Dear Property Owner
Our office received a complaint regarding your property located at 201 Derby Street/57 Wharf Street of wood
material from the railing assembly in the `Bell Tower' had been dropping down onto the sidewalk below. This
allegation was investigated and found to be true.
The facade and rail on the Derby Street and Wharf Street elevations appears in need of repair immediately
as it poses a risk to Public Safety. A building permit application is required by this Department once the
condition of the facade/Bell Tower is assessed and prior to starting corrections that are required.Under
the provisions of Massachusetts State Building Code (780 CMR Section 116, 780 CMR Section
107.6.2 and Massachusetts General Law's Chapter 143)
You are hereby ordered to contact this 'Immediately upon receipt of this letter and to begin to rectify these
conditions within 7 days of receipt of this notice. Failure to do so may result in further actions being brought
against you,up to and including the issuance of Municipal tickets or filing of criminal complaints at District
Court. You have the right to appeal this order to the State Board of Building Regulations at One Ashburton
Place, Boston, Ma.

The renovations will require conformity with the International Building Code 2009, International
Existing Building Code 2009&Massachusetts Amendments to the IBC 2009-780CMR Eighth
Edition.
In the case of this structure, the original use is classified as Mixed Use(Separated per Table 508.4)
(B) Business &(M) Mercantile. The proposed use is classified as Mixed Use(Separated per Table
508.4)(B) Business &(M) Mercantile.
The following IBC, Massachusetts, and local Codes were reviewed to develop the required renovation.

Summary of the Code Analysis Findings
The renovated project will have an operable fire alarm system.
The renovated project will have an operable automatic sprinkler system.
The proposed renovation will comply with the requirements for level 2 alterations (700— IEBC 2009).
There are no structural modifications anticipated in the proposed project scope.

I have reviewed your request for a Special Permit to do an
archaeological excavation at the above referenced location, as required
by Chapter 16 1/2-2-(2) of the City of Salem Code of Ordinances, on
Saturday, March 14, 1992 and on Saturday, March 21, 1992.
I understand that due to the time frame involved and the fact that
this work must be done during low tide that this is of an emergency
nature. I am therefore granting the permit with the following
conditions:
1. No work is to be done before 8:00 a.m. or after 5:00 p.m.
2. Every effort will be made to delay the use of the backhoe to as
late in the morning as possible.

As we discussed by phone, UMASS Archaeological Services will be conducted an
archaeological excavation on Derby Wharf in Salem, beginning March 12, 1992.
The work is being conducted for the National Park Service. Because we must
workduring low tide and the time frame for the project is very short, we
would like to be able to work on Saturdays. Our work requires minimal use of
a small backhoe which will dig small trenches. After several hours of hand
excavation in the trenches by the archaeologists, the backhoe will refill the
trenches. Thus, the noise during the day will be minimal. We would like to
request your permission to work on the next two Saturdays and will take all
necessary steps to minimize noise in the area.
