There are concerns that these porches have the potential to have an excessive
live load, and that this could further exacerbate the potential for collapse. Until

The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations

1.,Rent Withholding(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
yourrent.
B. You did not cause the violations and they c lie repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent iiito court if a judge orders you to pay it. (For this,it is best to put the,
rent money aside in a safe place.) _

At the suggestion of Linda Bllerh , H.U.D.-Boston Regional
Office, the 56 Ward Street Condom' ium Trust is writing to
ask for your support in ou effort o obtain satisfactory
completion of improvements o ' gin specified by the Salem
Planning Board for our UDAO-fu e c ndo conversion in the
Point Neighborhood Cond nversion P oject. We purchased our
units with the understan60 at the Sat Planning Board in-
tended to comply fully, with the work i ized on one or both
of the first two docu�}e is attached. T first list of improve-
ments , though not datced d not on the P anning Board letterhead,
was given to at least w applicants who quired last year but
did not finalize purcha e until this year. The second list was
given to those w rch d in 1984, and a pears on the third
page of a prose t n th Planning Board letterhead, but also
undated (Appe dices and B , respectively. ) please note that
the fi t ocume t pric s the units at $26 ,000, while the second
documen p 'ces e s units at $29,600 yet omitted originally
specifi d i rovm is uch as pointing of brick and full rehabil-
itation f windows.
A few ex les of non-compliance, clearly apparent to even non-
professiona eye
1. Large holes and missing chunks of mortar in outside
brick. (When was pointing last done?)
2. Rotting windc*4casings cause many windows to be inoperable.
Pulleys are outdated and can only be obtained from contrac-
tors who occasionally save them when demolishing structures.
Rotted wood in the casing flakes with every use,' leaving
unusual debris and providing a home for a variety of pests
such as fleas , roaches, and mysterious winged ants which
may be termites. A wood-rot odor permeates the building.
3. one "rebuilt" porch, top floor front, facing Congress St.
and Shetland Properties, has a frightening cant to the
floor, and was apparently "reinforced" by slipping wedges
into the gaps between the roof above and the top of the
porch columns; these wedges fill the space but hardly add
support to the structure. Another porch, ,-top rear on the
west side, has weak, possibly rotted floor planks.
4. "New" vinyl floor covering in kitchens and baths is scarred,
cut, and permanently stained with glue, installed some time

ago by inexperienced, poorly-supervised crews of neighbor-
hood workers. (When were these scraps installed?)
5. "New" floor paint was splashed on top of existing paint,
plaster, dirt and putty, and shows long abuse. (When
were unit and porch floors and common area stairs actually
last painted?)
6 . ,New" wallpaper was slapped on top of one, sometimes two
layers of old wallpaper. It is now stained from various
leaks and whatever occurred during the three-year period
the building was said to have been unoccupied except by
cats , vermin and street people who sheltered here during
cold, wet weather.
7. Some spooky wiring: Sometimes my livingroom ceiling light
works, sometimes it doesn' t. The washer of one neighbor
is wired to, and being paid for, by the neighbor below.
A glance at the frayed antique wiring in ceiling fixtures
is a very sobering experience. (Who signed off the electric
work and when?)
Since 'everyone who purchased these units qualified for UDAG-funded
interest-free loans to assist in purchase, we would like to have
a H.U.D. inspector visit the building to determine how well com-
pliance has been met. Or, we will accept outside independent
contractors if the evaluation is paid for by the Salem Planning
Board.
The Trust has approached four different engineering firms to in-
vestigate the building and the estimates range from $10,000 to
$2500. We enclose a copy of the report of the lowest bidder to
date, Fay, Spofford & Thorndike, Inc. of Lexington. (Appendix C )
To date, the individuals at the Planning Board that we have been
able to contact have either disclaimed responsibility in terms
of their current job descriptions or have implied that we should
have been more wary buyers. Few of us succeeded in our efforts
to see the units more than once prior to purchase, and instead
put our faith in the documentation so freely proffered by the
Planning Board. At least one UDAG-funded buyer has moved on to
greener pastures and is renting the unit, thus treating it as a
real estate investment rather than as a primary residence. Our
complaint to the Planning Board (Appendix D) has remained unacknow-
ledged to date. The current renter is negotiating with Ms. Eaton
for the purchase of her unit but found her asking price unreasona-
ble. The Trust feels that the Salem Planning Board should ascertain
that the price not be speculative under these circumstances, and
should assist this potential buyer to reach agreement within a
reasonable period of time. Absentee landlords are not in the
best interests of the neighborhood.

Finally, those of us who are making these units our residence
would like to see the City of Salem fulfill an, earlier promise
to the Point neighborhood: to build a South River Canal-side
park. With state Coastal Zone Management funds now available
for waterfront areas, the Planning Board should undertake a
needs assessment of the area, taking age and ethnic census
data into consideration, and apply for a grant to develop a
canal-side park and promenade which could be enjoyed by all
ages of a mixed but largely Hispanic neighborhood. We feel
there is strong neighborhood support for such a recreational
area, that it would not require large amount of money, and
that it could very easily qualify for CMZ funds with Planning
Board sponsorship. Winter Island must be saved, of course, but
the neighborhood also has Salem Willows and Pickering Wharf ,
while the Point has only a playground at the southern end, far
from Ward Street.
Please take a drive or a walk up Ward Street from Congress St.
and take a look for yourself. No. 56 Ward is the first large
yellow brick building on the left. Continue up the street to
observe, after school hours, the large number of small children
playing in the streets with Salem's addict population. You will
probably not see the significant numbers of elderly who do not
feel safe on this street. On up to the corner where the teens
do their "break dancing" on the sidewalk for lack of a better
spot. A single 5-minute visit to the street would convince you
of the need for the park which was scrubbed by the Planning
Board some time ago.

THE POINT NEIGHBORHOOD
CONDOMINIUM CONVERSION PROGRAM
The Point Neighborhood Condominium Conversion Program is part of a neighborhood
impro•.ement project administered by the City of Salem and funded by an "Urban
Development Action Granth (UDAG) from the United States Department of Housing and
Urban Development. The condo conversion program is designed to improve the housing
quality in the Point Neighborhood, while providing homeownership opportunities for
low and moderate income .families.
How the Program Works? _ . - -
Families interested in buying one of the newly renovated condos in the Point
apply to the City. The applicant family is reviewed by. the City to determine their
priority designation. Priority designations are based on the following preferences:
existing neighborhood residents; families who have been relocated from otlier HUD
programs; families currently living in substandard housing; and low and moderate
inco.ae families. However, everyone is eligible to apply and ultimately buy a condo
rega-d.leas of priority designation.
The City then reviews the applicant family's financial information to determine
whether they are "bankable"; that is, can they get a mortgage from a bank. And the
City determines how large of an "Equity Loan" the City needs to provide for the
family as a downpayment. ,
If the applicant family is determined to be able to afford and get a mortgage,
the City assists them to sign a "Purchase and Sale Agreement" for the condo they want
and then takes them to a local bank to apply for a mortgage. Several local banks
have set--aside mortgage funds for the program's condos.
What Ys an Equity Loan?
The City of Salem will provide a loan to eligible condo buyers for their down—
payment of up to 40% of the sales price (depending on need). The equity, loan is
interest free and will have to be paid back only if and when the condo is resold.
A family is eligible for an equity loan if their income is below the U.S_ Department:
of HUD's definition of "moderate" income.
Special Requirements
Only families intending to live in the condo they are purchasing are eligible
to buy.
If, after buying a condo, the family decides to sell it, the City of Salem has
the right to buy the unit before anyone else at a price equal to the original price

Dear Mr. Griffin:
It was a pleasure meeting with you this past week to discuss the
professional engineering services you will require to evaluate the con-
dition of the brick wall at the front Of the building and the roof of
the condominium. The condition of the mortar in the brick joints indi-
cates a potential problem with water penetration. A complete survey of
the face will determine how extensive this condition is. While we were
unable to access the roof during my visit, your description of leakage
conditions indicates that problems with the roofing and/or flashing do
exist. The cause of these problems should be determined to establish
the scope of remedial work necessary.
Fay, Spofford & Thorndike, Inc. (FST) , organized as a partnership in
1914 and incorporated in 1956, is a Massachusetts-based consulting firm
with offices in Boston and Lexington. The firm provides multidisciplin-
ary services for the planning, design, and implementation of public
works and private industry projects. The staff consists of over 200
employees, approximately 125 of whom are engineers and planners. FST
has an impressive record of projects involving investigations of exist-
ing conditions, development of remedial measures, analysis of priori-
ties, alterations to existing structures and design of new structures.
These projects have been conducted for both the public and private
sector and have encompassed all phases of engineering for building sys-
tems including structural, electrical, mechanical, and civil engineering.
We have enclosed our company brochure for your information.
We have recently completed evaluations for condominium complexes in
Boston and Brockton, MA. These projects involved condition surveys and
reports on structures similar to 56 Ward Street, although on a somewhat
larger scale.

We propose that the initial scope of services consist of the follow-
ing:
1. Field survey of front face of building from street level to ob-
serve and record condition of brick and mortar
2. Field survey of roofing to observe condition of membrane and
flashings
3. Short letter report indicating conditions observed, and includ-
ing recommendation and estimated cost of remedial work found
necessary
4. Attendance at one evening meeting with the Association to dis-
cuss the Report
We understand that extensive meetings and ultimately testimony in
court may be necessary to assist your Association in resolving responsi-
bility for corrective measures to repair the building. However, it is
not reasonable to attempt to estimate the extent of services which may
be necessary at this time. We therefore recommend that the initial
scope be limited to the field survey and letter report.
In regard to the roof survey, our work will consist of a visual in-
spection of the roofing and flashing. On past projects we have also
engaged the services of Roof Moisture Consultants Inc., of Boston, MA to
perform a non-destructive moisture survey to establish degree of satura-
tion and location of points of water penetration into the roofing mate-
rials. This moisture survey is particularly useful when points of water
intrusion are not discernible by visual observation. Should this mois-
ture survey be deemed necessary after our visual inspection, the cost of
these services will be approximately $750. We suggest that this amount
be allocated and the decision to perform the moisture survey be made
after our visual inspection.
The cost of our services, including expenses, to perform the visual
field survey, prepare a report on our findings, including recommenda-
tions and cost of repair, will be the lump sum of $2,500.

Dear Ms. Lindon:
While in the process of forming the condo association at
56 Ward St. , the owners present , at the four meetings, held
to date agreed that the Salem Planning Boad be formally not-
ified regarding the ongoing rental of apartment 2-A.
Linda Eaton, the present owner of unit 2-A, lived in the
apartment only until early siring of this year, then relocated
her residence to Georgetown, renting the apartment to a couple .
said to be her relatives. This couple moved to Alabama in
July, leaving an acquaintance (relative?) in the apartment.
This party says he will be moving soon.
Later in July Ms. Eaton told the owners of 3-A and 4-A that she
wanted to sell her unit, and asked if they were interested in
buying as individuals. They were not, but rio formal offer was
made to the entire group of owners. Recently Ms. Eaton adver-
tised the apartment for rent again, at $500.00 per month, even
though at least three potential buyers have inquired about the
unit.
Although Ms. Eaton was informed of the condo association meetings,
she has never appeared. The other owners concur that this situa-
tion is an improper use of public funds and in conflict with UDAG
regulations. All the owners have clearly understood that interest-
free loans for down payments were to purchase a primary residence
and not real estate investment property.
Therefore, we are requesting that the Salem Planning Board take
steps to enforce these regulations before the group considers
other measures.

In response to a complaint from the Salem Board of Health this
Department inspected the exterior of the premises located at
56 Ward Street, Salem, Massachusetts 01970.
The inspection revealed the porches at all levels to be a
hazard to the public safety and welfare.
You are ordered to take immediate action to correct this condition.
Your failure to comply with this order will require further action
against you by this Department and the City of Salem.
