It is my understanding that appropriate permits have been taken out for"build-out" phase of the project. Ms. Galligan was inquiring whether any special permit was necessary to store and give out nonperishables to their clients. Centra/Business District; The subject parcel, 280 Washington Street, is situated in the B-5 District. Uses allowed by right therein include: ARTICLE V. Sec. 5-2(g) B-5 District (1). All uses permitted in B-1; (2). Other retail and service establishments. Sec. 5-2(d) B-1 District (2). Grocery. . . (7). Dry goods store. . . Thus, it would appear that the "food pantry" is an appropriate use within these definitions. Catholic Charities is service oriented — serving those in need — including but not limited to providing basic food supplies. t Page Two of Two August 10, 1999 Inspector Strout RE: 280 Washington Street Although not necessary, there would also be the possibility that if the use were deemed "religious", it would be exempt from local zoning regulations. "No ordinance or bylaw shall . . . prohibit, regulate or restrict the use of land or structures for religious purposes. . ." Mass. Gen. L. c 40A, § 3. I have not located a case directly on point. Whether the property will be tax exempt would help through analogy. I did speak with Salem Health Agent Joanne Scott regarding the intended use of the food pantry (ie. storing nonperishable food to give out to clients). Although the food is given out free, the Health Agent should still review the storage area for appropriateness as the food is served/given to the public. See 105 Code Mass Regulations 590.000 et seq. Once Catholic Charities moves into its new location, it should contact Joanne Scott (741-1800) to inspect same. Nonetheless, for the reasons mentioned above, it appears that Catholic Charities has the right, without a special permit, for the intended partial use of their new location for a food pantry. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts 'General Laws Chapter 40A. Petitioner requests a 'Variance from off-street parking requirements for the property located at 275-260 Washington Street. This property is located in a B-1 district. The Variance which has been requested may be granted upon a finding of this Board that: I . Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings, or structures in the same district. 2 . Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogation from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful considerations the evidence presented at the hearing, makes the following findings of fact: 1. The petitioner was represented by Attorney John Serifini Jr. 2. The only opposition was from an abutter, Mr. Richard Socolo of Atlantic Credit, who voiced concern of lace of parking in the area. His concerns were addressed and opposition was withdrawn. On the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property I1 and not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substation hardship to the petitioner. 3.
