Fire Department incident/!/31/09 Dear Mr. Lewis, The Salem Fire Department was called to your residence on 1/31/09 regarding a concern related to your heating equipment,s direct vent.Salem Fire contacted me via telephone and I discussed the situation with Deputy Chief Beaudet. It was agreed that no life safety threat to the occupants of the home existed. I informed Deputy Chief Beaudet that I would have my Plumbing and Gas Inspector follow up with an inspection during the week. Mr. Ross was able to inspect the equipment and determine that the "Peerless Boiler"had been installed and inspected in 1999. The Massachussetts Gas Code in 1999 did not specify the height of a vent above the ground. Instead, the "Code" allowed installers to use the Manafacturers, Installation guide as the "Code".The Lewis,s were able to produce the "Peerless Boiler Install Guide" and Mr. Ross checked and confirmed that the install was legal in 1999. This means that you are not required to change anything and that currently the equipment is legal and may continue in use the way it is .If you choose to upgrade the install, we will inspect the vent and apply the Mass Gas Code and Fire laws that are currently in effect. It should be noted that at no time was the safety of the Public or the Occupants of 23 Warren Street in question. If further information is required, please contact me directly. (R-2) 4: A hearing on this petition was held May 27, 1987 with the following Board Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinski and Strout. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property, is requesting a Special Permit to extend nonconforming rear & side setback to allow construction of a deck in this s R-2 district. You may remember hearing from us in 2006 and 2007, when we sent you a copy of a bond document issued by CNA Surety as part of the process of entering our neighbor's property at 21 Warren Street with contractors according to Massachusetts General Law 266-1208, "Entry on land by abutting property owners not constituting trespass."The tight proximity of our boundary with that of#21 necessitates that we enter the neighbor's property to set up ladders for work on the north side of our house. However, the owner of#21, Charlene Laurion, has refused to allow us permission to enter her property in order to make repairs to our house. Our contractors did much work in 2006 and 2007, but now need to replace the roof as we have water leaking in to the extent that ceiling plaster is damaged. Therefore, we've renewed the bond for the period 10/27/2008 to 10/27/2009 and intend to comply with all of the provisions of the law. You may remember that the persistent problems with Charlene Laurion and her houseguest, Peter Postell, led to charges of criminal harassment convictions for both of them. To keep you up to date, Postell has been barred from coming within 100 yards of the house until July 2009. Laurion recently violated her probation by resuming the harassment; she has one violation hearing pending, plus two new criminal harassment charges. Sergeant Harry Rocheville has been very active in handle these recent issues. The vent appeared O-K. to me. A small amount of soot on the snow near the vent looked to be something a have seen at other locations many times before. My concern was the distance that the vent was from the ground, approximately one foot. I contacted the Building Inspector and was informed that gas unit vents are installed according to the manufacturers specs. He will send his assistant there Monday to look at the situation. I was informed by the homeowner, and subsequently by the Salem Police that this is an ongoing neighbor dispute. Units respandiang were: Unit CAR 2 responded. 15:30:00 all units back in service.
