A complaint came in from the neighborhood association around Szetala Ln. and was called in by a
gentlemen for the association as a whole.
During drainage construction for Church on Forrester St the construction co. used fenced in area —Used
as staging area, left huge cement piles, dirt piles. "We" would like it removed. (Would not leave call
back#, or name) asked how we could call them back and believe he will call back at a later date to find
out status. (Gave him calling hours to return a call.)

Donna Schutz (Shoots) called re fence letter she got @ 251 Jefferson Ave. "You have the wrong
address'. Asked her where she lived. 251 Jefferson. (huh) She went on to say fence belongs to
neighbor, on property line. That last winter snow plow damaged fence and fence is falling into their
yard. She will call in during c/b hours to discuss letter with you. States you need to contact person to
the left of her house (if you are looking @ house). Did not take her number.

A hearing on this petition was held Aprill8, 1990 with the following Board
Members present: James Fleming, Chairman; Richard Bencal , Vice Chairman; Mary
Jane Stirgwolt; Associate Members Arthur Labrecque and Peter Dore. Notice of
the hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Variance from rear setback
requirements to allow a deck to remain in this R-1 zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, building or structures in the same district.
b. literal enforcement of the provisions of the Zoning Ordinace would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal , after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1 . The new deck has replaced one that was in disrepair.
2. No opposition was presented.
3. Support in the form of a letter from the Plummer Home, the immediate
abutter, was submitted.
4. The new deck added safety and convenience for the property.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property but
not the district in general ;
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner;
3. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent
of the district or the purpose of the Ordinance.

A hearing on this petition was held September 15, 1993 with the following
Board Members present: Francis X. Grealish, Chairman; George Ahmed,
Stephen O'Grady and Associate Member Arthur Labrecque. Notice of the
hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting Variances to divide the
existing lot into two lots; Lot 1 containing the single family dwelling
will contain approximately 6,112 sq.ft. ; Lot 2 will contain approximately
1,578 sq.ft. and is situated at the tip of the property. Lot 2 will be an
unbuildable lot with the existing shade trees and vegetation remaining.
The Variance which has been requested may be granted upon a finding by this
Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other lands, buildings and structures involved.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented
at the hearing, and after viewing the plans, makes the following findings
of fact:
1. There was no opposition to the proposed request, an abutter spoke in
favor.
2. The petitioner and her late husband purchased the property in 1969 and
the petitioner still lives there.
3. Petitioner has paid taxes on entire property since it was purchased.
4. When petitioner tried to sell in 1989 it was discovered that a portion

of the property referred to as lot 2 above and as lotr,,K on_ pan1dubmijted
had a clouded title, i.e. owners other than herself.
5. Petitioner lost the prospective 1989 sale as she was unable to' transfer
clear and marketable title to the entire lot.
6. Petitioner has incurred substantial financial hardship in trying to
clear the title to this portion of the land shown as lot 16 on the plan
submitted to the Board and as lot 2 on schedule A of petitioner's request.
7. Petitioner would be required to go through lengthy and costly land
court procedure to clear the title of this portion of the property if this
variance is not granted, causing her additional hardship.
8. The lot referred to as Lot 16 on the plans submitted will not be a
buildable lot.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the
variance requested, subject to the following conditions:
1. Petitioner shall comply with all city and state statutes, ordinances,
codes and regulations.
2. The petitioner shall obtain approval from the City of Salem Planning
Board.
3. The lot referred to as lot 16 on the plans submitted and as lot 2 in
schedule A attached to the application, shall not be a buildable lot.
No structure may be placed on said lot.
4. The present and future owners of lots referred to as lots 12-15 on the
plan submitted and as lot 1 on schedule A attached to the application
shall continue to maintain said lot 16 on the plan submitted.
