A hearing on this petition was held April 20, 1983 with the following Board
Members present: James Hacker, Chairman; Scott Charms, AcIFMgg Secretary; Messrs.
Piemonte, Hopper, LaBrecque, Associate Members Luzinski andcL�71jq�,x StieWt-&- the
hearing was sent to abutters and others and a notice of the hearing was pu >_shed in
the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
The petitioners have requested a variance for the property in question to allow a
stairway to be built to within four (4) feet of the side boundary.
The Board of Appeal, after consideration of the evidence presented at the public
hearing and after viewing plans of the property makes the following findings of fact:
1. No opposition was raised to the petitioners plan by neighbors;
2. The proposed stairway cannot be built on the back of the dwelling
because of the topography of the land.
On the basis of the above findings of fact and the evidence presented at the public
hearing, the Board of Appeal concludes as follows:
1. The property in question is unique because of its topography;
2. The condition described above especially affects the property in
question but does not generally affect the zoning district in which
it is located;
3. The condition described above creates a substantial hardship to petitioners;
4. The desired variance may be granted without substantial detriment to the
public good.
Therefore, the Board of Zoning Appeals voted unanimously in favor of granting the
variance requested by petitoners. The Board grants a variance to the petitioners on
the following terms and conditions:
1. Petitioners may build'a stairway within four (4) feet of the side line at
17 Varney Street;
2. Petitioners must obtain a Certificate of Compliance from the Fire Marshall.

Dear Mr. Hartwell,
On March 3, 1989 I inspected the above referenced property and found
that you are in violation of the Salem Zoning Ordinance, a two family in a
one family dwelling, which was vacant at the time. I found interior stairs
to be in an unsafe manner, also the exterior stairs with a factory built
chimney blocking part of the egress.
To correct these violations you should apply for a Board of Appeal
for varinace for your second unit and obtain a permit to fix interior stairs
and to remove factory built chimney. If we can be of any further assistance
contact our office.

We have received complaints thru the Health Department of on going
violations at 17 Varney Street, and after checking our files you have been
notified a numerous amount of times by my predassors, but have elected to
neglect your responsibilities.
Ill) You are renting an elegal apartment and must file papers to the Board
of Appeal to rectify this problem. Violation of the City of Salem Zoning
Ordinance Section V-R (Permitted used in an R-2 district) .
Ill) You have never acquired a sign off on the permit issued for stairway
and dormer, permit #569-90. Said ballisters are in violation of Section
3401 . 11 .2 of the Mass State Building Code.
ll3) Means of egress in one and two family dwelling units shall have two
(2) independent means of egress, remote as possible from each other and
leading to grade, Section 3401 . 10 of the Mass State Building Code.
Il4) Masonary steps must be made safe at rear yard level, Section 104.0
Maintenance of Building and Structure.
These issues must be addressed at once. Failure to do so will result
in legal action. Please notify this office upon receipt of this letter
as to your intentions of a starting date to rectify these problems.

Due to complaints received at this office, an inspection was made at the
above referenced property.
Once again it has cane to our attention that the second apartment has
been occupied without having corrected outstanding violations.
To correct these violations, you should apply to the Board of Appeal
for a special permit to allow a second unit, and obtain a building permit to
correct the interior stairs.
Ample time has been given to rectify these violations. Please contact

check into whether this is a legal three family or not. Mr. Hacker said they should
not act on something that is not before us. Mr. Vallis said the parking area will be
crushed stone. Mr. Charnas moved to allow the petitioner to divide the property into
two lots, lot 18 containing 6,220 sq.ft. ; lot 16 containing 5,920 sq.ft, and to allow
setbacks to allow existing garage to within five feet of side yard of lot 16 and to
allow existing 3 family structure to within five feet of side yard of lot 18 on

On March 3, 1989 I inspected the above referenced property and found
that you are in violation of the Salem Zoning Ordinance, a two family in a
one family dwelling, which was vacant at the time. I found interior stairs
to be in an unsafe manner, also the exterior stairs with a factory built
chimney blocking part of the egress .
To correct these violations you should apply for a Board of Appeal
for varinace for your second unit and obtain a permit to fix interior stairs
and to remove factory built chimney. If we can be of any further assistance

It is incumbent upon you as owner(s) to contact the City of Salem Health Department

This letter is to confirm our conversation on November 19, 1990 regarding
the illegal use of the above referenced address.
Please be advised that the property is in violation of the City of Salem
Zoning Ordinance Section V A (permitted uses in an R-2 District) . It is also
in violation of the Massachusetts General Laws, Chapter 140. , sub-section 22,
regarding lodging houses.
You have fourteen (14) days upon receipt of this letter to correct this
violation and arrange for a site inspection. Failure to do so shall result
in a canplaint being issued in Salem District Court.
