In response to a complaint from the City of Salem Health Department
regarding the second means of egress at the above referenced property, I
conducted an on-site inspection. I found the second floor apartment to be
in violation of the Massachusetts State Building Code, Sec. 3401. 10.1,
Means of Egress. This violation must be corrected immediately.
You are hereby requested to contact this office upon receipt of this
notice for proper location of egress and to apply for the appropriate
permits. Failure to comply will result in the appropriate legal action
being taken.

We are in the process of securing a contractor to handle the
egress problem.
This problem was aggrieved and addressed back in 1966.
According to the plans of 1966, that were approved by your office,
the stair case to this exit is missing; however the location of
exit is in compliance with the Board of Appeals decision of 1966.
The reason for the delay since re6eipt 'of your correspondence is
that the tenants have- not been receptive in permitting us access
to survey the egress problem.
Please understand that I wish to resolve this matter in the
most expeditious manner.

To provide additional means of egress from dwelling;
non-conforming use in an Industrial area requiring
thirty-foot front, aide and rear yards.
On April 6s '1966, petitioner appealed to the Board of Appeal
to reverse a decision of the Building Inspector refusing a
permit for the addition of two stair cases on a two family
I! dwelling at this location.
A hearing was held on this petition on April 25, 1966, pur-
suant to notices mailed postpaid to the petitioner, abutters,
Board Members, and others, and advertisements published in
the Salem Evening News.
All members were present at this hearing. Petitioner appeared
and stated his plan. There was no opposition.
After due consideration thereof, the Board voting unanimously
on the grounds of alleviating hardship to the petitioner, and
granting this petition would cause no detriment to the public
good and would not substantially derogate from the intent and
purpose of the Ordinance, granted the appeal.

It will be necessary for me to refuse to issue a permit to
alter your dwelling at 9 Woodbury Court to provide additional

of the City of Salem Zoning Ordinance regarding distances to

1 This is an Industrial area and your dwelling .is an exist-
ing non-conforming use. In this district the Ordinance requires
a thirty-foot front yard, a thirty foot side yard, and a thirty
F foot rear yard.
i However, I wish to advise you of your right to appeal from
this decision to the Board of Appeal who may in ; some cases
grant a variance from the application of the Zoning Ordinance.
If you decide to appeal to the Board, please file your
appeal specifying the grounds thereof within thirty days of
the date of this letter with the City Clerk. To cover the cost
of advertising your petition, please present a check in the
amount of $22.50, made payable to the Salem News Publishing
Company.
The next hearing of the Board of Appeal will be held on
April 25, and petitions to be heard at this hearing must be
advertised April 9, and April 16.
