SRA Decision.BBC Cafe Permit.5-8.19 Salem Redevelopment Authority Decision 133 Washington Street Boston Burger Company— Cafe Permit Meeting Date: May 8, 2019 Members Present: Grace Napolitano, Dean Rubin, Gary Barrett Members Absent: Russell Vickers, David Guarino Decision: At a regular meeting of the Salem Redevelopment Authority(SRA), upon a motion duly made and seconded, it was unanimously voted to approve the cafe permit as presented and conditioned herein. Referenced Plans and Documents 1. Application package prepared by Boston Burger Company Management, including site plans, and photographs of existing conditions and site furniture, submitted on 3/28/19 with additional information submitted on 4/12/19. 2. Staff Comments dated 5/1/19. Conditions of Approval 1. Consistency with Aproved Design/Plans: Should the applicant determine that the project may not be completed as presented and conditioned herein, he/she/they shall return to the DRB to review proposed modifications prior to making any changes in the field. 2. Patio Umbrellas: The applicant shall only utilize umbrellas without corporate logos. 3. Serving of Alcohol: The applicant shall obtain the permission of the City of Salem Licensing Board to serve alcohol to patrons seated outside of the establishment. Should the Licensing Board not approve the service of alcohol, thereby necessitating the application to redesign the patio seating area, the applicant shall return to the SRA for review of a new outdoor seating configuration. Findings 1. Activating Underutilized Pedestrian Space: Placing outdoor seating at the rear of the restaurant will activate a currently underutilized space. The activity and lighting that will be in this space will create a more welcoming environment for pedestrians passing through the area. 2. High Qualitv Furnishings: The applicant will be using high quality furnishings for the tables, chairs, umbrellas, and planters. The furnishings will complement the building's aesthetic and will not derogate from the visual appeal of the area. 3. Accessible Passage: The applicant has indicated, via the application documents, that there is approximately 5 '/2' of clear sidewalk between the outer edge of the tables and the curb of the sidewalk along Washington Street. The applicant has also indicated that there is 10' and 7 Y2' of clearance between the rear of the building and the condos and the patio space, respectively.
