Dear Mr. Munroe :
Please be advised that I have examined census lists,
utility records and affidavits relative to the above entitled
real estate and it is my opinion that it was a lawful three-
family prior to adoption of the Zoning Ordinance on August
27 , 1965. In addition, the records of the Assessor' s Office
indicate it is currently assessed as a three-family.
Accordingly, it is my opinion it should be afforded the
protection of Section VIII (E. ) of the aforementioned ordinance
relative to nonconforming uses and, thus, it' s current use
as a three-family is permissible.

Please be advised that this office represents Mr. Raymond Young, owner of
the property located at 151 Williams Street, Salem, Massachusetts.
The above-referenced property, located in an R-2 district, consists of a
three-story dwelling with a separate apartment located on each floor. Enclosed
you will find the following evidence of the non-conforming use of the multi-
family dwelling located on the premises as a three-family house since 1960:
(1 ) Census records compiled by the City of Salem for the years 1960 through
1964, inclusive;
(2) Records from the R. L. Polk directory for the City of Salem for the years
1960, 1962 and 1964;
(3) Affidavit of William H. K. Donaldson;

Dear Inspector LaPointe:
Please be advised that the undersigned represents Mr. Raymond Young
the owner of the above referenced property. As you are aware, there
exists a factual question as to whether the building is a non-conforming
three family structure. We are presently gathering evidence in an
effort to prove to the Building Department that the structure was
occupied by three families prior to the enactment of the Zoning Ordinance.
Based upon my advice, as well as that of yourself and the Building
Department, Mr. Young has agreed that the third floor unit should
not be occupied pending a decision by the Building Inspector and/or
the Board of Appeals. Mr. Young will take steps to prevent the use
and occupation of the third floor unit pending these proceedings and
in recognition that no occupancy permit can be issued for that unit
at the present time.
I would appreciate it if you would review this matter with the Building
Department with a view toward issuance of occupancy permits for the
first and second floor units only. In the event you should issue
those permits and subsequent inspection reveals use and occupation
of the third floor unit Mr. Young recognizes that you would be required
to terminate all permits for the building.
