MEMOS RE-VANDALISM AT ELMER VARNEY PROPERTY ON WYMAN AVENUE.
8.15.72 Telephone call from Officer Thomas O' Shea of the Salem Police
Department , reporting vandalism to unfinished dwelling house
on Wyman Avenue. Hillco Homes had obtained a permit to erect
a single family dwelling at this site in 1964 from former act-
ing Building Inspector W R Burns. During construction, an
attempt was made to construct a two-family dwelling instead of
a one-family permitted in the area, and as a result all construc-
tion at the site was ordered stopped.
8.15.72 Building inspector' s office contacted ASsistant City Solicitor
Mr. Donaldson who had been in touch with Mrs. Varney, mother of
original builder and who had her own residence in the immediate
area; Mrs. Varney had been in the hospital when she contacted
Mr. Donaldson on a private matter.
Mr. Donaldson suggested we get in touch with Mr. Varney,original
owner of the property when construction was commenced.
8.15.72 A telephone conversation with Mr. Varney at his residence in
Waltham revealed that he had been forced to appear in court with
regard to outstanding obligations to the Hillco Homes people, with
Attorney Berkal representing the builders; Mr. Varney had refused
to pay any of the bills after he was made aware that the builders
had proceeded to ignore all of the city of Salem building regulations
He further stated that the City had taken the property from him for
non-payment of taxes, and that he had not even received a tax bill
for several years.
A check with the assessors ' office revealed that they still had him
on their records, with no other address for residence or mailing,
other than the Wyman Avenue address where the unfinished structure
was located.
8.15.72 Called beclF to Mr. Donaldson' s office and acquainted him with all
of this information; he appeared at this office later on and we
showed him what information we had in the records of the office.
A day or so later, Mr. Donaldson met with Mr. O'Brien discussed the
matter of this dangerous structure open to additional vandalism, and
it was agreed that in the best interests of the health and welfare of
the people, it should be demolished immediately.

Perry and Harold Leathe :
Francis F. Perry is a director of Hilco Homes of
Northern Massachusetts, filed a certificate for
business 12/29/62.
Buskin, Inc . , So Main Street, Middleton informed
the Town Clerk by letter that as of the date of
the letter 9/26/62 they were gevering connections
with Main Line Homes, signed "Francis F. Perry"
whose name was also connectedawith Main Line Homes,
and whose home address is Haverhill Road, East
Boxford.
Main Line Homes, a corporation in New Jersey or
Pennsylvania build fabricated homes ; Main Line
Erectors were the ones who put them up.
There is a Lindsey R. Perry (who is probrably the
L. R. Perry we have ) resides on Sunrise Road,
Boxford.
Harold Leathe resides in Yarmouth, Maine.
Buskin, Inc. , i-O * finance company did business
with the Naumkeag Trust Company on a 1962 Thunder-

An application for a building permit to_ erect a single family
dwelling was received in this office, and a permit issued for con-
struction of same.
Upon a routine inspection of the work, it was discovered that
the building was being prepared for occupancy by two families. This
area is a single family district , zoned R-1. The permit was revoked
and construction ceased.
The lot of land on which the structure stands does not have an
opportunity to make connection with the city water or sewer system.
If these factors are to be taken care of by drilling for water on
the lot and a septic tank with leeching bed, the plans for the same
with plans showing locations must be submitted to the Board of
Health for examination and approval.
Furthermore , the plans and specifications are not in complete
accord with the local building code .
New plans clearly indicating conversion to one-family occupancy
should be submitted to this department , and plans and specifications
for obtaining water and disposing of sewage should be presented to the
Board of Health.
If these conditions were complied with, a building permit could
be reissued and -the original proposal to erect a single family dwel-
ling could be completed.

Thank you very much for your recent letter.
I must apologize for my tardiness in answering ,
your letter. However, I have been out of tow
on an extensive trip.
From what you have pointed out in your
letter, the matter certainly could be settled
for a reconversion of the construction to date
to conform the plans. for a one family dwelling.
Inasmuch as very little inside work has been
done, it could probably be altered without to
much difficulty.
I am presently in the process of discussing
legal aspects of this situation with Barr., D.
Berkal, Esquire, and his decision will ultimately
direct our future plans with this property, specif-
ically how quickly we act.
