A May 20, 2014 letter (attached) was sent to you from this office regarding the use of Asphalt, Brick and Concrete (ABC) materials for fill on the proposed roadway improvement project and the 16 Wyman Street property itself, herein after referred to as "the project". That letter stated that, in accordance with Massachusetts Department of Environmental Protection regulations Site Assignment Regulations for Solid Waste Facilities, 310 CMR 16.00 and Solid Waste Management Facility Regulations, 310 CMR 19.000), herein after referred to as (MA DEP) requirements,the use of the ABC materials was illegal and must be removed immediately. On several occasions, the writer spoke directly to your Contractor performing work on the project and both times your Contractor's request to perform further work was denied. Your Contractor was directed to remove all ABC materials and that until such time, no further work is allowed on the project. It is clear that a substantial amount of ABC material remains and further work has been performed in violation of the direction provided. On November 12, 2014, another letter (attached) was sent to you from the writer stating this material is illegal and all material must be removed and disposed of in accordance with all applicable local and state (MA DEP) requirements. You were again notified that no further work shall occur on the project until this office received written documentation from a Massachusetts Licensed Site Professional (LSP)that no ABC material remains and how the material was disposed. The roadway construction permit issued by this office has been revoked. This Trust may be terminated at any time by delivery to the Trustee of an instrument in writing setting forth such termination signed by any Beneficiary and acknowledged. Provided, however, that this Trust shall terminate in any event twenty (20) years from the date hereof. The Trust Estate shall be directly liable for the payment or satisfaction of all obligations and liabilities incurred by the Trustee and agents of this Trust within the scope of their authority. Although the Trustee, as Trustee, may be made party to any suit or proceeding to enforce any such obligation or liability, he shall not, on account thereof, be held to any personal liability i therein but shall be party only insofar as is necessary to enable such obligation or liability to be enforced against the Trust I Estate. All such agreements, obligations, and instruments shall refer to this Declaration. Failure to comply with the provisions of this section shall, however, in no event render any Trustee, beneficiary, or agent personally liable to this Trust or to its beneficiaries . 9 . Succeeding or additional Trustees may be appointed and any Trustee may be removed, by an instrument or instruments in writing signed by a majority of the Beneficiaries; provided in each case that such instrument or instruments, or a certificate by any Trustee naming the Trustee or Trustees appointed or removed, and in the case of any appointment, the acceptance in writing by any Trustee or Trustees so appointed. Upon the appointment of any I succeeding or additional Trustee, title to the Trust estate shall thereupon, without necessity of any instrument of conveyance or transfer, be vested in such additional or succeeding Trustee jointly with the remaining or other Trustee, if any.
