A May 20, 2014 letter (attached) was sent to you from this office regarding the use of Asphalt, Brick and Concrete (ABC) materials for fill on the proposed roadway improvement project and the t6 Wyman Street property itself, herein after referred to as "the project". That letter stated that, in accordancewith Massachusetts Department of Environmental Protection regulations Site Assignment Regulations for Solid Waste Facilities 310 CMR 16.00 and Solid Waste Management Facility Regulations 310 CMR 19 000), herein after referred to as (MA DEP) requirements, the use of the ABC materials was illegal and must be removed immediately. On several occasions, the writer spoke directly to your Contractor performing work on the project and both times Your Contractor's request to perform further work was denied. Your Contractor was directed to remove all ABC materials and that until such time, no further work is allowed on the project. It is clear that a substantial amount of ABC material remains and further work has been performed in violation of the direction provided. On November 12, 2014, another letter (attached) was sent to you from the writer stating this material is illegal and all material must be removed and disposed of in accordance with all applicable local and state (MA DEP) requirements. You were again notified that no further work shall occur on the project until this office rei•eived written documentation from a Massachusetts Licensed Site Professional (LSP) that no ABC material remai how the material was disposed.
