My opinion follows. The Assessors have stated by letter to you that 5 Wyman Street was not held in common ownership with any other property since 1965. Inasmuch as there has been no merger of title, this is a buildable lot as long as it is in excess of 5,000 square feet. 6 Wyman Street. It appears that this was held in common ownership with 8 Wyinan Street but only for a 2 year period of time. There has, therefore, been no merger and it would appear that this lot is buildable as long as it exceeds the 5,000 square feet requirement. 8 Wyman Street it appears that this was held in common ownership for the years 1973 through 1975 but did not result in a merger inasmuch as it did not exceed the 5 years necessary. This lot is also buildable as long as it fits the 5,000 square foot requirement. Mr. Leo E. Tremblay Page Two June 14, 1996 6 Wyman Avenue. As I read the Assessors letter this property was held in continuous ownership for a period of 1965 through 1975. From 1965 to 1973 this property was held in the name of Mary T. Varney. From 1973 to 1975 it was held in the name of Elmer R. and Gladys W. Varney. Accordingly, it would appear to me that there-had been a merger between 1 Wyman Street and 6 Wyman Avenue. In order to build on to 6 Wyman Avenue it would require that the property at 1 Wyman Street be included or that appropriate relief be granted by the Board of Appeals.
