It is now my opinion that l l — 11 '/2 Varney Street was a three family properly prior to
the adoption of current Salem Zoning in 1965.
Therefore, it is a grandfathered, nonconforming three unit building. This determination is
for zoning purposes only and does not reflect any possible code violations or other
situations.

Dear Mr. St. Pierre,
I represent Antonio &Emilia Neto who own a three-family dwelling at 11-11 1/2
Varney Street, Salem,MA. The property was recently under agreement to be sold to
Christopher and Mary Cantone. However they were informed by your office that the
property is in the R-2 zoning district and that the dwelling could only be used as a two-
family. As a result, the purchase did not close. It is my understanding that at the time
of your opinion you did not have any supporting documentation to indicate it was a
legally existing three-family dwelling.
Mr. &Mrs. Cantone are still interested in purchasing the property if it is a legal
three-family. I have found documentation which I believe is sufficient to designate the
dwelling as a legal three-family. My clients purchased the property in March of 1976 by
deed recorded with the Essex South District Registry of Deeds in Book 6226, Page 68, a
copy of which is enclosed herewith. The dwelling was a three-family dwelling when
the Neto's purchased it in 1976. The home has three separate heating systems, three
electrical meters, three gas meters and each unit has two means of access and egress.
Please also note that this is not a situation where the homeowner illegally converted a
two-family into a three-family dwelling subsequent to their purchase. I am enclosing a
copy of the 1963 Polk directory which shows that three separate families occupied the
dwelling at least thirteen years prior to my clients purchase. I am also enclosing a

copy of the 1973 Polk directory which shows that two separate families occupied the
dwelling with the third unit vacant.
In addition, I am enclosing a copy of the Ward 4, Precinct 2, 1964 Annual Listing
which shows three independent families occupied the home as registered voters.
Enclosed also is a letter from one of the immediate abutters, Ms. Jeanette Hughes, of 13
Varney Street, dated November 13, 2007, stating that she has occupied her home for
over 52 years and during that time she has personally observed that the property at 11
Varney Street was a three-family residence.
It is my understanding that if a use/structure existed (whether legally or
illegally) prior to the new zoning ordinance adopted in 1965, then said structure/use is
grandfathered, and now legal.. I am respectfully requesting that you revisit this matter
and reconsider your previous opinion. I believe there is sufficient evidence to opine
that the dwelling is a legally existing non-conforming three-family. Would you kindly
inform me of your decision at your earliest convenience. If you should require any
additional information or documentation, please feel free to contact me at any time.
