RE: Notice of Filing a Permanent Solution Statement with Conditions for the Properties located at 26, 30
and 40 Colonial Road Salem, Massachusetts RTN#3.2666
Dear Mayor Driscoll:
Golder Associates Inc. (Golder) has prepared this communication on behalf of BASF, whom is hereby providing
notification of filing a Permanent Solution Statement (PSS) with Conditions with the MassDEP. Previously, in
October 2018 an Activity and Use Limitation (AUL), was filed in accordance the Massachusetts Contingency Plan
(MCP)for these Properties.The City of Salem was notified in October 2018 of the AUL filing.As stated in 310 CMR
40.1403 of the MCP, a copy of the PSS shall be provided to:
1. The Chief Municipal Officer;
2. The Board of Health;
The PSS and AUL provide for continued commercial/industrial use of the referenced Properties. As long as the
provisions of the PSS and the AUL are complied with a condition of No Significant Risk as defined by the MCP will
be maintained at the Properties. The AUL prohibits future residential types of uses on the Properties and restricts
certain subsurface construction activities. Based on the filing of this PSS no future assessment or remedial
actions are anticipated at the Disposal Site.
The PSS,AUL and associated MCP documents on file with the MassDEP are available to the public and can be
viewed at MassDEP website using Release Tracking Number(RTN)3-2565 at
http://public.dep.state.ma.us/SearchableSites2/Search.aspx or at the MassDEP Regional Office,205B Lowell
