McIntosh and Plumbing Inspector Erle Soper, of the property at-102 Webb Street, Salem. The following items were noted, and recommendations are herewith made: I. OUTSIDE AREA 1. The grounds are overgrown with weeds; structural materials --wood, metals, etc.--clutter the rear of the property. It is advised that the areas adjacent to the building be cleaned of the overgrowth and wastes immediately. 2. At you mentioned, a rear opening- leads to a crawl space under the structure. Since it is possible for vermin and insects to enter through this.,opening, it needs to be closed and tightly sealed, and/or an entrance that can be closed and fitted tightly needs 'to be constructed according to the build- ing code. II. BUILDING--INTERIOR 1. All processing equipment and surfaces--countertops, tables, etc.--need thorough cleaning and sanitizing prior to the opening of the establishment. 2. The lower will moulding is not tightly secured to the wall r 9a � Salem Health Department 9 North St. Salem, Mass. 01970 and floor and is difficult to clean. This moulding should be removed and replaced with material (a) designed with a smooth, concave outer (when installed) surface and (b) tightly sealed for ease of cleaning. 3. The ice machine runoff drainline runs free. It should be connected to an indirect wasteline with an air gap as specified in the plumbing code. 4. Chlorinated detergent should be available to sanitize all equipment, and hot water at 170°F (minimum) should be provided. 5. The doors to the shipping/receiving and toilet areas are required to be self-closing, rather than free-swinging. 6. Handwashing facilities should be installed in food prepar- ation areas and toilet rooms. This equipment should include dispensers of antiseptic soap and paper sanitary towels. As I had assigned that to an intern some time ago, I mistakenly thought that I had forwarded his report to you. Obviously, it appears that I did not. Nonetheless, please see attached reported describing the rather curious ownership setup of the property and the premises thereon. It appears that the city bought the land from B&M Railroad, but not the structure, which appears to be owned by Ralph Barrett of Sarasota, Florida. We could not find a lease (or any other identifiable 30B documentation) regarding this structure. I am not aware if there are any payments presently being made. At least in 1991, it appears then City Planner William Luster offered the same lease rate as paid to B&M ($679/yr.). I will copy planning on this memo to see if any payments made or when ceased. It does not appear that this property is needed by the city. It would be my suggestion that it be declared surplus and sold by sealed bid. I would certainly expect Mr. Barrett to be the high bidder so that he could consolidate land and building; however, if someone were to outbid him, they would need to deal with him directly regarding the structure. The Front of the structure faces Me Manus Square with its southern most side abutting Webb Street. See Addendum I_ The structure has a primarily wood exterior and asphalt shingled roof cover, with 1 Unit,0 baths, 1 halfbath,0 rooms, and 0 bedrooms. See Addendum 2. History of Ownership According to the 1911 Salem Municipal Almanac the property was originally owned in four separated holdings by Annie Dowbridge, William R. Graves,N.L. Very, and S.A. Symnes. Annie Dowbridge owned the structure in question. Since 1911 there is no evidence of any transaction concerning the land at the Registry of Deeds. At some point the Boston and Maine Corporation obtained title to all the land described herein. In 1993 the property was granted to the City of Salem, along with other parcels in consideration for Five Thousand Dollars. BK 12107 PG 443-459, Essex County Registry of Deeds, see also Addendum 3 &4. As of this date the city is the owner of the land in Fee Simple Absolute. This is supported by the City Tax Assessors report, which shows the City of Salem as the owner of 1.60 acres of land assessed at $300,800. See Addendum 5. The structure on 102 Webb Street is not owned by the City of Salem. The ownership history of the structure could not be determined at the Registry of deeds because there is no history of any transactions concerning the structure. The City Tax Assessors report shows Ralph Barrett of 8528 Woodbriar Dr. Sarasota FL. as the owner of property with 0.0 acres of land and an assessed value of$66,900. See Addendum 5. Supporting the contention that Ralph Barrett is the owner of the structure is a letter addressed to Mr. Barrett dated 1991 from William E. Luster, the Salem City Planner. In the letter Mr. Luster acknowledges Mr_ Barrett as the owner of the structure and expresses the City of Salem's intent to continue the lease agreement that Mr. Barrett currently had with Guilford Transportation. Mr. Luster states in the letter: "the City does not intend to demolish or otherwise detract from the business on the site ... the City would be interested in maintaining a lease agreement with Mr. Barrett(or any other proposed building owner) for a rental fee equal to the amount currently paid to Guilford ($679/per year)." See Addendum 6& 7. I failed to find any record of the lease at the registry of deeds. Use The structure is currently being rented to "Deborah's Fine Pastries"and is used as a bakery. There is evidence that the pastries are being prepared on site and then sold to patrons. The area is currently zoned as an R-2 district. Under the zoning by-law the operation of a bakery is not an admissible use in an R-2 district nor can a special permit be obtained for such use.
