property has been occupied as a residential unit without the benefit of proper
permits or zoning requirements.
This may be a violation of the Mass State Building Code, Section 115.2
C compliance with permit ) and violation of the City os Salem Zoning ordinance,
Section V,A ( permitted uses in a R-2 District ) .
Please contact this office within seven (7) days of receipt of this letter.
Failure to do so shall result in a "Stop-Work" notice on your previous building
permit and a criminal complaint being issued against you in Salem District Court .
Violation penalties; anyone who shall violate a provision of the Mass State
Building Code shall be punishableby a fine of not more than one thousand ($ 1 ,000. )

115.1 Compliance with code: The permit shall be a license to
proceed with the work and shall not be construed as authority
to violate, cancel or set aside any of the provisions of this
code, except as specifically stipulated by modification or legally
granted variation in accordance with Section 126.0.
115.2 Compliance with permit: All work—shall conform to the
stamped or endorsed application and plans for which the permit
has been issued and any approved-amendments theratb.

115.3 Change in site plan: A lot or site shall not be changed,
increased or diminished In area from that shown on the official
j site plan, as specified in Section 113.6, unless a revised plan
showing such changes accompanied by the necessary affidavit of
owner or applicant shall have been filed and approved.

change is caused by reason of an official street opening,

SECTION 116.0 DEMOLITION OF STRUCTURES
116.1 service connections: Before a building or structure can
be demolished or removed, the owner or agent shall notify all
utilities having service connections within the building or struc-
ture, such as; water, electric, gas, sewer and other connec-
tions. A permit to demolish or remove a'buflding or structure
shall not be issued until a release is obtained from the utilities,
stating that their respective service connections and appurten-
ant equipment, such as; meters and regulators have been re-
moved or sealed and plugged In a safe manner.
i 116.2 Lot regulation: When a building or structure has been
demolished or removed and a building operation has not been
} projected or approved, the vacant lot shall be filled with non-
organic fill, graded and maintained in conformity with adjacent
grades. The lot shall be maintained free from the accumulation
of rubbish and all other unsafe or hazardous conditions which
endanger the life or health of the public; provisions shall be
made to prevent the accumulation of water or damage to any
foundations on the premises or the adjoining property; and the

A hearing on this petition was held April 17, 1991 with the following Board
Members present: Richard Bencal, Chairman; Edward Luzinski, Joseph Correnti,
Richard Febonio and Associate Member Arthur Labrecque. Notice of the hearing was
sent to abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Variance from use and parking to
convert a two family dwelling into a three family dwelling in this R-2 district.
The Variances which have been requested may be granted upon a finding by this
Board that:
a. Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings or structures in the same district.
b. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise.
c. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, makes the following findings of fact:
1 . The property was purchased in 1986 by the petitioner as a two family structure,
2. Interior changes and alterations were made illegally, without legal permits
to convert to a three family dwelling.
3. The property has been used illegally as a three family for at least three years.
4. Opposition was voiced by neighbors, abutters and others.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions do not exist which especially affect the subject property
but not the district in general.
2. Literal enforcement of the provisions of the Ordinance would not involve
substantial hardship to the petitioner.
3. The relief requested cannot be granted without substantial detriment to the
public good or without nullifying and substantially derogating from the intent
of the district of the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, O_5, against the granting

property has been occupied as a residential unit without the benefit of proper
permits or zoning requirements.
This may be a violation of the Mass State Building Code, Section 115.2
( compliance with permit ) and violation of the City os Salem Zoning Ordinance,
