As you are aware, there exists a factual question as to whether the building is a non-conforming three family structure. We are presently gathering evidence in an effort to prove to the Building Department that the structure was occupied by three families prior to the enactment of the Zoning Ordinance. Based upon my advice, as well as that of yourself and the Building Department, Mr. Young has agreed that the third floor unit should not be occupied pending a decision by the Building Inspector and/or the Board of Appeals. Mr. Young will take steps to prevent the use and occupation of the third floor unit pending these proceedings and in recognition that no occupancy permit can be issued for that unit at the present time. I would appreciate it if you would review this matter with the Building Department with a view toward issuance of occupancy permits for the first and second floor units only.
