrington and Representatives Ruane and McLaughlin regarding the Forest River--acquisition. Brian French informed the' Commission that he has sent a list of the Harbor Islands the ConCom wants transferred to its custody to Bill Tinti. Brad Northrup made the suggestion that following the receipt of custody of these islands, plans should be made to inventory what is on them. Dolores Jordan informed the Commission that she had heard from the Sierra Club regarding the Bottle Bill and she asked for volunteers to be at the polls on election day. No one was available to help with placards . Dick Morton. informed the commissicn that next year's budget is due December ist. Brian French and David DeVoe are to work on the budget and then present it to the Commission for approval. Business Richard Morton presented the financial report. There is $67.63 in the checking account. Richard explained that two telephone bills had been submitted in the last warrant. The bill for $121.37 was marked past due and the City is unable to pay it unless it receives the original bill. Brad Northrup reported to the Commission on the Mass. Coastal Zone Management j • meeting he attended on October 12th. The meeting was to elicit comments from \ various Boards and Commissions concerning problems and plans for the coastal zone . CZM is in the process of drafting regional plans and guidelines for lard usage which should be available during the winter of 1977. It was also brought out that the State is eligible for funding in order to provide technical advisors for the local communities. A booklet entitled Ecosystems and Resources of the Massachusetts Coast was also passed out. Brad also noted various other items treated during the meeting: 1. Mr. Buckley of the Waterways Advisory Board stated that the 94th Reserve Command ` is going to clean up Winter Island and build a boat ramp. It is hoped that there will be boat storage available there next year. There are also plans to build an office for the Harbormaster there. 2. There are plans for a Waterways Commission which would have more authority than the present Waterways Advisory Board. 3 . Plans for a marina located at Collins Cove was discussed by Mr. Buckley. 'The construction will not begin for several years but the plan calls for a 500 slip marina, parking on a filled area and the beach on the West end. 4. The Waterways Advisory Board has granted approval to increase the Willows Anchorage' area. • -5- �. 5 Brad spoke of the proposed transfer of various Harbor Islands to the ConCom's custody and the state of the Forest River project. 6. Philip Moran informed Brad that he had recived work that Osgood Park is being polluted with raw sewerage, possible coming from Salem State. (Richard Morton is to check into this .( Richard Morton informed the Commission that he has given Bill Tinti the necessary information regarding the proposed court case against Mr. Ragone. William Tinti will now be preparing the papers to obtain an injunction against Mr. Ragone. Dick stated that when he called the State Attorney General's office regarding additional action against Mr. Ragone he was in- " formed that it was more effective to go through the local court. There will be a meeting on October 28th at 7:30 P.M. between Paul Willis and Attorney Johnson to discuss possible action to be taken by Mr. LeBlanc concerning his filling of land on -Leach St. It was brought to the Commission's attention that there have been complaints of air pollution coming from the boiler chimney of Salem State. Richard Morton investigated,this and is still awaiting a response from the College. Mary Ellen Pelletier spoke to the Commission regarding further developments pertaining to Mr. Ingemi. Mr. Melvin Evans of the United States Fish & Wildlife Serv. referred the information he had received to the Environmental Protection (• Agency as well as to the Army Corps of Engineers . A letter to Mr. Ingemi from the Army Corps of Engineers, dated October 5th, stated that Mr. Ingemi had not applied for a Federal Permit to fill the area "adjacent and conting- uous to the Forest River" and that "this appears to be a violation of Federal laws ." Brad Northrup made the motion that the ConCom should direct the City Solicitor, William Tinti, to immediately start action against John Ingemi in order to have him file a Notice of Intent under the Wetlands Protection Act. It was seconded by Donald Hunt and the vote was unanimous . Richard Morton announced there would be two hearings in the near future. One would be Mr. Burke who owns the property next to Mr. Ragone and the other would be Mr. John Ingemi. P1r. William Tinti then spoke to the Commission of possible action regarding Messrs. Paul Willis & Richard Morton are to attend a meeting with Bill Tinti and Gerard LeBlanc regarding Mr. LeBlanc's filling of land on Leach St. The discharge permit for Lynn Sand & Stone was briefly discussed. Their permit allows them to pump water from the quarry to Fosters Dam Pond. Brad Northrup informed the Commission that he had received verbal assurance from the Division of Conservation Services that approval will be granted for the self-help funding that would provide matching funds for the Forest River acquision. In October of 1977 the Commission can apply for additional funding from BOR. Receipt of the October Environment News was noted. • i.; 2 • The monthly report from the Army Corps of Engineers of permits issued or denied for the month of September was noted. The minutes from the Marblehead ConCom were noted. Brian noted that he had received a letter form Mr. Quigley stating that he had not received the card from the appraiser requesting whether or not he wanted to be present when his appraisal was done. When he receives the card he will return it. Richard Morton is to contact David Lash concerning this. The Commission has received the receipt from the registered letter sent to Mr. Joseph Ragone revoking his Order of Conditions (DEQE File no. 64-11 . David DeVoe and Brian French are to work on the Budget which is due Decem- ber lst. Business The Commission received a request to determine applicability of the Wetlands Protection Act regarding construction being done at the Stop and Shop Super- market located at 15 State Road. The project consists of an addition to the supermarket on the southeasterly side with approximate dimensions of 61' -6' by 118 . The existing parking lot will be repaired by resurfacing as necessary.. Since the building addition is being constructed in an area that was formerly paved, and since no increase in the paved parking area is planned, there will be no additional surface water run-off. Paul Willis made the motion that the Wetlands Protection Act is not applicable in this instance. Mary Ellen Pelletier seconded the motion and the vote was unanimous. Mary Ellen Pelletier informed the Commission that she had been in contact with Charles Ames, Superintendent of Highways in Marshfield, regarding the dumping of prolerized material. He informed her that they had used it as fill for a dump. Because of recent legislation, however, prolerized material can no longer be used for land fill. Mary Ellen also stated that she had mailed a certified letter to Mr. Ingemi stating that his continued failure to comply with the Wetlands Protection Act and file a Notice of Intent.will cause the City to take legal action against him. Richard Morton has contacted Prolerized of New England in an attempt to discover alternatives for the elimination of Prolerized material. No information was given. Paul Willis spoke to the Commission regarding the proposed water quality test program of the Forest River area. Paul reported that the Forest River estuary contains a grey silty type material. This pollutant may or may not be coming from Mr. Ragone's or Mr. Ingemi's land. Paul pointed out that Thomson's meadow serves to remove suspended solids and so a different study.__ would be more effective for the area beyond Thomson's Meadow. Minutes of Meeting 10/26/76 -3- • Paul suggested four areas to be considered for this study. Starting with the area in and around Mr. Ingemi's property, Paul suggested the testing begin at the pit site. The swamp would be tested next, and then the outfall of the swamp to the pond on Mr. Ragone's property. The fourth area to be considered would be the other side of Mr. Ragone's pond going downstream. Paul Willis state that there would be 25-50 tests done at an estimated cost of $150. Paul Willis is to call Cat Cove Marine laboratory to adk if they would investigate the source of estueric pollution. Richard Morton and Brad Northrup spoke to the Commission of the filling being done by North Shore Dredging on Mr. Mackey's property at the end of Blaney St. At the request of the Commission the police served Mr. Mackey with a cease and desist. Richard Morton contacted Mr. Censi at the Division of Waterways and found that Mr. Mackey has applied for a permit. Dick also questioned Mr. Censi regarding a possible outstanding fine of $15,000 owed by Mr. Mackey. Mr. Censi could not readilylocate that information, but he would contact Richard when he had. A copy of a letter from the Clerk's Office of the The Appeals Court was received. The letter stated that the briefs filed for the court case of Loring Hills Developers Trust vs. Planning Board of Salem have been reviewed. It also stated that oral arguments may not be necessary. A memorandum has been received from Evelyn Murphy of the Executive Office of Environmental Affairs regarding the newly revised planning requirements for participation in the state Self-Help and Federal Land and Water Conservation Fund programs. Donald Hunt informed the Commission that his letter to the Salem Evening News regarding the Bottle Bill was in the November 1st edition of the paper and that a copy of the letter will be on file . There will be a joint meeting with the Board of Health at 5:00 P.M. on November 9th to consider a joint suit against Mr. Ingemi. David DeVoe explained to the Commission that because of complications arising from the telephone bill, a warrant may not be submitted this month. He has received a letter from the Telephone Company which he hopes will clear up the difficulties. Donald Hunt, David DeVoe and Brian French are to work on the Budget for next year which will be discussed and voted on at the next meeting. Dr. Jerome Long of Terrain Investigation, Inc. next spoke to the Commission of the Wetland's Mapping Project which is now completed. The wetlands are shown on the City's Topographic plans at the scale of one inch equals one hundred feet. Dr. Long explained that he used the stereo prints taken by Avis Airmap, Inc. in 1971 for aerial photo interpretation of the wetlands, the boundaries of which were verified by field investigation. The results of the peat probes done during the field investigation were categorized and color coded as follows: firm-bottomed with negligible organics (orange , shallow or- ganic soil of less that three feet in thickness (green , and relatively deep peats in excess of three feet (brown In addition to recording information on soils, plant communities which thrive within wetlands were noted since Massachusetts State Law currently defines wetland by the presence of certain hydrophilic plants. Dr. Long also mentioned that there were difficulties in mapping certain areas of the City that had been considerably built up since • the aerial photos and topo maps had been completed. Dr. Long suggested that there be a review period for the Conservation Commission and the Planning Board to more throughly study the mapping, followed by a challenge period for the public. David Lash is to coordinate this. Paul Willis reported to the Commission on a meeting he had attended with Messrs. Morton, Tinti, Johnson, LeBlanc and Gibney. Paul explained that Mr. LeBlanc wishes to give the beach in question to the City to be transferred to the custody of the ConCom. Paul pointed out that the boundaries of this land are still in question. A motion was made by Brad Northrup that the Conservation Com- mission recommends to Mr. LeBlanc that his property be given to the City under the management of the Parks Department and that the Commission will write to the Mayor with a copy to Mr. Gibney stating this recommendation. The motion was seconded by Paul Willis and the vote was unanimous. Paul Willis is to write the letter to the Mayor. Mary Ellen Pelletier spoke to the Commission regarding information she has received concerning the dumping of prolerized material in Marshfield in 1972. In a letter from Paul T. Anderson, Regional Sanitary Engineer, to Walter Flaherty, Board of Public Works in Marshfield, Mr. Anderson states that this prolerized material is unsuitable for cover material in a sanitary landfill. In addition he states that this material is combustible and that this material should be covered with at least six inches of uniformly compacted cover material before the end of each working day. • The proposed Inland Wetlands and the Floodplain Ordinance will be distributed to all present at the meeting for review prior to discussion at the next meeting. Paul stated that a letter from Thomas Rich detailing the tests to be done and cost estimate is in the mail. Thomas Rich would do this testing following the next heavy rain. Brian referred to a copy of a letter from Paul Anderson, Regional Sanitary Engineer to Walter Faherty, Board of Public Works, Marshfield dealing with the suitability of prolerized automobile material as cover in a sanitary landfill. Mr. Anderson stated that the Department of Public Health, "considers this material to be throughly unsuitable for cover material in a sanitary landfill." Brian also stated that on September 5, 1975 Mr. Ingemi stated that there would be no additional activity on the land in question. Mr. Ingemi stated that nothing has been done on Lot 21. He further stated that activity on the land adjacent to his land is not his responsibility. Mary Ellen Pelletier stated that there have been numerous changes in the area of Barnes Road. Mr. Ingemi again stated it was not his land and he was A r -2- not responsible. Mr. Ingemi agreed that no work would be done on lot 21 until the .issues at hand are resolved with the ConCom. Mr. Serafini pointed out that the pollution in the area is not totally the result of Mr. Ingemi's past use of the land, others have also con- tributed to the pollution. Robert La.voire of Essex Survey stated that he had not realized that there would have to be testing done on the soil and water on the land in question. He questioned what standards would be applicable to this area. Brian French read the minimum water quality standards of the Common- wealth of Massachusetts for Class C water. A motion was made by Brad Northrup, seconded by Paul Willis and unani- mously voted to extend the hearing to March 29, 1977. It was agreed by the parties involved that the following items will be submitted to the Commission prior to the date of continuation: 1. A copy of a letter sent to Bruce Mallett of the Department of Environ- mental Quality Engineering from John Toomey of the Salem Board of Health concerning the dumping of prolerized material on the Ingemi property. r Minutes of Meeting 12/13/76 Page 2 The Planning Board minutes of November 18th were noted. These minutes • contain a discussion of the proposed zoning of the Flood Hazard District. The Planning Board minutes of November 8th, containing information concerning proposed zoning changes regarding lot size and dwelling unit area requirements for RC, Rl, R2, and R3 were noted. A copy of a letter to John Serafini from Alan Randall of the Army Corps of Engineers stating that the fill placed on Mr. Ingemi's property may be subject to the jurisdiction of the Army Corps of Engineers. Mr. Randall has requested that Mr. Ingemi's proposed project as well as a statement outlining any steps Mr. Ingemi intends to take to insure that the fill material does not have an adverse effect on the water quality of the area be submitted. The minutes from the Peabody ConCom of October 20th and November 9th have been received. Mary Ellen Pelletier is to contact them in order to ascertain if any further action has been taken concerning the pro- posed dredging in Spring Pond. Because of difficulties with the Warrant, several bills have not been paid. This should be taken care of with the December warrant. Donald Hunt and Brian French have met with the Mayor concerning the proposed budget of 1977-1978. Brad Northrup and Brian French met with Hyman Marcus regarding the seven acres he owns located in back of the Stop & Shop that he wishes to sell. One-half of this area consists of a pond. His asking price, as of this time, is $100,000. Brad is to contact Mr. Marcus in order that interested Commission members may view the property on Sunday at 9:00 A.M.
