Danielle McKnight,Staff Planner Thomas St.Pierre,Building Inspector ,. t.978-619-5685/f.978-740-0404 c 978-619-5641/£978-740-9846 TO THE BOARD OF APPEALS: The Undersigned represent that he/she is/are the owners of a certain parcel of land located at: Address: 3 Webster Street - Zoning District: R-2 An application is being submitted to the Board of Appeal for the following reason(s): This statement must describe what you propose to build, the dimensions, the zone property is in, and the zoning requirements. Example: I am proposing to construct a IO'x 10'one story addition to my home located at 3 Salem Lane, in the R-2 Zoning District. The Zoning Ordinance requires the minimum depth of the rear yard to be 30 feet. The current depth ofmy rear yard is 32 feet;the proposed addition would reduce the depth of the rear yard to 22 feet. .see attached Statement of Grounds For this reason I am requesting: //Article VI. Sec. 6-4, Table 1 (>riance(s)from provisions of Sectio h` of the Zoning Ordinance, specifically from Minimum Lot Area; (i.e.minimum depth of rear yard). What is allowed is 7,500 s.f. per dwelling unit (ft?sq ft?stories? %?), and what I amproposingis 833 s.f. per dwelling unit (ft?sgft?stories?%?). Parking: Required: nine spaces. Proposed: 3 spaces Article VIII, Section 8-6 (qA Special Permit under Section/ of the Zoning Ordinance in order to change f rom one nonconforming use to another. ( )Appeal of the Decision of the Building Inspector(described below): The Current Use of the Property Is: Are the lot dimensions included on the plan? (example: Two Family Home) Warehouse/ Woodworkip ( )No n/a because The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning Ordinance. ZONING BOARD OF APPEALS PETITION FORM The following written statement has been submitted with this application: O For all Variance requests a written Statement of Hardship demonstrating the following must be attached: a) Special conditions and circumstances that especially affect the land, building,or structure involved, generally not affecting other lands, buildings, and structures in the same district; b) Literal enforcement of the provisions of the Ordinance would involved substantial hardship to the applicant;and c) Desirable relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. ( )For all Special Permit requests a Statement of Grounds must be attached. An application for a special permit for a nonconforming use or structure shall include a statement demonstrating how the proposed change shall not be substantially more detrimental than the existing nonconforming use to the neighborhood in accordance with Art.V, §5-3. Such a statement should include reference to the following criteria: a) Social, economic,or community needs served by the proposal; b) Traffic flow and safety, including parking and loading; c) Adequacy of utilities and other public services; d) Impacts on the natural environment, including drainage; e) Neighborhood character;and f) Potential fiscal impact, including impact on City tax base and employment. ATTEST Address: 27 Congress Street, Suite 414 < a em T7d e: (978) , —8065 ign re ay 27, 2009 Date DATE SUBMITTED TO BOARD OF APPEALS: CITY CLERK This original application must he filed with the City Clerk. STATEMENT OF GROUNDS 3 WEBSTER STREET SALEM, MA The Petitioner is proposing to convert the property at 3 Webster Street from its present use as a warehouse/woodworking shop to six (6)residential condominium units. There will be no structural changes made to the exterior as part of the conversion. There will be three (3) off-street parking spaces provided for occupants of the building within the building itself. The property is located in the R-2 zoning district, however, the current use of the building as a warehouse/woodworking shop, and the structure itself are legally non-conforming pursuant to Article VIII, Sec. 8 of the Zoning Ordinance. The Petitioner's proposal constitutes a change in the nonconforming use and structure which can only be accomplished with a Special Permit issued by the Board of Appeals pursuant to Article VIII Section 8-6. The Board may grant such a Special Permit upon a finding that the proposed changes will not be substantially detrimental to the public good and will not nullify or substantially derogate from the intent and purpose of the Zoning Ordinance. In addition the project also requires a variance from the density regulations of the Zoning Ordinance relating to minimum lot area per dwelling. Article VI, Table I requires a lot area of 7,500 s.f. per dwelling unit in the R-2 District. In this instance, the area of the lot is 5,000 s.f. which results in a lot area per dwelling unit of 833 s.f. The proposal would also require a variance from the parking requirements of the Ordinance, both in terms of the number of spaces and the dimensions of such spaces. The lot in this case is occupied entirely by the building, leaving no opportunity for exterior parking spaces. The petitioner is proposing, however, to locate there (3) spaces within the building, which is six (6) spaces less than the 1 % spaces per unit required. The conversion of the building from use as a warehouse/woodworking shop to owner occupied housing will substantially lessen the potential impact that the use of this property could have on the surrounding neighborhood in terms of vehicular traffic, congestion and noise. Since the multifamily use is entirely consistent and harmonious with the other uses in the area, the change to such a use will not derogate at all from the intent and purpose of the Ordinance. The Petitioner's proposal is a valuable opportunity to replace a less desirable use with one that is compatible with other properties in the neighborhood. In addition, the property will be converted from a use that does not presently generate tax revenue to a use that will substantially contribute to the City's tax base. I The building at 3 Webster Street is substantially larger than any other residential structure in the area, consisting of approximately 9,600 s.f. To convert it from commercial to residential use requires a complete reconstruction of the interior of the building. The only way to achieve the conversion of the building to residential use is with a certain level of density to support the costs of the rehabilitation. The literal enforcement of the requirements of the R-2 District will prevent the conversion of this property, causing hardship to the property owner and the community. For the same reasons set forth above, desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the District or the purpose of the Ordinance. y . .. Tremblay Building L:spector. City of Salem One Salem Green Salem, Massachusetts 01970 RE: 3 Webster Street Salem, Massachusetts Dear Mr. Tremblay: I have been asked to give an opinion in reference to the nonconforming status of the property located at 3 Webster Street, Salem, Massachusetts. My opinion follows. A review of the documentation as supplied to me indicates that the premises in question have been in nonconforming use well back before zoning. The question that has been raised is whether or not there had been abandonment of the nonconforming status for a period exceeding two years. Your letter of April 2, 1997 seems to indicate that there has been an abandonment although no information is supplied to support that claim. ('1 copy Ul all affidavit Jli1/p11eLL 11VLL1 ti011 iVY'Cy, 1V0.UL1fGQb Y vv vv viku:b, indicates that he had occupied the premises from 1979 until he moved to New Hampshire on a full-time basis which appears to have happened in 1996 or early 1997. Assuming that Mr. Towey's statement that he was on the property until 1996 or 1997 is true, there would be no abandonment as the property had not been vacant for over two years. There also appears to be no intent to abandonment. Mr. Leo F. Tremblay Page Two December 19, 1997 Mr. Towey's affidavit as well as the affidavit of Mr. Peter Copelas, owner of the property, would indicate that the building has never been vacant for a two year period of time, nor has it ever been Mr. Copelas' intent to abandon the nonconforming status of the building. Based on the foregoing, it would be my opinion that the nonconforming status of the property in question continues and that the occupancy of the property by another woodworking company would not be in violation of the zoning ordinance. If you have additional information that you wish to furnish me which might cause me to form a different view, I would be happy to examine the same. I would only suggest to you that I will, as you know, be leaving this post as of January 5, 1998 and that I will be on vacation from December 24, 1997. Thank you for your consideration. G ADDRESS 135 BOSTON STREET BY , March 24, 1997 To Whom it Mav Concern: Please accept this letter as clarification on the term of my occupancy at 3 Webster St., Salem. From 1979 until 1987, Fran Armento and I operated our business, Naumkeag Woodworking, at 3 Webster St. in Salem. This was a full-time business performing custom furniture building, cabnitry and general woodworking. During much of this time, I was a legal resident of New Hampshire, and commuted daily from Concord to.Salem. Over the course of 8 years of doing business on the North Shore we developed a substantial and loyal customer base. Shortly after my partner's retirement, I decided to move my office closer to home and also open a small shop nearby in the hopes of slowly developing customers in my local community. I continued to travel to Salem on a regular basis over the next 10 years and use my shop on Webster St. to service my customers on the North Shore. By last summer, the need for a physical presence in Salem had deteriorated to the point that it was no longer reasonable, and I moved my remaining machinery, and several unfinished projects to New Hampshire. Since my occupancy over the past few years was essentially part-time, I performed various small projects maintaining and repairing the building in lieu of rent. During the course of my tenancy, I found the building to be ideally suited for woodworking, furniture making and cabinetry, and I recommended a similar use to Mr. Peter Copelas, the building owner, this past summer when I vacated the premises. MASSACHUSETTS 01970 TELEPHONE: 978-745-9595 FAX 978-740-9846 1009 JUN 30 P 2: 2U KIMBERLEY DRISCOLL MAYOR CITY June 29,2009 Decision City of Salem Zoning Board of Appeals Petition of PETER COPELAS seeking Variances from minimum lot area per dwelling unit and minimum number of parking spaces required, and a Special Permit to change from one nonconforming use to another, to allow for the conversion of a warehouse/woodworking business to six(6) residential units on the property at 3 WEBSTER STREET, Salem,MA(R2 zoning district). Statements of fact: 1. Attorney Scott Grover presented the petition on behalf of the petitioner, Peter Copelas, who owns the property. 2. In a petition dated May 27,2009,the petitioner requested Variances from minimum lot area per dwelling unit and required parking, and a Special Permit to change from one nonconforming use to another, in order to convert the existing warehouse/woodworking business into six residential units. 3. A public hearing on the above mentioned Petition was opened on June 17, 2009, pursuant to Mass General Law Ch. 40A, % 11. The hearing was closed on June 17, 2009,with the following Zoning Board of Appeals members present: Robin Stein (Chair), Rebecca Curran,Richard Dionne, Beth Debski,Bonnie Belair(alternate), and Jimmy Tsitsinos (alternate). 4. The Board of Appeals received six letters in support of the project and four letters in opposition to it. At the hearing, several residents voiced concerns about parking, privacy and the density of the proposed project, and expressed a preference for a commercial use for the property, rather than residential, because they felt a commercial use would be less intensive. Other neighbors spoke in support of the project, saying the redevelopment of the building as proposed would remove blight, raise property values and benefit the neighborhood. The Board of Appeal, after careful consideration of the evidence presented at the public hearing, and after thorough review of the plans and petition submitted, makes the following findings: i I 2 1. Special conditions and circumstances exist affecting the parcel and building, which do not generally affect other land or buildings in the same district. The building, constructed in the 1880s, was built to the lot lines, taking up the entire parcel. This makes it difficult to accommodate all of the required parking on site, and difficult or impossible to meet the zoning requirements for lot area per dwelling unit in the R-2 zone for any residential development, without tearing down the structure. 2. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance, as the changes proposed would result in significant improvements to the property at 3 Webster Street. Additionally, the residential use proposed is more in keeping with the residential character of the R-2 zone than a commercial use. 3. Literal enforcement of the provisions of this ordinance would involve substantial hardship, financial or otherwise, to the appellant. 4. The applicant may vary the terms of the Residential Two-Family District to construct the proposed development, which is consistent with the intent and purpose of the City of Salem Zoning Ordinance. 5. In permitting such change, the Board of Appeals requires certain appropriate conditions and safeguards as noted below. On the basis of the above findings of fact and all evidence presented at the public hearing including, but not limited to, the Plans,Documents and testimony, the Zoning Board of Appeals concludes: 1. To allow for the redevelopment of the site as proposed, the requested Variances from minimum lot area per dwelling unit and minimum number of parking spaces are granted. 2. To allow for a change in nonconforming use, a Special Permit is granted. In consideration of the above, at its meeting on June 17,2009, the Board of Appeal voted four(4) in favor(Stein,Belair,Dionne,Debskt) and one (1) opposed (Curran) to grant Variances from minimum lot area per dwelling unit and minimum number of parking spaces required, and a Special Permit to change from one nonconforming use to another, to allow for redevelopment of the site as shown on the plans titled "Webster Street Condos, 3 Webster Street, Salem,MA," dated May 29, 2009,and prepared by Pitman &Wardley Architects LLC,sheets A 1 through A-4 and B-1 through B-4 subject to the following terms, conditions, and safeguards: 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. r / 3 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. A Certificate of Occupancy is to be obtained. b. Petitioner shall obtain street numbering from the City of Salem Assessor's Office and shall display said numbers so as to be visible from the street. 7. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to the Planning Board. 8. Unless this Decision expressly provides otherwise, any zoning relief granted does not empower or authorize the Petitioner to demolish or reconstruct the structure(s) located on the subject property to an extent of more than fifty percent (50%) of its floor area of more than fifty percent(50%) of its replacement cost at the time of destruction. If the structure is demolished by any means to an extent of more than fifty percent(50%)of its replacement cost or more than fifty percent (50%) of its floor area at the time of destruction, it shall not be reconstructed except in conformity with the provisions of the Ordinance.
