FINNISS FOR A VARIANCE FOR THE PROPERTY LOCATED AT 70 WARD STREET (R-3 DISTRICT) . Hearing on this petition was held on September 15, 1976 with Chairman John M. Gray, Sr., and members Jane T. Lundregan, William Abbott, Arthur LaBrecque, and Donald Eames present. Notices were duly mailed to abutters and others in accord— ance with Massachusetts General Laws, Chapter 808. Attorney Donald Koleman represented the petitioner before the Board. The lot is an undersized lot and is located in an R-3 District, but has always been used for commercial purposes. The neighborhood is basically a commercial neighborhood. The building located on the property burnt down recently and the petitioner wishes to construct a new building which would be used for commercial purposes. , The Board voted unanimously to grant the petition as requested. The Board found C , that the size of the lot and character of the surrounding neighborhood made the lot one which would not be compatible with residential uses. The Board found that to deny the petition as requested would cause hardship to the petitioner because of the character of the neighborhood and the size of the lot, therefore the Board voted to grant the petition requested, and found that it could do so without substantial detriment to the surrounding neighborhood and without derogating from the intent of the Salem Zoning by-laws. RANTED APPEALS FROM THIS DECISION, IF ANY, SHALL BE MADE PURSUANT TO SECTION 17 OF THE MASSACHUSETTS GENERAL LAWS, CHAPTER 808, AND SHALL BE FILED WITHIN TWENTY DAYS AFTER THE DATE OF FILING OF THIS DECISION IN THE OFFICE OF THE CITY CLERK. A COPY OF THIS DECISION HAS BEEN FILED WITH THE PLANNING BOARD AND THE CITY CLERK. VARIANCE GRANTED HEREIN SHALL NOT TAKE EFFECT UNTIL A COPY OF THE DECISION BEARING THE CERTIFICATION OF THE CITY CLERK THAT TWENTY DAYS HAVE ELAPSED AND NO APP;3AL HAS BEEN FILED, OR THAT IF SUCH AN APPEAL HAS BEEN FILED IT HAS BEEN DISMISSED OR DENIED AS RECORDED IN THE SOUTH ESSEX REGISTRY OF DEEDS AND INDEXED IN THE GRANTOR INDEX UNDER THE NAME OF THE ONNER OF RECORD, OR RECORDED AND NOTED IN THE OWNER'S CERTIFICATE OF TITLE. The structure was ordered condemned by the Board of Health on June 17, 1976 because of the poor state of repair and a multitude of violations of Article Two of the Sanitary Code of the Commonwealth. 2. You advised the Board of Health by letter that you were applying for a variance before the Board of Appeals to raze the present structure and build a cement block structure. it was further indicated the building would be razed no later than July of 1976. 3. At the September 15, 1976 hearing before the Board of Appeals your request for a variance to construct a building for commercial purposes in the R-3 District was approved. 4. The twenty-day period on any appeal of the decision of the Board of Appeals in regard to 70 Ward Street has now expired no one has appealed the decision. You are requested to proceed immediately to raze this structure as in its present condition it presents an extreme danger to nearby buildings in the event of fire.
