Dear Landlords,
Pursuant to your request to make repairs inside the building
(the installation of 1/4 inch fire wall on the dividing wall) in
the premises that I lease from you, please be advised that you
can perform that work anytime that it is convenient for you. I
would like, however, you to make an adjustment in the rental sums
for the days of my loss of use of the property. If, however, you
can perform the work on the weekends, no such rental adjustment
is necessary:
Additionally, I would like you to repair the rear wall and
the rear fire escape door at the same time that you perform the
other work. I have been making that request for quite some time
and you have failed to address it. Thank you.

Dear Mr. Tassinari:
Following the discussion on and about your property at 125 Ocean Avenue last
Monday, June 23, 1997, and after discussion with two professional pest control
operators, it is evident that the wall on your property bordering the McDonald's
parking lot is providing a chronic rodent harborage. Both pest control operators
discussed the near impossibility of exterminating rodents from that wall.
Enclosed please find the report of one of those pest control operators.
This wall which harbors rodents is creating a public health nuisance. Rodents
carry disease, destroy property and may cause fires. Therefore, in accordance
with Massachusetts General Law Chapter 1111, Section 123, you are
ordered to remove the wall within 30 days of receipt of this letter. Failure
to do so may result in a penalty of up to $1000.00 per day.
Should you be aggrieved by this Order, you have the right to request a hearing
before the Board of Health. A request for such a hearing must be received in
writing in this office of the Board of Health within
seven (7) days of receipt of this Order. At said hearing, you will be given the
opportunity to be heard and to present witness and
documentary evidence as to why this Order should be modified or withdrawn.
You may be represented by an attorney. Please also be informed that you have
the right to inspect and obtain copies of all relevant inspection or investigation
reports, orders , and other documentary information in the possession of this
Board, and that any adverse party has the right to be present at the hearing.

Dear Joanne,
During our meeting on Monday, June 23, 1997 at 125 Ocean Street in Salem,
Massachusetts, we heard many suggestions on how to alleviate rodent harborage.
We heard from the Building Inspector, the City Exterminator, Mr. Tassinari and his
realtor, the Health Department and myself.
As you know we are currently providing monthly pest control services for MacDonald's
on Canal Street to eliminate rodent harborage on their property.
It is my opinion that if Mr.Tassinari paves the area behind MacDonald's cedar fence
(his bark lot) as he described to us, it will help the present situation. However, if the
embankment is not addressed at the same time of the paving project then rodents will
continue to utilize the embankment for harborage. i believe the following method
would be successful in controlling rodent harborage:
1. remove the cement blocks, stones and debris from embankment
2. reduce pitch of embankment to prevent erosion
3. use crushed stone (3/4 inch size maximum) to cover ambankmen�.
4. implement a rodent control maintenance program

Due to a complaint received through the Neighborhood Improvement
Committee hot line, I conducted an inspection of the above mentioned property
and the following violations were found:
1. Overgrowth of grass and weeds at side and rear of property.
2. Repair corner of buildint at right hand side.
3. Repair or replace basement windows.
4. Install rail at rear entry stair.
Please notify this department upon receipt of this letter as to your
course of action to rectify these violations. Failure to do so will result in
legal action being taken against you.

Dear Mr. Tassinari
Health Department Sanitarian, Mark Tolman, representatives of MacDonalds restaurant, and
John Morrell, President of Morrell Associates (Public Health Consultants), recently conducted a
visual inspection of your property located at the corner of Broadway and Ocean Avenue in
Salem.
The inspection determined there is evidence of rodent harborage within the boundaries of your
property. The following items were noted on site; overgrowth, rubbish,trash, garbage, old wood
pallets, rolls of old and rusted metal fencing, scrap metal roof sheeting, scrap wood and old
barrels.
These items constitute harborage and debris and cause you to be in violation of the State
Sanitary Code CMR 410.550 and 410.602.
You are hereby ordered to remove all debris from your premises within twenty-one(21) days and
maintain the premises free from such debris.
Failure on your part to comply within the specified time will result in a complaint being sought
against you in Salem District Court.
Should you be aggrieved by this order,you have the right to request a hearing before the Board
of Health. A request for said hearing must be received in writing in the office of the Board of
health within 7 Days of receipt of this order. At said hearing, you will be given an opportunity to
be heard and to present witness and documentary evidence as to why this order should be

Dear Mark,
Thanks for taking the time on February 29, 1996 to meet with me, Ed Delorey and McDonald's manager
Tom Fish to inspect McDonald's property and the property behind the restaurant.'
In the fall of 1995, 1 discussed with Joanne the rodent activity on the lot behind the cedar fence at
McDonald's. Some of the visuable signs were runways under the cedar fence and gnawed and scratched
areas on the cedar fence at the runways. At this time no signs of rodent activity(such as rodent holes,
runways) were seen on the McDonald's property.
From our inspection last Thursday, we noted rodent burrows were established on the McDonald's
property.
It is imperative that a rodent extermination program must be established and maintained at the adjoining
property in conjunction with the existing rodent extermination program at McDonald's that was started last
month when rodent burrows were noted by Ed Delorey. To eliminate rodent harborage, the metal debris,
overgrown grass, shrubs, and trees on the adjacent property must be addressed as part of the rodent
extermination program.
