The ensuing communication shall serve as notice to the accompanying "Removal of Certificate
of Occupancy"card dated September 16, 2015; regarding 3 Watson Street. Complaints were
received by our Department the aforementioned property and upon inspection on Tuesday
September 15 2015 the property was found to be unoccupied and uninhabitable and in violation
of the Massachusetts State Building Code.
I- Heating and electrical on all levels in the building is not operational in a manner suitable
for human habitation. Doors to the building are screwed shut causing concern for egress
out of the building.
2- Prior to the occupancy being reinstated a signed and notarized affidavit from a Registered
Massachusetts Architect stating the building is in compliance with the Massachusetts State
Building Code, including a Code Review by a Registered Massachusetts Architect.
3- Electrical, Plumbing, Fire Prevention and gas permits shall be applied for by a licensed
Massachusetts individual with disclosure to such department that any work existing has
been previously reviewed and is compliant.
Until such time that all requirements of this letter and any further requirements are complete:

ACTION REPORT—3 Watson Street January 13, 2015
At approximately 6:15 p.m. on Thursday, January 8, 2015, I was asked by the Salem Fire Department to meet them on
their call at the aforementioned property located at 3 Watson Street on a call on call on carbon monoxide levels.
I was informed that these levels were at the time of my arrival dissipated.
Upon arriving at the residence and a subsequent site walk through the basement level, first floor unit, second floor unit,
third floor and common spaces it was determined that the work being performed on the heating system did not require a
permit. This was further confirmed with a telephone conversation I had with Dennis Ross, the City of Salem Plumbing
Inspector.
The plumber at the site had commented that the building had been broken into recently and tools had been stolen and
possibly the intruders spent the night previous. Above mentioned site walk reveled no sign of squatters or individuals
staying at present time. Building windows and doors had been secured prior to my arrival, and was secure also upon
leaving site.

Our office received a complaint regarding life safety and sanitary conditions at your property located at
3 Watson Street. The complaints were investigated on Friday, April 13, 2012 along with Ms. Elizabeth
Gagakis and Mr. David Greenbaum of the Salem Health Department. Said property was found to be in
violation of multiple Massachusetts State Building Code requirements.
The most concerning off these violations that has been received and noted during the inspections are the life safety
and egress stairway violations have been noted at the property, including no smoke detectors or Cot detectors in the
third floor unit,for these reasons a Required Inspection must be conducted by our inspection team to assure
compliance with the code and city ordinances.It is requested that all egress stairways and exit doors be cleared
immediately of any and all storage, debris and other items.
Under the provisions of 780 CMR, Section 104.6—Right of Entry, of the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter to schedule this
required inspection. If this Property has rental units, these tenants must be notified in advance of this inspection so
that access to these spaces may also be accomplished
This Required Inspection shall be conducted by this office on Monday,April 23, 2012 at 10.00 a.m. as noted above.;
failure to respond to this notification will be construed as non-compliance, and as such an Administrative Search
Warrant will be sought, so as to allow the lawful inspection of this property.

regarding your property located at 3 Watson Street. The re-inspection was investigated on Monday, May
7, 2012, along with officials from The Board of Health and Fire Prevention offices.
it was noted that no compliance work had progressed since our last site visit of April 23, 2012, and that
further more illegal spray painting of motorcycle parts lead occurred in the basement and motor oils
and antifreeze were again noted in the rear yard of the property, this was at prior inspection at property
on April 13, 2012 as well as our May 7s re-inspection. Please refer to Note 10 of this letter for further
explaination.
.Conditions that have been deemed to be insufficient;
I- Exit Stairways, Section 1020.1 - "an exit shall not be used for any purpose that interferes with its
frmction as a means of egress"Exit stairways can have no chairs, televisions, boxes, trash etc. or
be used for storage of objects at any time as was the situation and noted at the time of inspection.
1- Guard Rails, Section 3400.0- Three(3) - exterior decks at front of building are not on accordance
with State Building Code requirements. Guards shall be secured to building and opening at
intersection ofpost at dwelling reduced to less than four inches.
3- Remove all charcoal and/or gas grilles for allporches and decks. Minimum five clearances from
all combustible materials as per Salem Fire Prevention requirement.
4- Remove wood burning chimney/fire pit from rear yard as per Salem Fire Prevention requirement.
5- First Floor Egress Doors —Installation of lever hardware on doors to outside.

Our office received a complaint regarding life safety and sanitary conditions at your property located at
3 Watson Street. The complaints were investigated on Tuesday, January 14, 2014 present were Mr. David
Greenbaum of the Salem Health Department and Mr. Thomas St. Pierre of this Department. Said property
was found to be in violation of numerous Massachusetts State Building Code requirements.
The most concerning off these violations that has been received and noted daring the inspections are the life safety
and egress stairway violations have been noted at the property, including no smoke detectors or Cot detectors in the
third floor unit,for these reasons a Required Inspection must be conducted by our inspection team to assure
compliance with the code and city ordinances. It is requested that all egress stairways and exit doors be cleared
immediately of any and all storage, debris and other items.
Under the provisions of 780 CMR, Section 104.6—Right of Enny, of the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter to schedule this
required inspection. If this Property has rental units, these tenants mast be notified in advance ofthis inspection, so
that access to these spaces may also be accomplished

This correspondence shall serve as notification of the remaining outstanding Building Code violations
regarding your property located at 3 Watson Street. The re-inspection was investigated on Monday, May
7, 2012, along with officials from The Board of Health and Fire Prevention offices.
It was noted that no compliance work had progressed since our last site visit of April 23, 2012, and that
further more illegal spray painting of motorcycle parts had occurred in the basement and motor oils
and antifreeze were again noted in the rear yard of the property, this was at prior inspection at property
on April 13, 2012 as well as our May 7" re-inspection. Please refer to Note 10 of this letter for further
explaination.
Conditions that have been deemed to be insufficient;
1- Exit Stairways, Section 1020.1 - "an exit shall not be used for any purpose that interferes with its
function as a means of egress"Exit stairways can have no chairs, televisions, boxes, trash etc. or
be used for storage of objects at any time as was the situation and noted at the time of inspection.
2- Guard Rails, Section 3400.0- Three (3) - exterior decks at front of building are not on accordance
with State Building Code requirements. Guards shall be secured to building and opening at
intersection ofpost at dwelling reduced to less than four inches.
3- Remove all charcoal and/or gas grilles for all porches and decks. Minimum five clearances from
all combustible materials as per Salem Fire Prevention requirement.
4- Remove wood burning chimney/fire pit from rear yard as per Salem Fire Prevention requirement.
5- First Floor Egress Doors—Installation of lever hardware on doors to outside.

I. Rent Withholding(General 1-aws Chapter_39 Section NA)

A. You can prove that your dwel:inv_unit or common areas contain code violations which are serious enough to endanger or maren
ally impair your health or safety and that your landlord knew about the violations before you were behind in your rcm.
B. You did not cause the violations and they can be repaired white you continue to live in the building.
C. You are prepurcd to pay any pbrtion tit(tie rent into court if a judge orders you to pay it.(For this it is best to put Vic rent money
aside in a safe place.)
2. Repair and_Deduct(General Laws Chapter.111 Section 127L).
The lase sometimes allows you to use your rent money to make the repairs yourself. If,your local code enforcement agency certifies that
there are code violations which endanger or materially impair your health,.safety or well-being and,your landlord has received written notice
of the violations,you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have
them made)within five days after notice or to complete repairs within 14 days after notice you can use up to four months''rent in any year to
make the repairs.
3. IiMliatory Rent lncreasesor Evictions Prohibited(General Laws Chapter 186,Section 18 and Chapter 239 Section 2A).
The owner may no: increase your rent or evict you in retaliation for making a complaint to your local code enforcement agency about
code violations. if the owner raises your rent or tries to evict within six months after you have made the complaint he or she will have to-show -
"a good reason for the increase or eviction which is unrelated to your complaint.You may be able to sue the landlord for damages if he or she
tries this.
Rent Receivership(General Laws Chapter I I I Sections 127C-H).
The occupants and/or the board of health may petition the District or Superior Coun to allow rent to be paid into court rather than to
the owner.The court may then appoint a"receiver"who may spend as much of the rent money as is neededvto correct the violation. The re-
ceiver isnot subject to a spending limitation of four months'rent. _
5. Breach of Warranty of Habitability.
You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit docs not meet minimum stand-
ards of habitability.
6. Unfair and Deceptive Practices(General Laws Chapter 93A).
Renting an apartment with code violations is a violation of the consumer protection act and regulations for which you may sue an
owner.
