Re: Violation at 25 Winter Island Road
Dear Mr. & Mrs. Karam:
As you are aware, On December 30, 2004 you filed a Request for Determination of
Applicability (RDA) with the Salem Conservation Commission for the addition of an
existing deck and clearing of some site vegetation within the Buffer Zone of a Coastal
Bank and within Land Subject to Coastal Storm Flowage. On January 13, 2005 the
Salem Conservation Commission issued a Negative Determination for the proposed work
within the buffer zone with the understanding (as shown on the approved plans dated
11/23/04) that minimal work would be performed within the buffer zone and therefore
would not require the filing of a Notice of Intent (NOI).
On April 13, 2005 it was brought to my attention that a considerable amount of site work
was being performed at 25 Winter Island Road, potentially within the buffer zone.
Following a site inspection, I observed a backhoe and a considerable amount of soil and
boulders stockpiled within the buffer zone with no erosion control measures in place. In
addition, to the above-referenced resource area on site, it was also determined that Salt
Marsh also exists on site. The Salt Marsh also has a one hundred foot buffer zone, and
the stockpiled material is located approximately 25 feet away. The work that is currently
being performed has significantly altered the buffer zone and could potentially harm the
coastal resource areas.
At this time, the Salem Conservation Commission is directing you to stop all work,
stabilize you site (by removing all stockpiled material and machinery from the buffer
zone and return the buffer zone to its original grade), and file a Notice of Intent including
all required submittal documents with the Salem Conservation Commission as soon as
possible.
