BUILDING CODE ANALYSIS
Property Description:
The building is an existing R2 and a three story stand alone type 5b unprotected structure.
The proposed use is also R2. It has direct access to a parking lot at the rear portion, and is
approachable from three sides with direct access, Andrew Street, Washington Square as
well as the parking lot. The fourth side is an existing side yard. Total height of the existing
structure is 37' -1 V to the existing top highest point of the roof cornice trim. It is 22,932
square feet on the main upper three floors with 7,644 on each floor and also 7,644 square
feet in the basement: a total of 30,576 square feet.
This existing building had 21 apartments within three separate wings on three floors. Due
to a substantial fire that occurred the building had to be gutted out to the exposed framing
and structure from the severity of damages and subsequent weather damages. As a
result, this was excessive and triggers an analysis under chapter 34 of the SBC 8'h edition
of Massachusetts. The following is our evaluation of the building and solutions:
Repairs&Renovations:
12 units, instead of 21 existing units will be repositioned to accommodate two remote
stairwells with access corridors to each unit. At the center court yard where 50% of the
prior secondary egress was utilized through existing fire escape structures that carried
down tenants to grade will be replaced with a new enclosed stairwell lobby. These outside
structures once eliminated will allow an elevator with new stairwell to accommodate tenant
direct flow to the two remote stairwells as required by code. Also, this allows the corridors
to be naturally ventilated to the exterior wall with windows as per the code requirements.
Under MGL48 h, g, & I of Massachusetts 4 units or more must install a fire protection and
automatic sprinkler system. Plans are being designed by a fire protection engineer and
installed by a licensed sprinkler contractor per NFPA and chapter 9 of MA SBC.

The existing structure under chapter 34 requires evaluation by an independent structural
engineer, and plans have been designed by Chet Derr, PE of Swampscott with HH Design
Group Architects for re-supporting the existing framing with steel beams and/or
engineered lumber and columns to new footings from the roof down to meet current dead
and live load code requirements before making the building weather tight.
Other building components that will be affected by the renovation is the energy efficiency
and sound transmission requirements. 17 SEER 90% energy efficient gas furnace, sealed
combustion that are 2 ton units for each apartment will be installed to outside wall unit
closets per apartment. The current codes require R38 insulation on the Roof deck with
R30 between floors. Spaces to the exterior perimeter walls of the building are required to
be R19 and R13 interior sound blankets with a wall section of 45-55STC minimum. All
windows will be replaced with new low E double pane energy star.35uv. glazing with
thermo block protection. Also, within the fire assembly walls between stairs, corridors and.
unit separations the fire ratings will be reduced to 1 HR. minimum as permitted by the
installation of the sprinkler system throughout the building.

In accordance with Chapter III, Sections 127A and 1278 of the Massachusetts General Laws, 105 CMR 400.00; State
Sanitary Code, Chapter I: General Administrative Procedures and 105 CMR 410.00: State Sanitary Code, Chapter 11:
Minimum Standards of Fitness for Human Habitation, an inspection was conducted of the property located at 98
Washington Square East#7 occupied by Lewis Dejarnette conducted by Mark Tolman, Sanitarian on Thursday,
February 18, 1999 at 2:00 P.M..
Notice: If this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's responsibility
to notify tenants of lead related reports and tests, and to ensure that this unit complies fully with 105 CMR 460.000:
Regulations for Lead Poisoning Prevention and Control. For further information or to request an inspection, contact the
Salem Health Department at 741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection report.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint being
sought against you in Salem District Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A request for
said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order. At said
hearing, you will be given an opportunity to be heard and to present witness and documentary evidence as to why this
Order should be modified or withdrawn. You may be represented by an attorney. Please also be informed that you have
the right to inspect and obtain copies of all relevant inspection or investigation reports, orders and other documentary
information in the possession of this Board, and that any adverse party has the right to be present at the hearing.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations

Corrected:
1. Rent-Withholding(Massachusetts General laws;Chapter 239 section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if-
A- You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and!that knew about the violations before you were behind in-
your rent-

Dear Mr. Rosenthal:
On Tuesday February 9, 1999, the Building Department responded to a complaint at
your property located at 98 Washington Square East.
As a result of this inspection, we found that the building was in violation of
Massachusetts State Building Code 780 CMR as follows;
1. Section 103.0 Maintenance, building is not being maintained in a safe, operable and
sanitary condition.
2. Section 121.0 unsafe structure, the foundation walls, columns, beams and floor joists
are deemed to be dangerous and would be especially unsafe in case of fire.
3. Gas, water and heating pipes need to be re-supported.
4. Water piping and waste lines leaking and causing additional structural damage.
You are hereby ordered to hire a registered structural engineer immediately to review
the structure and prepare a written report with stamped drawings. The owner shall
submit a written schedule with a time frame for repairs to be completed and have a
licensed contractor apply for a building permit. No new tenants shall occupy the building
until work is completed and the laundry room shall remain closed.
I have also enclosed an application for a Certificate of Inspection which is required to be
done immediately. Please return the application with the fee and an appointment will be
scheduled to go through all the units and common areas.
Failure to comply with the requirements of this order immediately will result in legal
action being taken against you in Salem District Court.

As we had discussed, the above-referenced property is a 21 unit
apartment dwelling that presently exists within the R-2 (Residential two-
family) zoning district. Please provide me with an official letter confirming
the "grandfathering" of this dwelling and approval of its use as a multi-
