Dear Sir:
On August 9, 1984, this department ordered removal-of-the-tremendous
overgrowth of grass and weeds at your property at-P Tremont Street
in Salem, within 48 hours.
The overgrowth constitutes a health and fire hazard and must be
cut and removed from your property immediately. The Health Department
and Fire Department cannot and will not tolerate this on-going
hazardous condition which has existed at your property for a long,
long period of time.
You are in violation of State Sanitary Code Chapter II, Mass. Gen.
Laws, Ch.11l, Section 127A - 410.602 which reads:
A(Land) The owner of any parcel of land, vacant or otherwise shall be
responsible for maintaining such parcel of land in a clean and sanitary
condition and free from garbage, rubbish or other refuse. The owner of
such parcel of land shall correct any condition caused by or on such
parcel or its appurtenance which affects the health or safety and well-
being of the occupants of any dwelling or of the general public.
Failure to comply with this Order will result in action being sought
against you in Salem District Court.
You are advised of your right to a hearing by filing a written.petition
within seven (7) days after receipt of this Order.

being run from your residence. A visual Inspection from the street seems to confirm this is the
case.Your property is a single family and no businesses are permitted at the property.
Therefore, under the authority of the Mass State Building Code 780 C.M.R section 115 you are
required to contact this office to arrange for a Required Inspection of the property within 7 days
of this notice. Failure to comply will result in daily fines and a possible complaint in Salem

By direct appeal, petitioner appealed to the Board of Appeals for a var-
iance from the applicable density requirements of the City. 7,oning Ordin�
puce with re Pard to the construction of a single family dwelling house
at 4 Tremont Street. ►
A hearing was held on this appeal on Monday, August 28,1972, pursuant-

ursuantto notices mailed postpaid to the petitioner, abutters , abutters to the
abutters , and others, and advertisements duly published in the Salem !!!

Board Members present at the hearing were Chairman John M. Gray, Sr. , l`
Donald Koleman, Arthur Labrecque , Associate member Warren Baughm, and k!r
William F. Abbott who acted as secretary to the meeting in the absence
of Joseph F. Doyle ; also unable to be present was Associate 'Member
Emery P. Tanch.
A Mr. McCaffery appeared for the petitioner. The case was presented to
the meeting, the same as in the original appeal on file; the lot contains
an area of 3120 square feet and has a frontage of fifty-nine feet ; while
the lot is in harmony with others in the immediate vicinity with esi.sti.ng
structures , it does not conform to the Zoning Ordinance requirements of
7000 square feet of land area with a sixty-foot frontage ; it was pointed
out to the Members that for many years a single family dwelling had occu-
pied this lot but had burned down. petitioner proposes to erect a s9-n I-
famil'-�r dwelling which will comply with the front and side yard requirements
of the Ordinance but because of the size of the lot , the 30-f6ot rear
yard reg,-elation can not be complied with, and the rear, yard will be fourteen
feet, on one end of the building and fifteen to the boundary from the pro-
posed structure on the other end.
No one appeared in opposition.
The Board members were of the general opinion that the lot area is in har-
mony with nei,mhboring lots and in this residential dictrict_eould not be
utili?ed for other than a small dwelling house ; the members found that to
erect such a structure as proposed in accordance with the plan showing_ the
proposed position of the dwelling on the lot would not be detrimental to
the oubl-ic good and would not substantially cleropIate. from the intent and'
nurnose of the Ordinance , and voted unanimously to -,rant the variance as
recoies ted.
