A hearing on this petition was held June 27, 1990 with the following Board
Members present: Richard Bencal , Chairman; Edward Luzinski , Vice Chairman;
Joseph Correnti , Secretary, Richard Febonio and Mary Jane Stirgwolt. Notice
of the hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner, owner of the property, is requesting Variances from lot size, width,
setbacks, use and parking to allow two family to be converted to a four family
in this R-2 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district.
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal , after careful consideration of the evidence presented at the
hearing and after viewing the plans, makes the following findings of fact:
1 . The building is not presently in compliance with the requirements of the
Salem Fire Department relative to smoke and fire safety.
2. The four units proposed by the petitioner would be less than 500 square
feet in size.
3. Petitioner has been assured by the M.B.T.A. that he may use the property
governed by an easement, but this has not been put in writing.
4. No one spoke in favor of this petition.
5. On abutter spoke in opposition, citing the severe parking shortage
in the immediate neighborhood.
6. This pacel is similar in size and character to many others in the R-2
zoning district.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:

of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted 2-3 against the motion to grant the
requested Variances. (Mr. Bencal , Mr. Luzinski and Ms. Stirgwolt voted opposed) .
Having failed to garner the four affirmative votes necessary to pass, the motion
to grant fails, the Variances are denied.

A hearing on this petition was held on January 18, 2005 with the following Board
Members present: Nina Cohen, Chairman, Richard Dionne,Nicholas Helides, Edward
Moriarty and Robin Stein. Notice of the hearing was sent to abutters and others and
notices of hearing were properly published in the Salem Evening news in accordance
with Massachusetts General Laws Chapter 40A
The Salem Zoning Board of Appeals held hearings on December 14, 2005 and January
18, 2006 on the petition of Raymond Page to amend the variance he received from the
Board, relative to the above referenced properties, on February 27, 1991. Said variance is
recorded in the Essex South District Registry of Deeds in Book 10706, Page 591.
The Board, with only four members sitting, opened the hearing on December 14, 2005.
After giving a brief introduction of the project and addressing comments from the Board,
Petitioner's counsel submitted a written waiver of any procedural defects resulting from
the hearing commencing without a complete Board.
FINDINGS OF FACT
1. The Petitioner owns the properties located at 22 Webb Street and 24 Webb Street,
Salem, Ma. in the R-2 District.
2. On February 27, 1991 the then Board granted the petitioner a variance allowing
22 Webb St. to be used as a three unit residential structure and required as
follows:
The petitioner is to provide three parking spaces on site at 22 Webb St.
And five spaces on 24 Webb Street as shown on the plan submitted, two
of the spaces are to remain available for free and open use of the
1 residents of 22 Webb Street. Both 22 Webb St. and 24 Webb St are to
remain in common ownership.
3. In support of his current application the Petitioner submitted a plan entitled "Plan
of Land 22 & 24 Webb Street Salem Property of Raymond Page" dated December
27, 2005 and prepared by Gail L. Smith P.L.S. (the "Plan").

4. The Plan shows a reconfiguration of the two properties including the removal and
relocation of the existing lot line. As depicted each property will contain
sufficient parking to support its existing use.
5. The Plan requires an additional twelve foot curb cut to access the newly designed
parking for 24 Webb Street and shows the elimination of a lengthy curb cut that
currently permits drivers to back out directly onto Webb Street
6. No neighbors spoke in opposition of the project and at least one neighbor spoke in
favor of the proposal as the Petitioner has greatly improved the two properties and
the new plan includes welcomed changes to the parking and the addition of
shrubbery and green space.
7. The Board considered the granting the petition would eliminate the need for the
shared parking variance that was previously granted, improves the existing
parking layout and access to Webb Street and provides the Petitioner with greater
flexibility in maintaining the properties.
8. Therefore, the Petitioner now asks the Board to waive the common ownership and
shared parking requirements of the 1991 variance and to approve said Plan
submitted with the present application.
Therefore, the Zoning Board of Appeal voted 4 in favor and 1 in opposition to grant the
request, subject to the following conditions:
1. Petitioner shall comply with all city and state statues, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department shall be strictly adhered to.
4. Petitioner is to obtain approval from any City Board or Commission having n

The Petitioner, Raymond Page, respectfully requests the
Board to modify its Decision dated February 27, 1991, granting
variances at 22 and 24 Webb Street, a copy of which is attached
hereto . The previous Decision required that the two dwellings
shown on the Plan be held in common ownership because each lot
had to contribute to the parking requirements in order for the
requested variance to be granted.
A new Plan filed with this requested modification shows a
new configuration of the lots so that each lot now has
sufficient parking to support the approved uses of the houses on
each lot . The number of units in each dwelling remains the
same . The Plan filed with this request will become part of the
Decision in the request for modification so that the requirement
of a common ownership of the two dwellings can be eliminated.
In 1991, the Petitioner, owner of adjacent lots at 22 and
24 Webb Street, appeared before the Board requesting a variance
from use and parking to allow the property at 22 Webb Street to
be converted to a three unit residential building in this R-2
zone. The Board granted that relief with the condition that two
of the five spaces located at 24 Webb Street be dedicated to the
residents of 22 Webb Street, which only had three spaces . The
Board also conditioned that both 22 and 24 Webb Street remain in
common ownership. Since that Decision, the Petitioner has met
those conditions, but now requests that it be modified so as to
allow five parking spaces on 22 Webb Street, the three unit
building, and four spaces at 24 Webb Street, the two unit
building, as shown on the attached Plan.
By moving the lot line some 42 feet and allowing a second
curb cut for 22 Webb Street, each lot will now have the required
parking necessary under the ordinance, which will obviate, the
need for a parking variance. Additionally, since each lot is
now independent from the other regarding the parking, the
Petitioner respectfully requests that the condition that the
lots remain in common ownership be deleted. The new lots remain
nonconforming, and there is no proposed change to the footprint
of the structures as they sit on the lot .
Wherefore, the Petitioner respectfully requests that the
Board modify its prior Decision so as to waive the common
ownership requirement and allow the new Plan, as submitted.

A hearing on this petition was held February 27, E wi�tVthe following Board
Members present: Richard Bencal, Chairman; Joseph Correnti, Mary Jane Stirgwolt
and Associate Member Arthur LaBrecque. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Variance from use and parking
to allow the property to be convert to a three unit residential building. The
property is located in an R-2 district.
Before hearing the merits of this petition the Board had to consider re-hearing
it as a petition to allow a four family dwelling at this site was denied by the
Board of Appeal on June 27, 1990. The Board of Appeal, after hearing evidence
regarding substantial change, and after receiving Consent from the Salem Planning
Board, voted unanimously, 4-0, that there was a substantial change, said change
being three (3) units rather than four (4) and they would hear the petition.
The Variances which have been requested may be granted upon a finding by the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district.
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and after
viewing the plans, makes the following findings of fact:
1 . The building on this property has been vacant for several years and has
become an eyesore.
2. The petitioner owns the property at 24 Webb St. and is in residence there.
3. The availability of the adjacent parcel for additional parking makes this
property unlike others in the zoning district.
4. The existing condition of the building requires a substantial investment to
make the building habitable.
5. The Ward Councillor wrote a letter supporting this petition as long as the
parking requirements under the zoning code are met.

6. The rehabilitation of this building dld`be a significant improvement
to the neighborhood.
On the basis of the above findings offact,MAR1 on he5evidence presented, the
Board of Appeal concludes as follows:

the district in general.
2. Literal enforcement of the provisions of the Ordinance would involve a
substantial hardship on the petitioner.
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the intent
of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the relief
requested, subject to the following conditions:
1 . All construction be in compliance with state and local building codes.
2. All construction be in accordance with plans and dimensions submitted.
3. A building permit be obtained.
4. A Certificate of Occupancy of each unit be obtained.
5. All requirements of the Salem Fire Department relative to smoke and fire
safety be strictly adhered to.
6. The petitioner is to provide three parking spaces on site at 22 Webb St. and
five spaces on 24 Webb St. , as shown on the plan submitted, two of these five
are to remain available for the free and open use of the residents of 22 Webb
Street. Both 22 Webb St.. and 24 Webb St. are to remain in common ownership.
