The illegal signage includes two internally illuminated window signs, in addition to a vinyl window sign above your storefront door. Your property is located in an Urban Renewal Area. All signs erected in an Urban Renewal Area are required to receive approval from the Design Review Board(DRB)and the SRA. Following this review process, you are to receive a City of Salem Sign Permit issued by the City Building Inspector prior to erecting your sign. On August 29, 2013 the DRB reviewed your recently submitted application for this signage and voted 6-0 to reject it on the grounds that it violates the City's Sign Ordinance and Commercial Design Guidelines, and that you or a representative were not present to discuss your application. We are requiring that you immediately remove your illegal signs and reinitiate the process of applying for signage that will be in compliance with both the City's Sign Ordinance and Commercial Design Guidelines. Failure to remove your signage will result in enforcement action(s)being taken by the City's Building Department. For your reference, I have attached a copy of a section of the City's Commercial Design Guidelines that specifically deals with signage. The next DRB meeting to which you may apply is on September 25; 1 will need seven copies of your submission by September 13. Please contact me at 978 619-5685 with any questions. The proposed restaurant will have dining/bar space in the lower level and we would like to provide full-access to all of our patrons in the lower level. Currently the lower level is not fully accessible. We have reviewed the proposed plans at a pre-development meeting with the local city officials and they are in support of the overall vision of the restaurant and they are excited to see this project come to life as part of Salem's Urban Renewal plan. The first variance is to install a vertical wheelchair lift in lieu of a full-service elevator. A full-service elevator is not technically feasible due to the first floor ceiling height. A full-service elevator requires a minimum clear dimension of 12'-2"to the bottom of the safety (hoistway) beam (see attached typical cut sheet from two elevator companies). The existing clear dimension to the finished ceiling is 12'-0". It is not possible to raise the ceiling in order to accommodate an elevator due to existing occupied tenant space above the restaurant. The second variance is to allow the vertical wheelchair lift to access a full story (9'-0" of vertical travel). Due to the amount of space required, a ramp is not feasible. The lift would comply with all of the requirements of 521 CMR 28.12.2. Thank you for your consideration in this matter. Sincerely, Mark McDonough, Owner of Serenitee Restaurant Group CC: City of Salem Inspectional Services City of Salem Commission on Disabilities Independent Living Center of the North Shore and Cape Ann, Inc.
