Claimant was a legal tenant of pre;-ises at 39 Union Street, Salem,
Massachusetts.
On 6/13/98 claimant's personal property was damaged when defendants'
roof collapsed causing serious flooding. Subsequent investigation by the Salem
Building Department revealed the damage was caused by a poorly maintained
roof & inadequate roof drains.
Kindly forward any reports or uocurnents of the investigation regarding this
loss.

Roof Collapse 39 Union St.
The dispatch office received a call reporting a collapsed roof at 39 Union St. Engine 2, 3,
Ladder 1 and Deputy John Munroe responded.
The distraught caller met the crews on arrival reporting that the roof had collapsed into
her second floor apartment.
Captain Jerry Giuma, the officer of Ladder 1, reported the apartment `looked like a rain
forest"as water was pouring in from,the heavy raimsll. The a--nal ladder was set up and
when fire "ghters wcuded-to the top they fo;;ad the roo,`bowrd in. A substantia: amount
of water had collected and was unable to recede due to a blocked opening in the roof s
drainage system.
Fire fighters were able to make their way onto the roof and clear the blocked drain,
however the weight of the water had collapsed the roof. The roof had sunken more than a
foot as indicated by the flashing around the chimney and drain.
Building Inspector John Goggin was called to the scene to assess the damage. The
building's owner from Marblehead also responded. Inspector Goggin determined the
building unsafe and the residents had to seek shelter elsewhere.
No one was injured.

On Saturday, June 14 , 1998, I conducted an inspection of
the property located at 39 Union Street in accordance
the Massachusetts State Building Code 780 CMR, 121 . 1 and
121 . 2 (unsafe structure) . Accompanying me on the
inspection was Deputy John Monroe of the Salem Fire
Department .
Findings :
The inspection conducted confirmed that the roof structure
collapsed due to lack of proper roof maintenance,
inadequate number and size of roof drains , structural
supports damaged or missing and water being collected
above the second floor kitchen ceiling in plastic and
buckets .
Our inspection also found the chimneys in need of repair
and a illegal painting spray booth in the basement.

You are hereby ordered to immediately hire a structural
engineer to determine the safety of the buildings roof,
ceilings , floors and all other structural supports .
All tenants shall vacate the property and no one may

building permit is acquired.

conducted by U. Moustakis/Tenant Salem Health Department, on
12/9/86 at 9:00 A.M .
Based upon said inspection, you are hereby ordered to take the following
action within 24 hours of receipt of this order:
Secure light fixtures in front hall (1st & 2nd floor) and provide
adequate pull chains for same.
Remove all obstructions from the back hallways (1st & 2nd floor)
All means of egress must be clear at all times.
Provide back hallway 1st floor with an operable light fixture and
adequate pull chain.
Provide a latch or lock for the door leading from back hall to cellar -
( if kept locked tenants must have keys . )
Remove dirty stagnent water in the washing machine in cellar.
Cats must not have access to cellar.
Exterior - Animal feces/droppings all around building must be cleaned and
kept cleaned. It was stated there is at least 3 dogs and several cats in
building constituting a nuisance condition that should be corrected by you
as landlord.
