Dear Mr. Santo:
Please be advised that I have examined various
documentation relative to the use of the above described
premises as a two-family dwelling. I have examined
Affidavits from the owner of the property as well as an
abutter. A letter from the City Assessors Office was also
provided. Additionally, this property is located in an R-2
zone and was used as a legal two-family prior to 1964. The
property also contains more than five thousand (5, 000) square
feet of land and has a fifty (50) foot frontage.
Accordingly, it is my opinion that this dwelling's use
as a two-family residence is legal and permissible.

apartments since 1964. I lived at 5 Williams St., and nW mother-
-in-law.-Mrs. Edna Kelley, occupied a separate apartment at the
same address.
About 1973 I moved to Marblehead, Mass. Some time
later my mother-in-law left her apartment at 5 Williams St..,
Salem and msved to Marblehead.
The two apartments at 5'Williams St. have been continuous-
ly occupUd and used as separate

At this time, we would like to bring to your attention that the above
referenced property is not listed as a two family dwelling according to our
records. There is a copy of our record enclosed.
To rectify this, you should submit any documentation dated prior to
August 27, 1965. The documentation should consist of voters' lists, rent
receipts, utility bills, notarized letters from neighbors stating. that the
property has been a two family since they can remember (prior to 1965) . All
of the above submitted with a check for $30.00 payable to the City of Salem so
we may submit, the information to the City Solicitor for his opinion. He will
detemnine the legality of the property.
