The complaints were investigated on Wednesday, April 26, 2012, said property was found to be in violation of Massachusetts State Building Code requirements. Conditions that have been deemed to be insufficient; I- Exit Stairways, Section 1020.1 - "an exit shall not be used for any purpose that interferes with its function as a means of egress"Exit stairways can have no obstructions, boxes, trash etc. or be used for storage of objects at any time as was the situation and noted at the time of inspection. 2- Guard Rails, Section 3400.0—Rear interior stairway from second floor apartment to first floor egress level is not on accordance with State Building Code requirements. Guards shall be installed at upper landing area and stair inside stair runner. 3- Rear interior stairway framing needs to be rebuilt or supported from second floor apartment to first floor egress level. Presently stairway constitutes an unsafe egress. 4- Rear basement interior stairway framing needs to be rebuilt from first floor egress landing to basement level. Presently stairway constitutes an unsafe egress; door shall swing freely and completely with no interruption. 8- General Note—Remove all slide bolt hardware at egress doors from all apartments and common areas. Thumb latch hardware may be installed as a replacement security. 9- 36"inches shall be maintained around all mechanical and electrical equipment. 10- Guard Rails, Section 3400.0— Upper loft/balcony level of second floor unit shall have a 36" minimum guard rail installed at opening overlooking lower level. 11- Common lighting needs to be installed or repaired in basement level. 12- Sewerage line in rear right corner of basement shall be scoped and/or cleared to confirm moisture at ground level is not from clogged sewage line. 13- Smoke detectors and carbon monoxide detectors need to be installed as per Salem Fire Prevention direction,you are directed to immediately to bring this violation into compliance. You are hereby ordered to begin to rectify these conditions within 7 days of receipt of this notice; failure to respond to this notification will be construed as non- compliance, with issuance of Municipal tickets and as such an Administrative Search Warrant will be sought, so as to allow the lawful inspection of this property. You have the right to appeal this order to the State Board of Building Regulations at One Ashburton Place, Boston, Ma. The complaints were received from the Salem Board of Health and the Salem Fire Prevention office, life safety property was found to be in violation of multiple Massachusetts State Building Code requirements. The most concerning off these violations that has been received are inadequate life safety equipment, egress stairway and fire separation violations have been noted at the property,for these reasons an inspection must be conducted by our inspection team to assure compliance with the code and city ordinances. Under the provisions of 780 CMR, Section 104.6—Right of Entry, of the State Building Code, access to this property must be granted for the purposes of this inspection. Please call this office immediately upon receipt of this letter to discuss this matter and confirm this required inspection. If this property has rental units,these tenants must be notified in advance of this inspection, so that access to these spaces may also be accomplished. This inspection must be completed immediately, a tentative time and date of Monday,April 30, 2012 at 10:00 a.m. ; failure to respond to this notification will be construed as non- compliance, and as such an Administrative Search Warrant will be sought, so as to allow the lawful inspection of this property.
