Building Inspector to review the status of the existing building permit for structural work and
progress of the work, to review of the remaining scope of work to be approved with a new building
permit based on the Construction Documents dated 18 June 2004, and to review the Construction {
Control requirements for submittals and verification of compliance with design under the
Massachusetts State Building Code.

1. The existing building permit for foundations and structural framing work approved per r
Construction Documents dated 19 March 2004 must be closed-out prior to approval of
new permits to proceed with remaining work per the revised and completed Construction
Documents dated 18 June 2004. h

observe the completed work and prepare Field Reports and punch-lists to document all
work which is either incomplete or which requires corrective measures in order to comply
with the requirements of the Construction Documents dated 19 March 2004 and all
Supplemental Instructions, Bulletins and Structural Clarification Sketches issued during the

4. Upon completion of all structural work, Pierce Architects and Structures North Consulting
Engineers shall conduct a final inspection of the work and submit final Field Reports and
written certifications that the work complies with requirements of the Building Code and
the Construction Documents dated 19 March 2004.
5. Upon receipt of the Field Reports and written certifications from the Architect and
Structural Engineer, the City of Salem Building Inspector will complete the required
inspections and approvals.

6. The City of Salem will review and approve a new building permit for the remaining work as
described by the Construction Documents dated IS June 2004 once Cote furnishes the fire
protection construction documents prepared by others, and upon satisfactory resolution of
what professionals will assume responsibility for complying with the Construction Control
requirements as delineated in my letter to you dated 21 October 2004.
Specifically the 21 October 2004 letter states you have two options for complying with the
Construction Control requirements of the Building Code:
• You provide the submittals required by the Construction Documents for review and
approval by Pierce Architects and Johnson Engineering & Design who are responsible
for their respective portions of the work, so that upon completion of the work we can
provide the required written reports and certifications that the work complies with the
Construction Documents and meets all applicable Building Code requirements; or
• You retain new registered architects and engineers to perform construction phase
services for the portion of the work for which they will be directly responsible. If you
elect to do so, it would be necessary to terminate our Agreement, and an additional
release would be required for you to continue to use our Documents, as well as
payment of all monies due for services rendered through the date of termination.
Structures North and Pierce Architects will be present at the site on Thursday morning October 28"
to conduct our field observations in order to prepare a punch-list of items to be completed or
corrected as noted in item 3 above.

existing building permit(which is limited to foundations and structural framing work) must be
closed-out and signed-off prior to the approval of a new building permit for the remaining work, I
am obligated to inform you that you are proceeding at your own risk by beginning with the
9 plumbing, mechanical, electrical and remaining architectural work without proper permits and i
approvals.
1 Since early September we have been waiting for you to provide us with the required notification R
prior to concealing any structural, plumbing, mechanical or electrical work. During this time we
have rightfully assumed you had already secured all necessary permits and approvals from the City o
of Salem Building Department, Electrical Department and Fire Department.
Please be advised therefore, when our engineers do conduct their site visits to observe the progress F

the terms of this Agreement."

In conclusion therefore, please revise and resubmit your letter to reflect the correct date of
termination and provide written evidence to justify that we have substantially failed to perforin in s

was not present at the site to observe any of this work prior to completion. No visual evidence
exists therefore that would confirm the installation of any underslab vapor matt or vapor
barrier,rigid insulation and concrete reinforcing.
Cote stated that he installed a 6 mil poly vapor barrier directly below the S" concrete slabs
and above the 2" rigid insulation. Pierce requested that Cote provide copies of photos taken
during the work that would confirm the preparation and compaction of subgrades, installation
of reinforced concrete footings, underslab waterproofing or vapor barriers, underslab rigid
insulation and reinforced concrete slabs as indicated. Pierce or Structures North can not
certify that this work was completed according to the Construction Documents until such
evidence is provided by the contractor(s).
4. It appears that most of the remaining Structural Punch List items have been completed. Cote will
contact Pierce/Structures North when work is 100%complete in very near future,so a final site
visit and approval of the structural work can be scheduled by Structures North.
5. Pierce observed that two new roof dormers have been constructed at the third floor with Anderson
casement windows installed;one located on east elevation of Unit 4 Dressing Room,and one
located on south elevation of Unit 5 Hall 2 in lieu of the skylight shown on the drawings.
Structures North to observe the completed construction and advise of any remedial work
required to comply with structural design.
6. Pierce observed that 1 Anderson casement window was substituted for the 2 Velux
skylights indicated to be installed in Bath 1 of Unit 5. The casement window was installed
in the plane of the sloping mansard roof, not plumb and vertical as recommended by
Anderson.

7. Most of the strapping has been installed at ceilings and mansard roofs. Several interior
partitions have been framed with the top plate located below the ceiling strapping in
locations where fire rated partitions are indicated and required.
Some firestopping has been completed satisfactorily, while other locations will require
removal of strapping and some existing ceilings in order to complete the installations
as indicated.
Pierce and Cote walked the entire building to identify the locations where strapping
must be removed in order to install solid wood blocking &firestopping. Pierce
recommended that all locations of fire rated partitions and ceilings be identified with
spray paint in order to confirm where continuity of firestopping, draftstopping and fire
protection is required.
8. Cote expressed interest in deleting the new 3/a" plywood subflooring indicated to be
installed throughout the entire attic. HVAC work is nearing completion in the attic, and
subflooring was not installed prior to proceeding with the mechanical work.
Pierce indicated that as an alternative to installing the new subflooring,the fire separation
partitions at third floor could be extended up through the attic and

terminated tight to underside of the roof sheathing. Pierce will confirm the Code
requirements and issue clarification sketches. In addition, Pierce will review the
scope of revisions required to provide for proper attic ventilation and supplemental
heat and issue clarifications and supplemental instructions after consultation with
Johnson Engineering.
Information or Action Required:
1. MPE submittals required by the Construction Documents still remain outstanding. Cote to
follow-up with subcontractors and deliver submittals ASAP. All required Submittals must
be reviewed prior to final approval of the Work and issue of any Construction Control
certifications and affidavits by the Architect and Engineers of record.
2. Pierce requested advance notification from Cote in order for Pierce,Structures North and Johnson
Engineering to schedule site visits to observe that the following Work has been completed in
accordance with all Code requirements and the Construction Documents prior to concealing of the
Work,listed in sequence:
1) Structural Punch List work.
2) Rough plumbing work,
Rough mechanical work,
Rough electrical work( including fire alarm and security systems).
NOTE: Rough sprinkler system observations by others.
3) Completion of all firestopping and draftstopping work.
4) Installation of fire-safing insulation and fire rated sealants (UL Classifications to be visible)
5) Installation of baffle vents in roof rafter bays. 4

AND SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 7 WINTER STREET R-2
A hearing on this petition was held July 16„ 2003, with the following Board Members
present: Nina Cohen, Stephen Harris, Richard Dionne, Joseph Barbeau and Bonnie
Belair. Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner is requesting a Variance from use to allow 6 residential units, to allow two
principal building on one lot, relief from minimum lot are per dwelling and number of
stories for proposed addition and s Special Permit to extend an already non-conforming
structure for the property located at 7 Winter Street located in a R-2 zone.
The provisions the Salem Zoning Ordinance which is applicable to the request for a
Special Permit is section 5-3 Q), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extent expansion of nonconforming lots, land,
structures,and uses, provided, however, that such change extension, enlargement or
expansion shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests may be
granted upon a finding by the Board that the grant of the Special Permit will promote the
public health, safety, convenience and welfare of the City's inhabitants.
The Variances which have been requested may be granted upon a finding of the Board
that:
A. Special conditions and circumstances exist which especially affect the land,
Building or structure involved and which are not generally affecting other lands,
buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
C. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district or the

DECISION OF THE PETITION OF WINTER STREET LCC REQUESTING A VARIANCE
AND SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 7 WINTER STREET R-2

The Board of Appeal, after careful consideration of the evidence presented, and after
reviewing the plans makes the following findings of fact:
1. Petitioner Winter Street LLC is a Massachusetts corporation that owns and
operates a local business known as The Inn at Seven Winter Street. Petitioner
and the principal Dee Cote were represented at the hearing by Attorney George
Atkins and by Dan Pierce, architect and designer for the project.
2. Petitioner presented a plan to convert the existing bed and breakfast to a six-unit
condominium. The plan utilizes the existing Second Empire Victorian residence
and grounds, and add a two story carriage house and two three-story additions,
each of which would be designed and constructed is a is a historically-
appropriate style. Two parking places for each of the six units would be provided
in an off-street lot at the rear of the property. Each two-bedroom unit would be
greater than 1500 of its size.
3. In support of the conversion, Mr. Atkins argued that condominium owners have a
greater interest in maintaining properties than do renters, and that the
condominium form of ownership can ensure capital repairs are performed on a
regular basis since the owners are on site. Basic maintenance, trash and snow
removal are functions normally performed for the condominium owners as a part
of the service paid for by the condo fees. He further argued that the residential
use is less than a commercial use. Finally he noted that because the project
involves six units, it would undergo site plan review by the Planning Board prior
to construction, thus ensuring a close review of the layout of the traffic flow,
services and other nuts and bolts of the development.
4. Architect Dan Pierce presented the project plan. He noted that five units would
be created in the main building, including one unit entirely on the first floor and
four two-story units in the in the house and additions. The plan calls for the
retention of all existing Victorian design features within and without the house,
which with the high ceilings and expansive room size, are a marketing asset to
the development. Most of the existing trees will be saved to preserve the
grounds. Early city plans show the property previously had a carriage house on
the grounds and the proposed two-story building will fit in with the scale of the
houses toward the rear of the property.
5. Speaking in support of the proposed plans were abutters John Wright, 5 Winter
St., Hannah Dozzi, 20 Pleasant St. and Dick Dunham 131 Bridge St. and
neighbors Joe Schoke of 16 Pleasant St., Jean Garakan 4 Parker Court, Paul
Guido 15 Pleasant St. and Mary Manning of 14 Winter Street. Proponents
argued that the plan would improve both the property and the street, which was
currently undergoing a renaissance that it would create housing to meet the
needs of smaller families and older empty-nesters, that it would ensure the
property would be well maintained and that they felt comfortable that Mr. Cote
would build it well
6. Opposed to the petitioner's plan were Kathleen Ward Atchason, 26 Winter St.,
Thea Grace Morgan, 11 Winger St. Jeffery Barrows, 14 Gregory St Marblehead,
Stephen Cummings of 20 Winter St., Jean Charanago, 16 Winter St., Marc and
Marlene Schaaedle of 135 Bridge Street and Robert Ciociola and Janice Martin,
new owners of 11 Winter St. Opponents expressed opposition to the increased

parking difficulties on Bridge Street and to the reduced size of the dwelling units,
which the argued, guaranteed a more transient resident than the existing residential
homes.
On the basis of the above findings of fact, and on the evidence presented at the
hearings the Zoning Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property but not the
district in general.
2. Literal enforcement of the provisions of the Ordinance would involve substantial
hardship on the petitioner.
3. The relief requested can be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent of the district or
the purpose of the ordinance
4. The Special Permit granted can be granted in harmony with the neighborhood and
will promote the public health, safety, convenience and welfare of the city's
inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief
requested, subject to the following conditions;
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted and
approved by the Building Inspector.
3. All requirements of the Salem Fire Department relative to smoke and fire
safety shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing
Structure.
6. Petition shall obtain a Certificate of Occupancy shall be obtained.
7. Petitioner shall obtain proper street numbering for the City of Salem Assessor's
Office and shall display said number so as to be visible from the street.
8. Petitioner is to obtain approval from any City Board of Commission having
jurisdiction including, but not limited to, the Planning Board.

Legal Remedies for Tenants of Residential Housing
The following is a brief summary of some of the legal remedies tenants may use in order to get
housing code violations corrected :
1. Rent Withholding(Massachusetts General Laws, Chapter 239, section 8A): If Code Violations Are Not
Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if:
You can prove that your dwelling unit or common areas contain code violations which are serious
enough to endanger or materially impair your health of safety and that your landlord knew about the
violations before you were behind in your rent.
You did not cause the violations and they can be repaired while you continue to live in the
building.
You are prepared to pay any portion of the rent into court if a judge orders you to pay it. ( For this,
it is best to put the rent money aside in a safe place)
2. Repair and Deduct (Massachusetts General Laws Chapter III section 127L): The law sometimes allows
you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that
there are code violations which may endanger or materially impair your health, safety, or well-being, and
your landlord has received written notice of the violations,you may be able to use this remedy. If the owner
fails to begin necessary repairs (or to enter into a written contract to have them made)within five days after
the notice or to complete repairs within 14 days after notice,you can use up to four months rent in any year
to make repairs.
3. Retaliatory Rent Increases or Evictions Prohibited (Massachusetts General Laws, Chapter 186, section
18, and Chapter 239, Section 2A): The owner may not increase your rent or evict you in retaliation for
making a complaint to your local code enforcement agency about code violations. If the owner raises your
rent to try to evict within six months after you have made the complaint,he or she will have to show a good
reason for the increase or eviction which is unrelated to your complaint. You may be able to sue the landlord
for damages or if he or she tries this.
4. Rent Receivership (Massachusetts General Laws Chapter 11, section 127 C-H): The occupants and/or the
Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to
the owner. The court may then appoint a"receiver"who may spend as much of the rent money as is needed
to correct the violation. The receiver is not subject to a spending limitation of four months'rent.
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your
rent returned if your dwelling unit does not meet minimum standards of habitability.
6. Unfair& Deceptive Practices (Massachusetts General Laws, Chapter 93A) : Renting an apartment with
code violations is a violation of the consumer protection act and regulations, for which you may sue an
owner.

A hearing on this petition was held November 17, 1999 with the following Board
Members present: Nina Cohen, Chairman, Ronald Harrison, Stephen-Harris, Stephen
Buczko and Richard.Dionne. Notice of the hearing was sent to abutters and others and ..
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A. _
The petitioner is requesting a dimensional Variances for lot area, lot area per dwelling,
lot area per dwelling, lot width, front yard, side yard and height for resubdivided land for
the property located at 3 Winter Street and 7 Winter Street.
The Variances which have been requested may be granted upon a finding by this Board
that:
1.Special conditions and circumstances exist which especially affect the land, building or
structures involved and which are not generally affecting other lands, buildings and
structures involve.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.

Legal Remedies for Tenants of
Residential Housing
Ile following is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Withholding(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
k You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent_
B. You did not cause the violations and they can be.repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a jud�g,orders you to pay it. (For this,it is best to put the ,
rent money aside in a safe place.)
2. R n it rid D r r(Massachusetts General Laws,Chapter 111, section 127L): The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your bath,safety,or well-being,and your landlord has received written notice of the violations;
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have thetlr
made)within five days after notice or to complete repairs within 14 days after notice, you can use up to four months'rent in:ang
year to make the repairs.
3. Retaliatory Rent Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186, section 18,and Chapter 239,
section 2A):'Me owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after you have made
the complaint, he or she.will:have.to show.a good reason for the increase or eviction which is unrelated to your complaint..You
may be able to sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11, section 127 C-H): The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your rent returned if your.
dwelling unit does not meet minimum standards of habitability.
6. Unfair and Deem iv . Practices(Massachusetts General Laws, Chapter 93A) Renting an apartment with code violations is a
violation of the consumer protection act and regulations, for which you may sue an owner.

9 . Add illuminated exit sign and lighting in back hallway
and down spiral stairway.
IO . Replace/repair existing exit signs and emergency
lighting .
11 Remove counter top stove from unit #303 .
12 . Provide continuous illumination to halls , stairways
and exits .
13 . Repair door latches to egress doors to fire escapes .
Failure on you part to comply within the time
specified will result in a complaint being sought against
