Sano with a Supplemental Report by Sgt. M. Berube. On Saturday November 13, 2010, at about 12:24PM this Detective was ` 11/15/2010 08:38 9787456492 SALEM DETECTIVES PAGE 03/05 2 notified at home by O.T.C. Lt. Losolfo of an industrial accident at 60 Washington Street were a worker was injured and not expected did survive his injuries. Lt. Losolfo related he would make notification to O.S.H.A. I arrived on scene at about 12:31PM, same date, and was briefed by Sgt. Marc Berube, Patrol Supervisor and first arriving officer, and reporting officer Charlene Sano. Upon arrival the victim was being attended to and transported by EMT/P's of Atlantic Ambulance. Also on scene was Deputy Chief Giunta of the Salem Fire Department as well full compliment of the responding fire crew (see Grime Scene Sign-In Sheet) . Based on observations and interviews, the following is believed to have occurred: Three employees of victor Sosa Construction, Inc. were working to repai.r the roof of the structure at 60 Washington Street, Salem, MA. That work included removing gravel by hand from the flat roof and placing it in sandbags. Those sandbags were then lowered by a rope and pulley mechanism to the ground below where they were emptied into a truck. The three employees include Juan vidalioio Alvarado, DOB: 08/29/71 (working on the ground) , and Rubilio Marivel Rodas, DOB: 11/25/65 and Gilmer Noelio Alvarado, DOB: 10/15/83 (both working on the roof) . At some point, for a reason/cause yet to be determined, a sandbag full of roof gravel, still attached to the rope and hook, fell downward without and resistance, striking Juan Alvarado. His injuries were fatal.. _ Ramon Ortiz, an employee of the Commonwealth of Massachusetts Trial Courts was identified as a witness, Mr. Ortiz related that he was crossing from Salem District Court at 65 Washington Street, towards 60 Washington Street. While crossing he was watching the roofing operation. He saw the bag attached to the rope fall downward. He yelled a warning to the worker underneath (Juan Alvarado) , The worker, either did not hear him or did not respond in time. Mr. Ortiz related the bag struck Juan Alvarado in the head "hard." and he went - down to the ground. It should be noted here that no hard or safety hats were observed on the job site or to be worn by any of the workers on site. A blue baseball hat believed to be worn by the victim was found about 5 feet away from him. Sgt. Berube was the first to arrive on scene. He observed the victim to be unconscious, with fixed and dilated eyes and to have a significant amount of blood in his mouth. Sgt. Berube began life ' saving measures until. Sal.em Firefighters and •then Atlantic Ambulance EMT's and paramedics arrived. Sgt: Berube related L•he Ford truck used to load the gravel, MA Commercial N25-192, was moved about 5 feet forward and the dumpster nearest the victim was moved to the left about 1 to 2 feet to clear the area for life saving measures. 1111512010 08:38 9787456492 SALEM DETECTIVES PAGE 04/05 3 Where as I had been informed the victim was not expected to survive the injuries, I made neti.ficati.on to the Massachusetts State Police requesting CPAC notification. This call was placed at about 12:42PM, same date. At about 12:43PM, same date, i notified Captain Griffin, C.I.D. Commander of the incident. At about 12:57PM, same date, I was contacted by Trooper Brian O'Neill of Essex CPAC. I advised him of the incident and Trooper O'Neill reported he would be .responding as well as crime Scene Services, At about 1:08PM, same date, Dr. Regan Marsh, pronounced Juan vidali,cio Alvarado dead at North Shore Medical Center, Salem Hospital. At about 1:I5PM, same date, I made the death notification to Gilmer Noelio Alvarado, Juan's brother and Rubilio Marivel Rodas, Juan's cousin. At about 1:32PM, same date, Lt. Losoli:o advised me O.S.H.A. had. responded and advised the agency would be sending an investigator to the scene. At about 1:50PM, same date, Trooper O'Neill arrived on scene and was briefed as to the investigation. At about 1:59PM, same date, Trooper O'Connor of the Crime Scene Services arrived on scene. At this point Troopers O'Neill, O'Connor, D,C. Giunta and I went to the roof of the building and made note of the conditions as documented by Trooper O'Connor by way of digital photography, Trooper, O'Connor also documented the exterior scene at ground .level At about 2:50PM, same date, Mr. Donald G. Naim, Safety and Health Compliance Officer for O.S.H.A. arrived on scene. Investigator Naim was briefed as to the investigation to that point. This Detective cleared the scene at 3:OOPM, same date. The property at 60 Washington Street Salem, MA is described as a three story commercial structure of brtok and steel. The City of Salem Accessor GIS .records show it is owned by Sixty Washington Realty Trust, 7 Rantoul Street, Beverly, MA 01915. The height of the structure where involved is to be about 40 feet. This measurement is not exact. Weather conditions do not appear to be a factor in the :incident as the conditions were sunny, low 60's, and, light winds. The work area, at the roof and at ground level, were not wet. A search of the Commonwealth of Massachusetts FUSS website shows 11/15/2010 08:36 9787456492 SALEM DETECTIVES PAGE 05/05 4 Victor Sosa's Home Improvement Contractor Registration, number 117227 expired on 9/11/2000. His Construction Supervisor's License, numner 99488 is current until 2/14/2012, Neither license shows any complaints filed against the registrant. At about 6:30PM, same date, I received information .from the City of Salem Building Inspector. Thomas St. Pierre that his office had no ,record of any permit being issued for roof work at 60 Washington Street, Salem, MA.
