The ensuing communication shall serve as our follow-up to our Thursday, November 10 2016;
site meeting. Present were yourself, Salem Police Officers Robert Phelan and Edward
Vaillancourt, Salem Fire Prevention inspector Daniel. Geary, Ms. Elizabeth Gagakis of the
Health Department and our Department. The purpose of the investigation was to identify any
safety concerns and code violations noted during the visit as well as concerns noted by a
complaint received by the Salem Police Department
Each City Department present at the meeting shall be submitting their own reports regarding any
violations cited, so let it be noted that violations stated in this correspondence are solely matters
that are governed by this office and the Massachusetts State Building Code 780 CMR, but are
not the only items of concern on the property.
First and foremost, thank you fbr allowing us to inspect the interior common area, the kitchen
area of your apartment and the property's exterior. One of our Departments responsibility is the
safety of the residents of the City of Salem, and you allowed us to do our job.
As discussed at the site the only two (2) - violations were noted at the property. One was the lock
and hasp on the second-floor apartment front hallway door that needs to be removed completely
from the jamb and frame. This second-floor apartment has two other egress as required by the
Building Code,but the hasp/lock still must be removed. If you wish to add an egress lockset or
dead bolt with a thumb latch for security after the removal, this would be acceptable under the
Massachusetts State Building Code.

The second violation is the empty swimming pool in your rear yard. The pool opening must be
covered with an approved pool cover, secured to your pool apron or the walls broken for
drainage and the pool filled and compacted to grade level.
Thank you for your understanding and anticipated corrections. You are hereby ordered to begin
to rectify these conditions within 7 days of receipt of this notice or notify this office of your
means for compliance. Failure to do so may result in further actions being brought against you,
up to and including the filing of criminal complaints at District Court.
You have the right to appeal this order to the State Board of Building Regulations at One
Ashburton Place, Boston, Ma.

DECISION ON THE PETITION,OF ALBERTA 8 ASHLEY HALL FOR A
SPECIAL PERMIT AT30 l!ALT�(R=2)
A hearing on this petition was held October 29, 1985 with the following Board
Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinski and
Strout. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property is requesting a Special Permit to convert a
a two family dwelling into a three family dwelling and a variance from parking.
The Board of Appeal, after careful consideration of the evidence presented and after
viewing the plans, makes the following findings of fact:
1 . Parking shown on plans was not laid out to scale;
2. One neighbor opposed;
3. Definite parking problem in the neighborhood.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions do not exist which especially affect this
property but not other property in the same district;
2. Literal enforcement of the provisions of the Ordinance would not
involve substantial hardship to the petitioner;
3. The relief requested cannot be granted without substantial detriment
to the public good and without nullifying or substantially derogating
from the intent of district or the purpose of the Ordinance.
4. Proposed use will not be in harmony with the district and will not
promote the convenience, welfare or safety of the City's inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, against the granting
of the Special Permit and Variance.
