A hair coloring chemical was found outside the shower stall and caked around the shower drain, when we added a few drops of water, there was a chemical reaction causing a particularly offensive odor. Be it ordained by the City Council of the City of Salem, that the Zoning Ordinance of the City of Salem, adopted on August 27, 1965, as heretofore amended, be further amended as follows: Add to Section VII, Supplementary Regulations, the following: R. Site Plan Review 1. Purpose: For the purposes of protecting and promoting the health, safety, convenience, and general welfare of the inhabitants of the City, promoting acceptable site planning practices and standards within the City of Salem and ensuring compliance with the City of Salem Master Plan and good zoning practices, notwithstanding any other provision of this Ordinance to the contrary, no structure or premises exceeding 10,000 square feet in non-residential gross building area, or containing six (6) or more residential dwelling units shall be constructed, reconstructed, enlarged, altered, or used except in accordance with a site plan submitted to and approved by the Planning Board in accordance with the request of this Paragraph. 2. Any application for approval of a Site Plan Review under this section shall be accompanied by five copies of a site plan which shall be at a scale to be established by the Planning Board, and, according to the size of the development, shall include five copies of all information required for a "Definitive Plan" under Sction III B of the Subdivision Regulations of the Planning Board of the City of Salem and such petiton shall also be accompanied by five copies of an Environmental Impact Statement as set out in Appendix A of the Subdivision Regulations of the Planning Board of the City of Salem, as requested. The Planning Board shall review and amend all such submitted plans in accordance with the following criteria: a) adequacy of parking facilities and number of parking spaces proposed for each . development; b) adequacy of loading facilities c) adequacy of traffic circulation system d) adequacy of access points and routes to and from the land parcel to adjoining streets and ways. e) adequacy of type and amount of external lighting to be provided on the parcel; f) adequacy of type, quality, and quantity of landscaping to promote an aesthetically pleasing environment and to properly screen the development from . adjacent land uses; g) adequacy of type, quality, and quantity of vegetative screening to protect adjacent and nearby land parcels from structures not aesthetically pleasing or wholly compatible with such parcels; h) adequacy of the methods of disposal of sewage, refuse, and other waste; -4- i) adequacy of the method of surface drainage across and from the site; j) adequacy of method of water distribution to and from the parcel and its structures; k) adequacy of pedestrian circulation systems to and from parking areas and structures; 1) adequacy of protection or enhancement of natural areas; m) compatibility of architecture of structures with architecture of surrounding or nearby buildings. 3. The Planning Board shall, within seven (7) days after receipt of said application, transmit one copy of said application and plan to the Inspector of Buildings, City Engineer, Board of Health and Conservation Commission who may, at their discretion, investigate the application and report in writing their recommendations to the Planning Board. The Planning Board shall not take final action on such plan until it has received a report therein from the Inspector of Buildings, City Engineer, Board of Health, and Conservation Commission or until thirty-five (35) days have elapsed after distribution of such application without a submission of a ` I e report. Notice of the filing of the application shall be given to the City Clerk, Fire Department, Police Department, Superintendent of Streets and School Department and further notice shall be given as required by the Planning Board and a public hearing shall be held within sixty-five (65) days after filing of an application in accordance with Massachusetts General Laws Chapter 40A. -5- 4. Failure of the Planning Board to take final action upon an application within ninety (90) days following the date of the public hearing shall be deemed to be a grant of the approval applied for. 5.. After a notice and public hearing as set forth above, the Planning Board, by a two-thirds vote, may approve the plan provided that: a. the proposed development shall properly screen itself, its buildings, structures, and other construction with vegetative landscaping, earth berms, fencing, or other appropriate screening as determined by the Planning Board. b. To protect the quality of the surrounding area and environment, if such surrounding area is residential in nature, is land reserved for conservation use, or is land which the Board determines to be appropriate for such a requirement, a buffer zone shall exist along the property line within which no construction or destruction of land shall take place. The size of such zone shall be determined by the Planning Board according to the size of the proposed development, the land uses of the surrounding area, the aesthetic aspects of the proposed development, and all impacts of the proposed development upon such surrounding areas which can be alleviated through such a buffer zone. c. In specific instances where the Planning Board deems such to be appropriate, it shall assess the compatibility of the architecture of a proposed development with the architecture of surrounding structures and land uses, and may request alterations to the architecture of such proposed.development to ensure compatibility. -6- d. The Planning Board may, in appropriate cases as it determines, impose further restrictions upon the development or parts thereof as a condition to granting the approval and may waive any defined restrictions. 6. In exercising its jurisdiction, the Planning Board shall conform to all requirements of procedure applicable under the Massachusetts General Laws, Chapter 40A, as amended, and the Salem Zoning Ordinance. 7. Any approval granted hereunder shall lapse within two (2) years if substantial construction thereof has not commenced by such date except for good cause. Section 2. This was the basis of our meeting last week for which we are awaiting your answer as to how you intend to proceed. This letter was distributed to me and the following participants at a meeting on June 5th: Gerard Kavanaugh, Peter Knowlton of LEA, John LeClerc, William Munroe and Captain Turner. I agree that the best solution for maintaining City owned water pipes, from your prospective, is to clean and line the mains. Our agreement with the Planning Board in accordance with their Special Permit dated May 6, 1985, paragraph #4 states, " a booster pump, subject to the review and approval of the City Engineer and the Fire Department, shall be installed to ensure adequate water pressure and flow for emergency fire use, unless determined to be unnecessary after future testing. Such determination shall be made prior to issuance of Certificate of Occupance for Phase II." This paragraph, #4, requires only a Booster Pump and not a storage tank. I am perfectly willing to honor this commitment. I assure you that we all made this agreement with the understanding that our installation of a Booster Pump would solve the problem. Captain Turner's concern relative to the Fire Department's inability to provide a pumper truck between hydrants could be overcome by our providing a perma- nent pump installation. This, however, does not address the inability of the City to provide an adequate quantity of water. PAUL S.NIMAN DIRECTOR OF PUBLIC SERVICES June 2, 1956 Mr. James Zieff Vinnin Associates Realty Trust 33 Bedford Street Suite 12/114 Lexington, MA. 02173 RE: Development - Vinnin Square Dear Mr. Zieff: The intent of this letter is to clarify my department's position regarding the water pressure and flow problems which affect your development known as the "4 lluge at i7 -..Or As you are aware, the tests performed by your engineer, Mr. Thomas White, in conjunction with the City's consultant, LEA of Boston, indicated that there was in- adequate flow and pressure to service your development off Loring Avenue. Your engineer recommended that the best solution was to clean and line the main in Loring Avenue for an estimated cost of $200,000. Since you found this cost prohibitive you and the City investigated other alternatives and determined the possible options are as follows: 1. Cleaning and lining main in Loring Avenue. 2. Cleaning the main in Loring Avenue without lining. 3. Installation of hydrants with valve pits on Loring Hills Avenue to allow pumper truck to pump between hydrants. 4. Installation of booster pump station and water storage tank on Loring Hills Avenue. My office has reviewed the proposal for cleaning the main in Loring Avenue without lining and finds it unacceptable. While this work would restore the hydraulic capacity of the pipe temporarily it has associated water quality problems since the main is not properly lined. Once new metal surfaces are exposed corrosion proceeds at an accelerated rate (in spite of corrosion inhibiting chemicals being added to the supply) . This corrosion can result in "red water" which can stain fixtures and reduce quality. I feel that this work offers a short term solution with long term problems. 2 - . Mi. James Zieff (Cont'd.) June 2, 1986 The possibility of installing hydrants with valve pits which would allow the . Fire Department to connect a pumper truck and boost the pressure and flow in case of fire has been found unacceptable by both the Fire Department and my office. The main reason is that the Fire Department does not feel they can guarantee that a pumper truck would always be available. Additionally we are concerned that this system still might not be able to provide sufficient fire flow with adequate residual pressure. The result would be that the City at peak demand could not supply adequate pressure to meet the DEQE's "Guidelines for Public Water Systems". The booster pumping station with storage tank is an acceptable solution to this office. However, it has some drawbacks. The principal problem is that it does not correct the underlying problem, Further, it is likely that the total system would be more expensive than cleaning and lining. The actual costs would depend on the size of the storage tank necessary to meet the I.S.O. fire rating. In conclusion, I feel that cleaning and lining is the best practical solution to the problem, A booster pump station and storage tank may be an acceptable solution but it does not correct the main problem and may be more expensive. The other two solutions .are unacceptable. Approval for any improvements to the water system must be obtained by my office before any work can proceed. Additionally, according to the Special Permit issued by the Planning Board, no Certificates of Occupancy for Phase II shall be issued until this matter is. resolved. I therefore suggest you set up a meeting with the Building Department, Fire Department, Planning Department , and Public Works Department to discuss your plans and insure no delays for the project. The building is a multi- family R-2 Use and the construction is Type 25, Protected Noncombustible. The requirements for fire and draftstopping are contained in Section 919.0, Firestopping and Draftstopping. (See attached). The issue to be discussed is whether or not compartmentation is required in the attic space of the building in order to meet the requirements of Section 919.0. Therefore, it is my opinion, that no compartmentation is required in the attic of the mid rise building at the Village at Vinnin Square, based on the code requirements noted in Section 919.7. " Section 437 . 2.1 . 1 - 7 . shall exhaust 40, 000 CFM or 6 air changes which ever is greater. . " Section 437 .2 . 1 .5 - "Any other approved design . . . . . . . . may be used in lieu of (these) requirements. " Our atrium has a volume of 30,000 C ,F , If we were to provide 40, 000 CFM we would end up with 65 air changes . I think you will agree this is excessive. It is our contention that this is not the intent of the code . We respectfull request that you approve our design which will provide 15 air changes per hour.
