For the record and your files, I shall summarize our conversation. I will add sketches illustrating the topics. 1. New Entry Construction in Corner near Winter Street: As shown on the drawings submitted to the Board of Appeals, our Working Drawings for construction are in keeping with the plans as approved by the Board of Appeals. Therefore, you will be able to issue a building permit for it, subject, of course, to normal Building Code compliance. Because the lot is odd-shaped and fronting on three public streets, and because the Board of Appeals has approved the plans, your interpretation makes this new construction legal without any further special hearings. I understand, that to obtain a building permit, a plot plan showing the new construction, properly dimensioned, is acceptable. A new survey will not be necessary. 2. Rear Vestibule Replacement: We propose 'to replace the existing rear vestibule and associated steps to allow inclusion in to a new vestibule access to the basement. Presently, the basement is accessibl&by bulkhead from the exterior. Please refer to sketches and photos enclosed. MALOFF FOR VARIANCES FOR 2 WINTER STREET A hearing on this petition was held on May 18, 19 w2ph q,b� le ng Board Members present: James Hacker, Chairman; N; ssrs. , harnas, opper, Luzinski, Piemonte and Associate Member Bencal. 4e of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Mass9blt &]LfiW*A4*zws Chapter 40A. Owners of the property. are Michael A. Clemens & Richard A. Clemens, Trustees C & C Realty Trust. Petitioners have requested a variance to allow them to use the first floor of the premises as professional dental offices in this R-2 district. Petitioners also request a variance from minimum parking'' requirements to allow a minimum of eight (8) spaces. . The Board of Appeal, after consideration of the evidence presented at the public hearing and after viewing the plans of the property, makes the following findings of fact: 1 . No opposition to petitioner's plan was raised by neighbors; 2. The shape and site of petitioner's lot are unique conditions affecting the lot, but not other lots generally in the district; 3. Because petitioner's lot is bounded by streets on three sides and by buildings on the fourth side, there is no possibility of obtaining additional land; 4. Wit".out allowing the premises a partial non-residential use, the. premises will probably continue to decline. On the basis of the above findings of fact and the evidence presented at the public hearing, the Board of Appeal concludes as follo.'^t 1 . Petitioner's request for variances can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent and purpose of the Zoning Ordinance of the City of Salem; 2.
