DECISION ON PETITION OF EDWARD R. _SOBOCINSKI, 82 WEBB STREET
CONCERNING PROPERTY LOCATED AT 82 G EBB STREET R--2 DISl'RICT
A hearing on this petition was held January 25, 1977 with members Arthur. Labrecque,
Donald Eames, Douglas Hopper, James Boulger and Chairman John Gray present. Notices
were sent to abuttors and others in accordance with glass. General Laws, Chapter 808.
Atty. Robert Ledoux represented the Petitioner before the Board. The Petitioner
has owned the premises located at 82 Webb Street for a number of years and the building
is used as a meat market. In the early 1950's an addition was built on to the existing
structure on Webb Street. At that time the Petitioner was granted a building permit
for the construction. However, during title examination by a Local bank, it was noted
that the building itself may be in violation of the City of Salem 'Zoning Ordinance in
that it does not have proper setback, side yard or rear yard density as well as having
possibly exceeded the maximum lot coverage for an R-2 Zone.
In an R-2 Zone the maximum lot coverage allowed is 35% and there is a requirement
of a 10 ft. side yard and a 30 ft. rear yard. The Petitioner requests that the Board
gram: him a variance so as to allow the structure to stand as it presently is with in-
sufficient setback, side yard, rear yard and lot coverage. The Petitioner maintains
that if thc. Zoning By-laws arc enforced it would involve practical + :fficulty and unto
hardship in that the building was constructed in accordance with plans prepared for him.
He understood that the building was constructed in accordance with plans that conformed
to the Salem Zoning Ordinance.
The Board voted unanimously to grant the variance to the Petitioner to allow the
existing structure at 82 Webb Street to stand as is with insufficient setback, side yard,
rear yard and lot coverage. The Board felt that to deny the variance requested would
cause extreme hardship to the Petitioner and that since the building had been as is for
a number of years, the variance could be granted without substantial detriment to the
surrou., ding neighborhood or without derogating from the intent of the Salem Zoning By-law.

Appeal from this decision, if any, shall be made pursuant to Section 17 of the Mass. Genera
Laws, Chapter 808, and shall be filed within 20 days after the date of. filing of this
decision in the office of the City Clerk.
Pursuant to Mass. General Law, Chapter 808, Section 11, the variance or special permit,
granted herein, shall not take effect until a copy of the -decision, bearing the certifica-
tion of the City Clerk, that 20 days have elapsed and no appeal has been filed, or that, it
such an appeal has been filed, that. it has been dismissed or denied, is recorded-in. the
South Essex Registry of Deeds and indexed under the name of the owner of record or is recor
and noted in the owner's certificate of title. Copies of the decision herein have been
filed with the Planning Board and the City Clerk.

Dear Mr. McIntosh:
As you know, Mr. Delpero, who is President, Treasurer and principal
Stockholder of Del Homes, Inc., has recently requested a certificate of occupancy
for his four unit condominium project at the above address. You have expressed
some concern regarding compliance of the project with the variance granted by the
Board of Appeals on January 26, 1984. In reviewing the variance, one question
concerns the closeness of the deck on the rear of the building to the rear lot line.
As I read the variance, a general variance from the front and rear yard
requirements was granted by the Board and the Board placed no restrictions on the
distance of any structure from any lot line.
I believe that, although the deck shape has been slightly altered from the
shape shown on the plans submitted with the variance application, the building has
been placed in the proper location, and the proximity of the deck to the rear lot
line is permitted by the variance granted, as shown on the plot plan which
accompanies this letter. I also note that on page 5, Section II B 7 of the City of
Salem Zoning Ordiance, the definition of the "building line" does not mention sun
decks but only covered porches and sun parlors leaving open the interpretation that
the dimension measurements should be taken from the rear face of the building
rather than from the deck.
In sum, I believe the structure "as built" complies with the basic footprint
presented to the Board of Appeals for a four family unit condominium and that a
certificate of occupancy requested, therefore, may properly issue.

Dear Mr. Serafini:
In response to your inquiry regarding the above referenced
property, my findings are as follows:
1. The present footprint of the structure at 82 Webb St, is
not the same as what was presented to the Zoning Board of
Appeals.
2. The present footprint of the structure exceeds what was
presented in the application for Building Permit.
3. In interpreting Sec. 11-B-7 page 5 of the City Zoning
Ordinance, Z find that the word Balcony is sufficient to
cover the meaning of Sun Deck.
For these reasons, I will not issue any Certificates of
Occupancy for 82 Webb St. until the situation is resolved either
by the Zoning Board of Appeals or the removal of these sections of
the Sun Deck (Balcony) that violates the plan that was presented
to the Board of Appeals.

maintenance dredging project subject to Section 5(9). The
order may be extended by the issuing authority for one or
more additional one-year periods upon application to the
said issuing authority at least thirty (30) days prior to
the expiration date of the order or its extension.
5. Any fill used in connection with this project shall be clean
fill, containing no trash, refuse, rubbish or debris, includ-
ing, without limiting the generality of the foregoing, lumber,
bricks, plaster, wire, lath, paper, cardboard, pipe,_ tires,
ashes, refrigerators, motor vehicles or parts of any of the
foregoing.
6. No work may be commenced untill all appeal periods have
-- — elapsed from the order of,. the Conservation Commission or from
a final order by the Department of Environmental Quality
Engineering. ,
7. No work shall be undertaken until the final order, with
respect to the proposed project, has been recorded in the
Registry of Deeds for the district in which the land is .

On Thursday, Vlay 5, 1983 , the Planning Board of the City of Salem
held a public hearing regarding the application of 11r . Ernest
DelPero , 13. Plains Road, Ipswich, TiA . ,for a Special Permit under
Section P , Wetlands and Flood Hazard Districts , of the Salem
Zoning Ordinance , with respect to the construction of a four-
unit dwelling at 82 Webb Street, Salem, IIA .
At a regularly scheduled meeting of the Planning Board on June 2 ,
1983 , the Board voted; by a unanimous . vote to approve the
application as complying with the requirements for the issuance
' of the permit with the following conditions :
1. All work shall conform to calculations entitled "Four-
unit dwelling, 82 Webb Street, Salem, T:TA . , Revised calculations
ariafdn. layout. " prepared by S . Nashed , P7 L'31031, dated
lay 18, 1983.
2 . '::orb: shall further conform to plans entitled "Topographic
