violation of the City of Salem Zoning Ordinance Section V regarding
conversion of rental housing to condominiums.
The conversion requires a Special Permit to be obtained from
the Zoning Board of Appeal.
Prior to the selling of any of the units, the Special Permit
must be obtained and procedures of the ZoningOrdinace must be adhered
to, and Certificates of Occupancy for each unit obtained.

An inspection made by me of the above referenced property on
May 25, 1983, units 1-C, 2-C, 2-A, 2-B and the three (3) stores
indicate the following:
1 . The units inspected satisfy the Building Code,
2. The egresses satisfy the Building Code,
3. The storage of boxes, etc. in the basement must be removed or
a proper fire rated storage room provided,
4. The plumbing Department, the Electrical Department, the Fire
Department, and the Gas Inspector make their own inspections and
their own determinations,
5. Determinations relating to the Zoning Ordinance are made by the
Zoning Enforcement Officer and have been done by separate letter.

TIMOTHY HAVEN CONCERNING PROPERTY LOCATED AT 105-107 ESSEX STREET (4 UNION ST.) `
Hearing on this petition was held on December 27, 1978 and continued on January 18,
1979, with Board Members Jane Lundregan, Douglas Hopper, James Boulger, John
Nutting and Joseph Piemonte present. Notices were sent to abutters and others in
accordance with Massachusetts General Laws, Chanter 40A.
Atty. John McNamanra represented the petitioner before the Board. The petitioner
is requesting a Special Permit on the property located at 105-107 Essex Street
to allow the use of the first floor es a retail store to sell stoves. The property
was previously used as a non-conforming use as a pottery studio. The history
of the property has been retail use for many years. There will be no interior
changes to the building, and no repair work will be done on the premises. The
stoves are for display only.
The Board voted to grant the Special Permit requested. The Board felt that the
proposed use is in no way detrimental to the surrounding neighborhood and is as
appropriate as the previous commercial use. The Board found it could grant the
Special Permit requested without detriment to the surrounding neighborhood,
