Harris, Assistant Building Inspector Danvers Department of Code Administration Chiller Location Town Halt 'The John Bertram Hous Danvers, MA 01923 Salem, Mass. Dear Mr. Harris: There appears to be some question and confusion regarding the locating of the chiller and the issuance of the building permit in 19$9-1990 for the conversion ofthe John Bertram House into an :usisb::d 1 iving facility. Since at the time you wore the Assistant Building h spector 1:or the City of Salem and were the, inspector in charge of the John Bertram House project, I would appreciate your vcrifieat:ion of our discussion regarding the chiller, a summary of which follows: During the project's design and preparation of the working drawings, and, prior to application for a building permit, I asked you if the proposod piece of air conditioning equipment known as th-: chiller or the pad upon which it would rest was considered a"structure' and if they could be installed within the side yard setback. Your interpretation was thrat neither was a O ucture, and they therefore could be insfallcd within the side yard as subsequently shown on the drawings approved for the building permit. If the above ab us with yuw-recollection of our discussion ofthe chiller, would you please indicate your agmument by sigiiug this letter below and returning it to me? If you have any additional comments, correc- tions, or would like to elaborate further, fea:l free to do so. Thank you for your time. Sincerely, Staley McDennet SM/Sb David J. Doering, Trustee of the Washington Square North Trust, which Trust is the owner of certain premises at 31 Washington Square North in Salem. It is our understanding that an air conditioning system has been added to the building situated at 29 Washington Square North (known as the Bertram House) , which encroaches into the 10-foot setback area required by the City of Salem zoning ordinance in the zoning district in which the subject premises are located. The structure constructed to house the air conditioning system is an unlawful structure, as it is located approximately two inches -- not ten feet -- from the property line dividing 29 Washington Square North from the property of our client at 31 Washington Square North. Demand is hereby made that you enforce the Salem zoning ordinance by taking any and all action necessary to cause the removal of the offending structure. It is your duty to enforce the provisions of the zoning ordinance, and to impose on the Bertram House the prescribed fine for each day that the violation created by the unlawful structure should continue . I stated that the unit had to be within this criteria during the worse case senario which would most likely occur during the early morning hours. The Health Department conducted testing on August 26, 1993 at 6:00 a.m. The following levels were recorded - unit off = 40-41 db(a) - unit on = 54-55 db(a) . The results demonstrate that the HVAC System of the Bertram Home is still creating noise above acceptable parameters. The matter must be resolved pending administrative action. I know that you and Mr. Burke made an inspection regarding this problem and I would appreciate it if you could update me as to your findings. Thank you very much for your prompt attention in this matter. Sincerely, Leo E. Tremblay Inspector of Buildings LET:bms cc: Councillor Harvey Dr. Paul Chevedden, 31 Washington Sq. Bertram House `Y,TII rc „ August 5, 1992 Mr. William Burke Health Agent Board of Health 9 North Street Salem, MA 01970 Dear Mr. Burke, I am w.^_ting you this note in response to your July 22, 199" letter and to update you on our progress in minimizing the noise levels of our air conditioning chiller unit. Our contractor, E. Amanti & Sons Inc. of Salem, has been in contact with the manufacturers representative, Stebbins-Duffy Inc. of Wakefield, for the Mcquay Chiller Unit in order to design and engineer more effective ways to reduce noise emissions. It has been difficult in getting a quick resolution on this because we are in the height of the vacation season. In any event, Amanti & Sons hopes to have a solution to the problem by next week and we plan to take corrective action as soon as possible. As you know, we have actively tried to solve the noise problem of the chiller unit in a number of different ways after we became aware of the issue. When first hearing of the problem, we fully enclosed the unit with a specially designed fence, then insulated the walls of the fence and added a sound/air flow metal scoop, and recently we had Amanti & Sons design and engineer a sound insulation cover for the compressor of the unit. These efforts appeared to help diminish the noise levels so as to meet the sound requirements on two previous decibel samplings but evidently did not meet those requirements for the last decibel sampling you made on July 14. 1 will call you as soon as soon as we have a timetable for implementing our next approach to reduce noise levels so that you can schedule a time to measure whether this approach was effective in meeting the Massachusetts Sound Level Criteria. If you have any questions on this, please feel free to call me at your convenience. Sd1111, Clifford T. The following results were recorded at the time of inspection: Property located at 31 Washington Sc No 11: 15Dm dB levels taken from Bedroom window with air conditioning unit on 56-58dB(A) dB levels taken from Bedroom window with air conditioning unit off 44-46dB(A) In accordance with the Massachusetts Sound Level Criteria the allowable limit above ambient (background) is. 10 dB(A) . Mr. Maurice Martineau Building Inspector 1 Salem Green Salem, MA 01970 Dear Mr. Martineau: My next-door neighbor, The John Bertram House at 29 Washington Square North, operates an industrial air-conditioning unit which generates noise far above the level permitted for a residential area. This machine runs on a 24-hour basis and has disturbed my peace to such an extent that I have had to seek medical attention. I informed William Carney of The Bertram House of this problem last August. Since that time engineers have made modifications to the air- conditioning unit, but these changes have done nothing to muffle the sound, which now is even louder than it was last summer. I informed The Bertram House again today of the problem, but they refused to turn the air-conditioning unit off and only gave vague assurances that the problem would be looked into in three-weeks time. They used this delay tactic last summer which obviated any need to rectify the problem. I ask that you kindly look into this matter and have The Bertram House comply immediately with city ordinances related to noise. Thank you very much. Sincerely yours, Dr. Paul E. Inside please find the State Building Code definition of structure. Hopefully this will resolve the issue of what is considered a structure. But in case it doesn't' the chiller unit, the pad and enclosure are all considered structures. The chiller unit could be located on a roof top and it also could be located at the rear of a corner lot. Further more my interpretation of a corner lot is that it fronts two streets and has two rears to property and no side yards. If I can be of any further assistance please do not hesitate to call. Sincerely, Leo E. Tremblay Inspector of Buildings Zoning Enforcement Officer LET:bs Enclosures: (5) cc: Clifford T. Hughes Francis T. Mayo \brtrml\ STALEY McDERMET ASSOCIATES PRESERVATION& RESTORATION ARCHITECTURE 175 ESSEX STREET 1' SALEM, MASSACHUSETTS 01970 (508)745-4969 February 7, 1994 Mr. Leo Tremblay,Building Inspector City of Salem Location of Chiller One Salem Green The John Bertram House Salem, MA 01970 29 Washington Square North Dear Mr. Tremblay: Mr. Clifford T. Hughes, representing the John Bertram House, has contacted me regarding your letter to him of December 8, 1993. In the letter you said that the existing chiller on the John Bertram House properly is a "structure" and as such must be relocated to conform with the City of Salem's Zoning Ordinance regarding setbacks. When I contacted you by phone in mid-December, I raised two questions. 1. What specifically was considered a structure: the chiller unit itself, the pad, or the enclosure? 2. Although we do not agree that the chiller is a structure, if it were to be determined to be a structure, where could it be re-located and be in conformance with the Zoning Ordinance? The problem is that Section 7-8 of the Zoning Ordinance states that: "No accessory building or structure shall be located within any required front yard or within any side yard of a corner lot." The John Bertram House is located on a corner lot, and according to Section 6.A.3. of the Zoning Ordinance, a corner lot contains two front yards. My question is whether a corner lot contains two side yards, or is one yard declared a side yard and one declared a rear yard? If a corner lot has only side yards, it appears that no legal location is possible for this chiller, if it is to be defined as a structure. If a corner lot has both a side yard and a rear yard, we need to know which is to be defined as the side yard and which is to be defined as the rear yard. Your response to my first question was that everything was considered a structure. You did not have an immediate answer to the second question, but said you would research it and contact me. The purpose of this letter is to confirm our conversation and to request a determination on the second ques- tion. We are continuing to work on a solution to this problem as well as to the noise issue currently before the Board of Health. Your answer will help us decide upon an appropriate course of action. Thank you for your time. Very Truly Yours, , Staley ermet nlJ cc: Clifford T. Hughes Francis T. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, a charitable organization, owners of the property in question, are requesting a Special Permit to extend a nonconforming structure and a nonconformin, use to allow construction of an addition and an increase in the number of units from 22 to 25 in this R-2 district. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of non- conforming structures, and for changes, enlargement, extension of expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detri- mental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . Support and opposition of the plan was voiced by neighbors, abutters and others; 2. The grant of the Special Permit would allow this non-profit organization to better care for aged men in the City and allow the residents to reside and continue living in dignity; 3. The proposed interior changes would bring the building up to present .building codes; 4. The property, before its closing was used for such a use since 1887. 5. The plan presented was a result of at least four (4) neighborhood meetings since October of 1988; 6. The proposed changes would provided for a better quality of life for the residents of the Bertram Home. DECISION ON THE PETITION OF THE BERTRAM HOME FOR AGED MEN FOR A SPECIAL PERMIT AT 29 WASHINGTON SQUARE NORTH, SALEM page two On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . The proposed use of the property will not be substantially more detrimental than the existing use to the neighborhood; 2. The relief requested can be granted without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance; 3. The grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. 4. The use as altered or extended will not depart from the intent of the Zoning Ordinance nor from the buildings prior use. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the Special Permit permit requested, subject to the following conditions: 1 . All construction be done as per all existing city and state building codes and as per the plans submitted; 2. Petitioner comply with all requirements of the Salem Fire Dept. relative to smoke and fire safety, including all requirements of the Massachusetts Sprinkler Law for facilities of this type; 3. A certificate of occupancy for all units be obtained; 4. Petitioner meet all requirements and receive a Certificate of Appropriateness from the Salem Historical Commission. Included in these requirements shall be project design, site placement and massing. SPECIAL PERMIT GRANTED Richard A.
